Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to November 2006. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between October 2006 and November 2006. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of November 2006. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2006-4 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2006-4 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Feeds Regulations, 1983 (Feeds Act): SOR/2006-147 amends the regulation in various sections to strengthen safeguards against Bovine Spongiform Encephalopathy (BSE). These final amendments come into force on July 12, 2007 and are found in the Canada Gazette, Part II, July 12, 2006, p. 871.

Interprovincial Movement of Hazardous Waste and Hazardous Recyclable Material Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for the Interprovincial Movement of Hazardous Waste Regulations are found in the Canada Gazette, Part I, September 2, 2006, p. 2515.

Mackenzie Valley Land Use Regulations (Mackenzie Valley Resource Management Act): Proposed amendments are found in the Canada Gazette, Part I, November 19, 2005, p. 3855.

Marine Transportation Security Regulations (Marine Transportation Security Act): Some sections of (final) SOR/2006-269 amendments are in force December 15, 2007; SOR/2006-270 final amendments are in force November 2, 2007. See Canada Gazette, Part II, Vol. 140, No. 23, 2006, p. 1729 & 1758.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Subsections 115(2.2) to (2.4) of Schedule IV as enacted by SOR/2004-250 (vehicle identification number in bar code format) come into force September 1, 2008. Radiation Emitting Devices Regulations (Diagnostic X-ray Equipment) (Radiation Emitting Devices Act): Proposed amendments are found in the Canada Gazette, Part I, October 8, 2005, p. 3312.

Regulations for the Prevention of Pollution from Ships and for Dangerous Chemicals (Canada Shipping Act): New proposed regulations replace the Air Pollution Regulations, the Garbage Pollution Prevention Regulations, the Great Lakes Sewage Pollution Prevention Regulations, the Pollutant Substances Pollution Prevention Regulations, the Non-Pleasure Craft Sewage Pollution Prevention Regulations, the Pleasure Craft Sewage Pollution Prevention Regulations, the Oil Pollution Prevention Regulations, and the Dangerous Chemicals and Noxious Liquid Substances Regulations. Restricted Components Regulations (Explosives Act): Proposed regulations are found in the Canada Gazette, Part I, August 12, 2006, p. 2365.

Safety Management Regulations (Canada Shipping Act, 2001): Proposed amendments change the wording of the regulation in order to make it consistent with the provisions of the new Canada Shipping Act, 2001 when it comes into force in early 2007. See Canada Gazette, Part I, June 17, 2006, p. 1636.

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act, 1992): Proposed amendments are found in the Canada Gazette, Part I, September 30, 2006, p. 3015.

Canada Labour Standards (Canada Labour Code, Part III): SOR/2006-231 replaces the heading before section 29, paragraph 30(1)(e)(iv), Parts I & VI of Schedule I (list of industrial companies re group termination), and Schedule II (Notice Related to the Canada Labour Code - Part III). French language version

Domestic Substances List (Canadian Environmental Protection Act, 1999): SOR/2006-202 adds 8 substances to Part 1, 7 substances to Part 3, and one substance to Part 4 of the DSL. SOR/2006-248 adds 10 substances to Part 1, one substance to Part 3, and one substance to Part 4 of the DSL. French language version

Life Saving Equipment Regulations (Canada Shipping Act): SOR/2006-256 amends several sections to improve safety by raising the water temperature at which passenger ships are required to provide dry evacuation. The amendment to section 18 of Schedule VII to the Regulations clarifies the performance criteria for emergency boats used to marshal life rafts or inflatable rescue platforms. Other amendments facilitate the administration of the regulations.

Mackenzie Valley Land Use Regulations (Mackenzie Valley Resource Management Act): SOR/2006-253 makes changes to reflect the 2005, c. 1 amendments to the Mackenzie Valley Resource Management Act. The main changes relate to operational details for the use of land including applications for, and the issuance of, land permits; the balance of the amendments are administrative in nature and are required because of changes in the terms used in the Act. See especially sections 1, 12, 16, 19-20, 22-24, 27, 31, 41.

Metal Mining Effluent Regulations (Fisheries Act): SOR/2006- 239 amending SOR2002-222. This regulation amends several definitions in s. 1(1). Sections 19 (Volume Effluent) has been replaced and 19.1 (Calculation of Monthly Mean Concentration and Loading) has been added. Sections 29 (Prescribed Persons) and 30 (Emergency Response Plan) have been replaced. The table (Authorization Officers) in Schedule 1 has been updated. Information in Schedule 2 has been updated to accord with the current names for provinces and territories. Definitions in s.1 of schedule 5 have been replaced. Schedule 6 (Annual Report Summarizing Effluent Monitoring Results) has been replaced. Schedule 6.1 (Prescribed Persons for Notification and Reporting) has been added. In addition to these changes there have been updates throughout this regulation to ensure consistence with other environmental legislation.

Nuclear Security Regulations (Nuclear Safety and Control Act): SOR/2006-191 amendments are now in force which require licensees to implement specific physical protection measures considered necessary to strengthen security at nuclear facilities. The amendments incorporate two orders initially issued by the Canadian Nuclear Safety Commission (CNSC) as a result of the threat to nuclear facilities following the terrorist events of September 11, 2001.

British Columbia Fire Code Regulation (Fire Services Act): B.C. Reg. 175/2006 adopts the National Fire Code of Canada 2005 with amendments; replaces the British Columbia Fire Code Regulation 318/2003. Effective December 15/2006. See the British Columbia Gazette, Vol. 49, No. 13.

Occupational Health and Safety Regulation (Workers' Compensation Act): Extensive new heath and safety requirements are scheduled to take effect January 1, 2007. The August 29, 2006 British Columbia Gazette, regulations 241/2006, 242/2006, and 243/2006 contain the changes.

Hazardous Waste Regulation (Environmental Management Act): B.C. Reg. 261/2006 contains a variety of updates and changes, including the definition of household hazardous waste. The section concerning the registration of hazardous waste has been repealed and replaced in s. 43. Section 49, concerning the analysis methods used concerning hazardous waste, has been replaced. Forms 1 and 2 have been substituted in Schedule 5 (Registration Form / Application for a Licence to Transport Hazardous Waste; Schedule 6 replaced (Registration Quantities); Schedule 8 repealed.

Integrated Pest Management Regulation (Integreated Pest Management Act): B.C. Reg. 258/2006 and 267/2006 amending 604/2004. This regulation amends definitions in section 1; adds section 2.1 (Administrator may designate "single entity"). The regulation amends other sections and updates them to accord with changes in other legislation.

Motor Vehicle Act Regulations: B.C. Reg. 265/2006 adds paragraphs (d) to (g) to section 19.14 (prescribed entities).

Building Code (Building Code Act, 1992); O. Reg. 350/06 replaces the current Building Code, effective December 31, 2006. See the Ontario Gazette, Saturday July 22, 2006, p. 2105.

Ethanol in Gasoline (Environmental Protection Act): New regulations are in force January 1, 2007. See the Ontario Gazette, issue 43, October 22, 2005, p. 1699.

Fire Code (Fire Protection and Prevention Act, 1997): O. Reg. 144/06 amends various sections, including adding SECTION 9.9 HOTELS. Effective January 1, 2007. See the Ontario Gazette, May 20, 2006, p. 917.

General - Waste Management (Environmental Protection Act): More sections of O. Reg. 461/05 are to come into force in 2007, and 2009: January 1, 2007 - new generator requirements; August 31, 2007 - land disposal restrictions: inorganic wastes; December 31, 2009 - land disposal restrictions: organic and mixed wastes & wastes, treated to specified standard and removal of all underlying hazardous constituents. See the Ontario Gazette, 27 August, 2005, pg. 2751.

Division 2 AMENDMENTS

Section 2.A Acts

Conservation Authorities Act: 2006 c. 3 (Bill 21), now proclaimed in force, repeals section 35(2) (marketing or selling of water power by authority).

Conservation Land Act: 2006 c. 23 (Bill 51), repeals and replaces subsection 3(2) and adds subsection 3(6.1). These amendments include provisions to broaden the purposes for which conservation easements and covenants are established to include water quality and quantity protection, watershed protection and management.

Coroners Act: 2006, c. 24 (Bill 89) adds section 22.1 (inquest mandatory for death of child in certain circumstances) and amends section 41 (costs of representation). 2005, c. 29, in force December 2006, replaces subsection 3(2) (cessation of office of coroner).

Planning Act: The part of 2006, c. 23 (Bill 51) which is in force adds clauses 50(3)(h) & 50(5)(h) The amendments ensure that the subdivision control and part-lot control provisions of section 50 do not interfere with the creation of conservation easements and covenants.

Section 2.B Regulations

General Regulation (Nutrient Management Act, 2002): O. Reg. 474/06 modifies the coming into force date requiring certain non-agricultural operations to establish Nutrient Management Strategies. A table in section 12 and text in section 15 have been altered to reflect this change.
