INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in May 2016. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in May 2016. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of May 2016 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Elevator Regulation (Elevator Act): Man. Reg. 219/2015 came into force on April 1, 2015, amending section 1 subclause 3(c)(iii).

Manitoba Fire Code (Fires Prevention and Emergency Response Act): Man. Reg. 221/2015 and Man. Reg. 20/2016 came into force on April 1, 2016. Both amend the Schedule, adding new subsection 1(2), replacing subsection 2(11) referring to Section 2.15 Retrofit Requirements, for Residential Care Facilities, and for Hospitals and Personal Care Homes.

Fire Safety Inspections (2014) Regulation (Fires Prevention and Emergency Response Act): Man. Reg. 220/2015 came into force on April 1, 2016 and makes a minor amendment in the Table in subsection 1(1) by replacing the reference to "Residential care facility, as defined in the Manitoba Fire Code, Manitoba Regulation 155/2011" with "Residential care occupancy, as defined in the Manitoba Fire Code, Manitoba Regulation 155/2011".

Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation (Nova Scotia) Act: S.N.S. 2014, c. 43 and 2015, c. 36, sections are all now in force making extensive amendments, including establishing a regime for imposing administrative monetary penalties, expanding liability for spills and damages and mirroring the amendment made to the federal Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation Act to allow a joint notice to be issued to prohibit the exploration and drilling for and the production, conservation and processing of petroleum on part or all of the area described in Schedule IV of the Act and the transportation of petroleum produced in that portion of the offshore area until December 31, 2022.

Proposed Changes Affecting the Control of Hazardous Substances under the Occupational Health and Safety Act

The Ministry of Labour (MOL) is proposing to consult on updates to the occupational exposure limits (OELs) under Regulation 833 (Control of Exposure to Biological or Chemical Agents) of the Occupational Health and Safety Act (OHSA). The MOL is also proposing to consult on amendments that will, if approved, introduce new respiratory protection and measuring provisions, as well as updating and harmonizing a number of other provisions.

Ministry of Labour Proposes to Mandate Construction Hazard Awareness Training

The Ministry of Labour is consulting on a proposal to amend the Occupational Health and Safety Awareness and Training Regulation (O. Reg. 297/13) under the Occupational Health and Safety Act to mandate hazard awareness training for construction workers.

Petrochemical - Industry Standard under the Local Air Quality Regulation (O. Reg. 419/05) (source: Environmental Registry)

In 2013, the Chemistry Industry Association of Canada (CIAC) approached the Ministry of the Environment and Climate Change (MOECC) with a request to develop a proposed Technical Standard under the Local Air Quality Regulation (O. Reg. 419/05: Air Pollution - Local Air Quality) for benzene and 1,3-butadiene. In practical terms, a technical standard provides a prescriptive set of air pollution control requirements that focus on key contributors to off-site concentrations of priority air toxics.

Division 2 ONTARIO AMENDMENTS

Section 2.A Ontario Acts

Environmental Protection Act : S.O. 2015, c. 25 adds new Part VI.1 Cessation of Coal Use at Generation Facilities.

Public Hospitals Act : S.O. 2016, c. 5 re-enacts subsection 17 (2) to provide that notice of a general or special meeting of a hospital corporation is sufficiently given if it is published on the hospital website.

Public Vehicles Act : S.O. 2016, c. 5 updates the language of provisions in subsections 2 (3) and (4) to refer to passengers with mobility disabilities, from previous language referring to physically disabled passengers. Current subsection 5 (4) of the Act requires the holder of an operating licence to give public notice in a newspaper and in posted signs when a scheduled service is discontinued or reduced or is not provided for more than 24 hours. Adds new subsection 5 (5) that requires further notice in a medium that is accessible to persons with disabilities in accordance with the regulations. Section 33 of the Act is amended to allow for regulations prescribing such media and prescribing licence holders or classes of licence holders that are required to give accessible notice. Definitions of "disability" and "mobility disability" are added to subsection 1 (1) of the Act in connection with the above amendments.

Workplace Safety and Insurance Act : S. O. 2016, c. 4 amends this Act with respect to posttraumatic stress disorder. The new section 14 provides that certain workers who are diagnosed with posttraumatic stress disorder are entitled to benefits under the Act for that disorder if certain conditions are met. The section creates a presumption that posttraumatic stress disorder in those workers arises out of and in the course of the workers’ employment, unless the contrary is shown. Sets out procedural and transitional rules governing claims made under the new section.

Section 2.B Ontario Regulations

Electrical Safety Code (Electricity Act): O. Reg. 319/15 came into force 05/05/16 amending Section 1.

Fish Licensing (Fish and Wildlife Conservation Act): O. Reg. 94/16 amends by adding subsection 2.2.

General (Ontario College of Trades and Apprenticeship Act): O. Reg. 91/16 revises dates in section 3.1 and subsection 8 (2).

Registrations under Part II.2 of the Act - Waste Management Systems (Environmental Protection Act): O. Reg. 87/116 makes a minor amendment in subclause 2(4)(b)(i) and 2(4)(b)(ii).
