Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to May 2006. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between April 2006 and May 2006. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of May 2006. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2006-2 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2006-2 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Forest Act: The section of 2004, c. 36 replacing section 44 (applications - woodlot licences) is now proclaimed in force.

Protected Areas of British Columbia Act: The part of 2005, c. 35 which repeals the description of Sunnybrae Park in Schedule C is now proclaimed in force.

Section 2.B Regulations

Administrative Review and Appeal Procedure Regulation (Forest and Range Practices Act): B.C. Reg. 83/2006 amends several sections, including: replacing Division 2 (Procedures after Receipt of Request for Review under the Forest Act, sections 3 to 5); adding Division 2.1 (Procedures after Receipt of Request for Review under the Range Act, sections 7.1 to 7.6), Division 4 (Procedures after Receipt of Request for Review under the Wildfire Act, sections 15.1 to 15.7); replacing section 21 (procedure following receipt of notice of appeal).

Motor Vehicle Act Regulations: B.C. Reg. 57/2006 amends Schedule 1 of Division 23: it replaces the signs and descriptions for "Truck Signs (Regulatory)" and (Do Not Enter (Regulatory), and adds signs and description for "Bus Signs (Regulatory)".

Occupational Health and Safety Regulation: B.C. Reg. 18/2006 amends section 26.65 to require logging trucks to have at the back of a cab a substantial barrier for the protection of the driver. Among other changes, B.C. Reg. 19/2006 replaces subsection 3.1(1) (OH&S program requirement); amends section 6.1 to specify a different test for asbestos determination; amends sections 11.6 (personal fall protection system), 13.29 (lower limit travel devices), 20.13 (thrust-out crane landing platform), 20.102 (marine construction). Among other changes, B.C. Reg. 20/2006 replaces Table 8.1 in section 8.34 (Respirator protection factors); replaces section 8.37 regarding respirable air quality and updates Canadian Standards Association (CSA) standard Z180.1 to the 2000 edition; amends sections to specify that fit tests must be performed in accordance with procedures in CSA standard Z94.4, 2002 edition; adds section 8.45 (maintenance and inspection of compressed air cylinders): the 1996 edition of CSA standard B339 replaces the previous one. Among other changes, B.C. Reg. 21/2006 amends sections 6.53, 6.55, and 6.57 to deal with safety aspects of cytotoxic drugs.

Petroleum and Natural Gas General Regulation (Petroleum and Natural Gas Act): B.C. Reg. 72/2006 amends section 2(e) to increase the fees for a well authorization.

Railway Safety Adopted Provisions Regulation (Railway Safety Act): B.C. Reg. 61/2006 amends items 3 & 5 of the table in section 5.

Recycling Regulation (Environmental Management Act): B.C. Reg. 65/2006 adds a Tire Product Category. See sections 1, 3.2 (retailers), 18 (transitional), and new Schedule 4.

Wildfire Regulation (Wildfire Act): B.C. Reg. 75/2006, among other changes: replaces sections 5 (fire fighting hand tools required for industrial activity), 6 (high risk activities), 13 (resources required for fire control activities), 25 (exemptions from certain regulations), 29 (circumstances for not seeking cost recovery), 33 & 34 (penalties & offences).

Reg. 461/05 are to come into force in 2007, and 2009: January 1, 2007 - new generator requirements; August 31, 2007 - land disposal restrictions: inorganic wastes; December 31, 2009 - land disposal restrictions: organic and mixed wastes & wastes, treated to specified standard and removal of all underlying hazardous constituents. Section 2.A Acts

Highway Traffic Act: Another section of 2005, c. 26 (Bill 169) now proclaimed in force, replaces subsection 170(15) (powers of officer to remove vehicle).

Planning Act: Another section of 2005, c. 26 (Bill 169) now proclaimed in force, adds clause (b.1) to subsection 51(25) (conditions on approval of a plan of subdivision).

Provincial Offences Act: As a consequential amendment of 2005, c. 18 a reference to an Act is changed in subclause 12(2)(a)(v).

Division 2 AMENDMENTS

Section 2.A Acts

Environment Quality Act: 2006, c. 3 (Bill 118) amends section 31 (reference to Green Fund). In addition, ministerial name changes are made in various sections. French language version

Act respecting the Ministère de l'Environnement: 2006, c. 3 (Bill 118) changes the name of the Act to: Act respecting the Ministère du Développement durable, de l'Environnement et des Parcs. The amendments provide for the establishment of a Green Fund to finance measures or programs that the Minister of Sustainable Development, Environment and Parks may carry out within the scope of ministerial functions. The Fund is intended, among other purposes, to support measures promoting sustainable development, especially in its environmental aspects, and make it possible for the Minister to grant financial assistance, within the framework of the law, in particular to municipalities and non-profit organizations working in the environmental field. Forest Act: The remaining section of 2004, c. 6 is now proclaimed in force, which amends section 124.37 (forest management funding program). French language version

Tobacco Act: 2005, c. 29 amendments now in force prohibit smoking in places where smoking was not, until now, prohibited under the Act and to further restrict smoking in the enclosed spaces. Prohibited areas include enclosed spaces used by private clubs; under big tops and in other similar facilities that are open to the public; at certain hours on school grounds and the grounds of childcare centres; buildings of a general and vocational college or a university; pubs, taverns, bars and bingo halls; formerly designated areas in such places as restaurants, the common areas of shopping centres, the gaming areas of state-owned casinos, amusement halls, marine passenger terminals, bus stations and railway passenger stations. The rules applying to the sale of tobacco are also amended. The prohibition to sell tobacco to a minor, formerly applicable only to the operator of a business, will now apply to everyone. It is strictly prohibited to have a tobacco vending machine installed. The retail sale of tobacco is an activity that must be declared in the register kept in accordance with another Act. The severity of penal provisions are increased, especially those relating to selling tobacco to a minor. Some amendments are to come into force on later dates. As a consequential amendment of 2005, c. 47, now proclaimed in force, changes of an administrative nature are made to sections 2 and 17. French language version

Pesticides Management Code: O.C. 319-2006 amends section 1 (reference to "Protection Policy for Lakeshores, Riverbanks, Littoral zones and Floodplains") and makes minor changes to sections 2 and 30 of the English version. French language version
