Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to March 2006. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between February 2006 and March 2006. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of March 2006. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2006-2 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2006-2 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Section 2.A Acts

Oil and Gas Commission Act: 2005, c. 35, now proclaimed in force, adds sections 6.2 to 6.5 (orphan sites; orphan site reclamation fund); amends sections 22 and 23.

Worker's Compensation Act: B.C. Reg. 374/2005 adjusts the dollar amounts in various sections to compensate for changes in the Consumer Price Index.

Section 2.B Regulations

Drinking Water Protection Regulation (Drinking Water Protection Act): B.C. Reg. 352/2005 replaces the following sections: 1 (definitions), 3 (exclusions from "domestic water system" in Act), 4 (prescribed water supply systems), 6(1) - (3) (construction permits), 12 (qualification standards for persons operating water supply systems); section 3.1 is added (small system exemption from section 6 of Act); sections 5(2) and 8 are amended.

Fishing Industry Regulations (Worker's Compensation Act): B.C. Reg. 371/2005 amends section 5 (commercial buyer of fish must pay assessments) and introduces gender neutral terminology in other sections.

Table of Exposure Limits for Chemical and Biological Substances (Workers' Compensation Act): October 2005 revisions clarify that "Particles not otherwise classified" (PNOC) have an 8-hour TWA exposure limit of 10 mg/m3 and a respirable limit of 3 mg/m3; a new end note (N) has been added to identify various specific nuisance dusts for which a respirable limit of 3 mg/m3 also applies.

Ground Water and Water Well Act: 2005, c. 26, now proclaimed in force, amends subsection 2(2); adds subsection 10(3) (order re well abandonment or improper seal or cap); amends section 11 (fines); adds clause 12(d.1).

Confined Spaces (Occupational Health and Safety Act): O. Reg. 632/05 new regulations regarding confined spaces are effective September 30, 2006. See the Ontario Gazette, December 24, 2005, p. 3693.

Construction Projects (Occupational Health and Safety Act): The remainder of O. Reg. 627/05 is in force April 1, 2006. The amendments concern the sections covering Electrical Hazards. See the Ontario Gazette, December 24, 2005, p. 3660. O. Reg. 628/05 adds new provisions regarding Confined Spaces - Part II.1, sections 221.1 to 221.19, effective September 30, 2006. Fire Code (Fire Protection and Prevention Act, 1997): O. Reg. 650/05 amends section 2.13 (installation of smoke alarms), effective March 1, 2006. See the Ontario Gazette, December 31, 2005, p. 3763.

General - Waste Management (Environmental Protection Act): More sections of O. Reg. 461/05 are to come into force in 2006, 2007, and 2009: March 31, 2006 - storage, mixing, and on-site processing approval requirements; January 1, 2007 - new generator requirements; August 31, 2007 - land disposal restrictions: inorganic wastes; December 31, 2009 - land disposal restrictions: organic and mixed wastes & wastes, treated to specified standard and removal of all underlying hazardous constituents. See the Ontario Gazette, 27 August, 2005, pg. 2751.

Health Care and Residential Facilities (Occupational Health and Safety Act): O. Reg. 631/05 adds new provisions regarding Confined Spaces, sections 43 to 43.19, effective September 30, 2006. See the Ontario Gazette, December 24, 2005, p. 3686.

Industrial Establishments (Occupational Health and Safety Act): O. Reg. 629/05 adds new provisions regarding Confined Spaces - Part I.1, sections 119.1 to 119.20, effective September 30, 2006. See the Ontario Gazette, December 24, 2005, p. 3671.

Mines and Mining Plants (Occupational Health and Safety Act): O. Reg. 630/05 adds new provisions regarding Confined Spaces - Part XII, sections 294 to 313, effective September 30, 2006. See the Ontario Gazette, December 24, 2005, p. 3679.

Division 2 AMENDMENTS

Section 2.A Acts

Highway Traffic Act: 2005, c. 31, Schedule 10 (Bill 18), now proclaimed in force, amends Part XI to make a lessee of a motor vehicle or street car that has consented to its use by another person liable for any loss or damage caused by its negligent operation. See sections 191.9, 192 & 193. More sections of 2005, c. 26 (Bill 169) are now proclaimed in force, amending section 79.1, adding section 134.1 (removal of vehicle, debris blocking traffic, and amending section 228.

Safety and Consumer Statutes Administration Act: 2004, c. 19 makes a minor change to the Schedule (name of another Act), effective March 31, 2006.

Section 2.B Regulations

Airborne Contaminant Discharge Monitoring and Reporting (Environmental Protection Act): O. Reg. 37/06: amends the definitions in section 1; replaces subsection 2(1), sections 3 (contaminants in Table 2A of referenced Guideline) and 14 (reports under section 6 for 2005); repeals sections 5, 7, 8, and 15.

Construction Projects (Occupational Health and Safety Act): The remainder of O. Reg. 627/05 is in force April 1, 2006. The division "Electrical Hazards" is completely replaced (sections 181 to 195.3). In addition, paragraphs 4 & 5 of subsection 11(1) are replaced, section 274 is replaced and section 277 is repealed.

Control of Exposure to Biological or Chemical Agents (Occupational Health and Safety Act): Parts of two amending regulations are now in force: O. Reg. 16/05 replaces the entries in part 4 of the Schedule for Hydrogen chloride and Molybdenum; O. Reg. 607/05 replaces subsections 9(2) - (4) (exposure values for airborne styene-based polyester resin) and the entry for Styrene in Part 4 of the Schedule.

Fire Code (Fire Protection and Prevention Act, 1997): O. Reg. 650/05, in force March 1, 2006, replaces Article 2.13.1.2(2) and adds 2.13.2.3(2.1) (smoke alarms).

Gaseous Fuels Code Adoption Document (Technical Standards and Safety Act, 2000): A Director's Order replaces section 1 of the Code Adoption Document (Canadian Standards Association (CSA) standard B149.1 is updated to the 2005 edition); annexes are added.

General (Application of Act) (Environmental Bill of Rights, 1993): O. Reg. 41/06 amends subsection 3(1) to prescribe the Nutrient Management Act, 2002 for purposes of section 16 of the Act.

General (Energy Efficiency Act): O. Reg. 38/06 replaces item 17 of the Schedule and repeals item 56 of the Schedule (item 56 to be added in January 1, 2007).

General - Waste Management (Environmental Protection Act): More sections of 461/05 come into force March 31, 2006 regarding new storage, mixing, and on-site processing approval requirements. New section 14.0.1 prohibits hazardous waste to be mixed or intermingled with any other waste or material unless in accordance with a certificate of approval. New sections 17.1 and 17.2 concern waste generation facilities and provide operation rules for storage, handling and maintenance. Subsection 16(1)(5.1) is added regarding hazardous waste transportation.

Prescribed Applications, Matters, Proceedings and Policies for the Purposes of Subsection 24(3) of the Act (Greenbelt Act, 2005): O. Reg. 13/06 adds section 2.1 (prescribed applications, matters, proceedings and policies).

Propane Code Adoption Document (Technical Standards and Safety Act, 2000): A Director's Order replaces Parts I and II of the Code Adoption Document. Canadian Standards Association (CSA) standards B149.1, B149.2, and B149.5 are updated to 2005 editions.
