INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in March 2017. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in March 2017. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of March 2017 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Conservation Officer Service Authority Regulation (Environmental Management Act): B.C. Reg. 291/2016 amends 1(2)(e), a reference to the Liquor Control and Licensing Act sections that can be enforced by members of the Conservation Officer Service, and updates this reference in the Table.

Occupational Health and Safety Regulation (Workers’ Compensation Act): B.C. Reg. 312/2016 come into force 03/04/17 adding Section 3.26 Joint Health and Safety Committees, covering evaluation of joint committees. It also added Section 3.27 pertaining to minimum training requirements for new joint committee members or worker health and safety representatives, and Section 3.28 pertaining to participation in investigations by employer or representative of employer and worker representative.

Recycling Regulation (Environmental Management Act): B.C. Reg. 284/2016 repeals and replaces section 4 Beverage container product subcategories found in Schedule 1.

Renewable and Low Carbon Fuel Requirements Regulation (Greenhouse Gas Reduction (Renewable and Low Carbon Fuel Requirements) Act): B.C. Reg. 287/2016 makes various amendments to this regulation.

Water Sustainability Regulation (Water Sustainability Act): B.C. Reg. 301/2016 amends dates referenced to in sections 55(3) and 56(2).

Planning Act : S.M. 2015, c. 26 is in force adding Division 3 (Special Planning Areas) ss. 11-12.16. S.M. 2012, c. 27, s. 90 is in force amending s. 62.1 (Consideration of water statutes).

Water Protection Act : S.M. 2012, c. 27 is in force adding the definition of "approved aquifer management plan" to subsection 1(1) and amending ss. 5, 15, 17, 25 and 29.

Wildlife Act : S.M. 2015, c. 33 ss. 7-9, 17 and 19 are in force amending ss. 41-43, 89 and 92 to remove the concept of wildlife under which a royalty is paid.

Section 2.B Manitoba Regulations

Off-Road Vehicles Regulation (Off-Road Vehicles Act): Man. Reg. 11/2017 replaces and substitutes Section 3: Safety helmet standards, and Section 3.1 Helmets complying with formerly prescribed standards.

Safety Helmets Standards and Exemptions Regulation (Highway Traffic Act): Man. Reg. 9/2017 replaces the title with "Motorcycle Helmets Regulation." Section 1 is replaces with "Helmet standards and specifications," and newly added section 1.1 "Helmets complying with formerly prescribed standards."

Subdivision Regulation (Planning Act): Man. Reg. 12/2017 makes minor amendments in Section 3 Map, and subsection 6(3).

Division 2 NEWFOUNDLAND AND LABRADOR AMENDMENTS

Section 2.A Newfoundland and Labrador Acts

Fire Protection Services Act : S.N.L. 2016, c. 45 amends Section 2 Definitions by repealing 2(a) and 2(b), and adding (n.1) "minister." Repeals and replaces: two subsections in Section 3 Fire Commissioner; subsection 4(3) relating to duties and responsibilities of the Fire Commissioner; Section 5 Emergency response and co-ordination; subsection 8(1) relating to Adoption and enforcement of fire protection codes or standards; subsections 30(1) and 30(4) relating to Fire Training; and, Section 32 Action Barred.

Highway Traffic Act : Two amendments have been applied. S.N.L. 2016, c. 40 repeals and replaces subsections 65(1.1) and 81(2) relating to the suspension or cancelation of the driver's licence or driving privileges. S.N.L. 2016, c. 51 adds a definition in subsection 2(qqq.1) for "three-wheeled vehicle," adds section 154.1 Three-wheeled vehicle equipment, and adds to the Schedule Penalities.

Lands Act : S.N.L. 2016, c. 53 repeals and substitutes various sections of this Act, and adds Part VI.1 General after section 73.

Official Inspection Station Regulations (Highway Traffic Act): Two amendments - N.L.R. 7/17 and N.L.R. 9/17 - make various changes.

Water Resources Act : S.N.L. 2016, c. 45 repeals and replaces subsection 35(2) relating to Technical Assistance.

Workplace Health, Safety and Compensation Act : S.N.L. 2016, c. 50 adds Part VII.1 Presumption Respecting Firefighters and Volunteer Firefighters.

Proposed Regulations to specify Administrative Penalties amounts under the Ontario College of Trades and Apprenticeship Act, 2009 (OCTAA)

Legislative amendments to OCTAA were enacted in December 2016 setting up the structure for a new administrative penalties framework to be used by the Ontario College of Trades in enforcing the OCTAA. As part of the implementation of these amendments, the Ministry of Labour is consulting on what the penalty amounts should be, and any other relevant details, including publication of notices of contravention.

Working at Heights Training

There is a two-year transition period for workers who, prior to April 1, 2015, met the fall protection training requirements set out in subsection 26.2(1) of the Construction Projects Regulation . These workers will have until April 1, 2017 to complete an approved working at heights training program.

This training requirement is in the Occupational Health and Safety Awareness and Training Regulation , and is in addition to training requirements under the Construction Regulation.

Ontario College of Trades and Apprenticeship Act , 2009: S.O. 2016, c. 37 applies amendments in various sections.

Section 2.B Ontario Regulations

Classification of Proposals for Instruments (Environmental Bill of Rights): O. Reg. 22/17 updates the ministry name to "Ministy of Municipal Affairs."

Environmental Compliance Approvals - Exemptions from Section 9 of the Act (Environmental Protection Act): O. Reg. 14/17 adds many definitions to Section 0.1. Replaces paragraphs, and adds new paragraphs, in subsection 1(1). Also adds a subsection 6.1 to section 1, and new sections: Section 2 Condition, masonry fireplace; Section 3 Condition, HVAC system; and, Section 4 Condition, standby power system.

General (Application of Act) (Environmental Bill of Rights): O. Reg. 21/17 amends and adds the name of various Ontario Ministries throughout the regulation.

Motor Vehicles (Environmental Protection Act): O. Reg. 417/16 came into force 01/04/17 making various amendments.

Registrations under Part II.2 of the Act - Printing (Environmental Protection Act): O. Reg. 15/17 revises reference to a regulation in the definition of "standby power system" in subsection 1(1).
