Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to June 2006. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between May 2006 and June 2006. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of June 2006. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2006-3 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2006-3 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Safety Management Regulations (Canada Shipping Act, 2001): Proposed amendments change the wording of the regulation in order to make it consistent with the provisions of the new Canada Shipping Act, 2001 when it comes into force in early 2007. See Canada Gazette, Part I, June 17, 2006, p. 1636.

Activities Designation Regulation (Environmental Protection and Enhancement Act): Alta. Environmental Protection Act: 2006, c. 12 (Bill 16) amends section 78 to extend authority for department officials to issue, vary, amend or revoke approvals; amends sections 91 and 92 to clarify the process for requesting a formal investigation where a person has a reasonable belief that the Act has been or is being contravened; amends section 99 to extend signing authority for orders to officials of the Department of Government Services where the minister delegates that authority; amends section 101 to clarify that orders remain in effect during an appeal until a decision is made with respect to the appeal.

Forestry Act: 2006, c. 17 (Bill 15) adds subsections 15(2), 22(2), and 27(8) which allows the Lieutenant-Governor in Council to impose a directed sale or a first offer refusal system for the sale of timber cut under a Crown timber licence, under a timber sale agreement, or under a cutting permit. New section 27.1 validates first offer for sale conditions required under cutting permits issued before the commencement of the section. In addition, further provisions are added to section 38 to allow the Lieutenant-Governor in Council to make regulations respecting a first offer refusal system.

Highway Traffic Act: 2006, c. 13 (Bill 17) adds sections 16.2 to 16.4 to continue to require an automobile dealer to be registered in order to carry on business notwithstanding the repeal of the Automobile Dealers Act.

Occupational Health and Safety Act: 2006, c. 16 (Bill 9) updates ministerial definitions in section 2 and replaces section 70 (to change the limitation period during which offences under the Act or regulations may be prosecuted).

Workplace Health, Safety and Compensation Act: 2006, c. 5 (Bill 22) amends section 65.1 to allow the payment of compensation benefits to surviving spouses who remarried before 1985. This would be retroactive to April 17, 1985. 2006, c. 19 (Bill 24) expands immunity from legal action to include officers and employees of the commission; also to officers, employees, advisors and commissioners of the review division (see sections 14 and 24.1). As a consequential amendment of 2006, c. 22 (Bill 25) age distinctions may be authorized notwithstanding the Human Rights Code.

Occupational Health and Safety First Aid Regulations (Occupational Health and Safety Act): N.L.R. 45/06 amends section 2 and adds section 3.1 in regard to certificates for advanced first aid, emergency first aid, and standard first aid.

Building Code: 2005, c. 47 makes administrative changes in various sections, including court changes; amends section 19 (offences, penalties); adds section 19A (limitation period for prosecution); the term "building official" replaces "inspector" throughout the Act.

Labour Standards Code: 2005, c. 38 adds section 79A (deduction of wages to pay for employer loss). Effective July 1, 2006.

Motor Vehicle Act: 2005, c. 32, now proclaimed in force, amends subsection 67(5) and adds section 273A (motor vehicle operated in the course of committing an offence). 2005, c. 38 adds clauses 67(5)(aa) & (ab); amends subsection 278 regarding theft of gasoline and Criminal Code offences related to the use of motor vehicles in the commission of an offence. Effective July 1, 2006.

Section 2.B Regulations

Species at Risk List Regulations (Endangered Species Act): N.S. Reg. 77/2006 adds 12 species at risk to the regulation.

Confined Spaces (Occupational Health and Safety Act): O. Reg. 632/05 new regulations regarding confined spaces are effective September 30, 2006. See the Ontario Gazette, December 24, 2005, p. 3693.

Construction Projects (Occupational Health and Safety Act): O. Reg. 628/05 adds new provisions regarding Confined Spaces - Part II.1, sections 221.1 to 221.19, effective September 30, 2006. See the Ontario Gazette, December 24, 2005, p. 3665.

Ethanol in Gasoline (Environmental Protection Act): New regulations are in force January 1, 2007. See the Ontario Gazette, issue 43, October 22, 2005, p. 1699.

Fire Code (Fire Protection and Prevention Act, 1997): O. Reg. 144/06 amends various sections, including adding SECTION 9.9 HOTELS. See the Ontario Gazette, May 20, 2006, p. 917.

General - Waste Management (Environmental Protection Act): More sections of O. Reg. 461/05 are to come into force in 2007, and 2009: January 1, 2007 - new generator requirements; August 31, 2007 - land disposal restrictions: inorganic wastes; December 31, 2009 - land disposal restrictions: organic and mixed wastes & wastes, treated to specified standard and removal of all underlying hazardous constituents. Section 2.A Acts

Highway Traffic Act: 2006, c. 36 (Bill 40), among other changes, adds subsections 71(4.1) (alcohol ignition interlock device as a condition of license), 261(1.1) & (1.2) (license conditions by Registrar).

Occupational Health and Safety Act: 2006, c. 36 (Bill 25) amends subsection 39(1) (to allow for disclosure of information where it will facilitate the administration of other legislation administered by the Board); amends subsection 43(1) (increases maximum fine for contravening Act or regulation provision).

Renewable Energy Act: Among other changes, 2006, c. 38 (Bill 35) amends section 1 to add a definition of "extra-provincial renewable energy supplier"; amends subsection 6(1) to require public utilities to submit plans of demand side management measures by January 1, 2007; repeals section 7; amends section 8 (minimum purchase price does not apply in respect of the purchase of electric energy under agreement entered into prior to December 20, 2005); amends section 13 (clarifies what information a public utility is required to give to a small renewable energy generator in a monthly bill reading notice; changes the units of measurement for the calculation of the energy credits that small renewable energy generators may earn from dollars to kilowatt-hours; changes the expiry date for the use of the credits earned by small capacity renewable energy generators in a calendar year).

Workers' Compensation Act: 2006, c. 42 (Bill 36) amends section 48.3 (adjustment of benefits where accident prior to Jan. 1, 1995); repeals subsection 48.4(3); adds subsection 49.1(2) (extended wage loss benefits). In force July 1, 2006.

Section 2.B Regulations

General Regulations (Smoke-free Places Act): EC2006-289 amends section 1 to clarify that the terms "elementary, intermediate or secondary school" and "hospital" include the grounds of the school or hospital and the buildings that are located on the grounds.

Pesticides Control Act Regulations: EC2006-313 makes several changes, including: adding the definitions of "certified applicator", "AG-1 Pesticide Use Certificate" and "AG-2 Pesticide Use Certificate" (section 1); adding a reference to the type of certificate held by a person taking continuing education courses (section 3); clarifying the insurance requirements (section 5); dealing with the issuance of a Class A Pesticide Applicator Certificates (section 6); changing the references from "Director" to "Minister" in respect of issuing a certificate, plus transitional provisions (section 8); revising the Loader/mixer Certificate provisions (section 10); clarifying the method of transport of concentrated non-domestic pesticides (section 27); clarifying the requirements for handling or transporting non-domestic pesticides on a highway or mixing such pesticides (section 29); clarifying the rules on cleaning and filling pesticide sprayers and equipment near a well or open body of water (section 38).
