Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to March 2006. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between March 2006 and April 2006. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of April 2006. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2006-2 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2006-2 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Migratory Birds Regulations (Migratory Birds Convention Act): SOR/2006-52 amends Table I.2 of Part V of Schedule I (Measures in Quebec Concerning Overabundant Species). The goal of the amendments is to restore the biological diversity of arctic wetland ecosystems and the ecosystems of important migration and wintering areas, by reducing the population size of overabundant snow goose populations.

Administrative Items Regulation (Safety Codes Act): As a consequential amendment of Alta. Reg. 49/2006 section 18 is amended and sections 17 & 19 repealed.

Administrative Penalty Regulation (Environmental Protection and Enhancement Act): Alta. Regs. 33/2006 and 34/2006 add provisions in the Schedule for two new regulations: 3.1 Emissions Trading Regulation, and 4.1 Mercury Emissions from Coal-fired Power Plants Regulation.

Environmental Management Act: 2006, c. 16 (Bill 15) among other changes: amends sections 106 & 107 (Conservation Officer Service); adds sections 107.1 (disposition of items seized by a conservation officer) and 108.1 (certificate of evidence of the chief conservation officer); replaces section 109 (inspections by officers); replaces subsections 111(2) & (3) (inspections of vehicles transporting waste); replaces section 112 (seizures and prevention orders).

Forest Act: Sections of 2006, c. 13 (Bill 9) in force, among other changes, add Part 11.1 (Inspections, Audits and Assessments), Divisions 1 to 5. The new Part concerns forest revenue officials, record keeping, assessment of estimated stumpage, penalties, appeals of assessments. 2003, c. 30 repeals subsections 56.1(5) & (6) (allowable annual cut), effective April 1, 2006.

Forest and Range Practices Act: 2006, c. 13 (Bill 9), among other changes, amends sections 30 (free growing stand), 59 ("dwelling"), 187 (forest development plan).

Forest Practices Code of British Columbia Act: As a consequential amendment of 2006, c. 13 (Bill 9), a ministerial change is made in section 197.

Forestry Revitalization Act: As a consequential amendment of 2006, c. 13 (Bill 9), clause 3(5)(a) is replaced.

Integrated Pest Management Act: 2006, c. 15 (Bill 15) among other changes: amends sections 17 (inspections), 19 (inspections by conservation officer of motor vehicle), 20 (contraventions).

Land Act: 2006, c. 1 (Bill 4) replaces subsection 97(1) (ministerial delegation). As a consequential amendment of 2006, c. 7 (Bill 3), section 1.1 is added (exclusions from definition of Crown land) and subsection 106(3) amended.

Mining Right of Way Act: As a consequential amendment of 2006, c. 13 (Bill 9), a ministerial change is made in sections 3 and 7.

Motor Vehicle Act: 2006, c. 15 (Bill 15) amends clause 212(4)(a).

Protected Areas of British Columbia Act: 2006, c. 15 (Bill 15) adds and replaces reserves and parks in Schedule A, B, C, & D.

Transportation Act: 2006, c. 15 (Bill 15) makes minor amendments to clause 8(2)(a) and subsection 86(1). As a consequential amendment of 2006, c. 13 (Bill 9), a ministerial change is made in section 56.

Wildfire Act: That part of 2006, c. 13 (Bill 9) in force replaces the definition of "grass land" in section 1.

Workers' Compensation Act: As a consequential amendment of 2006, c. 7 (Bill 3), a minor change is made to subsection 37(1).

Recycling Regulation (Environmental Management Act): B.C. Reg. 23/2006 amends the regulation in various places by adding an electronic product category. See especially new section 3.1 and new Schedule 3.

Reviewable Projects Regulation (Environmental Assessment Act): B.C. Reg. 14/2006 amends section 6 (criteria for proposed modification of industrial projects).

Highway Traffic Act: The remainder of 2005, c. 37 is now proclaimed in force. Schedule B makes several amendments required by the The Drivers and Vehicles Act to help smooth the transition from government administration of the licensing and registration system to administration by the Manitoba Public Insurance Corporation. Other amendments ensure that the Government of Manitoba maintains control over matters of public interest, such as setting the charges to be paid for licences, registrations and other services, and determining when a statutory or regulatory contravention will constitute an offence.

Off-Road Vehicles Act: As a consequential amendment of 2005, c. 37, now proclaimed in force, several sections are amended because of The Drivers and Vehicles Act, including the definitions in section 1; sections 4 to 12, 55 to 57.2, 60, and 69 are repealed.

Taxicab Act: As a consequential amendment of 2005, c. 37, now proclaimed in force, various sections are amended as a result of the proclamation of The Drivers and Vehicles Act.

Section 2.B Regulations

Periodic Mandatory Vehicle Inspection Regulation (Highway Traffic Act): Man. Reg. 43/2006: amends various sections to change references from The Highway Traffic Act to The Drivers and Vehicles Act; replaces section 8.1 (charges for inspection certificate forms and decals); repeals Schedule A, B, and C.

Fire Code (Fire Protection and Prevention Act, 1997): O. Reg. 650/05 amends section 2.13 (installation of smoke alarms), effective March 1, 2006. See the Ontario Gazette, December 31, 2005, p. 3763.

General - Waste Management (Environmental Protection Act): More sections of O. Reg. 461/05 are to come into force in 2006, 2007, and 2009: March 31, 2006 - storage, mixing, and on-site processing approval requirements; January 1, 2007 - new generator requirements; August 31, 2007 - land disposal restrictions: inorganic wastes; December 31, 2009 - land disposal restrictions: organic and mixed wastes & wastes, treated to specified standard and removal of all underlying hazardous constituents. Health Care and Residential Facilities (Occupational Health and Safety Act): O. Reg. 631/05 adds new provisions regarding Confined Spaces, sections 43 to 43.19, effective September 30, 2006. See the Ontario Gazette, December 24, 2005, p. 3686.

Division 2 AMENDMENTS

Section 2.A Acts

Highway Traffic Act: More sections of 2005, c. 26 (Bill 169) are now proclaimed in force. The amendments include: New sections 84.2 & 84.3 create an offence if a vehicle part or anything affixed to a vehicle becomes detached while being driven on a highway. Section 128, governing rate of speed, and section 214.1, governing rate of speed in community safety zones, are amended to increase the fines and penalties. New section 146.1 requires drivers to obey traffic control stop and slow signs displayed by a traffic control person on or adjacent to a roadway where construction or maintenance work is being carried out or by a firefighter on or adjacent to a roadway where an accident has occurred.

Personal Health Information Protection Act, 2004: As a consequential amendment of 2006, c. 4 (Bill 36) sections 38 &39 are amended, and subsection 46(1) is replaced. See "Public Hospitals Act" entry.

Public Hospitals Act: As a consequential amendment of 2006, c. 4 (Bill 36) various sections are amended to reflect the fact that funding will come from local health integration networks, as opposed to only the Minister of Health and Long-Term Care as presently, and to reflect the power of networks to make integration decisions and the power of the Minister to make integration orders. See especially sections 6, 20, 34, and 44.

Division 2 AMENDMENTS

Section 2.A Acts

Building Act: 2005, c. 10 *** amends several sections to include references to petroleum equipment installations. A description of the original Bill 92 follows: "The object of this bill is to transfer to the Régie du bâtiment du Québec and to the Minister of Sustainable Development, Environment and Parks some of the responsibilities currently held by the Minister of Natural Resources and Wildlife under the Act respecting petroleum products and equipment. The responsibilities transferred to the Régie du bâtiment du Québec consist in ensuring the quality of construction work on petroleum equipment, ensuring the safety of people using petroleum equipment, and monitoring and controlling compliance with construction and safety standards relating to petroleum equipment. The responsibilities transferred to the Minister of Sustainable Development, Environment and Parks concern the environmental issues related to the use of certain petroleum equipment and the cases where a characterization study and, possibly, a rehabilitation plan is necessary..."

Environment Quality Act: As a consequential amendment of 2005, c. 10 *** section 31.51.1 is added (owner or operator of petroleum equipment tank to notify Minister and perform or commission a characterization study of the land where the tank is located); paragraphs (2.1) & (2.2) are added to section 31.69 (regulations). Forest Act: As a consequential amendment of 2005, c. 44, effective April 1, 2006, section 196 is amended regarding the Minister of Revenue. French language version

Highway Safety Code: More sections of 2004, c. 2 are now proclaimed in force. The amendments give peace officers the power to require a driver to have a vehicle's tinted windows inspected by the Société de l'assurance automobile du Québec. See new sections 520.2, 539.1 to 539.8. As a consequential amendment of 2005, c. 44, in force April 1, 2006, administrative changes are made to sections 15 and 393. As a consequential amendment of 2005, c. 10 *** paragraph 519.65(13) is repealed. French language version

Act respecting petroleum products and equipment: 2005, c. 10 *** changes the name of the Act to: Petroleum Products Act. It removes safety provisions from the Act, repeals sections 6 to 14, Parts (Chapters) III and IV (sections 16 to 66), Part VII (sections 77 to 86), 93, 100 to 102, 104 and 105. See amendments to sections 2, 87, 88, 90, 91, 97 and new section 114.1. French language version

Act respecting threatened or vulnerable species: As a consequential amendment of 2005, c. 44, effective April 1, 2006, section 36 is amended regarding the Minister of Revenue. French language version

*** Section 84 of An Act to amend the Act respecting petroleum products and equipment, the Building Act and other legislative provisions (2005, c. 10) provides for the Act to come into force on 1 April 2006 or on any later date to be set by the Government. O.C. 154-2006 provides for the Act to come into force on 1 April 2007.

*** L'article 84 de la Loi modifiant la Loi sur les produits et les équipements pétroliers, la Loi sur le bâtiment et d"autres dispositions législatives (2005, c. 10) prescrit son entrée en vigueur le 1er avril 2006 ou à toute date ultérieure déterminée par le gouvernement. Building Code [Construction Code]: O.C. 120-2006 updates references to Canadian Standards Association standards B149.1, B149.2, B149.3, and Z276 in Chapter II (Gas), sections 2.01 to 2.15.

Regulation respecting occupational health and safety in mines (An Act respecting occupational health and safety): O.C. 119-2006 amends the regulation in several areas: it adds new definitions relating to explosives, in particular regarding the place of loading, the loading area and the blasting area. It amends certain air quality provisions and provisions relating to equipment, such as equipment powered by internal combustion or diesel engines, and hoists. Safety measures are increased as regards fire prevention, the storing and loading of explosives, fuel and other combustible materials, and electrical equipment. Two modules (IV and VI) are added that concern the training of underground mine workers. To remove ambiguities resulting from the use of certain words, the amendments clarify tunnel faces, combustible liquids and grease, and certain terms such as materials and equipment.
