Introduction
The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to July 2006. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

1. Legislation in progress/proposed
1A. Acts
Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.
Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).
Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.
1B. Regulations
List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.
2. Amendments
Contains information about amendments which have come into force between June 2006 and July 2006. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.
3. Repealed Legislation
Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of July 2006. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).
4. New documents for the 2006-3 Issue of the Canadian enviroOSH Legislation CD
Documents that will be on the 2006-3 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Feeds Regulations, 1983 (Feeds Act): SOR/2006-147 amends the regulation in various sections to strengthen safeguards against Bovine Spongiform Encephalopathy (BSE). These final amendments come into force on July 12, 2007 and are found in the Canada Gazette, Part II, July 12, 2006, p. 871.
Mackenzie Valley Land Use Regulations (Mackenzie Valley Resource Management Act): Proposed amendments are found in the Canada Gazette, Part I, November 19, 2005, p. 3855.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Subsections 115(2.2) to (2.4) of Schedule IV as enacted by SOR/2004-250 (vehicle identification number in bar code format) come into force September 1, 2008. Regulations for the Prevention of Pollution from Ships and for Dangerous Chemicals (Canada Shipping Act): New proposed regulations replace the Air Pollution Regulations, the Garbage Pollution Prevention Regulations, the Great Lakes Sewage Pollution Prevention Regulations, the Pollutant Substances Pollution Prevention Regulations, the Non-Pleasure Craft Sewage Pollution Prevention Regulations, the Pleasure Craft Sewage Pollution Prevention Regulations, the Oil Pollution Prevention Regulations, and the Dangerous Chemicals and Noxious Liquid Substances Regulations. Safety Management Regulations (Canada Shipping Act, 2001): Proposed amendments change the wording of the regulation in order to make it consistent with the provisions of the new Canada Shipping Act, 2001 when it comes into force in early 2007. See Canada Gazette, Part I, June 17, 2006, p. 1636.

Section 2.A Acts
Feeds Act: As a consequential amendment of 2002, c. 28, now proclaimed in force, paragraph 5(h) is replaced (reference to new Pest Control Products Act).
Hazardous Products Act: As a consequential amendment of 2002, c. 28, now proclaimed in force, paragraphs 3(1)(c) and 12(c) are replaced (reference to new Pest Control Products Act). French language version
Pesticide Residue Compensation Act: As a consequential amendment of 2002, c. 28, now proclaimed in force, the definition of "Minister" in section 2 is replaced and paragraphs 3(1)(a) & (b) are replaced (reference to new Pest Control Products Act).
Section 2.B Regulations
Coal Mines (CBDC) Occupational Safety and Health Regulations (Canada Labour Code - Part II): SOR/2006-138 adds Part VIII - Entering A Closed Mine, sections 167 - 169. These are provisions for employers who propose to enter a closed mine without the intent to significantly disturb the ground. Such employers shall, before entering the mine, adopt and implement a safety code. French language version
Migratory Birds Regulations (Migratory Birds Convention Act, 1994): SOR/2006-136 replaces subsection 13(3) and amends Schedule I to establish hunting season dates for 2006/2007, and the number of migratory game birds that may be taken or possessed during those dates.
Sulphur in Diesel Fuel Regulations (Canadian Environmental Protection Act, 1999): SOR/2006-163 amends subsection 3(2) to provide additional flexibility to facilitate the introduction of 15 milligrams per kilogram (mg/kg)-sulphur diesel fuel for on-road use in 2006. The amendments allow a slightly higher sulphur limit of 22 mg/kg for sales of on-road diesel fuel during a period of 45 days, from September 1, 2006 to October 15, 2006, after which the final sales limit of 15 mg/kg takes effect. The Dangerous Goods Handling and Transportation Act: 2006, c. 4 (Bill 4) amends the Act to make its terminology and regulatory framework more consistent with the Transportation of Dangerous Goods Act, 1992 (Canada). The enforcement powers of inspectors and environment officers are restated so that they are consistent with such powers under other Department of Conservation Acts. The Department's ability to require reimbursement of cleanup and accident-response costs from persons who mishandle dangerous goods or contaminants is enhanced, including a non-judicial process for intercepting payments from others to such persons. A liability protection provision is added to protect persons acting in good faith under the Act from civil liability for their actions. The Environment Act: 2006, c. 24 (Bill 42) amends clause 41(1)(cc). French language version
The Water Rights Act: 2006, c. 8 (Bill 14) provides for the appointment of officers to enforce the Act. It gives officers and other authorized persons protection from liability and the power to conduct inspections and searches. It also allows orders to be served by registered mail and modernizes the language of several provisions in the Act. See especially sections 18, 18.1, 24.1.

Clean Environment Act: 2006, c. 10 (Bill 15) replaces section 22.1 (stewardship board) and amends section 32 (regulations).
Motor Vehicle Act: 2006, c. 13 (Bill 19) amends various sections to make the Minister of Transportation responsible for some sections of the Act (see new section 2.2). Other amendments include: section 192 (stopping on road) and subsection 225(4.1) (flashing amber lights for school buses).

Division 2 AMENDMENTS
Section 2.A Acts
Aggregate Resources Act: 2006, c. 19, Sch. P (Bill 190) adds section 14.1 and amends section 46 to the effect that licensees and permittees must inform the Aggregate Resources Trust of the amount of material they have removed from a site. Subsection 62(1) is replaced (documents relating to quantities of aggregate removed and to inventories of material on site are to be kept). Replacement section 63 gives an inspector the power to issue a compliance order and, where a pit or quarry is being operated without a licence, an order may be made requiring that operations cease. New section 63.1 provides for an appeal from an order of an inspector under section 63.
Ambulance Act: 2006, c. 19, Sch. C (Bill 190) changes the name of a court in section 15.
Bridges Act: 2006, c. 19, Sch. T (Bill 190) adds subsection 2(1.1) (ministerial approval).
Building Code Act: 2006, c. 19, Sch. O (Bill 190) amends clause 7(1)(e) and subsection 13(6) to reflect the role of registered code agencies that may be appointed. Other amendments are made which are technical in nature.
Class Proceedings Act: 2006, c. 19, Sch. C (Bill 190) changes the name of a court in sections 1 and 30.
Coroners Act: 2006, c. 19, Sch. C (Bill 190) changes the name of a court in section 40. Schedule D amends section 10 (reference to federal legislation).
Emergency Management Act: 2006, c. 13 (Bill 56), now proclaimed in force, changes the name of the Act to the Emergency Management and Civil Protection Act and amends the definition of emergency to include dangers caused by disease or health risk (see subsection 1(2)). New section 2.0.1 permits the establishment of a Cabinet Committee to advise the Cabinet on matters relating to emergencies. The primary purpose of the amendments are to provide emergency powers to the Lieutenant Governor in Council and to the Premier to deal with emergencies. These are dealt with in the replacement sections 7 and 7.1, and new sections 7.0.1 to 7.0.11 and 7.2. Section 11 (protection from action) is replaced and section 13.1 added (nothing done under the Act constitutes an expropriation).
Environmental Bill of Rights: 2006, c. 19, Sch. K (Bill 190) amends section 116 to update a reference to another Act.
Environmental Protection Act: 2006, c. 19, Sch. K (Bill 190) amends section 168.6 concerning certificates of property use; section 168.13 is amended regarding protection for municipalities from certain orders made under the Act; section 168.18 is amended regarding a secured creditor who becomes the owner of property by virtue of a foreclosure. These provisions are amended to ensure that the protection from orders does not apply in respect of anything done after the municipality or secured creditor ceases to own the property.
Fire Protection and Prevention Act: 2006, c. 19, Sch. M (Bill 190) adds subsection 49(5) (provisions of Labour Relations Act, 1995 apply relating to conciliators).
Healing Arts Radiation Protection Act: 2006, c. 19, Sch. C (Bill 190) changes the name of a court in sections 11, 12 and 25. Schedule L changes ministerial names in various sections.
Health Protection and Promotion Act: 2006, c. 19, Sch. D (Bill 190) amends subsections 21(1) and 37(3) (reference to federal legislation). Schedule L replaces clause 91.1(5)(b) and changes ministerial names in various sections.
Highway Traffic Act: 2006, c. 19, Sch. D (Bill 190) amends subsections 1(1), 41(6)(b), 42(4)(b), 210(5) & (6) (reference to federal legislation). Schedule T makes administrative changes to update obsolete references in various sections and make terminology consistent in section 144. 2006, c. 20 (Bill 209) amends the Act to extend certain provisions to cover the operation of vessels within the meaning of the Criminal Code (Canada). See sections 41, 43, 48, 48.3, and 210.
Lakes and Rivers Improvement Act: 2006, c. 19, Sch. P (Bill 190) adds section 17.3 (holder of approval to comply with conditions) and amends subsection 28(1) (adds offences).
Lightning Rods Act: 2006, c. 19, Sch. C (Bill 190) changes the name of a court in section 7.
Niagara Escarpment Planning and Development Act: As a consequential amendment of 2006, c. 2 (Bill 206), now proclaimed in force, subsection 5(9.1) is added (Commission deemed local board). 2006, c. 19, Sch. P (Bill 190) amendments relate to provisions dealing with the communication of a notice of decision on an application for a development permit and the service of certain notices and orders. See section 25 and new section 28.1.
Occupational Health and Safety Act: 2006, c. 19, Sch. D (Bill 190) amends clause 43(2)(c) (reference to federal legislation). Schedule M adds section 68.1 which allows a Director to publicly disclose the name of a person convicted of an offence under the Act, a description of the offence and the sentence.
Oil, Gas and Salt Resources Act: 2006, c. 19, Sch. P (Bill 190) provides new definitions for "correlative rights", "facility", "well", "pipeline" and "inspector" (section 1). The major amendments relate to: clarification of the powers and duties of the Mining and Lands Commissioner (subsection 1(3)); providing inspectors with additional inspection powers and the power to make an order for the plugging of a well or the decommissioning of a facility (section 7.0.1); providing for the Minister's consent to the transfer of a well licence or a permit (section 10.1); prohibiting the construction of buildings or structures within 75 metres of a well or facility that has not been decommissioned (new section 10.2).
Ontario Heritage Act: Parts of 2006, c. 11 (Bill 53) in force add subsections 27(3) - (5) (intention to demolish) and amends subsection 40.1(5).
Ontario Water Resources Act: 2006, c. 19, Sch. K (Bill 190) amends section 30 to require notice of discharges that impair the quality of water to be given to the Ministry of the Environment, not the Minister.
Provincial Offences Act: 2006, c. 19, Sch. D (Bill 190) amends sections 103 and 107(7) (reference to federal legislation).
Public Hospitals Act: 2006, c. 19, Sch. C (Bill 190) changes the name of a court in sections 41 and 43. Schedule L changes ministerial names in various sections.
Public Lands Act: 2006, c. 19, Sch. P (Bill 190) makes administrative changes to clause 14(1)(a) and 34(3).
Road Access Act: 2006, c. 19, Sch. C (Bill 190) changes the name of a court in section 1.
Safety and Consumer Statutes Administration Act: 2006, c. 19, Sch. G (Bill 190) adds section 11.1 to provide protection from personal liability for various persons in respect of acts or omissions in the performance in good faith of their duties or powers. Also, section 12 is amended so that a designated administrative authority is allowed to set and govern payments that persons are required to make to any established fund or account.
Workplace Safety and Insurance Act, 1997: 2006, c. 13 (Bill 56), now proclaimed in force, amends the definition of "worker" in subsection 2(1) and replaces subsection 71(3) (Crown deemed employer). The changes relate to the declaration of an emergency.
Section 2.B Regulations
Blue Box Waste (Waste Diversion Act, 2002): O. Reg. 255/06 amends section 2 (composition and election of board of directors of Stewardship Ontario).
Building Code (Building Code Act, 1992): O. Reg. 349/06 amendments includes provisions that promote the use of green technologies, create more flexibility in the construction of small care homes; and update the list of applicable law. New articles include: 3.1.5.24 Combustible Solar Collector Systems; 3.2.7.1.A & 9.34.2.8 Motion Sensors; 5.6.2.3. & 9.26.1.3 Solar Collector Systems; 7.4.10.6 Hydraulic Loads from Roofs or Paved Surfaces. Article 7.6.1.15 Solar Domestic Hot Water Systems is replaced.
Conservation Reserve (Public Lands Act): O. Reg. 332/06 adds conservation reserves 281 to 292 to the regulation.
Drinking Water Systems (Safe Drinking Water Act, 2002): O. Reg. 247/06 makes extensive changes to the regulation. The topics relate to: testing for chlorine residual in water distribution systems; the persons allowed to conduct certain tests as part of operational checks in small municipal residential, non-municipal year round residential, and large non-residential systems serving designated facilities; testing for organic and inorganic chemical parameters; microbiological testing of drinking water; clear definitions of testing frequency; updating of requirements related to specific microbiological parameters; clearer corrective actions in response to adverse microbiological test results, and for user notification to use alternate supply; adverse conditions and corrective action related to chlorine residual; exemption from treatment for non-municipal year-round residential systems; engineer's report and engineering evaluation of treatment equipment; system registration; point of entry (POE) treatment; exemptions for systems using transported water.
Drinking Water Testing Services (Safe Drinking Water Act, 2002): O. Reg. 250/06 adds sections 3.1 (supervised chlorine residual and turbidity checks) and 3.2 (exemption from treatment requirements).
Endangered Species Regulation (Endangered Species Act): O. Reg. 321/06 replaces items 3 & 4 of Schedule 1 with a new item 3.
Food Premises (Health Protection and Promotion Act): O. Reg. 308/06 amends sections 1 and 2 to provide for farmers' market and farm products; the exemption for religious organizations, service clubs or fraternal organizations is subject to conditions set out in section 2(3).
General (Crown Forest Sustainability Act, 1994): O. Reg. 257/06 replaces section 6 (rate of interest on Crown charges).
Non-Residential and Non-Municipal Seasonal Residential Systems that Do Not Serve Designated Facilities (Safe Drinking Water Act, 2002): O. Reg. 249/06, among other changes, adds section 8.1 (exemptions from transfer of ownership requirements of Act); replaces section 1-2 of Schedule 1 (frequency of sampling); adds subsections (1.1) & (1.2) to section 4-6 of Schedule 4 (laboratory report).
Ontario Drinking-Water Quality Standards (Safe Drinking Water Act, 2002): O. Reg. 248/06 removes items in Schedule 1 (Microbiological Standards) and amends item 72 of Schedule 2 (Trichloroethylene).

An Act respecting off-highway vehicles: 2006, c. 12 (Bill 9) provides for stricter regulation of the use of such vehicles. Among other changes: it increases the minimum age for operation from 14 to 16; it imposes conditions for the use of trails, including the requirement to pay an access fee; it also makes adjustments concerning the operation of vehicles on private land and trails operated by a club as well as on certain public highways; progressive fines for speeding offences are prescribed; measures to better control noise emissions and hydrocarbon releases into the environment are included; provisions maintain for a five-year period immunity from legal action for neighbourhood nuisances, noise or odours relating to the vehicle operation on trails forming part of the interregional network to be established by order of the Minister, which will be reviewed after three years; it grants immunity to persons who agree to trails being laid out and operated on their property.
