INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in November 2017. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in November 2017. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of November 2017 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Division 2 CANADA AMENDMENTS

Section 2.A Canada Acts

Species at Risk Act : SOR/2017-229 amends Schedule 1 List of Wildlife Species at Risk, specifically items under the section heading Birds, by adding to Part 2 Endangered species, and removing and adding items to Part 3 Threatened species and Part 4 Special concern.

Timber Regulations, 1993 (Forestry Act): SOR/2017-52 Erratum, Canada Gazette, Part II, Vol. 151, No. 22 replaces subsection 19(2).

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act, 1992): SOR/2017-137 makes amendments to align the regulations with changes introduced in the 19th edition of the UN Recommendations, the IMDG Code 2016 and the 2015-2016 ICAO Technical Instructions with respect to safety marks, classification information, shipping names, special provisions and marine pollutants. The amendment introduces ambulatory incorporation by reference (also known as "dynamic" incorporation by reference) of the UN Recommendations, the IMDG Code, the ICAO Technical Instructions and the Supplement to the ICAO Technical Instructions as well as the UN Manual of Tests and Criteria (MOTC) and 14 technical standards incorporated in the TDGR. Canadian stakeholders will be required to use the most recent versions of those documents. The amendment also aims to reduce regulatory barriers to cross-border trade with the United States and eliminates the need to obtain an equivalency certificate in order to transport hot air balloon cylinders of propane by road, rail or ship. Amendments also reflect the requirements in PD 38 regarding the accelerated phase-out of legacy DOT-111 tank cars.

Regulatory amendments related to air emissions of sulphur dioxide and other items (source: Environmental Registry)

The Ontario Ministry of the Environment and Climate Change (ministry) is proposing to amend Ontario Regulation 419/05: Air Pollution - Local Air Quality (O. Reg. 419/05 or the "Regulation") made under the Environmental Protection Act. The proposed amendments would introduce updated air standards for sulphur dioxide and clarify the requirements for assessing operating conditions in O. Reg. 419/05. The ministry is also reviewing the need for consequential amendments.

Food and Organic Waste Framework (source: Environmental Registry)

The province has developed a proposed Food and Organic Waste Framework ("Framework"). Toromont Industries Ltd., 3131 Highway 7 West, Concord, Ontario, contracted with J.M.R. Electric for a portion of the electrical work and the employer of the injured worker. October 27, 2017Bondfield Construction was convicted on two counts and fined $175,000. J.M.R. Electric was convicted on two counts and fined $75,000. The regulation states that where the starting of a machine, transmission machinery, device or thing may endanger the safety of a worker, control switches or other control mechanisms shall be locked out and other effective precautions necessary to prevent any starting shall be taken. Dayus Roofing Inc., 5120 Halford Road, Windsor, OntarioJuly 17, 2017Dayus Roofing Inc. pleaded guilty to the offence of failing, as an employer, to ensure that the measures and procedures prescribed by section 26.1(2) of Ontario Regulation 213/91 (the Construction Projects Regulation), were carried out in the workplace. This requires an employer to adequately protect workers with a guardrail system, or with another fall protection method such as a travel restraint system, a fall restricting system or a fall arrest system. Health Protection and Promotion Act : S.O. 2016 c. 30 s. 39 repeals Paragraph 3 of the definition of "health care provider or health care entity" in subsection 77.7 (6) of the Act.

Personal Health Information Protection Act : S.O. 2016, c. 30 s. 43 repeals the definition of "health information custodian" and makes related revisions throughout the Act.

Smoke-Free Ontario Act : Two amendments have been applied. S.O. 2016 c. 30 s. 49 repeals clause (a) of the definition of "home healthcare worker," pertaining to a community care access corporation, in subsection 9.1 (5) of the Act. S.O. 2017, c. 20, Sched. 11, s. 40 amends the item numbering in the Table in Section 15 Offences.

Waste Diversion Transition Act, 2016 : S.O. 2017, c. 20, Sched. 8, s. 43(3) repeals and replaces subsection 43(8) of the Act.

Provincial Parks : General Provisions (Provincial Parks and Conservation Reserves Act, 2006): O.
