Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to February 2007. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between January and February 2007. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of February 2007. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2007-1 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2007-1 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Feeds Regulations, 1983 (Feeds Act): SOR/2006-147 amends the regulation in various sections to strengthen safeguards against Bovine Spongiform Encephalopathy (BSE). These final amendments come into force on July 12, 2007 and are found in the Canada Gazette, Part II, July 12, 2006, p. 871.

Interprovincial Movement of Hazardous Waste and Hazardous Recyclable Material Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for the Interprovincial Movement of Hazardous Waste Regulations are found in the Canada Gazette, Part I, September 2, 2006, p. 2515.

Mackenzie Valley Land Use Regulations (Mackenzie Valley Resource Management Act): Proposed amendments are found in the Canada Gazette, Part I, November 19, 2005, p. 3855.

Marine Spark-Ignition Engine and Off-Road Recreational Vehicle Emission Regulations (Canadian Environmental Protection Act, 1999): Proposed regulations are found in the Canada Gazette, Part I, December 30, 2007, p. 4553.

Safety Management Regulations (Canada Shipping Act, 2001): Proposed amendments change the wording of the regulation in order to make it consistent with the provisions of the new Canada Shipping Act, 2001 when it comes into force in early 2007. See Canada Gazette, Part I, June 17, 2006, p. 1636.

Division 2 AMENDMENTS

Section 2.A Acts

Pesticide Residue Compensation Act: As a consequential amendment of 2006, c. 11 (Bill C-17) subsection 14(1) is replaced (appointment of Assessor and Deputy Assessors).

Railway Safety Act: As a consequential amendment of 2006, c. 11 (Bill C-17) subsection 34(1) is replaced (order or emergency directive an order of the court).

Section 2.B Regulations

Domestic Substances List (Canadian Environmental Protection Act, 1999): SOR/2006-266 adds 1 substance to Part 1 of the DSL. SOR/2006-267 deletes 1 substance and adds 9 substances to the DSL; adds 22 substances to Part 3 and 1 substance to Part 4 of the DSL. SOR/2006-289 adds 397 substances to Part 1 of the DSL. Environmental Assessment Act: B.C. Reg. 342/2006 repeals subsection 5(3).

Environmental Management Act: B.C. Reg. 342/2006 makes a minor change in clause 138(3)(a).

Forest Act: B.C. Reg. 344/2006 makes minor corrections and changes throughout the Act, including replacing section 176.

Forest and Range Practices Act: B.C. Reg. 344/2006 amends the definition of "official" in subsection 1(1) and makes a correction in clause 118(2)(d).

Integrated Pest Management Act: B.C. Reg. 342/2006 makes a minor correction in clause 7(2)(c)(i).

Motor Vehicle (All Terrain) Act: B.C. Reg. 348/2006 makes a minor correction in subsection 9(3).

Environmental Protection Act: 2006, c. 32 (Bill 36) adds subsections 111(1)(rr.1) and 115(7) (allowing the making of regulations with regard to ticketable offences under the Act).

Highway Traffic Act: 2006, c. 54 (Bill 67) adds subsections 43(3.1), (3.2), 75(5.1) and (5.2). Subsection 43(3) has been amended to reference paragraph (1)(b). Section 207 has been repealed and replaced. The amendments provide for the possibility of imprisonment for a conviction for a second offence.

Urban and Rural Planning Act: 2006, c. 33 (Bill 37) adds subsection 34(3) (to modify the application of interim development regulations under the Act).

Consolidated Hearings Act: 2006, c. 32 (Bill 130) As a consequential amendment of 2006, c. 32 this act has been updated to reference the City of Toronto Act, 2006.

Conservation Authorities Act: 2006, c. 32 (Bill 130) As a consequential amendment of 2006, c. 32 this act has been updated to reference the City of Toronto Act, 2006 in subsection 33(1).

Drainage Act: 2006, c. 32 (Bill 130) As a consequential amendment of 2006, c. 32 this act has been updated to reference the City of Toronto Act, 2006 in subsection 61(4).

Environmental Protection Act: 2006, c. 32 (Bill 130) As a consequential amendment of 2006, c. 32 this act has been updated to reference the City of Toronto Act, 2006 in subsections 100.1(5), 154(2), (3), (5), (6), (7), 168.12(2), 168.13(1), 168.14(1) and 168.15(2).

Fire Protection and Prevention Act: 2006, c. 32 (Bill 130) As a consequential amendment of 2006, c. 32 this act has been updated to reference the City of Toronto Act, 2006 in subsections 7.1(5), 38(3), (5), and subsection (7). Subsections 38(6) and (8) have been repealed and replaced.

Fuel Tax Act: 2006, c. 33 (Bill 151) Schedule K changes include: amending sections 4 & 4.1 (imposition of penalties on exporters and importers of fuel who are not registered under the Act). The enactment of new section 14.1 authorizes applications to the Superior Court of Justice for the statutory interpretation of the Act and any other relevant legislation. Currently, subsections 26(2) and (3) provide penalties if a dealer possesses fuel in bulk from which the dye has been removed or coloured fuel that has been mixed or combined with any other type or grade of fuel. The re-enactment of those subsections clarifies that the penalty provisions apply to the possession of fuel that is a mixture of coloured fuel and any other fuel.

Highway Traffic Act: 2006, c. 33 (Bill 151) adds sections 5(1)(h) and 5(3) (fees) and makes minor changes in section 7.

Mining Act: 2006, c. 33 (Bill 151) Schedule R amends subsection 176(1) to give authority to make regulations relating to the valuation of rough diamonds and to the collection of records relating to rough diamond production.

Oil, Gas and Salt Resources Act: 2006, c. 33 (Bill 151) Schedule W replaces section 10.2 (restriction on building near a well revised).

Ontario Heritage Act: As a consequential amendment of 2006, c. 34 (Bill 152) subsection 24(2) is repealed.

Planning Act: 2006, c. 32 (Bill 130) As a consequential amendment of 2006, c. 32 this act has been updated to reference the City of Toronto Act, 2006 in subsections 28(7.3), 28(12), 40(4), 41(4), 41(11), 42(16), and 44(10). Subsection 28(8) has been repealed. Subsections 28 (4), (4.1), (4.2), (4.3), (4.4) ,(5), 34(4), 40(3)(a), and 58 have been repealed and replaced.

Safe Water Drinking Act, 2002: 2006, c. 32 (Bill 130) As a consequential amendment of 2006, c. 32 this act has been updated to reference the City of Toronto Act, 2006 in subsections 114(7)(e), 124(3) and 124(6). Subsections 2(1), 124(5), and 124(7) have been replaced.

Technical Standards and Safety Act: The part of 2006, c. 34 (Bill 152) now in force amends section 2 to strike the term "hydrocarbon" before "fuels".

Off-Highway Vehicle Act: S.P.E.I., 2006, c. 14 (Bill 13) This act amends sections 1(g)(vii) and 22(g). Subsections 1(g)(v) and (vii) have been repealed. Sections 16.1 and 16.2 have been added to the act. They detail the powers and responsibilities of a peace officer during the seizure of an off-highway vehicle. Section 20 has been repealed and replaced. This section outlines the minimum fines and for offences under the act.

Public Health Act: 2006, c. 17 (Bill 26) Sections 1(c.1), (e.1), (h.1) and 23(f.1) have been added to the act. Section 18 (pandemic plan) has been repealed and replaced. Sections 18.1 (no delegation of authority), 18.2 (temporary isolation or quarantine facility), 18.3 (compensation), 22.1(protection of persons who report), 22.2 (persons reporting protected from liability), 22.3 (liability protection) and 22.4 (limited license) have been added.

Renewable Energy Act: 2006, c. 20 (Bill 3) adds subsections 11(2.1) & (2.2) (energy credits - alternative expiry date) and replaces subsection 13(7) (expiry of credit).

Section 2.A Acts

An Act respecting industrial accidents and occupational diseases: 2006, c. 53 (Bill 40) makes amendments mainly with respect to financial matters. It clarifies the provisions concerning the insurance coverage applicable to the members of the board of directors of a legal person. It changes the way the employers' assessment is collected, providing for it to be paid in periodic payments calculated on the basis of the salaries or wages paid to workers over a period. It also introduces certain provisions to ensure employers' compliance with the legal requirements with respect to financing. Lastly, certain provisions are amended concerning employers personally liable for the payment of benefits, in particular in order to clarify the rules governing the guarantees they must provide to ensure the payment of benefits to their workers. Some provisions are to come into force on proclamation. As a consequential amendment of 2002, c. 24, now in force, sections 12.1, 294, and 296 are amended in regard to reintegration support funds under new correctional system legislation. An Act respecting the lands in the domain of the State: 2006, c. 40 (Bill 38) This amendment concerns the implementation of the new register (Register of the domain of the State). It determines the content and regulation of the registrar. Division IV (Register of the Domain of the State) has been repealed and replaced. Subsections 17(1) and (2) have been amended.
