Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to August 2007. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between July and August 2007. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of August 2007. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2007-3 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2007-3 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and citation.

Feeds Regulations, 1983 (Feeds Act): SOR/2006-147 amends the regulation in various sections to strengthen safeguards against Bovine Spongiform Encephalopathy (BSE). These final amendments come into force on July 12, 2007 and are found in the Canada Gazette, Part II, July 12, 2006, p. 871.

Interprovincial Movement of Hazardous Waste and Hazardous Recyclable Material Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for the Interprovincial Movement of Hazardous Waste Regulations are found in the Canada Gazette, Part I, September 2, 2006, p. 2515.

Marine Spark-Ignition Engine and Off-Road Recreational Vehicle Emission Regulations (Canadian Environmental Protection Act, 1999): Proposed regulations are found in the Canada Gazette, Part I, December 30, 2007, p. 4553.

Marine Transportation Security Regulations (Marine Transportation Security Act): Some sections of (final) SOR/2006-269 amendments are in force December 15, 2007; SOR/2006-270 final amendments are in force November 2, 2007. See Canada Gazette, Part II, Vol. 140, No. 23, 2006, p. 1729 & 1758.

Regulations Amending Certain Regulations Made under the Nuclear Safety and Control Act. Prohibition of Certain Toxic Substances Regulations, 2005 (Canadian Environmental Protection Act, 1999): Proposed amendments appear in the Canada Gazette, Part I, June 17, 2006, p. 1593.

Restricted Components Regulations (Explosives Act): Proposed regulations are found in the Canada Gazette, Part I, August 12, 2006, p. 2365.

Review Panel Regulations (Pest Control Products Act). Proposed regulations are found in the Canada Gazette, Part I, December 6, 2006, p. 4305.

Safety Management Regulations (Canada Shipping Act, 2001): Proposed amendments change the wording of the regulation in order to make it consistent with the provisions of the new Canada Shipping Act, 2001 when it comes into force in early 2007. See Canada Gazette, Part I, June 17, 2006, p. 1636.

Storage Tank Systems for Petroleum Products and Allied Petroleum Products Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for Registration of Storage Tank Systems for Petroleum Products and Allied Petroleum Products on Federal Lands (SOR/97-10) are found in the Canada Gazette, Part I, April 7, 2007, p. 829.

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act, 1992): Proposed amendments are found in the Canada Gazette, Part I, September 30, 2006, p. 3015. More proposed amendments are found in the Canada Gazette, Part I, February 10, 2007, p. 255.

Section 2.A Acts

Agricultural Land Commission Act: 2007, c. 9 (Bill 6), now proclaimed in force, replaces section 39 (definition of "board" in sections 40 to 45).

Environmental Assessment Act: 2007, c. 9 (Bill 6), now proclaimed in force, replaces subsection 14(4) (reference to new Public Inquiry Act).

Environmental Management Act: More sections of 2004, c. 18 are now proclaimed in force. Among other changes: section 39 is amended ("summary of site condition" added); subsection 42(1) is replaced; section 53 is amended (approvals); subsection 63(1) is amended (Minister's regulations - contaminated sites; site profiles & conditions); clause 120(17)(a) is replaced (site profiles). 2007, c. 24 (Bill 35) replaces clause 127(1)(e) (additional sentencing orders). 2007, c. 9 (Bill 6), now proclaimed in force, replaces subsection 93(11) (appeal board) and amends section 113 (inquiries).

Forest Act: As a consequential amendment of 2007, c. 29 (Bill 20), now proclaimed in force, a minor change is made in clause 48(1)(c).

Foresters Act: 2007, c. 9 (Bill 6), now proclaimed in force, replaces subsections 27(5) and 31(1) (protection from lawsuits).

Health Act: 2007, c. 9 (Bill 6), now proclaimed in force, amends section 15 and adds sections 15.1 (maintenance of order at hearings), 15.2 (contempt proceeding for uncooperative person), 15.3 (commission staff), and 15.4 (immunity protection).

Integrated Pest Management Act: 2007, c. 24 (Bill 35) replaces clause 31(1)(e) (additional sentencing orders).

Land Act: 2007, c. 24 (Bill 35), now proclaimed in force, adds Part 1.1 (Integrated Land and Resource Registry), sections 7.1 - 7.8 to the Act. 2007, c. 29 (Bill 20) makes a change to terminology regarding education in subsection 51(1) .

Mines Act: 2007, c. 9 (Bill 6), now proclaimed in force, replaces section 8 (power to compel persons to answer questions and order disclosure) and adds section 8.1 (contempt proceeding for uncooperative person).

Water Act: 2007, c. 24 (Bill 35) replaces clause 95(1)(e) (creative sentencing orders). 2007, c. 9 (Bill 6), now proclaimed in force, replaces section 89 (power to summon witnesses) and adds sections 89.1 (maintenance of order at hearings) and 89.2 (contempt proceedings for uncooperative person).

Wildlife Act: 2007, c. 24 (Bill 35) repeals Part 2. Section 84.1(1)(e)(ii) has been repealed and replaced. Part 3, with sections 118 - 125, has been added to the Act (Habitat Conservation Trust). These sections concern trust properties.

Section 2.B Regulations

Drinking Water Protection Regulation (Drinking Water Protection Act): B.C. Reg. 5/2007 in force August 2007, replaces section 7 (operating permits and fees) and adds sections 7.1 & 7.2 (decals affixed to permits), and 7.3 (temporary facilities). Also, Schedule C - Operating Permit Fees - is added.

Organic Matter Recycling Regulation (Environmental Management Act): B.C. Reg. 198/2007 adds "red-meat waste" to Schedule 12.

Recycling Regulation (Environmental Management Act): B.C. Reg. 297/2006, in force August 7, 2007, amends the definition of "producer" in section 1 (tire product category) and repeals sections 3.2 and 18.

Waste Discharge Regulation (Environmental Management Act): B.C. Reg. 198/2007 amends the regulation by adding definitions for "poultry" and "red-meat animals" in Schedule 2. Definitions for "poultry processing industry" and "slaughter industry" have been repealed and replaced. Subsection 1(2) in Schedule 2 has been added to the act. The table in Schedule 1 has replaced "Rendering Industry" with "Meat by-product Processing Industry". B.C. Reg. 246/2007 updates the table in Schedule 2 by adding references to the "Code of Practice for the Slaughter and Poultry Processing Industries".

Division 2 AMENDMENTS

Section 2.A Acts

Ambulance Act: 2006, c. 21, Sch. F (Bill 14), now proclaimed in force, changes the reference to an Act in subsections 4(2.2) & 6.7(4).

Building Code Act, 1992: 2006, c. 22 is now proclaimed in force. Definitions for "maintenance inspection" and "maintenance inspection program" have been added to the Act. Section 15.10.1 and subsections 34(2.1) and (2.2) have been added regarding maintenance inspection programs. 2006, c. 21, Sch. F (Bill 14), now proclaimed in force, amends several sections regarding ministerial approvals, plus changes to the name of an Act.

Conservation Authorities Act: 2006, c. 21, Sch. F (Bill 14), now proclaimed in force, adds subsection 30(3) (reference to an Act). As a consequential amendment of 2006, c. 22 (Bill 43) clause 13.1(6)(c) is added and subsection 16(2) is amended.

Consolidated Hearings Act: 2006, c. 21, Sch. F (Bill 14), now proclaimed in force, changes the reference to an Act in subsection 19(2). As a consequential amendment of 2006, c. 22 (Bill 43) the Clean Water Act, 2006 is added to the Schedule.

Crown Forest Sustainability Act, 1994: As a consequential amendment of 2006, c.12 (Bill 11) in force September 4, 2007, section 5 is amended (reference to new Act).

Environmental Assessment Act: 2006, c. 21, Sch. F (Bill 14), now proclaimed in force, changes the reference to an Act in subsection 3.2(2).

Environmental Bill of Rights: 2006, c. 21, Sch. F (Bill 14), now proclaimed in force, changes the definition of "regulation" in subsection 1(1) and amends clause 1(6)(c).

Forest Fires Prevention Act: 2006, c. 21, Sch. F (Bill 14), now proclaimed in force, changes the reference to an Act in subsections 23(2) & 37(2).

Fuel Tax Act: 2006, c. 21, Sch. F (Bill 14), now proclaimed in force, changes the reference to an Act in subsection 28.3(4).

Greenbelt Act, 2005: 2006, c. 21, Sch. F (Bill 14), now proclaimed in force, changes the reference to an Act in subsections 3(4) & 18(3).

Health Protection and Promotion Act: 2006, c. 21, Sch. F (Bill 14), now proclaimed in force, changes the reference of an Act in subsection 7(3). 2006, c. 26 (Bill 28), now proclaimed in force, repeals section 22.1 and subsections 97(b) -(f). Subsection 96(1)(a) is repealed and replaced. 2007, c. 10, Sch. F (Bill 171) adds references to the extended class of registered nurses to several sections. Part VI.1 (Provincial Public Health Powers) is added to the act. Sections 81.1 (Associate Chief Medical Officer of Health) has been added to provide for this new position. Section 81.2 has been amended to empower the Minister to enter into agreements with boards of health.

Highway Traffic Act: Parts of 2007, c. 13 (Bill 203) are in force which amend several sections, including: adding sections 1.1 (application of Act to places other than highways) and 4.1 (electronic formats); amending sections 41.1 & 41.2 (reinstatement of licences); replacing section 57 (regulations establishing conduct review programs); amending section 62 (lamps on vehicles); amending subsection 144(1) ("emergency vehicle"). 2006, c. 21, Sch. F (Bill 14), now proclaimed in force, changes the reference to an Act in subsections 119(3), 122(6) & 128(9).

Mining Act: 2006, c. 21, Sch. F (Bill 14) is now proclaimed in force. References to the Regulation Act have been replaced with the Legislation Act, 2006. 2007, c. 7, Sch. 22 (Bill 187) adds Part VIII to the Act. This part regulates the payment of royalties from diamond mines. Sections 139.2-139.5 have been added which deal with voluntary rehabilitation of mine lands. As a consequential amendment of 2006, c.12 (Bill 11) in force September 4, 2007, section 31 is replaced (mining activities prohibited in provincial parks).

Oak Ridges Moraine Conservation Act: 2006, c. 21, Sch. F (Bill 14), now proclaimed in force, amends section 9 and changes the reference to an Act in subsection 18(3).

Occupational Health and Safety Act: 2006, c. 21, Sch. F (Bill 14), now proclaimed in force, changes the reference to an Act in subsections 32.2(3) & 61(3.11).

Off-Road Vehicles Act: As a consequential amendment of 2006, c.12 (Bill 11) in force September 4, 2007, the definition of "conservation officer" in section 1 is amended.

Oil, Gas and Salt Resources Act: 2006, c. 21, Sch. F (Bill 14), now proclaimed in force, changes the reference to an Act in subsection 7.1(2).

Ontario Heritage Act: 2006, c. 21, Sch. F (Bill 14), now proclaimed in force, changes the reference to an Act in subsection 25.2(7).

Personal Health Information Protection Act, 2004: 2007, c. 10, Sch. H & K (Bill 171) amendments ensure consistency within the Act, and with other privacy legislation Sch. K references the Ontario Agency for Health Protection and Promotion in subsection 39(2).

Places to Grow Act, 2005: 2006, c. 21, Sch. F (Bill 14), now proclaimed in force, changes the reference to an Act in subsection 17(3).

Planning Act: As a consequential amendment of 2006, c. 22 (Bill 43), now proclaimed in force, paragraph 3.1 of subsection 34(1) is replaced (zoning bylaws of local municipalities regarding contaminated lands; sensitive or vulnerable areas).

Public Lands Act: 2006, c. 21, Sch. F (Bill 14), now proclaimed in force, changes the reference to an Act in subsection 51(2).

Public Hospitals Act: 2006, c. 21, Sch. F (Bill 14) Subsection 12(12) has been added to the act to reference the Legislation Act, 2006. Under 2007, c. 10, Sch. I (Bill 171) protection from liability has been extended to include directions from the Minister to hospital supervisors. Section 10 (Protection from personality liability) is repealed and replaced. The Crown is not protected from vicarious liability under subsection 10(2).

Safe Drinking Water Act, 2002: 2006, c. 21, Sch. F (Bill 14), now proclaimed in force, changes the reference to an Act in subsections 9(5), 15(7), 21(9), &157(3).

Smoke-Free Ontario Act: 2007, c. 10, Sch. J (Bill 171) amends the table in section 15.

Technical Standards and Safety Act, 2000: 2006, c. 21, Sch. F (Bill 14), now proclaimed in force, changes the reference to an Act in subsection 36(4).

Waste Diversion Act: 2006, c. 21, Sch. F (Bill 14), now proclaimed in force, changes the reference to an Act in subsection 30(9).

Section 2.B Regulations

Compressed Natural Gas (Technical Standards and Safety Act, 2000): O. Reg. 214/01 is amended by 257/07. The title of the regulation is changed to "Compressed Gas". References to natural gas are broadened to include a larger variety of gases by having "natural" struck from the descriptions. A more general definition of "gas" is added and the definition of "natural gas" is repealed and replaced. A definition of "hydrogen" has been added to section 1. "NGV" has been changed to "GV".

Food Premises (Health Protection and Promotion Act): O. Reg. 338/07, amends the regulation of food sold on the street. Section 5.1 (Street Food Vending Carts) is added to the regulation. Subsection 5(3) is repealed and definitions for "public space" and "street food vending car" have been added.

Fuel Industry Certificates (Technical Standards and Safety Act, 2000): O. Reg. 215/01 is amended by 256/07. References to natural gas are broadened to include a larger variety of gases by having "natural" struck from the descriptions. References to hydrogen fuel have been added to section 3. Section 52.1 has been added to the regulation.

General Regulation (Environmental Assessment Act): R.R.O., 1990, no. 334 is amended by 263/07. Several sections have been amended to reflect changes to the Environmental Assessment Act. The terminology of "Municipal Class Environmental Assessment" has been adopted. Subsections 2(1)(d), 6(1) and 5(3)(a) haves been repealed and replaced.

General - Waste Management (Environmental Protection Act): O. Reg. 280/07 adds "lubricating oil" to the definitions in section 1; designates "used lubricating oil" as waste in section 2; adds subsection 28.3 and new section 28.6 regarding waste-derived fuel sites. O. Reg. 292/07 replaces the definition of "corrosive waste" in section 1 and corrects a CAS number in Schedule 1 (in row K175).

Mine Development and Closure under Part VII of the Act (Mining Act): O. Reg. 304/07 amends the regulation to reference new Forms in sections 5, 6 and 10. Subsection 26(a.1) has been added to the regulation.
