Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to November 2005. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between October 2005 and November 2005. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of November 2005. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2005-4 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2005-4 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. SOR/2005-237 adds 20 chemicals to Part 1, 1 to Part 2, and 19 to Part 3 of the DSL. SOR/2005-300 adds one item to Part 5 of the DSL under "Organisms". Forest Resources Improvement Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 167/2005 replaces Schedule 1 (Maximum Timber Dues Adjustment for Coniferous Timber), in force January 1, 2006. See the Alberta Gazette, Part II, September 30, 2005, p. 591.

Division 2 AMENDMENTS

Section 2.A Acts

Traffic Safety Act: Sections of 2005, c. 34 (Bill 39) now proclaimed in force, include provisions for: requiring drivers to slow down when passing emergency vehicles and tow trucks and doubling the fines for speeders, to make roads safer for police officers, firefighters, ambulance workers, tow truck operators and construction workers, as well as motorists; allowing police to seize a vehicle, for 24 hours, that is used for racing or driving on a bet, where public safety is at risk; changing provisions concerning driving without insurance, use of evidence from a vehicle's "black box" in legal proceedings, and reporting of unsafe drivers.

Section 2.B Regulations

Activities Designation Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 157/2005 amends the regulation in several areas, including: adding or replacing the following definitions in section 2: "Class I compost facility", "Class II compost facility", "mobile incinerator"; adding or replacing the following definitions in section 3: "alternate fuel", "burning waste as fuel", "land treatment", "small incinerator"; the Schedules are amended regarding the storage of hazardous recyclables and waste, wastewater systems, energy recovery, and other matters.

Administrative Penalty Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 163/2005 amends items in the Schedule (penalty provisions of various regulations).

Commercial Vehicle Dimension and Weight Regulation (Traffic Safety Act): Alta. Reg. 190/2005 replaces Schedule 12 (High Load Corridor Routes).

Conservation and Reclamation Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 160/2005 amends section 3.1 (approval holder compliance with code of practice); adds clause 17.1(c); replaces the Schedule (reference to codes of practice).

Environmental Protection and Enhancement (Miscellaneous) Regulation: Alta. Reg. 161/2005 amends sections 8.1 (compliance with codes of practice) and 9.

Oil and Gas Conservation Regulation (Oil and Gas Conservation Act): Alta. Reg. 184/2005 adds section 12.151 (Large Facility Liability Management Program). Alta. Reg. 185/2005 amends section 1.020 (meaning of "resident"); repeals sections 3.010(7) & 3.068; adds sections 3.012 & 3.013 (abandonment of wells), 3.071 (determination of suspension, abandonment or reclamation costs for a well or facility), 16.541 (application for payment from orphan fund re suspension, abandonment, and reclamation costs). Alta. Reg. 189/2005 adds clause 1.100(2)(b.1).

Pipeline Regulation (Pipeline Act): Alta. Reg. 186/2005 adds subsections 1(5) & (6) (meaning of "resident"); makes a minor change to subsection 9(4); adds subsection 82(8) (licensee shall abandon a pipeline).

Substance Release Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 159/2005 amends the regulation, including replacing section 14.1 (compliance with codes of practice and approvals) and adding section 14.2 (adoption of codes of practice).

Waste Control Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 162/2005 amends the regulation in several areas, including: replacing "Class I compost facility", "Class II compost facility", "Class I landfill", "land treatment" definitions in section 1 and adding new definitions "inert waste", "soil containing hydrocarbons", "TEQ" (toxicity equivalency factors (dioxin)); adding section 3.1 (duties of generator of hazardous waste); amending section 13 (hazardous waste which may be disposed in Class I landfill); replacing sections 14 (codes of practice) and 26 (burning at a waste management facility); replacing Schedule 4.

Water (Offences and Penalties) Regulation (Water Act): Alta. Reg. 164/2005 makes a minor section numbering change in subsection 2(2).

Control of Exposure to Biological or Chemical Agents (Occupational Health and Safety Act): Additional amendments to Part 4 of the Schedule are effective December 31, 2005 and March 1, 2006. See the Ontario Gazette, issue 8, 2005, subsections 1(2) & (3), p. 78.

Designated Substance - Benzene (Occupational Health and Safety Act): O. Reg. 105/04 changes the exposure limits to airborne benzene in subsections 4(1) & (2), effective December 31, 2005. See the Ontario Gazette, issue 19, 2004, p. 831.

Reg. 461/05 are to come into force in 2006, 2007, and 2009: March 31, 2006 - storage, mixing, and on-site processing approval requirements; January 1, 2007 - new generator requirements; August 31, 2007 - land disposal restrictions: inorganic wastes; December 31, 2009 - land disposal restrictions: organic and mixed wastes & wastes, treated to specified standard and removal of all underlying hazardous constituents. This prohibits the charging or refilling of air conditioning or refrigeration equipment with a Category I substance on or after April 1, 2006, if the equipment is designed to be used or is being used for commercial or industrial purposes. The section also adds a prohibition restricting the installation, after April 1, 2006, of such equipment if it uses a Category 1 substance. In addition, subsection 8.2(1) is replaced to prohibit the charging of a chiller, on or after January 1, 2006, with a Category 1 substance except in the circumstances permitted. The section also requires the owner of a chiller in need of a major overhaul to ensure that it is not operated until it is given such an overhaul. Corrections are made to section 11.

Waste Resource Management Regulations (Environmental Protection Act): EC2005-572 replaces the Manifest Form in Schedule D as a result of revisions to the federal Export and Import of Hazardous Waste and Hazardous Recyclable Material Regulations.
