Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to October 2005. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between September 2005 and October 2005. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of October 2005. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2005-4 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2005-4 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Final version amendments (Rear Impact Guards) SOR/2004/195 are found in the Canada Gazette, Part II, Oct. 6, 2004, p. 1326. New Substances Notification Regulations (Canadian Environmental Protection Act, 1999): This regulation will be repealed beginning November 2005 and replaced with New Substances Notification Regulations (Chemicals and Polymers) and New Substances Notification Regulations (Organisms). Section 2.B Regulations

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): SOR/2004-195, in force September 2005, adds section 223 to Schedule IV -"Rear Impact Guards". The purpose of this section is to reduce the injuries and deaths that occur when a passenger vehicle collides with the rear of a larger and heavier vehicle, such as a tractor-trailer. In such collisions, the passenger vehicle may slide underneath, or underride, the trailer to such an extent that the rear extremity of the trailer enters the passenger compartment. This amendment is intended to prevent passenger compartment intrusion, which can cause severe injuries and death, by limiting the extent of rear underride.

Guide 71: Emergency Preparedness and Response Requirements for the Upstream Petroleum Industry (Energy Resources Conservation Act): The title has been changed to "Directive 071: Emergency Preparedness and Response Requirements for the Upstream Petroleum Industry". The Alberta Energy and Utilities Board (EUB) is discontinuing its "Guides" and converting them to "Directives". Directive 071 also consolidates all "errata" made since the original publication. These changes occur in various places in the document.

Highway Traffic Act: Sections of 2005, c. 31 (Bill 31) now proclaimed in force, add sections 239.2 (increased penalties for offences resulting in death) and 239.3 (limitation period- offences resulting in death), and amends the definition of "Category B offence" in subsection 264(1). Sections of 2004, c. 30 now proclaimed in force: amend section 95 (construction zone); add section 109.1 (approaching emergency vehicles on highway); replace sections 134, 135 and add section 135.1 (railway crossings); add subsection 238(2.1) (speeding when road workers present).

Section 2.B Regulations

Electricians Licensing Regulation (Electricians' Licence Act): Man Reg. 116/2005 increases the examination fees in section 15.

Swimming Pools and Other Water Recreational Facilities Regulation (Public Health Act): Man. Reg. 108/2005 makes several changes to the regulation regarding, among other things: the regulating authorities, design and specifications for new or altered swimming pools, operating permits, warning requirements, lifeguard qualifications, lifesaving station requirements, water quality tests, continuous filtration of recirculated water requirements for new pools, policies for use of pools by organized groups, emergency procedures.

Air Pollution - Local Air Quality (Environmental Protection Act): New regulation 419/05 regarding air pollution comes into force on November 30, 2005. It replaces Regulation 346. See the Ontario Gazette, issue 29, 2005, p. 2374.

Designated Substance - Benzene (Occupational Health and Safety Act): O. Reg. 105/04 changes the exposure limits to airborne benzene in subsections 4(1) & (2), effective December 31, 2005. See the Ontario Gazette, issue 19, 2004, p. 831.

Control of Exposure to Biological or Chemical Agents (Occupational Health and Safety Act): Additional amendments to Part 4 of the Schedule are effective December 31, 2005 and March 1, 2006. See the Ontario Gazette, issue 8, 2005, subsections 1(2) & (3), p. 78.

Designated Substance - Asbestos (Occupational Health and Safety Act): O. Reg. 279/05 amends the regulation effective November 1, 2005. See the Ontario Gazette, issue 26, 2005, p. 809.

Farming Operations (Occupational Health and Safety Act): New regulation 414/05 regarding farming operations comes into force on June 30, 2006. See the Ontario Gazette, issue 29, 2005, p. 2365.

General - Waste Management (Environmental Protection Act): More sections of O. Reg. 461/05 are to come into force in 2006, 2007, and 2009. New sections include Waste Generation Facilities, Land Disposal of Hazardous Waste; the Schedules are replaced and added to. See the Ontario Gazette, 27 August, 2005, pg. 2751.

Industrial Establishments (Occupational Health and Safety Act): O. Reg. 280/05 amends the regulation effective November 1, 2005. See the Ontario Gazette, issue 26, 2005, p. 811.

Division 2 AMENDMENTS

Section 2.A Acts

Environmental Protection Act: The remainder of 2001, c. 17 is in force October 1, 2005. The amendments add section 168.3.1 (prohibitions on certain changes of use, and exception) and subsections (5) & (6) to section 168.6.

Highway Traffic Act: The remainder of 2004, c. 22 (Bill 73) is now proclaimed in force. Sections 7 (permits), 175 (certificate of offence), and 207 (photo-radar evidence evidence).

Safety and Consumer Statutes Administration Act, 1996: As a consequential amendment of 2005, c. 17 (Bill 158) an Act is added to the Schedule.

Section 2.B Regulations

Fire Code (Fire Protection and Prevention Act, 1997): O. Reg. 451/05 replaces subsection 1.1.2 - Records of Tests and Inspections; adds Canadian Standards Association Standard (CSA) Z305.12-98 in a new section 2.15 - Portable Oxygen Systems; replaces Article 2.1.1.3 and Clause 2.8.3.2.(1)(a); adds to Articles 2.4.3.1 and 2.8.1.1.

General (Energy Efficiency Act): More sections of O. Reg. 384/05 in force September 1, 2005 replace items 24 and 35 in the Schedule, regarding Canadian Standards Association (CSA) standards C746-98 (large air-conditioners and heat pumps) and C744-04 (packaged terminal air-conditioners and heat pumps).

General - Waste Management (Environmental Protection Act): Among other changes, the parts of O. Oil and Gas Pipeline Systems Code Adoption Document (Technical Standards and Safety Act): The Director's Order of March 2005 replaces sections 1 (Reference Publications), 2 (General Requirements), 3 (Polyethylene Certification), and 4 (Welder Qualification). The amendments update the cited Canadian Standards Association (CSA) standards to later editions.

Records of Site Condition - Part XV.1 of the Act (Environmental Protection Act): The following Parts of the regulation come into force October 1, 2005: IV - Change of Property Use, and X - Certificates of Property Use.

Seat Belt Assemblies (Highway Traffic Act): O. Reg. 195/05 replaces section 8 (restraint systems for children) and adds section 8.1 (exemptions to section 8 requirements).
