Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to December 2006. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between November 2006 and December 2006. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of December 2006. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2007-1 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2007-1 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Decision Body Time Periods and Consultation Regulations (Yukon Environmental and Socio-economic Assessment Act): Proposed regulations are found in the Canada Gazette, Part I, September 17, 2005, p. 3113.

Feeds Regulations, 1983 (Feeds Act): SOR/2006-147 amends the regulation in various sections to strengthen safeguards against Bovine Spongiform Encephalopathy (BSE). These final amendments come into force on July 12, 2007 and are found in the Canada Gazette, Part II, July 12, 2006, p. 871.

Interprovincial Movement of Hazardous Waste and Hazardous Recyclable Material Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for the Interprovincial Movement of Hazardous Waste Regulations are found in the Canada Gazette, Part I, September 2, 2006, p. 2515.

Mackenzie Valley Land Use Regulations (Mackenzie Valley Resource Management Act): Proposed amendments are found in the Canada Gazette, Part I, November 19, 2005, p. 3855.

Marine Transportation Security Regulations (Marine Transportation Security Act): Some sections of (final) SOR/2006-269 amendments are in force December 15, 2007; SOR/2006-270 final amendments are in force November 2, 2007. See Canada Gazette, Part II, Vol. 140, No. 23, 2006, p. 1729 & 1758.

Metal Mining Effluent Regulations (Fisheries Act): Proposed amendments are found in the Canada Gazette, Part I, April 8, 2006, p. 771.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Subsections 115(2.2) to (2.4) of Schedule IV as enacted by SOR/2004-250 (vehicle identification number in bar code format) come into force September 1, 2008. Prohibition of Certain Toxic Substances Regulations, 2005 (Canadian Environmental Protection Act, 1999): Proposed amendments appear in the Canada Gazette, Part I, June 17, 2006, p. 1593.

Radiation Emitting Devices Regulations (Diagnostic X-ray Equipment) (Radiation Emitting Devices Act): Proposed amendments are found in the Canada Gazette, Part I, October 8, 2005, p. 3312.

Regulations for the Prevention of Pollution from Ships and for Dangerous Chemicals (Canada Shipping Act): New proposed regulations replace the Air Pollution Regulations, the Garbage Pollution Prevention Regulations, the Great Lakes Sewage Pollution Prevention Regulations, the Pollutant Substances Pollution Prevention Regulations, the Non-Pleasure Craft Sewage Pollution Prevention Regulations, the Pleasure Craft Sewage Pollution Prevention Regulations, the Oil Pollution Prevention Regulations, and the Dangerous Chemicals and Noxious Liquid Substances Regulations. Review Panel Regulations (Pest Control Products Act). Proposed regulations are found in the Canada Gazette, Part I, December 6, 2006, p. 4305.

Safety Management Regulations (Canada Shipping Act, 2001): Proposed amendments change the wording of the regulation in order to make it consistent with the provisions of the new Canada Shipping Act, 2001 when it comes into force in early 2007. See Canada Gazette, Part I, June 17, 2006, p. 1636.

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act, 1992): Proposed amendments are found in the Canada Gazette, Part I, September 30, 2006, p. 3015.

Division 2 AMENDMENTS

Section 2.A Acts

Section 2.B Regulations

Energy Efficiency Regulations (Energy Efficiency Act): SOR/ 2006-271 amends SOR/94-651. These amendments are intended to address recommendations of the Standing Joint Committee for the Scrutiny of Regulations and amend minimum energy performance standards for heating and cooling components as well as other appliances. Several definitions in section 1, have been added and updated. Section 3 has been amended along with sections 4, 5, and 12. Sections 16 and 16.1 and Schedule I of Part I have been repealed and replaced. Extensive amendments have been made to Schedule IV to further the goals of the Energy Efficiency Act.

Marine Transportation Security Regulations (Marine Transportation Security Act): SOR/2006-269 amendments add new Part 5 and correct inadvertent minor errors and inconsistencies and clarify that certain existing provisions are mandatory. Part 5 Security Clearance consists of sections 501 to 519. Some parts of the regulation will be brought into force in December 2007 and 2008.

Migratory Birds Regulations (Migratory Birds Convention Act, 1994): SOR/2006-284 corrects an error in table II of Part I of Schedule I.

Newfoundland Offshore Petroleum Drilling Regulations(Canada-Newfoundland Atlantic Accord Implementation Act): SOR/2006-281 replaces sections 170 and 171. The requirement to flow test potential hydrocarbon reservoirs is now at the discretion of the operators.

Nova Scotia Offshore Petroleum Drilling Regulations (Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation Act): SOR/2006-282 replaces sections 170 and 171. The requirement to flow test potential hydrocarbon reservoirs is now at the discretion of the operators.

On-Road Vehicle and Engine Emission Regulations (Canadian Environmental Protection Act, 1999): SOR/2006-268 amending SOR/2003-2. The main purpose of these amendments is to add new requirements for motorcycles from 2006 and beyond. These changes also align the regulations with new rules under the United States Environmental Protection Agency (U.S. E.P.A.). New definitions have been added to section 1. Sections 17 (Motorcycles), 28 (Nox Emissions Deficits) and section 36 has been replaced. Section 2.1 (Background) has been added along with sections 17.1, 32.1 (Subfleet Averaging Requirements for Motorcycles) 32.2, 32.3 (Calculation of Subfleet Average Emissions Values), 32.4 (Emission Credits for Class III Motorcycles), 32.5 (Emission Deficits for Class I and II Motorcycles), 32.6 and 32.7 (End of Model Year Reports), 36.1 and 37.1 (Records Concerning Subfleet Average Emissions Values for Motorcycles). Section 44(1)(g) has been repealed. Other amendments maintain consistency and provide greater clarity. French language version

Port Authorities Operations Regulations (Canada Marine Act): SOR/2006-278 adds section 31.1 regarding licences for the port authorities of Vancouver and Fraser River.

Prohibition of Certain Toxic Substances Regulations, 2005(2-Methoxyethanol, Pentachlorobenzene and Tetrachlorobenzenes) (Canadian Environmental Protection Act, 1999): SOR/2006-279 adds pentachlorobenzene (QCB) and tetrachlorobenzenes (TeCBs) to the Prohibited Toxic Substances List in Schedule 2, Part 2; adds 2-methoxyethanol (2-ME) to the List in Schedule 2, Part 1. The amendments come into force February 2007 but are found in the document. French language version

Oil and Gas Conservation Regulation (Oil and Gas Conservation Act): Changes to the regulation by Alta. Reg. 269/2006 include: new and amended definitions in section 1.020; new sections 3.051 (gas from all formations in a development entity), 7.025 (gas from coal), 11.145 (obligations of licensee of each control well to Board); replacement of section 11.102 (testing oil and gas wells).

British Columbia Fire Code Regulation (Fire Services Act): B.C. Reg. 175/2006 adopts the National Fire Code of Canada 2005 with amendments; replaces the British Columbia Fire Code Regulation 318/2003. Effective December 15/2006. See the British Columbia Gazette, Vol. 49, No. 13.

Occupational Health and Safety Regulation (Workers' Compensation Act): Extensive new heath and safety requirements are scheduled to take effect January 1, 2007. The August 29, 2006 British Columbia Gazette, regulations 241/2006, 242/2006, and 243/2006 contain the changes.

Workplace Safety and Health Regulation (Workplace Safety and Health Act): Man. Reg. 217/2006 replaces 12 separate regulations. In force February 1, 2007.

Division 2 AMENDMENTS

Section 2.A Acts

Workers' Compensation Act: The remainder of the 2005, c. 17 amendments add section 49.3 (obligation to re-employ worker as a result of an accident), effective January 1, 2007.

Section 2.B Regulations

Livestock Manure and Mortalities Management Regulation (Environment Act): Man. Reg. 219/2006 amends 42/98. This regulation has added nine definitions to section 1. Sections 11 (No discharge into water), 12 (Allowable application to land), and 14 (Prohibitions on winter spreading), have been updated. Several new sections have been added to the regulations including sections 12.1 (Allowable applications to land re phosphorus), 12.2 (New or expanded livestock operations in certain areas), 14.1 (Designation of Red River Valley Special Management Area), 14.2 (Restrictions on fall spreading), 18 (Review). Schedule C (Setback Requirements for Livestock Manure Application On Land Adjacent to Surface Water or a Surface Watercourse) has been added to this regulation. It includes a table which determines the setbacks for the spreading of manure near bodies of water.

Excluded Industries, Employers and Workers Regulation (Workers' Compensation Act): Man. Reg. 153/2006 amends 196/2005. The Manitoba Workers Compensation Board is extending coverage to new industries and work environments. The regulation repeals sections 10 (aviation and air transport), 33 (exploration and prospecting), 49 (landscape architecture and design), 50 (landscaping and yard maintenance), 56 (mushroom plants), 62 (property management), 80 (surveyors), 81 (taxidermy) and section 90 (window cleaning - exterior) of Schedule A. Section 48 of Schedule A has been amended and section 47.1 has been added. This amendment is effective on January 1, 2007.

Building Code (Building Code Act, 1992); O. Reg. 350/06 replaces the current Building Code, effective December 31, 2006. See the Ontario Gazette, Saturday July 22, 2006, p. 2105.

Division 2 AMENDMENTS

Section 2.A Acts

Health Protection and Promotion Act: The part of 2005, c. 29 is now in force which repeals section 65 (retirement).

Section 2.B Regulations

Ethanol in Gasoline (Environmental Protection Act): O. Reg. 535/05 is effective January 1, 2007.

Fire Code (Fire Protection and Prevention Act, 1997): O. Reg. 144/06 amends several Articles regarding hotel establishments, and adds a new Section 9.9 - HOTELS. Effective January 1, 2007.

General (Energy Efficiency Act): The remainder of O. Regs. 384/05 & 38/06 are in force January 1, 2007. Items 2 and 56 of the Schedule are amended.

General (Nutrient Management Act): O. Reg. 511/05 amends the definition of "solid" in subsection 1(1), effective January 1, 2007.

General (Waste Management Act): More sections of 461/05 come into force January 1, 2007. The 461/05 amendments prohibit the land disposal of untreated hazardous wastes - including any hazardous waste from other jurisdictions. Effective January 1, 2007 section 18 (initial generator registration report) will apply to waste produced, collected, handled, or stored at the waste generation facility that is subject waste and that is characteristic waste or listed waste; the waste generator report format is specified. The following Schedules are replaced (with the same name): 1, 1.1, 2- 4, 5-8, 10-13; Schedule 5 is renumbered as Schedule 9.
