CCOHS Legislation Monthly Report

July 2005

Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to July 2005. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between March 2005 and June 2005. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of July 2005. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2005-3 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2005-3 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Final version amendments (Rear Impact Guards) SOR/2004/195 are found in the Canada Gazette, Part II, Oct. 6, 2004, p. 1326. In force September 23, 2005. Proposed amendments to Standards 210.1 and 210.2 (User-ready Tether Anchorages for Restraint Systems and Lower Universal Anchorage System for Restraint Systems and Booster Cushions) are found in the Canada Gazette, Part I, November 20, 2004, p. 3385. Subsections 115(2.2) to (2.4) of Schedule IV as enacted by SOR/2004-250 (vehicle identification number in bar code format) come into force September 1, 2008. New Substances Notification Regulations (Canadian Environmental Protection Act, 1999): It is proposed to repeal this regulation and replace it with New Substances Notification Regulations (Chemicals and Polymers) and New Substances Notification Regulations (Organisms). Also, there are proposed amendments to the New Substances Fees Regulations. All can be found in the Canada Gazette, Part I, October 30, 2004, beginning on page 3030.

Notice of Railway Works Regulations (Railway Safety Act): Proposed amendments may be found in the Canada Gazette Part I, November 20, 2004, p. 3394.

Nuclear Security Regulations (Nuclear Safety and Control Act): Proposed amendments may be found in the Canada Gazette, Part I, June 4, 2005, p. 1980.

Division 2 AMENDMENTS

Section 2.A Acts

Department of Human Resources Development Act: The remainder of 2004, c. 26 is now proclaimed in force, repealing Part III.1 (Canada Education Saving Grants).

Food and Drugs Act: 2004, c. 23 is now proclaimed in force, adding subsections 30(5) & (6) (regulations) and 37(2).

Hazardous Products Act: SOR/2005-133 adds item 12 to Part II of Schedule I (banning children's jewellery containing more than 600 mg/kg total lead and more than 90 mg/kg migratable or leachable lead).

Section 2.B Regulations

Crewing Regulations (Canada Shipping Act): SOR/2005-136 amends sections 40 and 52 to address certification of operators of electronic chart display and information systems.

Great Lakes Sewage Pollution Prevention Regulations (Canada Shipping Act): SOR/2005-139 replace definitions in section 2; repeals section 3; replaces subsection 6(7); amends Parts II & IIIof the Schedule (marine sanitation device to be designed to treat sewage; sampling of influentand effluent).

Migratory Birds Regulations (Migratory Birds Convention Act): SOR/2005-125 amends subsection 2(1) to update the definition of non-toxic shot to include tungsten-bronze-iron shot asan approved non-toxic shot alternative, and to ensure that the definition is consistent in all ofEnvironment Canada's wildlife regulations.

Wild Animal and Plant Trade Regulations (Wild Animal and Plant Protection and Regulation of International and Interprovincial Trade Act). SOR/2005-101 replaces Schedule I (animals andplants listed in the appendices to the Convention on International Trade in Endangered Species ofWild Fauna and Flora (CITES)).

Drinking Water Protection Regulation (Drinking Water Protection Act): B.C. Reg. 300/2004 replaces section 14 (well floodproofing), effective November 1, 2005. See British Columbia Gazette, July 13, 2004, p. 843.

Sewerage System Regulation (Health Act): B.C. Reg. 326/2004 replaces Sewage Disposal Regulation (B.C. Reg. 411/85), effective May 31, 2005. See British Columbia Gazette, July 13, 2004, p. 967.

Water Regulation (Water Act): B.C. Reg. 549/2004 amends the regulation effective January 1, 2006. See British Columbia Gazette, December 14, 2004, p. 1302.

Division 2 AMENDMENTS

Section 2.A Acts

Motor Vehicle Act: More sections of 2004, c. 68 are now proclaimed in force. The Act is amended in several places, including: adding section 25.1 (remedial courses and programs for drivers); replacing section 89 (deemed suspension of driver's licence), subsection 105.1(1) (impounding vehicle), section 233 (reinstatement of suspended licence). 2005, c. 2 (Bill 3) and 2005, c. 17 (Bill 2), which both make minor amendments, are now proclaimed in force.

Section 2.B Regulations

Conservation Officer Service Authority Regulation (Environmental Management Act): B.C. Reg. 193/2005 makes a minor change to the table in section 2.

Motor Vehicle Act Regulations: B.C. Reg. 173/2005 adds section 1.01 (prescribed date for motor vehicle related offence); amends Table 4 in Division 28 (under Criminal Code). B.C. Reg.174/2005 adds Division 46 (section 46.01) (Remedial Courses and Programs for Drivers). B.C.Reg. 197/2005, among other changes, adds section 10.051 (adoption of federal constructionstandards) and makes amendments consequential to this in other sections.

Petroleum and Natural Gas General Regulation (Petroleum and Natural Gas Act): B.C. Reg. 190/2005 amends section 2(e) (well authorization fees).

Waste Discharge Regulation (Environmental Management Act): B.C. Reg. 156/2005 amends the table in Schedule 2 (reference to Code of Practice).

Wildfire Regulation (Wildfire Act): B.C. Reg. 206/2005 amends the regulation in several places, including: amending definitions in section 1; replacing sections 13 (resources required for firecontrol activities), 14 (rates of compensation), 25 (exemptions from certain regulations), 31(2)(rates for government fire control costs); Schedules 2 (under "Danger Region 3") & 3 areamended.

Ontario Heritage Act: 2005, c. 6 (Bill 60) makes amendments to the following Parts of the Act: Part II: Several amendments are made in relation to the administration and powers of the OntarioHeritage Trust. Part III: The Conservation Review Board is given certain additional proceduralpowers contained in the Statutory Powers Procedure Act. Part III.1: A new Part III.1 to the Actgives the Minister the power to prepare heritage standards and guidelines for the identificationand preservation of government property that has cultural heritage value or interest. Part IV & V:Amendments concern municipalities and the designation of properties. Part VI: Amendmentsrelate to archaeological sites. Part VII: Several amendments are made to Part VII of the Act,including amendments to clarify how provisions of the Ontario Municipal Board Act apply tomatters arising under the Ontario Heritage Act. Amendments are also made to the offenceprovisions and regulation-making powers.

Section 2.B Regulations

Emissions Trading (Environmental Protection Act): O. Reg. 193/05 amends the regulation in several places. The amendments relate to emission reduction credits for nitric oxide, nitrogenoxides, and sulphur dioxide.

Ontario Power Generation Inc. (Environmental Protection Act): O. Reg. 192/05 adds section 0.1 (calculation of nitrogen oxides); amends section 1 (emissions) and sections 2 and 3.
