INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in May 2017. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in May 2017. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of May 2017 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Geothermal Resources Act : S.B.C. 2008, c. 36 many sections proclaimed in force amending, repealing and adding various sections.

Mines Act : S.B.C. 2016, c. 7 adds sections 36.1-36.7 for enforcement of administrative penalties, and amends section 38.

Oil and Gas Activities Act : S.B.C. 2015, c. 23, ss. 48, 49 and 51 proclaimed into force amending the definition of "oil and gas activity" in section 1, and adds a paragraph under section 111. Oil and gas activities.

Wildlife Act : S.B.C. 2017, c. 2 makes amendments to hunting authorizations.

Section 2.B British Columbia Regulations

Building Act General Regulation (Building Act): Three amendments have been applied this month. B.C. Reg. 52/2017 adds Divisions for building officials, annual report and fees, and fee-setting criteria. B.C. Reg. 116/2017 moves Definition for Division from 13.1 to 15.1, and moves Criteria for fee-setting process from 14 to 16. B.C. Reg. 139/2017 adds a section for energy conservation unrestricted.

Electrical Safety Regulation (Safety Standards Act): B.C. Reg. 50/2017 adds sections for class 2 security alarm systems and adds Division 3 for Combustible Wood Dust Hazards.

Elevating Devices Safety Regulation (Safety Standards Act): B.C. Reg. 45/2017 repeals section 4(1) and amends subsection 4.6 (3) in section 4.6 Mechanic in training certificate of qualification.

Gas Safety Regulation (Safety Standards Act): B.C. Reg. 45/2017 repeals section 5(2) in section 5. What all applicants for a certificate of qualification must do.

Geothermal Geophysical Exploration Regulation (Geothermal Resources Act): B.C. Reg. 39/2017 repeals section 1 Definitions, and added subsection (3) to section 2 Application of regulation under the Petroleum and Natural Gas Act.

Power Engineers, Boiler, Pressure Vessel and Refrigeration Safety Regulation (Safety Standards Act): B.C. Reg. 45/2017 repeals 42 (2) and amends wording in sections 1 to 3.

Safety Standards General Regulation (Safety Standards Act): B.C. Reg. 45/2017 adds section 1.1 defining "Canadian credential" and "safety regulation," and replaces section 2.1 (Applicants with Canadian credentials) with s. 2.1-2.3 regarding certificates of qualification.

Administrative Penalties Regulation under the Waste Diversion Transition Act, 2016

The Resource Productivity and Recovery Authority (the "Authority") is responsible for the oversight of existing programs under the WDTA and the producer responsibility scheme under the RRCEA, including compliance and enforcement under both acts. The proposed regulation would govern the determination of the amount of, and the manner in which Authority staff will issue an order to pay an administrative penalty for non-compliance with the WDTA and its regulations.

Excess Soil Management Regulatory Proposal (source: Environmental Registry)

The Ministry of the Environment and Climate Change (MOECC) is engaging Ontarians on an Excess Soil Regulatory Proposal (regulatory proposal) that proposes a new regulation and key complementary regulatory amendments related to the management of excess soil. It is anticipated that this regulatory proposal will be finalized before the end of 2017.

Division 2 ONTARIO AMENDMENTS

Section 2.A Ontario Acts

Coroners Act : S.O. 2017, c. 7 makes amendments requiring the provision of information from medical practitioners to the coroner, in the case of a medically assisted death.

Forest Fires Prevention Act : S.O. 2017, c. 8, Sch. 12 amends section 21.1 with respect to liability for costs and expenses where a fire is caused by the conduct of a person, and amends section 35 to increase the maximum fines that may be imposed.

Fuel Tax Act: S.O. 2017, c. 8, Sch. 14 makes amendments allowing for a collector who proposes to colour only biodiesel or a collector who meets the prescribed requirements to be registered as a dyer if the collector meets the eligibility requirements set out.

Oil, Gas and Salt Resources Act : S.O. 2017, c. 8, Sch. 23 makes amendments with respect to the regulation of compressed air energy storage projects prescribed by the regulations and of projects that involve the injection of substances into underground geological formations.

Waste Diversion Transition Act, 2016 : Sections 56 to 64 of this Act came into force 17/05/17, covering Administrative penalties, Failure to pay administrative penalty when required, Appeal of order, Extension of time for requiring hearing, Contents of notice requiring hearing, Stay on appeal, Parties, Powers of Tribunal, and Appeals from Tribunal.

Workplace Safety and Insurance Act : There are two amendments applied this month. S.O. 2017, c. 7 makes amendments for provision that a worker who receives medical assistance in dying is deemed to have died as a result of the injury or disease for which the worker was determined to be eligible to receive medical assistance in dying. S.O. 2017, c. 8, Sch. 33 makes amendments related to benefits for mental stress, payments for loss of earnings, and updates and adjusts dollar amounts.

Section 2.B Ontario Regulations

General (Mandatory Blood Testing Act, 2006) : O. Reg. 119/17 adds nursing students engaged in training to section 3. Additional persons who can apply under the Act.

General (Ontario College of Trades and Apprenticeship Act): O. Reg. 78/17 amends a date referenced in section 3.1 Exemption, barbers and repeals section 8. Transition, cancellation of statement of membership.

Act respecting the Ministère du Développement durable, de l'Environnement et des Parcs : S.Q. 2017, c. 4, sections are in force making amendments related to the creation of the Conseil de gestion du Fonds vert, whose mission is to provide a governance framework for the Fund and the establishment of the Fund for the Protection of the Environment and the Waters in the Domain of the State. The latter fund is dedicated to the financing of any measure the Minister may carry out within the scope of his or her functions that is not related to a matter covered by the Green Fund.
