Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to July 2007. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between June and July 2007. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of July 2007. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2007-3 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2007-3 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Feeds Regulations, 1983 (Feeds Act): SOR/2006-147 amends the regulation in various sections to strengthen safeguards against Bovine Spongiform Encephalopathy (BSE). These final amendments come into force on July 12, 2007 and are found in the Canada Gazette, Part II, July 12, 2006, p. 871.

Interprovincial Movement of Hazardous Waste and Hazardous Recyclable Material Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for the Interprovincial Movement of Hazardous Waste Regulations are found in the Canada Gazette, Part I, September 2, 2006, p. 2515.

Marine Spark-Ignition Engine and Off-Road Recreational Vehicle Emission Regulations (Canadian Environmental Protection Act, 1999): Proposed regulations are found in the Canada Gazette, Part I, December 30, 2007, p. 4553.

Marine Transportation Security Regulations (Marine Transportation Security Act): Some sections of (final) SOR/2006-269 amendments are in force December 15, 2007; SOR/2006-270 final amendments are in force November 2, 2007. See Canada Gazette, Part II, Vol. 140, No. 23, 2006, p. 1729 & 1758.

Safety Management Regulations (Canada Shipping Act, 2001): Proposed amendments change the wording of the regulation in order to make it consistent with the provisions of the new Canada Shipping Act, 2001 when it comes into force in early 2007. See Canada Gazette, Part I, June 17, 2006, p. 1636.

Storage Tank Systems for Petroleum Products and Allied Petroleum Products Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for Registration of Storage Tank Systems for Petroleum Products and Allied Petroleum Products on Federal Lands (SOR/97-10) are found in the Canada Gazette, Part I, April 7, 2007, p. 829.

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act, 1992): Proposed amendments are found in the Canada Gazette, Part I, September 30, 2006, p. 3015. More proposed amendments are found in the Canada Gazette, Part I, February 10, 2007, p. 255.

Division 2 AMENDMENTS

Section 2.A Acts

Canada Labour Code (Part II - Occupational Health and Safety): As a consequential amendment of 2001, c. 26, now proclaimed in force, paragraph 127(2)(a) is replaced (reference to Canada Shipping Act, 2001). French language version

Canada Marine Act: As a consequential amendment of 2001, c. 26, now proclaimed in force, sections 56(3), 58(2)(f), 120(1), and 122(1) are amended (reference to new Canada Shipping Act, 2001.

Canada National Marine Conservation Areas Act: As a consequential amendment of 2001, c. 26, now proclaimed in force, subsections 16(3) & (5) and 29(4) are replaced.

Canada-Newfoundland Atlantic Accord Implementation Act: As a consequential amendment of 2001, c. 26, now proclaimed in force, subsection 160(1) is replaced (definition of "spill").

Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation Act: As a consequential amendment of 2001, c. 26, now proclaimed in force,subsection 165(1) is replaced (definition of "spill").

Canada Oil and Gas Operations Act: As a consequential amendment of 2001, c. 26, now proclaimed in force, subsection 24(1) is replaced (definition of "spill").

Canadian Environmental Protection Act, 1999: As a consequential amendment of 2001, c. 26, now proclaimed in force, section 277 is repealed. The remaining 2005, c. 23 amendments are brought into force upon the proclamation of the Canada Shipping Act, 2001. Various sections are amended to reference the new Act. French language version

Canadian Transportation Accident Investigation and Safety Board Act: As a consequential amendment of 2001, c. 26, now proclaimed in force, section 61 is repealed.

Fisheries Act: As a consequential amendment of 2001, c. 26, now proclaimed in force, subsections 38(7), 42(7) and section 88 are amended to reference the newly proclaimed Canada Shipping Act, 2001. French language version

Food and Drugs Act: SOR/2007-120 amends Schedule D to replace the reference to "Blood and blood derivatives". French language version

Marine Liability Act: As a consequential amendment of 2001, c. 26, now proclaimed in force, sections 29(1) & (2), 42, 51(1), 103(2) are amended in reference to the newly proclaimed Canada Shipping Act, 2001.

Marine Transportation Security Act: As a consequential amendment of 2001, c. 26, now proclaimed in force, the definition "Canadian ship" is replaced in subsection 2(1).

Merchant Seamen Compensation Act: As a consequential amendment of 2001, c. 26, now proclaimed in force, definitions are replaced and added in subsection 2(1); sections 31(1)(c), 42(2), and 47 are amended regarding the proclamation of the Canada Shipping Act, 2001.

Migratory Birds Convention Act, 1994: The remaining 2005, c. 23 amendments are brought into force upon the proclamation of the Canada Shipping Act, 2001. Various sections are amended to reference the new Act.

Non-Smokers' Health Act: As a consequential amendment of 2001, c. 26, now proclaimed in force, subsection 2(2) is replaced (application outside Canada). French language version

Northwest Territories Waters Act: As a consequential amendment of 2001, c. 26, now proclaimed in force, the definition of "use" in section 2 is amended (reference to newly proclaimed Canada Shipping Act, 2001).

Nuclear Safety and Control Act: As a consequential amendment of 2001, c. 26, now proclaimed in force, section 54 is repealed. French language version

Nunavut Waters and Nunavut Surface Rights Tribunal Act: A coordinating amendment of 2002, c. 10 is now in force, which replaces the definition of "use" in section 4 to reference the newly in force Canada Shipping Act, 2001. .

Section 2.B Regulations

Feeds Regulations, 1983 (Feeds Act): SOR/2006-147 (in force July, 2007) amends SOR/83-593. Sections 11, subsection 12(1) and 26(1)(i) and (j) have been repealed and replaced. Sections 19(1) adds (d.1) - (d.3) regulating the types of proteins and fats that may be added to the feed.

Ozone-depleting Substances Regulation, 1998 (Canadian Environmental Protection Act, 1999): SOR/2007-129 amends SOR/99-7. Definitions have been added to section 1. Sections 6.1, 6.2, 7.1 and 7.2 have been added to Schedule 5 and section 7 repealed and replaced. To promote flexibility this amendment allows the transfer of permits of methyl bromide between companies that have valid critical or emergency use exemptions. These amendments allow Environment Canada the ability to monitor such transfers in addition to the current regime import permits. French language version

Safety Management Regulations (Canada Shipping Act): SOR/2006-255 replaces sections 1 to 4 in order to make the wording of the regulations consistent with the provisions of the Canada Shipping Act, 2001, just recently brought into force.

Tackle Regulations (Canada Shipping Act): As a consequential amendment of "Cargo, Fumigation and Tackle Regulations," SOR/2007-128, sections 2(2), 5(2), 20 to 35 (Part IV), 60 and Schedules I to III are repealed. French language version

Wildlife Area Regulations (Canada Wildlife Act): SOR/2007-138 updates the definitions "non-toxic shot", "tungsten-bronze-iron shot" and "tungsten-nickel-iron shot". A definition for "tungsten-iron-nickel-copper shot" has been added. These minor adjustments ensure non- toxicity and consistency with wildlife regulations while permitting a greater variety of formulations.

Division 2 AMENDMENTS

Section 2.A Acts

Public Health Act: 2007, c. 18 (Bill 5) replaces subsection 66(2) (codes, standards, guidelines). 2007, c. 23 (Bill 14) makes several amendments to the Act, including: replacing subsection 45(1) (isolation orders); amending section 52.1 (orders re public health emergencies); adding section 52.21 (Minister's orders re likelihood of pandemic influenza); amending subsection 52.8(1) (termination of public health emergency order); adding section 52.811 (termination of suspension orders); replacing section 52.91 (employer cannot terminate employee for absence from employment during a public health emergency); replacing section 66.1 (protection from liability).

Workers' Compensation Act: 2007, c. 12 (Bill 30) changes the name of an Act in subsection 14(4).

Section 2.B Regulations

Commercial Vehicle Certificate and Insurance Regulation (Traffic Safety Act): Alta. Reg. 98/2007 extends the expiry date of the regulation to 2010 (see section 66).

Oil and Gas Conservation Regulation (Oil and Gas Conservation Act): Alta. Reg. 109/2007 replaces sections 16.040 (classifications of oil sands projects), 16.050 (wells exempt from payment of administration fee), 16.080 (calculation of administration fees for oil sands projects), 16.081 (adjustment factor applied to administration fees for wells), 16.100 (fiscal year of the Board for 2007-2008).

Drinking Water Protection Regulation (Drinking Water Protection Act): B.C. Reg. 5/2007 makes amendments to the regulation regarding operating permits and fees, effective August 2007. See B.C. Gazette, Part II, February 13, 2007, p. 7.

Commercial Transport Regulations (Commercial Transport Act): B.C. Reg. 144/2007 updates the name of an Act in section 5.02(b) & (c).

Emergency Vehicle Driving Regulations (Motor Vehicle Act): B.C. Reg. 136/2007 adds the terms "emergency light" and "emergency siren" to the regulation, which affects amendments to clause 3(1)(a), section 4 and subsection 5(1).

Emission Inspection Exemption Regulation (Motor Vehicle Act): B.C. Reg. 161/2007 amends sections 3 and 4 regarding the Basic Insurance Tariff.

Forest Planning and Practices Regulation (Forest and Range Practices Act): B.C. Reg. 152/1007 amends 14/2004. Sections 46.11 (Free growing stand requirements applies to each hectare) and 97.1 (Declaration regarding free growing stand obligations met to the extent practicable) have been added to this regulation. Amendments to sections 44, 46.2 and 86 have been amended to mark these additions.

Motor Vehicle Act Regulations: B.C. Reg. 110/2007 adds section 39.001 and replaces sections 39.01 to 39.03 regarding passenger seating requirements. B.C. Reg. 116/2007 replaces Division 36 - Child Seating and Restraint Systems, sections 36.01 to 36.09. B.C. Reg. 126/2007 amends sections 40A.01, 40A.02, 40A.03 regarding inspections and repeals 40A.04 to 40A.06. B.C. Reg. 135/2007 amends clause 34.05(1)(d). B.C. Reg. 161/2007 amends section 40.01 by adding definitions relating to motor vehicle emission inspection and maintenance.

Occupational Disease Recognition Regulation (Workers' Compensation Act): B.C. Reg. 120/2007 adds bursitis, tendinitis and tenosynovitis as occupational diseases in section 1, effective August 14, 2007.

Occupational Health and Safety Regulation (Workers' Compensation Act): B.C. Reg. 105/2007 adds sections 3.22 -3.25 to the regulation. These sections deal with safety training of new or young workers. B.C. Reg. 106/2007 adds the definitions of "medical sharp", "parenteral contact" and safety-engineered medical sharp". The definition of "biohazardous material" has been repealed and replaced. Subsections 6.36(1.2) - (1.6) were added, regulating the types of needles and medical sharps to be used in given procedures. In dealing with the same subject, subsection 6.36(1.1) has been repealed and replaced.

Passenger Transportation Regulation (Passenger Transportation Act): B.C. Reg. 163/2007 repeals subsection 1(4).

Violence in the Workplace Regulations (N.S. Reg. 209/2007). New regulations are found in the Royal Gazette, April 27, 2007, no. 9. Sections 1 - 6 effective October 1, 2007, remainder a year later.

Division 2 AMENDMENTS

Section 2.A Acts

Fisheries and Coastal Resources Act: The part of 2005, c. 50 which amends section 38 (Board loans) is now proclaimed in force.

Motor Vehicle Act: Two sections of 2007, c. 20 (Bill 168) are now proclaimed in force. The amendments amend sections 292 and 293 to make section 151 violations a Category A offence.

Section 2.B Regulations

Environment Act and Regulations Fees Regulations (Environment Act): Amended by 244/2007. Minor adjustments have been made to subsections 4(1)(b) and 4(2).

Ontario Fire Code (Fire Protection and Prevention Act, 1997): Replacement Code, O. Reg. 213/07, in force Nov. 21, 2007. See Ontario Gazette, June 9, 2007.

Division 2 AMENDMENTS

Section 2.A Acts

Ambulance Act: 2007, c. 10, Sch. A (Bill 171) replaces subsection 4(3); adds Part IV.1 - Land Ambulance Services - Designated Persons, comprising section 7; replaces subsection 19(3).

Environmental Protection Act: The remainder of 2005, c. 12 is now proclaimed in force. These amendments replace the existing unproclaimed provisions that deal with administrative penalties imposed by regulatory officials. The new provisions refer to these penalties as "environmental penalties". The new provisions list the types of contraventions for which environmental penalties may be imposed and describe the types of persons on whom they may be imposed. See especially sections 14, 145.4, 145.5, 157, 182.1, and 182.2.

Highway Traffic Act: The part of 2005, c. 26, Schedule A which adds section 58.1 (driving schools) is now proclaimed in force.

Ontario Water Resources Act: The remainder of 2005 c.12 are now proclaimed in force. Definitions of "environmental penalty" and "regulated person" are added to section 1. These additional sections and amendments list the violations for which environmental penalties may be imposed and who may be regulated. See the addition of sections 106.1 and 106.2 to the act. 2007, c.10 (Bill 171) deletes references to "water works". Also, references to potable water in section 75 are deleted. Subsection 106.1(3)(b) is amended to bring its terminology in line with that of subsection 30(1). Section 24 (Licence, etc., condition, permission to inspect) has been repealed and replaced. References to the Safe Drinking Water Act, 2002 has been added to subsection 113(1). Parts of 2007, c.12 (Bill 198) are now in force. Definitions for "Great Lakes-St. Lawrence River Basin Sustainable Water Resources Agreement", "holder" and "well" have been added. The Great Lakes-St. Lawrence River Basin Sustainable Water Resources Agreement has been implemented and amendments are made to correspond to its requirements. Subsections 13(8)-(11) have been repealed and section 13.1 and 33.1 have been added to the act. In addition to other amendments, sections 34.2 - 34.4 have been added to the Act.

Safe Drinking Water Act: Among other changes, sections of 2007, c. 10, Schedule D (Bill 171) in force amend section 54 (establishment or replacement of a regulated non-municipal drinking- water system, approvals) and section 127 regarding certificates.

Technical Standards and Safety Act, 2000: S.O. 2006, c. 34 is now fully in force. Investigators have been added as persons involved in the administration of technical standards under this Act. Sections 4 (Appointments of directors, inspectors and investigators), 5 (Powers of directors, general), 18 (Powers on inspection), 19 (Entry, inspection, etc.), 20 (Obstruction) have been amended to reflect this addition and changes to inspection and investigation powers and procedures. Sections 22.1 (Search warrant), 22.2 (No warrant required in exigent circumstances) and 22.3 (Seizure of things in plain view) have been added and section 17 (Inspection) has been repealed and replaced.

Section 2.B Regulations

Classification and Exemption and Spills and Reporting of Discharges(Environmental Protection Act): O. Reg. 657/98 is amended by 225/07 (old title: Classification and Exemption of Spills). This regulation has been divided into Part I (Classification and Exemption of Spills), with a Part II added (Reporting of Discharges), containing a new section 13. Subsection 8(1) has been amended and subsection 10(1) has been repealed and replaced.

Classification of Proposals for Instruments (Environmental Bill of Rights): O. Reg. 681/94 is amended by 216/07. Section 10.1.2 (Class I Proposals - - Oak Ridges Moraine Conservation Act, 2001) has been added to the act.

Commercial Motor Vehicle Operators' Information (Highway Traffic Act): O. Reg. 424/97 is amended by 247/07. Section 1.2 has been added to the act. This section concerns the exemption of pick-up trucks from the requirements of the Act under section 16. A minor change has been made to the wording of subsection 1.1(1).

Effluent Monitoring and Effluent Limits - Petroleum Sector (Environmental Protection Act): O. Reg. 537/93 is amended by 232/07. Minor amendments have been made to subsections 7(1), 11(2), 14(2), 20(2), 22(1), 23(1), 24(1) and (2).

Effluent Monitoring and Effluent Limits - Pulp and Paper Sector(Environmental Protection Act): O. Reg. 760/93 is amended by 233/07. Minor amendments have been made to subsections 7(1), 11(2), 14(7), 21(2), 23(1), 24(1), 25(1) and (2).

Effluent Monitoring and Effluent Limits - Metal Mining Sector (Environmental Protection Act): O. Reg. 560/94 is amended by 234/07. Minor amendments have been made to subsections 7(1), 11(2), 21(1), 24(4), 26(1), 27(1), 28(1) and (2).

Effluent Monitoring and Effluent Limits - Industrial Minerals Sector(Environmental Protection Act): O. Reg. 561/94 is amended by 235/07. Minor amendments have been made to subsections 7(1), 11(2), 21(1), 25(1), 26(1), 27(1) and (2).

Effluent Monitoring and Effluent Limits - Metal Casting Sector (Environmental Protection Act): O. Reg. 562/94 is amended by 236/07. Minor amendments have been made to subsections 7(1), 11(2), 21(2), 23(1), 24(1), 25(1) and (2). Paragraphs 1-3 of section 20(1) have been repealed and replaced, with minor changes.

Effluent Monitoring and Effluent Limits - Organic Chemical Manufacturing Sector (Environmental Protection Act): O. Reg. 63/95 is amended by 237/07. Minor amendments have been made to subsections 7(1), 11(2), 16(6), 24(3), 26(1), 27(1), 29(1), 31(1) and (2).

Effluent Monitoring and Effluent Limits - Inorganic Chemical Sector(Environmental Protection Act): O. Reg. 64/95 is amended by 238/07. Minor amendments have been made to subsections 7(1), 11(2), 16(6), 24(3), 26(1), 27(1), 29(1), 31(1) and (2).

Effluent Monitoring and Effluent Limits - Iron and Steel Manufacturing Sector(Environmental Protection Act): O. Reg. 214/95 is amended by 239/07. Minor amendments have been made to subsections 7(1), 11(2), 16(6), 24(3), 26(1), 27(1), 29(1), 30(1) and (2).

Effluent Monitoring and Effluent Limits - Electric Power Generation Sector(Environmental Protection Act): O. Reg. 215/95 is amended by 240/07. Minor amendments have been made to subsections 6(1), 10(2), 22(4), 24(1), 25(1), 29(1) and (2). Paragraphs 1 and 2 of section 27(1) and paragraphs 1-5 of subsection 30(2) have been repealed and replaced, with minor changes.

Electrical Safety Code (Electricity Act, 1988): O. Reg. 62/07 amends section 1 (document date updated).

General (Application of Act) (Environmental Bill of Rights, 1993): O. Reg. 73/94 is amended by 217/07. References have been amended to accurately reflect changes to the names of various ministries. References to the Ministry of Consumer and Business Services have been repealed. Subsections dealing with the Greenbelt Act, 2005 and the Oak Ridges Moraine Conservation Act, 2001 have been added to sections 3, 6 and 7.

Oil and Gas - Offshore (Occupational Health and Safety Act): Sections 1 and 2 of O. Reg. 566/06 are now in force. "Adequate" and "adequately" have been added to the definitions in section 1. Regulations dealing with noise exposure have repealed and replaced in section 41.

Ontario Drinking-Water Quality Standards (Safe Drinking Water Act, 2002): O. Reg. 242/07 replaces item 44 (Lead) in Schedule 2 (Chemical Standards).

Oil and Gas Conservation Regulations, 1985 (The Oil and Gas Conservation Act): Sask. Reg. 38/2007 amends R. R. Sask., c. 0-2, Reg. 1. Part IV.1 (Oil an Gas Orphan Fund) has been replaced. The broader term "facility" has been added to the terminology of wells. Part IV (Licencing) makes significant changes to the regulation of licencing and test drilling. Prohibitions on drilling under section 19 (Prohibited areas - drilling) have been amended. Amendments have been made, in sections 49-52, concerning the storage, maintenance, abandonment and reclamation of wells or facilities. Schedule 1 (Fees) has been repealed and replaced and Schedule 1.1 (Warning Symbols) has been added.
