Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to August 2005. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between June 2005 and July 2005. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of August 2005. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2005-3 Issue of the Canadian enviroOSH Legislation CD

New Substances Notification Regulations (Canadian Environmental Protection Act, 1999): It is proposed to repeal this regulation and replace it with New Substances Notification Regulations (Chemicals and Polymers) and New Substances Notification Regulations (Organisms). Division 2 AMENDMENTS

Section 2.A Acts

Canadian Environmental Assessment Act: As a consequential amendment of 2005, c. 1 (Bill C-14), subsections 40(2.2) - (2.4) are added.

Mackenzie Valley Resource Management Act: 2005, c. 1 (Bill C-14) amends the Act in several places to give effect to a land claims and self-government agreement among the Tlicho, the Government of the Northwest Territories and the Government of Canada.

Marine Transportation Security Act: The parts of 2001, c. 29 affecting this Act are now proclaimed in force. The amendments establish the jurisdiction and decision-making authorities of the Transportation Appeal Tribunal of Canada regarding decisions surrounding screening officer designations, assurances of compliance, administrative monetary penalties and refusals to remove notations concerning violations from personnel records. See sections 5,6, 19-19.8, and 32-51.

Northwest Territories Waters Act: As a consequential amendment of 2005, c. 1 (Bill C-14), sections 9.1 (Tlicho communities) and 14(7) are added.

Section 2.B Regulations

Notice with respect to substances in the National Pollutant Release Inventory for 2004 (Canadian Environmental Protection Act, 1999): The Canada Gazette Part I amends the 2004 Notice in the first paragraph and in Schedule 2 to reflect a change in the reporting due date to July 4, 2005.

Air Pollution - Local Air Quality (Environmental Protection Act): New regulation 419/05 regarding air pollution comes into force on November 30, 2005. It replaces Regulation 346. See the Ontario Gazette, issue 29, 2005, p. 2374.

Designated Substance - Benzene (Occupational Health and Safety Act): O. Reg. 105/04 changes the exposure limits to airborne benzene in subsections 4(1) & (2), effective December 31, 2005. See the Ontario Gazette, issue 19, 2004, p. 831.

Control of Exposure to Biological or Chemical Agents (Occupational Health and Safety Act): Additional amendments to Part 4 of the Schedule are effective December 31, 2005 and March 1, 2006. See the Ontario Gazette, issue 8, 2005, subsections 1(2) & (3), p. 78.

Division 2 AMENDMENTS

Section 2.A Acts

Building Code Act, 1992: Most of the remainder of 2002, c. 9 is now proclaimed in force. Amendments permit the building code to be enforced by new entities called "registered code agencies" besides the "principal authorities" A principal authority will be able to appoint a registered code agency to perform specified functions in connection with the construction of one or more buildings (see new section 4.1). Principal authorities may also authorize certain classes of applicants for permits under section 8 of the Act to appoint a registered code agency to enforce the building code in connection with an applicant's construction (see new section 4.2). The functions, powers and duties of registered code agencies are set out in the new sections 15.14 to 15.22. The amendments consolidate certain provisions relating to the enforcement of requirements for plumbing and sewage systems (see new sections 6.1 and 6.2) and provisions relating to unsafe conditions (see new sections 15.9 and 15.10). Other amendments are made with respect to the enforcement of the Act and building code by principal authorities. 2002, c. 17, Sch. C amendments are also proclaimed in force. They amend the 2002, c. 9 provisions regarding municipal governments.

Environmental Protection Act: Parts of 2005, c. 12 (Bill 133) are in force. Among other changes, the amendments replace existing unproclaimed provisions that deal with administrative penalties imposed by regulatory officials. A new section 91.1 of the Act is added to require persons prescribed by regulation to develop and implement plans to prevent or reduce the risk of a spill, or to prevent, eliminate or ameliorate any adverse effects that result or may result from a spill. The amendments permit the Director to issue an order requiring the owner of a pollutant that was spilled, or a person having control of the pollutant, to pay for certain costs and expenses incurred by the government. A similar power is given to municipalities. See the new sections 99.1 and 100.1. Sections are added to Part XIII (costs ordered by Environmental Review Tribunal). Section 150 is amended (joint and several liability). Section 187 (penalties) is replaced. The amounts of the environmental penalties may be as high as $100,000 a day. Section 188.1 is added (sentencing considerations).

Highway Traffic Act: 2005, c. 14 (Bill 142) amends section 176 (expands function of school crossing guards).

Ontario Water Resources Act: Parts of 2005, c. 12 (Bill 133) are in force. Among other changes: section 1 is amended (deemed water quality impairment); section 84 is amended (joint and several liability); section 102.3 is added (appeals from Environmental Review Tribunal); sections 108 & 109 are replaced (penalties); section 110.1 is added (sentencing considerations).

Planning Act: As a consequential amendment of 2002, c. 9, now proclaimed in force, subsections 41(4.1) - (4.3) are added (site plan control).

Safety and Consumer Statutes Administration Act, 1996: A part of 2004, c. 19 (Bill 70) is now proclaimed in force which makes a minor amendment to the Schedule (name of Act).

Section 2.B Regulations

Benefit for Loss of Retirement Income (Workplace Safety and Insurance Act, 1997): O. Reg. 338/05 amends the regulation in various sections (references to "spouse") and replaces subsections 9(2) & (3).

Certification of Drinking-Water System Operators and Water Quality Analysts(Safe Drinking Water Act): O. Reg. 256/05 amends definitions in section 1 (including a reference to new Ontario Regulation 252/05 (Non-Residential and Non-Municipal Seasonal Residential Systems that Do Not Serve Designated Facilities)).

Definitions of "Deficiency" and "Municipal Drinking-Water System" (Safe Drinking Water Act): O. Reg. 257/05 adds paragraphs 3 & 4 to section 1.

Drinking-Water Systems (Safe Drinking Water Act): O. Reg. 253/05, among other changes, amends the definitions in section 1, including adding "children and youth care facility"; adds section 4.1 (Exemptions: certain systems that do not serve designated facilities); amends Schedules 1, 2, 6, 9, 12, 15, 16, and 22.

Drinking-Water Testing Services (Safe Drinking Water Act): O. Reg. 254/05 amends sections 6, 12, 13, and 15 (reference to new Ontario Regulation 252/05 (Non-Residential and Non-Municipal Seasonal Residential Systems that Do Not Serve Designated Facilities)).

General (Energy Efficiency Act): The remainder of O. Reg. 44/04 is now in force. Items 40 and 44 of the Schedule are replaced and items 56 and 57 added. O. Reg. 384/05 amends and adds standards to items in the Schedule. See items 1, 2, 4, 7, 20, 23, 30 & 31. Other amendments are due in 2006 and 2007.

General (Workplace Safety and Insurance Act, 1997): O. Reg. 336/05 redefines "spouse" in subclause 11(3)(b)(i).

Independent Forest Audits (Crown Forest Sustainability Act, 1994): O. Reg. 347/05 adds subsection 3(5) to clarify the meaning of "spouse".

Ontario Drinking-Water Quality Standards (Safe Drinking Water Act): O. Reg. 255/05 amends subsection 2(2) (reference to new Ontario Regulation 252/05 (Non-Residential and Non-Municipal Seasonal Residential Systems that Do Not Serve Designated Facilities)).
