Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to June 2007. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between May and June 2007. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of June 2007. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2007-3 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2007-3 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Feeds Regulations, 1983 (Feeds Act): SOR/2006-147 amends the regulation in various sections to strengthen safeguards against Bovine Spongiform Encephalopathy (BSE). These final amendments come into force on July 12, 2007 and are found in the Canada Gazette, Part II, July 12, 2006, p. 871.

Interprovincial Movement of Hazardous Waste and Hazardous Recyclable Material Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for the Interprovincial Movement of Hazardous Waste Regulations are found in the Canada Gazette, Part I, September 2, 2006, p. 2515.

Marine Spark-Ignition Engine and Off-Road Recreational Vehicle Emission Regulations (Canadian Environmental Protection Act, 1999): Proposed regulations are found in the Canada Gazette, Part I, December 30, 2007, p. 4553.

Marine Transportation Security Regulations (Marine Transportation Security Act): Some sections of (final) SOR/2006-269 amendments are in force December 15, 2007; SOR/2006-270 final amendments are in force November 2, 2007. See Canada Gazette, Part II, Vol. 140, No. 23, 2006, p. 1729 & 1758.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Subsections 115(2.2) to (2.4) of Schedule IV as enacted by SOR/2004-250 (vehicle identification number in bar code format) come into force September 1, 2008. Regulations Amending Certain Regulations Made under the Nuclear Safety and Control Act. Regulations for the Prevention of Pollution from Ships and for Dangerous Chemicals (Canada Shipping Act): New proposed regulations replace the Air Pollution Regulations, the Garbage Pollution Prevention Regulations, the Great Lakes Sewage Pollution Prevention Regulations, the Pollutant Substances Pollution Prevention Regulations, the Non-Pleasure Craft Sewage Pollution Prevention Regulations, the Pleasure Craft Sewage Pollution Prevention Regulations, the Oil Pollution Prevention Regulations, and the Dangerous Chemicals and Noxious Liquid Substances Regulations. Review Panel Regulations (Pest Control Products Act). Proposed regulations are found in the Canada Gazette, Part I, December 6, 2006, p. 4305.

Safety Management Regulations (Canada Shipping Act, 2001): Proposed amendments change the wording of the regulation in order to make it consistent with the provisions of the new Canada Shipping Act, 2001 when it comes into force in early 2007. See Canada Gazette, Part I, June 17, 2006, p. 1636.

Storage Tank Systems for Petroleum Products and Allied Petroleum Products Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for Registration of Storage Tank Systems for Petroleum Products and Allied Petroleum Products on Federal Lands (SOR/97-10) are found in the Canada Gazette, Part I, April 7, 2007, p. 829.

Drinking Water Protection Regulation (Drinking Water Protection Act): B.C. Reg. 5/2007 makes amendments to the regulation regarding operating permits and fees, effective August 2007. See B.C. Gazette, Part II, February 13, 2007, p. 7.

Division 2 AMENDMENTS

Section 2.A Acts

Commercial Transport Act: 2003, c. 94 (as amended by 2006, c. 28) amends provisions relating to insurance in sections 1 and 6, effective June 1, 2007.

Forest Act: 2007, c. 18 (Bill 18) amends the Act in several places, and include the following in force changes: adding section 1.1 (delegation by minister); amending section 43.51 (probationary community forest agreement); replacing section 47.3 (direct award of specified licences); amending section 58.1 (timber sales licences); adding section 75.22 (cut control period for short term licences that are extended); amending section 75.4 (cut control period for woodlot licence); adding section 81.1 (refusal of cutting permit or road permit). Some sections of 2007, c. 18 are not yet in force. 2007, c. 27 (Bill 24) adds section 60.501 (deletions of Crown land under Park Act).

Forest Range and Practices Act (S.B.C. 2002, c. 69): As amended by 2007, c. 18 (Bill 18). In addition to other amendments, this Act replaces subsection (2) and adds subsection (2.1) of section 37 (Approval of a range use plan or range stewardship plan). Section 52.1 (Authorization for silviculture, stand tending, forest health or another purpose) and Division 3 (Delegation) have been added. This amendment repeals and replaces section 114 (Evidence of designation) and subsection 141(3) (Power to make regulations). Section 87 (Fines) has been amended to reflect changes to this Act. (Other changes are yet to come into force).

Forestry Revitalization Act: 2007, c. 14 (Bill 18) amends subsection 6(4) (Compensation).

Motor Vehicle Act: 2003, c. 94 (as amended by 2006, c. 28) and 2004, c. 68 amends provisions relating to insurance throughout the Act, effective June 1, 2007.

Passenger Transportation Act: 2003, c. 94 (as enacted by 2006, c. 28) adds the definition "motor vehicle liability policy" to section 1 and amends section 3 (reference to an Act). In force June 1, 2007.

Protected Areas of British Columbia Act: Amended by 2007, c. 27 (Bill 24). Descriptions have been amended in, added to or repealed and replaced in Schedules C, D, E and F.

Wildfire Act: Amended by 2007, c. 18 (Bill 18). The definition "free growing stand" has been added to section 1. Subsection 58(1) has been amended to reflect the repeal and replacement of subsection 69(2). Sections 25 (Recovery of fire control costs and related amounts), 27 (Administrative penalties and cost recovery), 28 (Remediation orders) have been amended and section 52 repealed.

Workers Compensation Act: 2007, c. 19 (Bill 26) makes a minor change to subsection 37(1).

British Columbia Building Code Regulation (Local Government Act): B.C. Reg. 108/2007 amends Division B of the Code, which is exempt from publication.

General Regulations (Labour Standards Code): N.S. Reg. 242/2007 adds section 7B (Reservists leave) to N.S. Reg. 298/90. The additions outline the rules regarding leave for reservists in the armed forces and provide definitions for terms such as "reasonable notice".

General Regulations (Hospitals Act): N.S. Reg. 236/2007 amending N.S. Reg. 16/79. Sections 18 and 19 have been repealed. Section 10 (Forms) has been replaced to reflect changes to the newly attached forms. Schedules A - S have been repealed and replaced with Forms A - E.

Section 2.A Acts

Environmental Protection Act: The 2007, c. 7, Sch. 30 (Bill 187) amendments in force include: replacing subsection 139(2) (refusal of licence, permit or approval by Director); amending section 168.1 (replacing definitions of "phase one environmental site assessment" and "phase two environmental site assessment"); adding subsection 168.3(4) (inaccuracy in a site condition record); amending section 168.26 (investigations of property and actions to reduce concentration of contaminants); amending section 176 (regulations).

Highway Traffic Act: The part of 2005, c. 26 which replaces section 107 (inspection and maintenance of commercial motor vehicles) is in force July 1, 2007.

Niagara Escarpment Planning and Development Act: 2007, c. 7, Sch. 28 (Bill 187) adds section 31 (limitation period for prosecutions).

Ontario Water Resources Act: The 2007, c. 7, Sch. 30 (Bill 187) amendments in force include: replacing section 89.1 (definitions re: records of site condition, ss. 89.2 to 89.3); amending section 89.2 (consequences of filing record of site condition); amending section 89.14 (investigations of property, etc.).

Workplace Safety and Insurance Act, 1997: 2007, c. 7, Sch. 41 (Bill 187) amendments include: replacing subsection 43(4) (earnings after injury); amending section 44 (review re: loss of earnings); adding subsections 49(3) & (4) (indexing factor); amending sections 51 (index amounts in the Act) and 52 (temporary indexing factor); adding new section 52.1 (regulations re: temporary indexing factor and additional adjustment); replacing subsection 107(2) (s. 43(13) of pre-1997 Act deemed to be repealed). 2007, c. 3 (Bill 221) amendments create presumptions that apply to firefighters and fire investigators prescribed by regulation. Where prescribed by regulation, heart injuries sustained on or after January 1, 1960 and diseases diagnosed on or after that date are presumed to be due to the worker's employment, unless the contrary is shown. Procedural and transitional rules governing claims to which a presumption applies are set out. See especially new sections 15.1 &15.2.

Section 2.B Regulations

General (Crown Forest Sustainability Act): O. Reg. 183/07 replaces section 28 (Scaling Manual reference). O. Reg. 184/07 replaces section 26.2 (Forest Information Manual reference). O. Reg. 185/07 adds subsection 26.(2) (amendments to Forest Management Planning Manual). O. Reg. 186/07 adds paragraph 12 to subsection 10(1) (certification).

Industrial Establishments (Occupational Health and Safety Act): O. Reg. 565/06 amendments regarding sound exposure levels are in force July 1, 2007, replacing section 139. O. Reg. 179/07 adds subsections (3) & (4) to section 4 regarding exemptions for minimum age regulations.

Refrigerants (Environmental Protection Act): O. Reg. 180/07 makes several changes to the regulation, including: replacing section 4 (general); adding sections 8.1 & 8.2 (ban on refrigerants containing chlorofluorocarbons, by 2009 & 2012); amending section 21 (issuance of certificates); replacing section 22 and adding sections 23 & 24 (other provisions relating to refrigerants containing chlorofluorocarbons; their designation as hazardous waste).

Section 2.A Acts

Highway Safety Code: 2004, c. 2 amendments now proclaimed in force harmonize the rules relating to the hours of service and hours of rest of heavy vehicle operators with those of other provinces. Section 2.B Regulations

Regulation respecting exemptions from the application of Title VIII.1 of the Highway Safety Code (Highway Safety Code): O.C. 368-2007 amends section 2 (vehicles exempted from Act).

Regulation respecting halocarbons (Environment Quality Act): O.C. 384-2007 postpones the coming into force of Chapter III (Environmental Qualifications of the Labour Force) which concerns awareness training, until June 1, 2008. See section 74. French language version

Section 2.A Acts

The Forest Resources Management Act: 2007, c. 29 (Bill 53) replaces sections 66 to 76 regarding enforcement, including: powers of officers, arrests, searches, entry on land, inspections, investigations.

The Government Organization Act: 2007, c. 6 (Bill 26) makes a minor amendment to subsection 11(2) (name of Act).

The Wildlife Act: 2007, c. 43 (Bill 52) replaces Part VI (Enforcement - sections 54 to 63.1) regarding the powers of wildlife officers, arrests, searches, inspections, investigations, seizures, etc. In addition, section 65 is repealed and clause 83(1)(mm.1) added.

The Wildlife Habitat Protection Act: 2007, c. 44 (Bill 38) amends various items in the Schedule; the withdrawal of "indicated lands" in the Schedule has been revoked and are re-designated as wildlife habitat lands. See the relevant excerpt from 2007, c. 44 before the Schedule.
