Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to June 2005. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between March 2005 and June 2005. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of June 2005. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2005-2 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2005-2 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. New Substances Notification Regulations (Canadian Environmental Protection Act, 1999): It is proposed to repeal this regulation and replace it with New Substances Notification Regulations (Chemicals and Polymers) and New Substances Notification Regulations (Organisms). Also, there are proposed amendments to the New Substances Fees Regulations. All can be found in the Canada Gazette, Part I, October 30, 2004, beginning on page 3030.

Notice of Railway Works Regulations (Railway Safety Act): Proposed amendments may be found in the Canada Gazette Part I, November 20, 2004, p. 3394.

Vinyl Chloride Release Regulations, 1992 (Canadian Environmental Protection Act, 1998): Proposed amendments may be found in the Canada Gazette, Part I, April 3, 2004, p. 1012.

Division 2 AMENDMENTS

Section 2.A Acts

Hazardous Products Act: SOR/2005-110 amends items in Schedule I to the Act, chiefly to reduce the maximum total lead content requirement to 600 mg/kg for surface coating materials in premises attended by children, or on articles for children.

National Energy Board Act: 2004, c. 15 amendments to the Act, now in force, provide the NEB with a clear statutory mandate to (a) order a pipeline company or certificate holder for an international power line to take measures to ensure the security of the pipeline or power line; (b) make regulations respecting security matters; (c) to ensure the confidentiality of information relating to security in its orders or proceedings; (d) provide advice to the Minister of Natural Resources on issues related to the security of pipelines and international power lines; and (e) waive the publication requirement for applications to export electricity, or to construct international power lines, if there is a critical shortage of electricity caused by terrorist activity. See sections 16.2, 26, 48, 49, 51.1, 58.12, 58.31, 81, 82, 112, 119.04, and 131.

Section 2.A Acts

Health Act: As a consequential amendment of 2004, c. 61, now proclaimed in force, section 21 is amended (substitute reference to court).

Railway Act: As a consequential amendment of 2004, c. 61, now proclaimed in force, subsections 33(4) and 53(1) are amended (substitute reference to court).

Transportation Act: As a consequential amendment of 2004, c. 61, now proclaimed in force, subsection 9(4) is amended (substitute reference to court).

Water Act: As a consequential amendment of 2004, c. 61, now proclaimed in force, clause 101(3)(b) is amended (substitute reference to court).

Section 2.B Regulations

Forest Planning and Practices Regulation (Forest and Range Practices Act): B.C. Reg. 102/2005 amends the regulation in several areas, including: adding sections 45.1 (exemption respecting free growing stand for certain forestry licences to cut), 107.3 (application of Code to certain forest development plans); replacing clause 86(4)(a) (road construction information); repealing sections 93, 107.1 & 107.2.

Fort St. Jean Pilot Project Regulation (now under Forest and Range Practices Act): B.C. Reg. 103/2005 amends the regulation in several areas, including: replacing section 42 (effect of approval on performance requirements), subsections 55(1) & (2) (administrative remedies), section 59 (declaration of completed obligations); amending sections in Schedules B and C; replacing Schedule G - Maximum Administrative Penalties.

Motor Vehicle Act Regulations: B.C. Reg. 113/2005 replaces Division 35 - Cargo Securement, sections 35.01 - 35.09.

Railway Safety Adopted Provisions Regulation (Railway Safety Act): B.C. Reg. 77/2005 amends sections 2, 3, and 4 and adds sections 5 (adopted provisions from the Canadian Transportation Accident Investigation and Safety Board Act), 6 (adopted provisions from the Transportation Safety Board Regulations, SOR/92-446), and 7 (adopted provisions from the Canada Transportation Act). The Schedule is replaced (Adopted Regulations, Rules, Standards Under the Railway Safety Act (Canada)).

Range Planning and Practices Regulation (Forest and Range Practices Act): B.C. Reg. 104/2005 adds subsection 1(5). B.C. Reg. 105/2005 amends the regulation in several areas, including: replacing sections 12 (other objectives; exemption from requirements), 15 (invasive plants), 32 (protection of fish); Part 3, sections 25 to 27 is repealed; amending sections 33, 34, 36, and 37.

Woodlot Licence Planning and Practices Regulation (Forest and Range Practices Act): B.C. Reg. 106/2005 amends the regulation in several areas, including: replacing section 13 (alternative performance requirements); adding sections 35.1 (requirements if free growing stand cannot be established), 57.1 (protection of fish habitat in fisheries sensitive watersheds), 58.1 (safeguards for water through licensed waterworks in community watersheds), 97 (application of Code to forest development plans); Schedule 2 is added (Fisheries Sensitive Watersheds).

Pesticide Control Act Regulations: EC2005-237 adds definitions to section 1 and adds sections 10.1 to 10.4. These new sections set out the requirements for the purchase of a regulated pesticide and for the issue of a Pesticide Purchase Permit. They also provide for an agricultural operation to authorize an employee to use a Pesticide Purchase Permit under specified conditions and the expiry of such an authorization. An application form and a permit form are added as appendices.
