Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to April 2007. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between March and April 2007. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of April 2007. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2007-2 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2007-2 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Feeds Regulations, 1983 (Feeds Act): SOR/2006-147 amends the regulation in various sections to strengthen safeguards against Bovine Spongiform Encephalopathy (BSE). These final amendments come into force on July 12, 2007 and are found in the Canada Gazette, Part II, July 12, 2006, p. 871.

Interprovincial Movement of Hazardous Waste and Hazardous Recyclable Material Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for the Interprovincial Movement of Hazardous Waste Regulations are found in the Canada Gazette, Part I, September 2, 2006, p. 2515.

Mackenzie Valley Land Use Regulations (Mackenzie Valley Resource Management Act): Proposed amendments are found in the Canada Gazette, Part I, November 19, 2005, p. 3855.

Marine Spark-Ignition Engine and Off-Road Recreational Vehicle Emission Regulations (Canadian Environmental Protection Act, 1999): Proposed regulations are found in the Canada Gazette, Part I, December 30, 2007, p. 4553.

Prohibition of Certain Toxic Substances Regulations, 2005 (Canadian Environmental Protection Act, 1999): Proposed amendments appear in the Canada Gazette, Part I, June 17, 2006, p. 1593.

Radiation Emitting Devices Regulations (Diagnostic X-ray Equipment) (Radiation Emitting Devices Act): Proposed amendments are found in the Canada Gazette, Part I, October 8, 2005, p. 3312.

Review Panel Regulations (Pest Control Products Act). Proposed regulations are found in the Canada Gazette, Part I, December 6, 2006, p. 4305.

Safety Management Regulations (Canada Shipping Act, 2001): Proposed amendments change the wording of the regulation in order to make it consistent with the provisions of the new Canada Shipping Act, 2001 when it comes into force in early 2007. See Canada Gazette, Part I, June 17, 2006, p. 1636.

Storage Tank Systems for Petroleum Products and Allied Petroleum Products Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for Registration of Storage Tank Systems for Petroleum Products and Allied Petroleum Products on Federal Lands (SOR/97-10) are found in the Canada Gazette, Part I, April 7, 2007, p. 829.

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act, 1992): Proposed amendments are found in the Canada Gazette, Part I, September 30, 2006, p. 3015. More proposed amendments are found in the Canada Gazette, Part I, February 10, 2007, p. 255.

Division 2 AMENDMENTS

Section 2.A Acts

Section 2.B Regulations

Hazardous Products (Glazed Ceramics and Glassware) Regulations(Hazardous Products Act): SOR/2007-30. This amendment further limits the leaching of lead and cadmium from the lip and rim area of drinking vessels, by amending section 5 and section 1 and 2 of the schedule.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): SOR/2006-94, in force April 1, 2007, requires the installation, in school buses, and in other buses having a gross vehicle weight rating (GVWR) of 4,536 kg. or less, of sets of anchors for infant and child restraint systems. See item 210.1 of Schedule III and sections 210.1 & 210.2 of Schedule IV.

Notice With Respect to Substances in the National Pollutant Release Inventory for 2006 (Canadian Environmental Protection Act, 1999): An amendment in the Canada Gazette, Part I, March 3, 2007 adds paragraphs to the General part of Schedule 2 which detail how changes in contact information, ownership and corrections to inaccurate information previously submitted are to be handled. It also makes minor corrections to items in Schedule 1, replaces section 5 of Schedule 3, and adds definitions to Schedule 4.

Onshore Pipeline Regulations, 1999 (Miscellaneous Program) (National Energy Board Act): SOR/2007-50 makes various amendments in response to questions raised by the Standing Joint Committee for the Scrutiny of Regulations. The amendments remove duplication, unnecessary words, and eliminate inconsistencies.

Drinking Water Protection Regulation (Drinking Water Protection Act): B.C. Reg. 5/2007 makes amendments to the regulation regarding operating permits and fees, effective August 2007. See B.C. Gazette, Part II, February 13, 2007, p. 7.

Division 2 AMENDMENTS

Section 2.A Acts

Transportation Act: 2007, c. 1 (Bill 2). Section 40 and subsection 87(2)(e) have been repealed. Minor amendments to have been made to 79(1)(e).

Section 2.B Regulations

Electrical Safety Regulation (Safety Standards Act): B.C. Reg. 17/2007 updates the B.C. Electrical Code Regulation to 2006, now citing Canadian Standards Association (CSA) standard C22.1-06 deemed amendments for which are found in the Schedule.

Elevating Devices Safety Regulation (Safety Standards Act): B.C. Reg. 17/2007 amends the Schedule to update Canadian Standards Association (CSA) standard B44 (safety code for elevators).

Gas Safety Regulation (Safety Standards Act): B.C. Reg. 50/2007 replaces section 30 (Canadian gas standards adopted as B.C. Natural Gas and Propane Code).

Motor Vehicle Act Regulations: B.C. Reg. 10/2007 amends section 43.05 (costs and charges for lien on impounded vehicle). B.C. Reg 36/2007: Several new definitions have been added or replaced, including a definition for 'on-duty time'. Sections 37.12 to 37.21 are repealed and replaced. Most of the amendments concern various requirements for on-duty for commercial carriers and drivers, including mandatory off-duty time and daily off-duty time.

Power Engineers, Boiler, Pressure Vessel and Refrigeration Safety Regulation (Safety Standards Act): B.C. Reg. 50/2007 replaces section 4 (adoption of codes and standards) and the Schedule (Adopted Codes and Standards).

Gas Plant Facility Regulations (Energy Resources Conservation Act): N.S. Reg. 102/2007 increases the fees in section 12 (Application Fee).

General Blasting Regulations (Occupational Health and Safety Act): N.S. Reg. 142/2007 amends sections 20(3) and 21(4)(b) regarding fees.

Mineral Resources Regulations (Mineral Resources Act): N.S. Reg. 123/2007 replaces section 70 (fees) and amends section 71 (royalties).

Off-highway Vehicles General Regulations (Off-highway Vehicles Act): N.S. Reg. 187/2007 adds/amends definitions in section 1A and adds section 16 which provides permission to operate off-highway vehicles on established trails.

Off-highway Vehicles Safety and Training Regulations (Off-highway Vehicles Act): N.S. Reg. 189/2007 & 190/2007 amendments create components of safety training, adjust the time periods for certain exemptions, and exempt certain people who previously owned or registered off- highway vehicles from safety training requirements. See sections 3, 7, 9, and 9A.

Onshore Petroleum Geophysical Exploration Regulations (Energy Resources Conservation Act): N.S. Reg. 147/2007 replaces Schedule I (Fees and Rentals).

Power Engineers Regulations (Crane Operators and Power Engineers Act): N.S. Reg. 95/2007 increases fees by replacing Schedule 1.

Solid Waste Resource - Management Regulations (Environment Act): N.S. Reg. 61/2007 This amendment adds paragraphs 18J to 18Q, outlining the regulation of the Electronic Products Stewardship Program. This program regulates the collection and disposal, re-purposing or recycling of electronic products. The amendment institutes other changes including the repeal of subsections 2(m), 18A(2) and 18B(2).

Steam Boiler and Pressure Vessel Regulations (Steam Boiler and Pressure Vessel Act): N.S. Reg. 162/2007 replaces Part VII - Fees in Respect of Construction, sections 84 to 103.

Underground Hydrocarbons Storage Regulations (Underground Hydrocarbons Storage Act): N.S. Reg. 165/2007 amends subsection 7(6) (application fee) and section 13 (annual rent).

Certificate of Approval Exemptions - Air (Environmental Protection Act): O. Reg. 110/07 amends paragraph 1 of subsection 1(1).

Control of Exposure to Biological or Chemical Agents (Occupational Health and Safety Act): O. Reg. 83/07 modifies the following items in Part 4 of the Schedule: Calcium sulfate, inhalable, including Gypsum and plaster of Paris; Carbon disulfide; Coumaphos, inhalable, vapour and aerosol; Fenamiphos, inhalable, vapour and aerosol; Fenthion, inhalable, vapour and aerosol; Fonofos, inhalable, vapour and aerosol; Iron oxide (Fe2O3), respirable, including Rouge; 2-Methoxyethanol (EGME); 2-Methoxyethyl acetate (EGMEA); Monochloroacetic acid, inhalable, vapour and aerosol; Propylene; Propylene dichloride, also known as1,2-Dichloropropane; Ronnel, inhalable, vapour and aerosol; 1,1,2,2-Tetrabromoethane, inhalable, vapour and aerosol. Propylene is struck from Part 9.

Electricity Projects (Environmental Assessment Act): O. Reg. 104/07 adds section 5.1 (municipal waste pilot project site).

Fees - Certificates of Approval (Environmental Protection Act): O. Reg. 109/07 adds the definition "thermal treatment" to section 1 and amends items 6 & 18 in Schedule 4 and 6 & 17 in Schedule 5.

General - Waste Management (Environmental Protection Act): O. Reg. 102/07 introduces various amendments throughout, in such areas as: biodiesel fuel; common mercury waste; food processing and preparation operations; intact waste batteries and waste battery recovery facilities; thermal treatment; waste biomass; waste electrical and electronic equipment. See especially sections 3, 5.0.1 (new section regarding municipal waste pilot project sites), 8, 28, and 28.1.

General Regulation (Environmental Assessment Act): O. Reg. 103/07 adds section 11.1 (municipal waste pilot project site). O. Reg. 106/07 repeals clauses 5(2)(d)(iv) & 5(3)(d) and adds subsection 15(2).

Licensing of Sewage Works Operators (Ontario Water Resources Act): O. Reg. 111/07 amends item 9 (thermal treatment) of Table 3 of Schedule 1.

Mines and Mining Plants (Occupational Health and Safety Act): O. Reg. 84/07 replaces section 11 (required training programs). Other 84/07 amendments are to come into force October 1, 2007 (see Ontario Gazette, March 24, 2007).

Mobile PCB Destruction Facilities (Environmental Protection Act): O. Reg. 108/07 adds the definition "thermal treatment" to section 1 and amends subsection 2(1).

Recycling and Composting of Municipal Waste (Environmental Protection Act): O. Reg. 107/07 adds the definition "final disposal" to subsection 1(1) and repeals subsections 28(4) & 35(4).

Waste Disposal Sites and Waste Management Systems Subject to Approval Under the Environmental Assessment Act (Environmental Protection Act): O. Reg. 105/07 changes the title of the regulation to "Waste Disposal Sites and Waste Management Systems Subject to Approval Under or Exempt from the Environmental Assessment Act". It also adds section 2 (exemptions for waste disposal sites).

Regulation respecting the application of the Building Act (Building Act): O.C. 222-2007 makes text changes to sections 1, 3.5, and 3.6 and adds the following sections: 1.1 (exemption from Chapter IV of the Act regarding a certain licence); 3.3.0.2. (exemption from the application of section 35 of the Act); 3.3.6. (exemption from application of Chapter VIII of the Construction Code and Chapter VI of the Safety Code). These changes are in regard to petroleum equipment installation.

Safety Code (Building Act): O.C. 221-2007 amends the Safety Code by adding Chapter VI - Petroleum Equipment Installation, sections 109 - 283. These sections regulate the installation and maintenance of petroleum equipment. Proper procedure and permits for their installation are outlined. Schedule 1 (Evaluation of Unprotected Steel Tank Condition) has been added to the code.
