Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to August 2006. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between July 2006 and August 2006. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of August 2006. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2006-3 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2006-3 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Crown Corporations Involved in the Provision of Commercial Loans Environmental Assessment Regulations (Canadian Environmental Assessment Act): Proposed new regulations may be found in the Canada Gazette, Part I, December 31, 2005, p. 4363.

Decision Body Time Periods and Consultation Regulations (Yukon Environmental and Socio-economic Assessment Act): Proposed regulations are found in the Canada Gazette, Part I, September 17, 2005, p. 3113.

Energy Efficiency Regulations (Energy Efficiency Act): Proposed amendments are found in the Canada Gazette, Part I, May 6, 2006, p. 1014.

Exclusion List Regulations, 2005 (Canadian Environmental Assessment Act): Proposed replacement regulations are found in the Canada Gazette, Part I, December 17, 2005, p. 4173.

Feeds Regulations, 1983 (Feeds Act): SOR/2006-147 amends the regulation in various sections to strengthen safeguards against Bovine Spongiform Encephalopathy (BSE). These final amendments come into force on July 12, 2007 and are found in the Canada Gazette, Part II, July 12, 2006, p. 871.

Mackenzie Valley Land Use Regulations (Mackenzie Valley Resource Management Act): Proposed amendments are found in the Canada Gazette, Part I, November 19, 2005, p. 3855.

Marine Transportation Security Regulations (Marine Transportation Security Act): Proposed amendments are found in the Canada Gazette, Part I, July 1, 2006, p. 1982 and p. 2009.

Metal Mining Effluent Regulations (Fisheries Act): Proposed amendments are found in the Canada Gazette, Part I, April 8, 2006, p. 771.

Migratory Birds Regulations (Migratory Birds Convention Act): Proposed amendments are found in the Canada Gazette, Part I, December 24, 2005, p. 4293.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Subsections 115(2.2) to (2.4) of Schedule IV as enacted by SOR/2004-250 (vehicle identification number in bar code format) come into force September 1, 2008. See Canada Gazette, Part II, Dec. 1, 2004, No. 24, p. 1796. Proposed amendments are found in the Canada Gazette, Part I, March 26, 2005, p. 1023. Proposed amendments (Introduction of Technical Standards Documents) are found in the Canada Gazette, Part I, October 1, 2005, p. 3256. Regulations for the Prevention of Pollution from Ships and for Dangerous Chemicals (Canada Shipping Act): New proposed regulations replace the Air Pollution Regulations, the Garbage Pollution Prevention Regulations, the Great Lakes Sewage Pollution Prevention Regulations, the Pollutant Substances Pollution Prevention Regulations, the Non-Pleasure Craft Sewage Pollution Prevention Regulations, the Pleasure Craft Sewage Pollution Prevention Regulations, the Oil Pollution Prevention Regulations, and the Dangerous Chemicals and Noxious Liquid Substances Regulations. Restricted Components Regulations (Explosives Act): Proposed regulations are found in the Canada Gazette, Part I, August 12, 2006, p. 2365.

Safety Management Regulations (Canada Shipping Act, 2001): Proposed amendments change the wording of the regulation in order to make it consistent with the provisions of the new Canada Shipping Act, 2001 when it comes into force in early 2007. See Canada Gazette, Part I, June 17, 2006, p. 1636.

Section 2.A Acts

Ecological Reserve Act: As a consequential amendment of 2006, c. 25 (Bill 28), now proclaimed in force, section 6 is replaced (designated wildland area as ecological reserve).

Fish Protection Act: The definition of "local government" from the original 1997, c. 21 is now brought into force.

Motor Vehicle Act: 2006, c. 15 (Bill 15), now proclaimed in force, repeals section 205 and adds clause 210(2)(t). The changes relate to the establishment by regulation of minimum clearances.

Protected Areas of British Columbia Act: As a consequential amendment of 2006, c. 25 (Bill 28), now proclaimed in force, conservancies are established (see new section 2.1 and Schedules E & F).

Wildlife Act: As a consequential amendment of 2006, c. 25 (Bill 28), now proclaimed in force, section 4 is amended (reference to conservancies).

Section 2.B Regulations

Commercial Transport Regulations (Commercial Transport Act): B.C. Reg. 131/2006 replaces Division 6 (Non-Resident Vehicles), sections 6.01 to 6.05.

Emission Inspection Exemption Regulation (Motor Vehicle Act): B.C. Reg. 141/2006 replaces section 2(f).

Motor Vehicle Act Regulations: B.C. Reg. 138/2006 amends sections 24.02 (operation of golf cart on highway), 24.04 (operation of all terrain vehicle on highway). B.C. Reg. 139/2006 replaces Division 22A (Collector Motor Vehicles), sections 22A.01 to 22A.04. B.C. Reg. 167/2006 adds section 7.091 (minimum clearance required).

Municipal Sewage Regulation (Environmental Management Act): B.C. Reg. 132/2006 replaces section 19 (municipal sewage connection to industrial sewer system); amends Schedule 4 and Schedule 7.

Occupational Health and Safety Regulation (Workers' Compensation Act): B.C. Reg. 17/2006, effective August 2006, replaces section 12.74 (standards for automotive lifts); makes amendments to sections 12.75 - 12.79 (automotive lifts); adds sections 12.80.1 (vehicle restraints for runway type automotive lifts) and 12.80.1 (swing-arm restraints for automotive lifts).

Passenger Transportation Regulation (Passenger Transportation Act): B.C. Reg. 168/2006 repeals clause 3(2)(a) and adds section 5(p) regarding exemptions for auxiliary passenger vehicles.

Riparian Areas Regulation (Fish Protection Act): B.C. Reg. 148/2006 replaces subsection 3(1) (application of regulation in the following regional districts) and adds 3(1.1); replaces subsection 4(2) (local government may approve or allow development to proceed).

Waste Discharge Regulation (Environmental Management Act): B.C. Reg. 132/2006 amends section 3 (operations exempt from the Act).

Water Regulation (Water Act): B.C. Reg. 146/2006 makes an administrative change in subsection 21(1); B.C. Reg. 147/2006 substitutes "court" for "board" in various sections and repeals section 33.

Labour Standards Code: 2006, c. 10 (Bill 45) amendments provide that no employee is required, and no employer shall require an employee, to work in a retail business on Sunday or a holiday unless the retail business is of a class exempted by regulation and that no owner or operator of a retail business is required, and no person shall require the owner or operator of a retail business, to operate on Sunday or a holiday as permitted by the Retail Business Uniform Closing Day Act. See sections 2, 7, 30, 30A, and 66A.

Motor Vehicle Act: 2002, c. 10, Part V, now proclaimed in force, replaces sections 292 to 299 regarding penalties and makes commensurate amendments to other sections. The replacement sections have been amended by 2003, c. 1, 2004, c. 42, and 2005, c. 8.

Section 2.B Regulations

General Regulations (Labour Standards Code): N.S. Reg. 117/2006 adds section 7A which outlines the classes of retail businesses which are exempt from section 66A of the Labour Standards Code (allowing workers to refuse work on a uniform closing day).

Species at Risk Regulations (Endangered Species Act): N.S. 114/2006 edits the entries for Bicknell's Thrush and Moose.

Ethanol in Gasoline (Environmental Protection Act): New regulations are in force January 1, 2007. See the Ontario Gazette, issue 43, October 22, 2005, p. 1699.

Fire Code (Fire Protection and Prevention Act, 1997): O. Reg. 144/06 amends various sections, including adding SECTION 9.9 HOTELS. Effective January 1, 2007. See the Ontario Gazette, May 20, 2006, p. 917.

General - Waste Management (Environmental Protection Act): More sections of O. Reg. 461/05 are to come into force in 2007, and 2009: January 1, 2007 - new generator requirements; August 31, 2007 - land disposal restrictions: inorganic wastes; December 31, 2009 - land disposal restrictions: organic and mixed wastes & wastes, treated to specified standard and removal of all underlying hazardous constituents. See the Ontario Gazette, 27 August, 2005, pg. 2751.

Construction Projects (Occupational Health and Safety Act): O. Reg. 628/05 adds Part II.1 - Confined Spaces, sections 221.1 to 221.19; these replace sections 60 to 63. Effective September 2006.

Industrial Establishments (Occupational Health and Safety Act): O. Reg. 629/05 adds Part I.1 - Confined Spaces, sections 119.1 to 119.20; these replace sections 67 to 71. Effective September 2006.

Health Care and Residential Facilities (Occupational Health and Safety Act): O. Reg. 631/05 replaces section 43 with new sections 43 to 43.19 regarding confined spaces. Effective September 2006.

Mine Development and Closure Under Part VII of the Act (Mining Act): Among other changes, O. Reg. 194/06: replaces paragraph 5 of Subsection 3(1) (surface stripping); amends section 8 (public information sessions); replaces definition of "life of a mine" in subsection 15(1); adds subsections 15(4.1) & (4.2) (calculation of life of a mine); amends various parts of Schedule 1 (Mine Rehabilitation Code of Ontario); amends items 3, 9 & 14 of Schedule 2. In force August 2006.

Mines and Mining Plants (Occupational Health and Safety Act): O. Reg. 630/05 adds Part XII - Confined Spaces, sections 294 to 313; these replace sections 271 to 275. Effective September 2006.
