Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to January 2007. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between December 2006 and January 2007. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of January 2007. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2007-1 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2007-1 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Decision Body Time Periods and Consultation Regulations (Yukon Environmental and Socio-economic Assessment Act): Proposed regulations are found in the Canada Gazette, Part I, September 17, 2005, p. 3113.

Feeds Regulations, 1983 (Feeds Act): SOR/2006-147 amends the regulation in various sections to strengthen safeguards against Bovine Spongiform Encephalopathy (BSE). These final amendments come into force on July 12, 2007 and are found in the Canada Gazette, Part II, July 12, 2006, p. 871.

Interprovincial Movement of Hazardous Waste and Hazardous Recyclable Material Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for the Interprovincial Movement of Hazardous Waste Regulations are found in the Canada Gazette, Part I, September 2, 2006, p. 2515.

Mackenzie Valley Land Use Regulations (Mackenzie Valley Resource Management Act): Proposed amendments are found in the Canada Gazette, Part I, November 19, 2005, p. 3855.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Subsections 115(2.2) to (2.4) of Schedule IV as enacted by SOR/2004-250 (vehicle identification number in bar code format) come into force September 1, 2008. Division 2 AMENDMENTS

Section 2.A Acts

Traffic Safety Act: 2003, c. 48 (as amended by 2005, c. 34), now proclaimed in force, amends section 40 and adds section 173.1 (seizure of vehicle in prostitution related offences).

Workers' Compensation Act: The remainder of 2005, c. 49 is now proclaimed in force. Section 46.1 is amended and sections 46.2 to 46.4 added. The changes are in regard to medical panels.

Section 2.B Regulations

Commercial Vehicle Certificate and Insurance Regulation (Traffic Safety Act): Alta. Reg. 211/2006 amends Alta. Reg. 314/2002. Subsection 43(1) updates this regulation to reflect the implementation of the Vehicle Inspection Regulation.

Standards and Administration Regulation (Agricultural Operation Practices Act): Alta.. Reg. 306/2006 makes minor corrections to sections 9(7) and Schedule 1 subsections 2(a) and 5(2) and Table 1.

Section 2.A Acts

Environment Act: 2006, c. 30 (Bill 113) is now proclaimed in force. Among other changes the amending legislation broadens the purpose of the Act to include environmental management and confirms that the polluter pay principle for an adverse effect on the environment applies; expands the power of the Minister to establish advisory committees and retain experts; requires the Minister to establish a Round Table to give advice to the Department related to environmental sustainability; makes clear that Part IV of the Act does not apply to class environmental assessments as prescribed in the regulations; gives the Minister the authority to suspend the environmental assessment process where the proponent is not complying with the Act or the regulations; adds authority with respect to the amendment and transfer of environmental assessment approvals; provides that a joint assessment agreement must stipulate time limitations for the various stages of the assessment; permits the Minister to place conditions on the transfer, assignment or disposition of an approval; enables the Minister to adopt standards, policies or procedures for the assessments, rehabilitation or management of contaminated sites; provides that the Province must maintain a goal of fifty per cent solid-waste diversion and establishes a target for waste disposal; provides that the Minister may enter into agreements with a municipality or other person with respect to product stewardship; requires organizers of public and private events to have available receptacles for compostable materials; expands the power of an inspector to enter and inspect under Section 119 of the Act.

Smoke-free Places Act: 2005, c. 59 is now proclaimed in force: The amendments require all indoor workplaces and public places to be smoke-free, with the exception of designated smoking rooms in health-care facilities for the acute or long-term care of veterans, in licensed nursing homes and residential care facilities and in homes for aged and disabled persons. It also requires outdoor areas of all restaurants, lounges, beverage rooms and cabarets to be smoke-free.

Section 2.B Regulations

Off-highway Vehicles General Regulations (Off-highway Vehicles Act): N.S. 255/2006 adds sections 15 and 15A to the regulation (clubs and associations). Section 1A has been amended to become 1B and a new section 1A has been added.

Smoke-free Places Regulations (Smoke-free Places Act): N.S. Reg. 206/2006 makes changes to the regulations to align the regulations with amendments to the Act made by 2005, c. 59.

Weights and Dimensions of Vehicles Regulations (Motor Vehicle Act): N.S. Reg. 228/2006 extends the period for which certain weight tolerances are allowed; increases certain penalties; clarifies certain defined terms.

Building Code (Building Code Act, 1992); O. Reg. 350/06 replaces the current Building Code, effective December 31, 2006. See the Ontario Gazette, Saturday July 22, 2006, p. 2105.

Division 2 AMENDMENTS

Section 2.A Acts

Building Code Act, 1992: S.O. 2006, c. 32, (Bill 130) Municipal Statute Law Amendment Act, 2006 amends subsections 8(7), 15.4(4), 15.6(7), 15.7(10), 15.9(10), 15.10(10), 17.1(3) the Building Code Act to include references to the City of Toronto Act, 2006.

Environmental Assessment Act: As a consequential amendment of 2006, c. 11 (Bill 53), now proclaimed in force, section 3.3 is added (traffic calming measure is not an undertaking for the purposes of the Act). As a consequential amendment of 2006, c. 32 (Bill 130), now proclaimed in force, section 37 is replaced (reference to municipality does not include local boards).

Greenbelt Act, 2005: S. O. 2005, c. 1 This act amends subsection 9(1)(a) and is now in force. As a consequential amendment of 2006, c. 32(Bill 130) subsection 23(1) has been repealed and replaced.

Health Protection and Promotion Act: 2006, c. 32 (Bill 130) As a consequential amendment of 2006, c. 32 (Bill 130) this act has been updated to reference the City of Toronto Act, 2006 in subsections 49(8) and 49(10).

Highway Traffic Act: 2006 c. 25 (Bill 148) This bill re-enacts section 106 setting rules on how a seatbelt is to be worn including requiring each person in a vehicle to have their own seatbelt. Exemptions on child car seats are now permitted in certain circumstances. Amendments have also been made to section 207.

Lakes and Rivers Improvement Act: 2006, c. 32 (Bill 130) As a consequential amendment of 2006, c. 32 (Bill 130) this act has been updated to reference the City of Toronto Act, 2006 in subsections 29(2) and 29(5). Subsections 29(6) and (7) have been repealed and replaced.

Nutrient Management Act, 2002: 2006, c. 32 (Bill 130) As a consequential amendment of 2006, c. 32 this act has been updated to reference the City of Toronto Act, 2006 in subsection 38(3). Subsections 38(5), (6) and (7) have been repealed and replaced.

Ontario Heritage Act: The remainder of the 2006, c. 11 (Bill 53) consequential amendments are proclaimed in force. Subsections 26(3) & 39.1(2) are added regarding publishing a notice in a newspaper. As a consequential amendment of 2006, c. 32 (Bill 130), now proclaimed in force, the same sections are affected in a similar way.

Ontario Water Resources Act: 2006, c. 32 (Bill 130) As a consequential amendment of 2006, c. 32 (Bill 130) this act has been updated to reference the City of Toronto Act, 2006 in subsections 54(11), 55(4), 88(2), 88(3),88(6), 89.6(2), and 89.9(1). Subsections 65(4), 65(5), 88(5), 88(7) and 89.7(1) have been repealed and replaced.

Planning Act: Most sections of 2006, c. 23 (Bill 51) are now proclaimed in force. Numerous amendments to the Act are made. Most of these modify aspects of the land use planning process, provide additional tools for implementation of provincial policies and give further support to sustainable development, intensification and brownfield redevelopment. Some technical and housekeeping amendments are also included.

Pesticides Act: 2006, c. 32 (Bill 130) As a consequential amendment of 2006, c. 32 this act has been updated to reference the City of Toronto Act, 2006 in subsections 31.3(5).

Public Utilities Act: 2006, c. 32 (Bill 130) As a consequential amendment of 2006, c. 32 (Bill 130), now proclaimed in force, the name of an Act is changed in subsection 56(5).

Waste Management Act, 1992: 2006, c. 32 (Bill 130) As a consequential amendment of 2006, c. 32 (Bill 130) this act has been updated to reference the City of Toronto Act, 2006 in subsections 18(5). Subsection 19(2)(a) has been replaced.

Weed Control Act: 2006, c. 32 (Bill 130) As a consequential amendment of 2006, c. 32 this act has been updated to reference the City of Toronto Act, 2006 in subsections 15(6), 16(7) and section 17.

Section 2.B Regulations

General (Aggregate Resources Act): O. Reg. 499/06. The amendments to O. Reg. 244/97 add a Schedule 4. Sections 2 and 3 have been replaced (fees) along with subsection 4(1). Subsection 6(4) has been added to this regulation.

General (Crown Forest Sustainability Act, 1994): O. Reg. 572/06 amends this regulation by adding subsection 4 to section 11.

Hearings Regulation (Consolidated Hearings Act): O. Reg. 524/06 amendments update section 2 to reflect changes in terminology.

Industrial Establishments (Occupational Health and Safety Act): O. Reg. 565/06. The major amendments to this regulation will come into force July 1, 2007. The amount of noise to which workers may be exposed during in an eight hour period is being reduced from 90 to 85 decibels. A new time weighted averaging system is being introduced to provide a more accurate means of measuring noise exposure. These regulations apply to industrial establishments.

Oil and Gas - Offshore (Occupational Health and Safety Act): O. Reg. 566/06. The amendments to this regulation are in force with the exception of sections 1 and 2 which will come into force July 1, 2007. The level of noise to which workers may be exposed during an eight hour period is being reduced from 90 to 85 decibels. A new time weighted averaging system is being introduced to provide a more accurate means of measuring noise exposure. These regulations apply to offshore oil and gas operators.

Registration (Professional Geoscientists Act, 2000): O. Reg. 573/06. Subsections 9.1(3), 19(1) (Professional practice and ethics examination) and section 25 (Professional Liability Insurance) have been revoked and replaced.

Seat Belt Assemblies (Highway Traffic Act): O. Reg. 255/06. The amendments to sections 2, 3, 4, 5, 6 and 7 have been made to reflect alterations in amendments to the Act's section 106. Other amendments reflect changes to the seatbelt requirements and the nature of the restraints required.
