Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to September 2006. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between August 2006 and September 2006. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of September 2006. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2006-4 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2006-4 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Decision Body Time Periods and Consultation Regulations (Yukon Environmental and Socio-economic Assessment Act): Proposed regulations are found in the Canada Gazette, Part I, September 17, 2005, p. 3113.

Energy Efficiency Regulations (Energy Efficiency Act): Proposed amendments are found in the Canada Gazette, Part I, May 6, 2006, p. 1014.

Exclusion List Regulations, 2005 (Canadian Environmental Assessment Act): Proposed replacement regulations are found in the Canada Gazette, Part I, December 17, 2005, p. 4173.

Feeds Regulations, 1983 (Feeds Act): SOR/2006-147 amends the regulation in various sections to strengthen safeguards against Bovine Spongiform Encephalopathy (BSE). These final amendments come into force on July 12, 2007 and are found in the Canada Gazette, Part II, July 12, 2006, p. 871.

Interprovincial Movement of Hazardous Waste and Hazardous Recyclable Material Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for the Interprovincial Movement of Hazardous Waste Regulations are found in the Canada Gazette, Part I, September 2, 2006, p. 2515.

Mackenzie Valley Land Use Regulations (Mackenzie Valley Resource Management Act): Proposed amendments are found in the Canada Gazette, Part I, November 19, 2005, p. 3855.

Marine Transportation Security Regulations (Marine Transportation Security Act): Proposed amendments are found in the Canada Gazette, Part I, July 1, 2006, p. 1982 and p. 2009.

Migratory Birds Regulations (Migratory Birds Convention Act): Proposed amendments are found in the Canada Gazette, Part I, December 24, 2005, p. 4293.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Subsections 115(2.2) to (2.4) of Schedule IV as enacted by SOR/2004-250 (vehicle identification number in bar code format) come into force September 1, 2008. Restricted Components Regulations (Explosives Act): Proposed regulations are found in the Canada Gazette, Part I, August 12, 2006, p. 2365.

Safety Management Regulations (Canada Shipping Act, 2001): Proposed amendments change the wording of the regulation in order to make it consistent with the provisions of the new Canada Shipping Act, 2001 when it comes into force in early 2007. See Canada Gazette, Part I, June 17, 2006, p. 1636.

Agricultural Operations (Agricultural Operation Practices Act): Alta. Reg. 193/2006 amends definitions in section 1; amends sections 2 (approval required for confined feeding operation) and 3 (registration required for confined feeding operation); replaces section 4 (authorization for manure storage facility); adds section 4.1 (ancillary structures for confined feeding operations); replaces Schedules 1 (Animal Units) and 2 (Threshold Levels). Effective October 1, 2006.

Beverage Container Recycling Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 164/2006 amends section 22 to extend the expiry date of the regulation.

Edmonton Restricted Development Area Regulations (Government Organization Act): Alta. Reg. 167/2006 amends Sections in items 1, 3, 5, 6, 8, 9 & 10 of the Schedule.

Motor Vehicle Propane Conversions Regulation (Safety Codes Act): Alta. Reg. 177/2006 amends section 12 to extend the expiry date of the regulation.

British Columbia Fire Code Regulation (Fire Services Act): B.C. Reg. 175/2006 adopts the National Fire Code of Canada 2005 with amendments; replaces the British Columbia Fire Code Regulation 318/2003. Effective December 15/2006. See the British Columbia Gazette, Vol. 49, No. 13.

Division 2 AMENDMENTS

Section 2.A Acts

Land Act: 2006, c. 24 (Bill 30), now proclaimed in force, adds Part 7.2 - Deposit of Electronic Plans in Registry - regarding plans made in relation to Crown land that is in electronic format, and any other electronic documents designated by the Surveyor General, section 93.9 to 93.991.

Oil and Gas Commission Act: The section of 2006, c. 24 (Bill 30) which amends section 12 is now proclaimed in force, regarding the application of certain labour legislation to officers and employees of the commission.

Protected Areas of British Columbia Act: Another section of 2006, c. 15 (Bill 15) is now proclaimed in force, replacing the description of Strathcona Park in Schedule C.

Section 2.B Regulations

Administrative Orders and Remedies Regulation (Forest and Range Practices Act): B.C. Reg. 226/2006 amends section references for various regulations in sections 9, 12, 14, 16, and 17; Division 4, sections 21 to 29 is repealed (transitional provisions).

Conservation Officer Service Authority Regulation (Environmental Management Act): B.C. Reg. 204/2006 amends subsection 1(2) to add more enactments that a member of the Conservation Officer Service may enforce.

Electrical Safety Regulation (Safety Standards Act): B.C. Reg. 198/2006 amends section 3 and adds section 3.1 (range of residential electricity consumption prescribed).

Forest Planning and Practices Regulation (Forest and Range Practices Act): B.C. Reg. 205/2006 replaces subsection 96(1.1) (the meaning of "an event causing damage" for the purpose of the Act). B.C. Reg. 223/2006 makes minor amendments to some sections. B.C. Reg. 224/2006 adds sections 4.01 (removing Crown timber to protect a community from wildfire), 79.2 (road use under a forestry licence to cut), and 79.3 (restricting road access to protect a community from wildfire).

Forest Recreation Regulation (Forest and Range Practices Act): B.C. Reg. 206/2006, among other changes, adds references to "recreation officer" in several sections.

Oil and Gas Waste Regulation (Environmental Management Act): B.C. Reg. 220/2006 makes corrections in subsections 6(4) & 6(6).

Open Burning Smoke Control Regulation (Environmental Management Act): B.C. Reg. 215/2006 amends the definition of "parcel of land" in subsection 1(1).

Ozone Depleting Substances and Other Halocarbons Regulation(Environmental Management Act): B.C. Reg. 220/2006 makes a correction in clause 27(4)(b)(iv).

Power Engineers, Boiler, Pressure Vessel and Refrigeration Safety Regulation(Safety Standards Act): B.C. Reg. 218/2006 amends sections 20, 24, 49, and 50 regarding low pressure thermal fluid plants.

Range Planning and Practices Regulation (Forest and Range Practices Act): B.C. Reg. 225/2006 makes a correction in section 30(a).

Safety Standards General Regulation (Safety Standards Act): B.C. Reg. 217/2006 repeals subsection 24(3).

Spill Reporting Regulation (Environmental Management Act): B.C. Reg. 220/2006 amends the definition of "PEP" in section 1 and amends subsection 2(1) (reporting spill).

Waste Discharge Regulation (Environmental Management Act): Among other changes, B.C. Reg. 220/2006 amends section 3 (operations exempt from Act) and the Schedule 1 & 2 (industries, trades, businesses, operations and activities) to change and introduce several terms.

Wildfire Regulation (Wildfire Act): B.C. Reg. 215/2006 adds "conservancy" to the definition of "protected area" in subsection 1(1).

Wood Residue Burner and Incinerator Regulation (Environmental Management Act): B.C. Reg. 220/2006 amends the definition of "wood residue incinerator" in section 1.

Fire Code (Fire Protection and Prevention Act, 1997): O. Reg. 144/06 amends various sections, including adding SECTION 9.9 HOTELS. Effective January 1, 2007. See the Ontario Gazette, May 20, 2006, p. 917.

General - Waste Management (Environmental Protection Act): More sections of O. Building Code (Building Code Act, 1992): O. Reg. 422/06 amends clauses 1.1.3.3. and 2.4.1.3. regarding the designation of buildings under the Ontario Heritage Act.

Oil and Gas Pipeline Systems Code Adoption Document (Technical Standards and Safety Act, 2000): The Code Adoption Document has been amended to incorporate the following: 1) Z662S1-05 Supplement No.1 to CAN/CSA Z662-03, Oil and Gas Pipeline Systems, 2) implementation of distribution system integrity management program (DSIMP) by April 30, 2008, 3) implementation of revisions according to Annex N of Supplement No. 1 for the transmission pipeline integrity program by June 30, 2007, 4) service regulators designed to release less than 50cf/h (cf/h = cubic feet per hour) in case of malfunction can be installed with a reduced clearance to building openings, appliance vent outlets, appliance air intake, sources of ignition, or mechanical air intake. Sections 1 to 5 have been replaced and Appendices 1 & 2 added.
