Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to March 2007. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between February and March 2007. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of March 2007. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2007-2 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2007-2 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Feeds Regulations, 1983 (Feeds Act): SOR/2006-147 amends the regulation in various sections to strengthen safeguards against Bovine Spongiform Encephalopathy (BSE). These final amendments come into force on July 12, 2007 and are found in the Canada Gazette, Part II, July 12, 2006, p. 871.

Interprovincial Movement of Hazardous Waste and Hazardous Recyclable Material Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for the Interprovincial Movement of Hazardous Waste Regulations are found in the Canada Gazette, Part I, September 2, 2006, p. 2515.

Mackenzie Valley Land Use Regulations (Mackenzie Valley Resource Management Act): Proposed amendments are found in the Canada Gazette, Part I, November 19, 2005, p. 3855.

Marine Spark-Ignition Engine and Off-Road Recreational Vehicle Emission Regulations (Canadian Environmental Protection Act, 1999): Proposed regulations are found in the Canada Gazette, Part I, December 30, 2007, p. 4553.

Safety Management Regulations (Canada Shipping Act, 2001): Proposed amendments change the wording of the regulation in order to make it consistent with the provisions of the new Canada Shipping Act, 2001 when it comes into force in early 2007. See Canada Gazette, Part I, June 17, 2006, p. 1636.

Section 2.A Acts

Forest Act: The remainder of 2006 c. 13 is now proclaimed in force, amending section 75.1 ("volume of timber harvested"). Sections 75.11 (exception for licences that define "volume of timber harvested"), 75.95 (transitional - volume of timber harvested) and subsection 80(3) have been added to the Act. Clause 146(2)(c) is added.

Motor Vehicle Act: B.C. Reg. 367/2006 makes a minor amendment to subsection 82(10.1).

Protected Areas of British Columbia Act: In S.B.C. 2006, c. 15 the description of Sudeten Park in Schedule C is repealed.

Workers' Compensation Act: B.C. Reg. 353/2006 makes a minor change in clause 21(4)(a). B.C. Reg. 366/2006 changes the dollar amounts in various sections of the Act.

Section 2.B Regulations

Cleaner Gasoline Regulation (Environmental Management Act): Among other changes, B.C. Reg. 3/2007 replaces the definition of "gasoline" in section 1 and repeals other definitions; repeals section 5 to 8 and Schedule 2; amends section 9 and Schedule 1 to update CGSB standards 3.5 and 3.511; amends section 10 to reference two federal regulations.

Fort St. John Pilot Projects Regulation(Forest and Range Practices Act): In B.C. Reg. 360/2006 subsections 24(1), (3), (4), 85(2), (3), (4) are repealed and replaced. Section 83 adds a paragraph (5).

Forest Planning and Practices Regulation (Forest and Range Practices Act): B.C. Reg. 355/2006: Section 70.1 has been added to the Act (authority to construct, maintain or deactivate a road). B.C. Reg. 320/2006: Subsection 4(2.1) has been added allowing a land surveyor to damage or destroy Crown timber in the course of his or her duties. Amendments are made to subsections 85(a)(i), (b), and 86(1). B.C. Reg. 321/2006 amends section 12.1 to 12.5 regarding forest stewardship plans; section 19 is amended in subsections (a), (b) and (c) substituting the term "agreement holder" for "holder of a forest stewardship plan"; clause 21(1)(c.1) is added and subsection 106.2(2) repealed.

Other changes include: amending section 4 to include a reference to bed and breakfast accommodation; amending section 5 to broaden its application to persons in general; amending section 7 regarding building alterations; amending section 33 to increase penalties for a violation of the Act.

Trade Union Act: S.N.S, 2006, c. 48 amends subsection 46A(3), (4) and (5). Subsections 52A(4) and section 52AA (firefighters), have been added to the Act. Schedule A (Arbitral Terms and Conditions of Employment for Police and Firefighter Interest Arbitration) has also been added.

Building Code (Building Code Act, 1992); O. Reg. 350/06 replaces the current Building Code, effective December 31, 2006. See the Ontario Gazette, Saturday July 22, 2006, p. 2105.

Division 2 AMENDMENTS

Section 2.A Acts

Highway Traffic Act: 2006, c. 11, Sch. B (Bill 53) and 2006, c. 32, Sch. D (Bill 130) both amend section 128 (rate of speed). Schedule C of 2006, c. 32 also amends sections 26(3) & 28 regarding parking permits for the disable, replaces subsections 166(1) (passing street cars) and 210(4) (improper use of disabled person parking permit).

Section 2.B Regulations

Ethanol in Gasoline (Environmental Protection Act): O. Reg. 64/07 adds subsection 2(6) which is replaced by O. Reg. 76/07 which also adds subsection (7). The amendments relate to exemptions for subsection (1) (standards for ethanol-blended gasoline).

Functional Abilities Form (Workplace Safety and Insurance Act, 1997): O. Reg. 28/07 amends the regulation to replace the Form in the regulation by a form available on the internet.

Highway Traffic Act: Sections of 2006, c. 8 (Bill 27), now proclaimed in force, amend section 1 (newly licensed drivers); amend section 82 (instruction permits); replace section 92.1 ("immediate family member" to accompany newly licensed driver); amend subsection 253(1) (accompanying driver); amend clause 312(z.1) (prohibiting or regulating electronic devices). Other amendments are yet to come into force.

Section 2.B Regulations

General Regulations (Off-Highways Vehicle Act): EC2007-70 amends section 1 to exempt miniature motor vehicles and minibikes from the application of the Act and regulations; section 6 is replaced (helmet requirements); section 6.1 is added (engine size); amendments to sections 8(2) and 10(a) relate to driver's licenses; subsection 12(2) is replaced and sections 12.1 and 12.2 added (age and licensing requirements).

Pesticides Control Act Regulations: EC2007-71: In addition to other amendments, section 6 adds a new class of Pesticide Applicator Certificate and how those holding a Class A can obtain a Class D Pesticide Applicator Certificate. Subsection 16(2) adds a reference to a golf course. Section 30.1 requires sellers to hold a Domestic Pesticide Vendor Business Certificate or a Non-domestic Pesticide Vendor Business Certificate. Section 39 concerns wind speed during the application of pesticide, excepting the use of a wiper, brush or roller or by a spot treatment. Forms 14-17 have been added to Schedule 3. Schedule 4 (Application Fees) has been revoked and replaced. Schedules 7 (Exempted Pesticides) and 8 (Self- Select Domestic Pesticides) have been added.
