INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in February 2017. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in February 2017. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of February 2017 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Working at Heights Training

There is a two-year transition period for workers who, prior to April 1, 2015, met the fall protection training requirements set out in subsection 26.2(1) of the Construction Projects Regulation . These workers will have until April 1, 2017 to complete an approved working at heights training program.

This training requirement is in the Occupational Health and Safety Awareness and Training Regulation , and is in addition to training requirements under the Construction Regulation.

Policy Proposal Notice: Discussion Paper: Developing a Modern Renewable Fuel Standard For Gasoline in Ontario

Description: To combat climate change, Ontario has committed to reduce greenhouse gases by 15% by 2020, 37% by 2030 and 80% by 2050, relative to the 1990 level. These goals are legislated in the new Climate Change Mitigation and Low-Carbon Economy Act.

To help achieve our targets and transition to a low carbon economy, Ontario’s Climate Change Action Plan commits to implementing a Renewable Fuel Standard for gasoline, which would reduce greenhouse gas emissions from gasoline by 5% by 2020.

The proposed Renewable Fuel Standard for gasoline is a key initiative for the government to reduce greenhouse gases in the transportation sector, combatting climate change while driving innovation in renewable fuels.

For clarity, Ontario will not lower the level of existing renewable content required under its Ethanol in Gasoline regulation and existing requirements under its Greener Diesel regulation will remain unchanged and in effect.

As the first step in introducing a Renewable Fuel Standard for gasoline in Ontario, the province has issued a discussion paper.

Purpose: Ontario is seeking comments on the design options under consideration for the proposed Renewable Fuel Standard for gasoline, as outlined in the discussion paper.

Comments Due Date: March 12, 2017

Regulation Proposal Notice: A regulation establishing a new water bottling charge (Ontario Water Resources Act)

Description: The proposed regulation would establish a new regulatory charge that would apply to water bottling facilities that take groundwater pursuant to a permit to take water issued under the Ontario Water Resources Act. The proposed charge would help finance activities and programs that the Ontario government is establishing to more effectively manage groundwater takings by water bottlers.

Purpose: Subsection 75 (1.5) of the Ontario Water Resources Act provides authority for the government to establish charges to recover the costs of provincial activities and programs related to promoting the conservation, protection and management of water in Ontario and its efficient and sustainable use. Under this authority, a regulation is being proposed that would establish a charge to recover costs that the province incurs specifically to gain a better understanding of and to more effectively manage groundwater takings by water bottling facilities. Alternative Low-Carbon Fuels (Environmental Protection Act): O. Reg. 392/16 revokes and replaces definitions for "municipal hazardous or special waste," "used tires," and "waste electrical and electronic equipment." Paragraphs 24 and 25 of Schedule 1 to the Regulation are revoked and replaced as well.

Building Code (Building Code Act): O. Reg. 361/13 subsection 138(2) in force adding subsection 4.1.3. Transition, January 2017. Subsections 4.2.1.1.(2), (3), and (6) also in force 01/01/17.

Cap and Trade Program (Climate Change Mitigation and Low-Carbon Economy Act): O. Reg. 473/16 makes extensive amendments to this Regulation.

Construction Projects (Occupational Health and Safety Act): O. Reg. 471/16 in force 01/01/17 and amends subsection 142.06(1) by striking out "and who may be exposed to a hazard described in section 26."

Ethanol in Gasoline (Environmental Protection Act): O. General (Smoke-Free Ontario Act): O. Reg. 336/15 subsection 8(2) in force 01/01/17 revoking paragraphs 4 and 5 of subsections 11.1(1) and 11.1(2).

General Regulation (Workplace Safety and Insurance Act): O. Reg. 470/16 revokes and replaces Schedule 3 Occupational Diseases.

General - Waste Management (Environmental Protection Act): Two regulations - O. Reg. 86/16 and O. Reg. 391/16 - apply various amendments. O. Reg. 86/16 revokes and replaces the definition of "asbestos waste," revokes the definition of "derelict motor vehicle," and adds definitions for "end-of-life vehicle" and "end-of-life vehicle waste disposal site" in subsection 1(1). Also adds paragraph "18. end-of-life vehicles" to subsection 2(1), revokes paragraph 3 of subsection 5(1) and adds section 5.1. O. Reg. 391/16 revokes and replaces the definition for "waste electrical and electronic equipment" in subsection 1(1) and revokes and replaces the definition of "municipal hazardous or special waste" in subsection 26.1(1).

Section 2.A Prince Edward Island Acts

Highway Traffic Act : S.P.E.I. 2016, c. 39 and sections of S.P.E.I. 2016, c. 41 amend this Act. The former repeals and replaces Section 206.1 referring to the definition of "designated accessible parking space" and the use of these spaces. Also amends the Schedule by repealing and replacing the entry relating to section 206.1(2). Various sections of the latter Act apply amendments including repealing and replacing the definition of "bicycle" in clause 1(a.1); repealing and replacing subsection 148(2) referring to the adoption by reference of codes, standards, regulations; and revising wording in various other subsections.

Public Health Act : S.P.E.I. 2016, c. 51 amends Section 1 by adding definitions for "health practitioner," "licensed practical nurse," "outbreak," and repealing and replacing definitions for "medical practitioner," "nurse practitioner," and "registered nurse." Repeals and replaces Section 35 referring to the duty to report, and subsection 56(1) referring to the requirement to provide information. Also applies various amendments to Section 72.

Unsightly Property Act : S.P.E.I. 2016, c. 58 amends Section 1 by adding definitions for "occupier," and "unsightly building or structure," and repealing and replacing the definition for "dilapidated building or structure." Sections 3, 7 to 11, and 12 are all repealed and replaced. Also applies various amendments to wording in various other subsections.

Section 2.B Prince Edward Island Regulations

General Regulations (Off-Highway Vehicle Act): EC2017-51 adds Section 11.1 "Operation on closed seasonal or closed scenic heritage highway Driver’s license required" to the regulations to authorize licensed drivers to operate snow vehicles on closed seasonal and closed scenic heritage highways. Also amends Section 20 "Noise" to increase the maximum speed permitted when driving an off-highway vehicle within 30 metres of a dwelling or place where a person is taking shelter or practising an outdoor sport, and corrects the misspelled words "kilometers" and "meters".
