INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in July 2017. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in July 2017. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of July 2017 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Canada - Newfoundland and Labrador Offshore Marine Installations and Structures Occupational Health and Safety Transitional Regulations (Canada - Newfoundland and Labrador Atlantic Accord Implementation Act): SOR/2017-118 makes extensive amendments.

Canada Labour Code (Part I) : S.C. 2017, c. 9 replaces references to Public Service Labour Relations Act with Federal Public Sector Labour Relations Act in a few sections. S.C. 2017, c. 12 amends ss. 28-29 and 38-39 regarding certification of trade unions.

Ship Station (Radio) Regulations, 1999 (Canada Shipping Act): SOR/2016-163 makes amendments to update the definition of survival craft, and replaces section 12.

Ship Station (Radio) Technical Regulations, 1999 (Canada Shipping Act): SOR/2016-163 makes amendments to update the definition of survival craft, updates references to small fishing vessel inspection regulations, and replaces subsections 2(1) and 49(2).

Small Vessel Regulations (Canada Shipping Act): SOR/2016-163 makes amendments to replace paragraph 8(1)(b) and subsection 1002(2) and amends the table title in section 14.

Règlement sur les petits bâtiments

Wild Animal and Plant Trade Regulations (Wild Animal and Plant Protection and Regulation of International and Interprovincial Trade Act): SOR/2017-123 makes extensive amendments to reflect the 49 changes to CITES Appendices I and II adopted at CoP17. These changes affect a total of 72 taxa and over 400 species or subspecies. Amendments are also made to CITES Appendix III which include the addition of 15 taxa to Appendix III (new export controls), including two species listed by the U.S. that are also found in Canada: Spiny softshell turtle (Apalone spinifera) and Common snapping turtle (Chelydra serpentine). One species was also deleted from Appendix III (removal of all trade controls). Nomenclature updates have been made to Schedule I of the WAPTR.

Agricultural Operations, Part 2 Matters Regulation (Agricultural Operation Practices Act): Alta. Reg. 108/2017 changes the expiry date to June 30, 2020 in section 6.

Section 2.A British Columbia Acts

Forest Act : S.B.C. 2016, c. 11 sections are in force making amendments related to allowable annual cut available and reduced non-BCTS licences.

Motor Vehicle Act : S.B.C. 2015, c. 13, sections are in force repealing ss. 48-50, related to the renewal of motor vehicle licences and air pollution emissions, and amending ss. 188.4 and 118.7. The definition of "person affected by a proposed action of the corporation" is replaced in s. 118.1.

Petroleum and Natural Gas Act : S.B.C. 2014, c. 10 section 30(a) comes into force on 01/08/17 adding wording in section 58(1)(b).

Protected Areas of British Columbia Act: S.B.C. 2016, c. 21 amends the description of Finn Creek Park in Schedule C.

Wildlife Act : S.B.C. 2016, c. 11 various sections come into force making amendments to various sections.`

Section 2.B British Columbia Regulations

British Columbia Building Code Regulation (Building Act): There are two amendments applied this month. B.C. Reg. 44/2017 amends Schedule 1 which includes amendments to Book I (General) of the British Columbia Building Code. B.C. Reg. 138/2017 makes extensive amendments to this regulation.

Fee, Levy and Security Regulation (Oil and Gas Activities Act): B.C. Reg. 106/2017 repeals s. 23 and adds ss. 23.1-23.2 and 24.1 to Part 4 regarding levies for producers and pipeline permit holders.

Firefighters' Occupational Disease Regulations (Workers Compensation Act): B.C Reg. 131/2017 adds primary site breast cancer, primary site prostate cancer and multiple myeloma section 2 Prescribed occupational diseases and the table in section 3 Minimum cumulative periods of employment prescribed.

Motor Vehicle Act Regulations (Motor Vehicle Act): B.C. Reg. 61/2017 amends s. 22A.03 and repeals Division 40 (Motor Vehicle Emission Inspection and Maintenance). B.C. Reg. 64/2017 amends ss. 24.03 and 24.07 related to the Insurance Corporation of British Columbia. B.C. Reg. 65/2017 amends s. 24.01 by adding the definition of "vessel" and adding boat haulers to the prescribed classes of devices. B.C. Reg. 105/2017 amends s. 22A.01 related to constructed motor vehicles. B.C. Reg. 113/2017 amends ss. 23.12 and 24.213-24.214 and adds the sign for Maximum speed when approaching or passing neighborhood golf carts to Schedule 1 of Division 23.

Occupational Health and Safety Regulation (Workers' Compensation Act): B.C. Reg. 142/2017 is in force Aug. 1, 2017 making amendments related to protection from hazards that may be caused by the release of liquefied gas being used for purging or gauging operations or well stimulation.

Petroleum and Natural Gas General Regulation (Petroleum and Natural Gas Act): B.C. Reg. 198/2016 comes into force 01/08/17 adding section 9 Special projects.

Water Sustainability Regulation (Water Sustainability Act): B.C. Reg. 130/2017 amends ss. 1, 39 and 54 and adds s. 35.1 regarding the diversion and use of water for firefighting.

Wood Residue Burner and Incinerator Regulation (Environmental Management Act): B.C. Reg. 109/2017 makes minor amendments to this regulation.

Proposal to amend O.Reg. 404/12 (Energy and Water Efficiency - Appliances and Products) under the Green Energy Act, 2009 ("Efficiency Regulation").

The proposed regulatory changes, if passed, would set or update test methods, scope and/or efficiency requirements for 15 products in the manner outlined below.

Proposed amendment to Lakes and Rivers Improvement Act Dam Construction Regulation (Ontario Regulation 454/96) to specify that approval is not required for alterations, improvements and repairs to existing dams in cases where they are governed by an agreement between the Minister and the dam owner.

The Ministry of Natural Resources and Forestry is seeking comments on a proposal to amend Ontario Regulation 454/96 under the Lakes and Rivers Improvement Act to enable 2016 policy for entering into agreements for alterations, improvements and repairs to existing dams. The proposed amendment will allow MNRF to govern alterations, improvements and repairs to existing dams for qualified dam owners through an agreement, and remove the duplicative requirement for LRIA section 16 approvals.

Ontario College of Trades and Apprenticeship Act, 2009 : S.O. 2016, c. 37 sections are in force adding s. 4.1 (Engaging in the practice of a compulsory trade) and Part VIII.1 (Administrative Penalties).

Commercial Motor Vehicle Inspections (Highway Traffic Act) : O. Reg. 404/16 makes changes to some definitions.

Drinking Water Systems (Safe Drinking Water Act, 2002): O. Reg. 458/16 makes updates to the language used.

General (Ontario College of Trades and Apprenticeship Act, 2009): O. Reg. 169/17 adds sections 12 and 13 relating to notices of contravention.

Code for Plumbing Services Regulations (Environmental Protection Act): EC2017-356 amends s. 4, and repeals ss. 5-5.1 and Appendix A as a result of removing exceptions to the National Plumbing Code that are no longer required. Section 5.3 is added regarding the prohibition of directing water from non-sanitary sources into a sanitary sewer system.

Pesticides Control Act Regulations (Pesticides Control Act): EC2017-383 amends s. 24 to require additional information is included in a notice respecting the application of certain non-domestic pesticides. Section 24.1 is replaced to require that a new notice be provided if the application cannot be started and completed within 48 hours of the proposed time and date. Application outside the 48 hour period is prohibited.
