INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in January 2017. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in January 2017. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of January 2017 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Proposed amendments to Highway Traffic Act Regulation 199/07 (Commercial Motor Vehicle Inspections) and Regulation 611 (Safety Inspections)

The Ministry of Transportation is proposing to: 1. Reduce the frequency of under-vehicle inspections of motor coaches as outlined in Regulation 199/07, Schedule 4. 2. Amend Regulation 611 to allow buses, school purposes vehicles and accessible vehicles to use the Limited Brake Inspection (LBI) when completing a safety inspection.

Division 2 ONTARIO AMENDMENTS

Section 2.A Ontario Acts

Fire Protection and Prevention Act : S.O. 2016, c. 37 repeals Sections 49 and 50 of the Act, which provided for conciliation during the collective bargaining process, and adds a new section 49 that provides for the referral of matters in dispute to arbitration. Also amends Section 50.5 to provide that in making a decision, the board of arbitration may not refer matters in dispute back to the parties to the arbitration. Technical amendments are also made, and transitional matters are provided for.

Health Protection and Promotion Act: S.O. 2016, c. 30 amends Section 67 so that medical officers of health are required to engage with their local health integration networks, and the Chief Medical Officer of Health is given the power to issue directives to local health inte- gration networks, rather than CCACs. Wording in Section 77.7(6) is also amended.

Highway Traffic Act: S.O. 2014, c. 9 and S.O. 2015, c. 14 apply various amendments to this Act.

Occupational Health and Safety Act : S.O. 2016, c. 37 amends the Act to give the Chief Prevention Officer the power to accredit health and safety management systems, and to give recognition to employers who use accredited health and safety management systems. The Chief Prevention Officer may also establish standards and criteria that must be met by health and safety management systems or employers in order to receive accreditation or recognition. Related amendments are also made.

Personal Health Information Protection Act : S.O. 2016, c. 23 adds a new definition of "relative" in Section 2.

Planning Act: S.O. 2016, c. 25, some sections are applied adding subsections pertaining to "Exception re Minister" to Section 17. Also replaces subsection 34(19.1), and adds a clause to subsections 50(3) and 51(17).

Smoke-Free Ontario Act: S.O. 2016, c. 30 adds a new reference to local health integration networks in subsection 9.1(5).

Section 2.B Ontario Regulations

Commercial Motor Vehicle Inspections (Highway Traffic Act): O. Reg. 421/15 replaces clauses (b) and (c) of the definition of "commercial motor vehicle" in subsection 1(1), and removes a reference in subclause (a)(ii) of the definition of "operator" in subsection 1(1).

Commercial Motor Vehicle Operators' Information (Highway Traffic Act): O. Reg. 420/15 comes into force 01/01/17 substituting definitions for "commercial motor vehicle" and "operator," and replacing Section 1.0.1.

Construction Projects (Occupational Health and Safety Act): O. Reg. 242/16 came into force 01/01/17 with new safety requirements related to the operation of suspended access equipment (SAE), strengthening and clarifying existing requirements for all buildings and structures where SAE may be used and where the regulation applies.

Display Screens and Hand-held Devices (Highway Traffic Act): O. Reg. 424/15 came into force 01/01/17 adding a definition for "commercial motor vehicle" in Section 1, and other minor amendments.

Drinking-Water Systems (Safe Drinking Water Act, 2002): O. Reg. 374/15 brings into force section 4(1) which adds Haloacetic acids to Schedule 13 Chemical Sampling and Testing.

Firefighters (Workplace Safety and Insurance Act): O. Reg. 113/14 sections 1(4) and 2(4) came into force 01/01/17 adding primary-site skin cancer under Section 4 Prescribed diseases.

General Regulation (Environmental Assessment Act): O. Reg. 361/16 came into force 01/01/17 and amends various definitions in Section 1, replaces section 7.1, adds subsections to Section 15.1, and replaces wording for "Minister of Natural Resources" throughout.

Mines and Mining Plants (Occupational Health and Safety Act): O. Reg. 167/16 (sections 3, 8 - 10) came into force 01/01/17 to require risk assessments and strengthen requirements for certain high hazards - including water and traffic management, and recording of seismic events.

Ontario Drinking-Water Quality Standards (Safe Drinking Water Act): O. Reg. 373/15 brings into force ss. 1(3)-(5), (7), and (8) amending various items in, and adding Chlorate and Chlorite chemical parameters to Schedule 2 Chemical Standards.

Provincial Parks: General Provisions (Provincial Parks and Conservation Reserves Act, 2006): O. Reg. 347/16 came into force 01/01/17 replacing Subsection 13(2) in regards to occupation of land at Algonquin Provincial Park and Rondeau Provincial Park.

Forest Resources Management Act: S.S. 2016, c. 18 amends ss. 7, 21-22, 38, 45, 82 and 93 and adds s. 79.1 (On conviction, person prohibited from obtaining a licence for a specific time).

Regional Health Services Act : S.S. 2016, c. 28 revises reference to subsection 16(6) in clause 18(1)(a).

Saskatchewan Employment Act : S.S. 2016, c. 17 replaces s. 2-56 (Compassionate care leave) and s. 4-3 (Selection of adjudicator), amends ss. 2-74, 4-4, 4-7 and adds s. 4-12 (Regulations for Part).

Saskatchewan Water Corporation Act : S.S. 2016, c. 22 replaces s. 31 to change the fiscal year.

Traffic Safety Act : S.S. 2016, c. 11 amends subsection 257(2) regarding actions for non-economic loss which may be brought against an operator to recover damages occasioned by a motor vehicle. S.S. 2016, c. 31 amends ss. 41, 48, 75, 150.2, 160, 247-248 and 280 related to prohibiting passengers riding side saddle on a motorcycle on a highway, or three-wheeled vehicles with passengers under the age of 7. S.S. 2016, c. 32 makes several amendments related to dealer certificates of registration, designated notices (of suspension, immobilization or impoundment), and drivers under the age of 21.

Workers' Compensation Act, 2013 : S.S. 2016, c. 33 amends s. 2 by replacing the definitions for "Occupational Health and Safety Division" and "occupational health and safety program" and adding definitions for "psychiatrist" and "psychologist". Section 187 is amended and s. 28.1 (Presumption of psychological injury) is added.

Scrap Tire Management Regulations (Environmental Management and Protection Act, 2010): Sask. Reg. 92/2016 amends ss. 2, 4-7, 10 and 12, adds s. 7.1 (Collection, transportation and processing) and replaces s. 9 (Suspension or cancellation of approvals).

Vehicle Inspection Procedures Regulations, 2007 (Traffic Safety Act): Sask. Reg. 94/2016 updates fees for certification of inspection stations in subsection 19(1).
