Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to May 2007. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between April and May 2007. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of May 2007. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2007-2 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2007-2 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Aviation Occupational Health and Safety Regulations (Canada Labour Code): Proposed amendments are found in the Canada Gazette, Part I, September 30, 2006, p. 2959.

Cargo, Fumigation and Tackle Regulations (Canada Shipping Act, 2001): Proposed regulations are found in the Canada Gazette, Part I, December 23, 2006, p. 4437.

Energy Efficiency Regulations (Energy Efficiency Act): Proposed amendments are found in the Canada Gazette, Part I, May 6, 2006, p. 1014.

Feeds Regulations, 1983 (Feeds Act): SOR/2006-147 amends the regulation in various sections to strengthen safeguards against Bovine Spongiform Encephalopathy (BSE). These final amendments come into force on July 12, 2007 and are found in the Canada Gazette, Part II, July 12, 2006, p. 871.

Interprovincial Movement of Hazardous Waste and Hazardous Recyclable Material Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for the Interprovincial Movement of Hazardous Waste Regulations are found in the Canada Gazette, Part I, September 2, 2006, p. 2515.

Marine Spark-Ignition Engine and Off-Road Recreational Vehicle Emission Regulations (Canadian Environmental Protection Act, 1999): Proposed regulations are found in the Canada Gazette, Part I, December 30, 2007, p. 4553.

Marine Transportation Security Regulations (Marine Transportation Security Act): Some sections of (final) SOR/2006-269 amendments are in force December 15, 2007; SOR/2006-270 final amendments are in force November 2, 2007. See Canada Gazette, Part II, Vol. 140, No. 23, 2006, p. 1729 & 1758.

Metal Mining Effluent Regulations (Fisheries Act): Proposed amendments are found in the Canada Gazette, Part I, April 8, 2006, p. 771. Proposed amendments are found in the Canada Gazette, Part I, May 5, 2007, p. 1171.

Migratory Birds Regulations (Migratory Birds Convention Act, 1994): Proposed amendments are found in the Canada Gazette, Part I, December 9, 2006, p. 4162.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Subsections 115(2.2) to (2.4) of Schedule IV as enacted by SOR/2004-250 (vehicle identification number in bar code format) come into force September 1, 2008. Regulations for the Prevention of Pollution from Ships and for Dangerous Chemicals (Canada Shipping Act): New proposed regulations replace the Air Pollution Regulations, the Garbage Pollution Prevention Regulations, the Great Lakes Sewage Pollution Prevention Regulations, the Pollutant Substances Pollution Prevention Regulations, the Non-Pleasure Craft Sewage Pollution Prevention Regulations, the Pleasure Craft Sewage Pollution Prevention Regulations, the Oil Pollution Prevention Regulations, and the Dangerous Chemicals and Noxious Liquid Substances Regulations. Safety Management Regulations (Canada Shipping Act, 2001): Proposed amendments change the wording of the regulation in order to make it consistent with the provisions of the new Canada Shipping Act, 2001 when it comes into force in early 2007. See Canada Gazette, Part I, June 17, 2006, p. 1636.

Storage Tank Systems for Petroleum Products and Allied Petroleum Products Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for Registration of Storage Tank Systems for Petroleum Products and Allied Petroleum Products on Federal Lands (SOR/97-10) are found in the Canada Gazette, Part I, April 7, 2007, p. 829.

Section 2.A Acts

Agricultural Operation Practices Act: 2007, c. 3 (Bill19) amends section 27 (appeal process).

Alberta Energy and Utilities Board Act: 2007, c. 3 (Bill19) amends section 26 (appeal process).

Climate Change and Emissions Management Act: 2007, c. 4 (Bill 3) represents the first negative incentive legislation for greenhouse gas emissions in Canada. Every facility that emits more than 100,000 tonnes of carbon dioxide equivalent gas per year must reduce its emissions intensity by 12% beginning July 1, 2007. Emissions intensity can be reduced by operational changes, contributing to a new greenhouse gas emissions reduction technology fund, or purchasing an offset.

Energy Resources Conservation Act: 2007, c. 3 (Bill19) amends section 41 (appeal process).

Natural Resources Conservation Board Act: 2007, c. 3 (Bill19) amends section 31 (appeal process).

Traffic Safety Act: As a consequential amendment of 2006, c. P-3.5, now proclaimed in force, the definition of "peace officer" in subsection 1(1) is amended.

Section 2.B Regulations

Administrative Items Regulation (Safety Codes Act): Alta. Reg. 35/2007 changes the name of a department in section 1(e).

Commercial Vehicle Dimension and Weight Regulation (Traffic Safety Act): Alta. Reg. 35/2007 changes the name of a department in section 1(kk)(iii).

Exploration Regulation (Mines and Minerals Act): Alta. Reg. 35/2007 changes the name of a department in section 1, 59, and 60.

Forest and Prairie Protection Regulations, Part I (Forest and Prairie Protection Act): Alta. Reg. 77/2007 makes minor corrections and changes throughout the document; repeals section 28; replaces Form B.

Labour Standards Code: 2006, c. 32 (Bill 83) adds section 66B and amends subsection 67(1) regarding entitlement to a rest or eating break. Subsection 68(2) is amended regarding the employment of children in hotels and restaurants.

Motor Vehicle Act: 2006, c. 36 (Bill 61) amends section 67 and adds new section 280A. The amendments are in regard to participation in an ignition interlock program. 2006, c. 35 (Bill 22) makes amendments regarding rates of speed of farm tractors, farm wagons, and implements of husbandry. See sections 2, 117, and 181.

Section 2.B Regulations

Off-highway Vehicles General Regulations (Off-highway Vehicles Act): N.S. Reg. 208/2007 makes a small change in subsection 1A(2) for clarification purposes.

Power Engineers Regulations (Crane Operators and Power Engineers Act): N.S. Reg. 220/2007 amends the regulations in several sections to increase inflexibility, respond to advances in technology, and to update and clarify some of the provisions. References to Canadian Standards Association (CSA) standards B51 and B2 have been updated.

Ontario Water Resources Act: As a consequential amendment of 2006, c. 21, Sch. C. (Bill 14), now proclaimed in force, subsection 48(3) is replaced (appearance by respondent), section 105 is amended, and subsection 112(3) is replaced (variation of order).

Personal Health Information Protection Act, 2004: As a consequential amendment of 2006, c. 21, Sch. C. (Bill 14), now proclaimed in force, subsection 72(5) is amended.

Pesticides Act: As a consequential amendment of 2006, c. 21, Sch. C. (Bill 14), now proclaimed in force, sections 13(10), 27(2), and 41 are amended, and subsection 46(3) is replaced (variation of order).

Provincial Offences Act: As a consequential amendment of 2006, c. 21, Sch. C. (Bill 14), now proclaimed in force, several sections are amended, including: adding the definition "representative" to subsection 1(1) (see also section 82) and substituting this word for "agent" or "counsel or agent" in several sections; replacing subsections 50(3) (exclusion of representatives), 57(1) (submissions as to sentence), 91(7) (barring representative in contempt), and 118(1) (right to representation).

Safe Drinking Water Act: As a consequential amendment of 2006, c. 21, Sch. C. (Bill 14), now proclaimed in force, subsection 146(3) is replaced (variation of order). More sections of the original 2002, c.32 Act are in force May 7, 2007 and January 1, 2013. See note in Act.

Waste Management Act: As a consequential amendment of 2006, c. 21, Sch. C. (Bill 14), now proclaimed in force, amends section 10 ("representative" defined).

Section 2.B Regulations

Construction (Lakes and Rivers Improvement Act): O. Reg. 160/07 replaces section 2 (approval required to do the following).

Highway Traffic Act: The remainder of 2006, c. 8 (Bill 27) is now proclaimed in force. Section 277.1 is amended (suspension of driver's license); sections 277.8 (consumption of alcohol by certain drivers) and 277.9 (24 hour revocation and suspension of driver's license - newly licensed driver).

Section 2.B Regulations

Electrical Inspection Act Regulations: EC2007-245 makes various changes, including: adding the definition of "certified electrician" in section 1 and repealing others; changing the qualifications for a contractor's license (section 5); replacing section 7 (who may perform electrical work); repeals sections 8 and 12.

Excavation Pits Regulations (Environmental Protection Act): EC2007-239 amends section 1 (definitions); amends section 3 to remove the reference to a bond in the application details and provides more specific requirements for a bond in a separate subsection; adds section 4.1 (application for a permit, the issuance of a permit by the Minister and the expiry of a permit); amends section 4 (proximity of an excavation pit to residential premises or areas used by the public); repeals section 9 because it is redundant to a section in the Act.

The Environmental Management and Protection Act, 2002: 2007, c. 13 (Bill14) repeals sections 24 to 26 and 28; section 27 is replaced (easements - sewage works).

The Forest Resources Management Act: As a consequential amendment of 2007, c. P-13.2 (Bill 12) sections 55 and 99(1)(t) are amended to update a reference to another Act.

The Public Health Act: 2007, c. 8 (Bill 7) adds clauses (jj)(iii.1) & (jj.01) to subsection 46(1) (regulations governing inspections and public eating establishments).

The Department of Environment Regulations, 2006 (The Government Organization Act): Sask. Reg. 21/2007 repeals subsection 3(2) (objects and purposes of Department re Forestry Secretariat).

The Forest Resources Management Regulations (Forest Resources Management Act): Among other changes, Sask. Reg. 14/2007 adds sections 3.1 (Provincial Forest Policy Advisory Committee), 3.2 (Provincial Science Advisory Board), 13.1 (claim staking and mineral exploration), 76.1 (waiver of dues and fees for exploration activities); replaces section 83 (assessment of administrative penalties), and Table 2 in Part 1 of the Appendix (Administrative Penalties).

The Water Regulations, 2002 (Environmental Management and Protection Act): Among other changes, Sask. Reg. 15/2007 amends section 35 (assessment and audit of water for human use); adds new sections 63.1 (minimum certificate exemption for certain municipal waterworks), 63.2 (minimum certificate exemption for certain water pipelines), 63.3 (minimum certificate exemption for certain municipal sewage works); adds Tables 3 & 4 to the Appendix.
