Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to September 2007. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between August and September 2007. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of September 2007. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2007- Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2007-4 Issue of the Canadian enviroOSH Legislation CD-ROM series. Feeds Regulations, 1983 (Feeds Act): SOR/2006-147 amends the regulation in various sections to strengthen safeguards against Bovine Spongiform Encephalopathy (BSE). These final amendments come into force on July 12, 2007 and are found in the Canada Gazette, Part II, July 12, 2006, p. 871.

Interprovincial Movement of Hazardous Waste and Hazardous Recyclable Material Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for the Interprovincial Movement of Hazardous Waste Regulations are found in the Canada Gazette, Part I, September 2, 2006, p. 2515.

Marine Spark-Ignition Engine and Off-Road Recreational Vehicle Emission Regulations (Canadian Environmental Protection Act, 1999): Proposed regulations are found in the Canada Gazette, Part I, December 30, 2007, p. 4553.

Marine Transportation Security Regulations (Marine Transportation Security Act): Some sections of (final) SOR/2006-269 amendments are in force December 15, 2007; SOR/2006-270 final amendments are in force November 2, 2007. See Canada Gazette, Part II, Vol. 140, No. 23, 2006, p. 1729 & 1758.

Prohibition of Certain Toxic Substances Regulations, 2005 (Canadian Environmental Protection Act, 1999): Proposed amendments appear in the Canada Gazette, Part I, June 17, 2006, p. 1593.

Restricted Components Regulations (Explosives Act): Proposed regulations are found in the Canada Gazette, Part I, August 12, 2006, p. 2365.

Review Panel Regulations (Pest Control Products Act). Proposed regulations are found in the Canada Gazette, Part I, December 6, 2006, p. 4305.

Safety Management Regulations (Canada Shipping Act, 2001): Proposed amendments change the wording of the regulation in order to make it consistent with the provisions of the new Canada Shipping Act, 2001 when it comes into force in early 2007. See Canada Gazette, Part I, June 17, 2006, p. 1636.

Storage Tank Systems for Petroleum Products and Allied Petroleum Products Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for Registration of Storage Tank Systems for Petroleum Products and Allied Petroleum Products on Federal Lands (SOR/97-10) are found in the Canada Gazette, Part I, April 7, 2007, p. 829.

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act, 1992): Proposed amendments are found in the Canada Gazette, Part I, September 30, 2006, p. 3015. More proposed amendments are found in the Canada Gazette, Part I, February 10, 2007, p. 255.

Division 2 AMENDMENTS

Section 2.A Acts

Canada Labour Code, Part I: As a consequential amendment of 2007, c. 19 (Bill C-11), the definition of "private constable" in subsection 3(1) is replaced. French language version

Government Employees Compensation Act: As a consequential amendment of 2006, c. 9, now proclaimed in force, the definition of "employee" in section 2 is amended. French language version

Non-Smokers' Health Act: 2006, c. 6 (Bill C-2) Subsection 2(1)(c) has been repealed and replaced. French language version

Railway Safety Act: 2007, c. 19 (Bill C-11) adds Part IV.1 (Police Constables), sections 44 & 44.1 (protection of railway property).

Section 2.B Regulations

Metal Mining Effluent Regulations (Fisheries Act): SOR/2007-161 replaces subsection 39(2) in order to re-issue the transitional authorizations with a new expiry date of December 6, 2008 (mines in Newfoundland and Labrador and Saskatchewan).

Migratory Birds Regulations (Migratory Birds Convention Act, 1994): SOR/2007-139 updates the definition of non-toxic shot to include tungsten-iron-nickel-copper shot as an approved non-toxic shot alternative; makes minor adjustments to the existing definitions of tungsten-nickel-iron and tungsten-bronze-iron ensuring non-toxicity while allowing a greater variety of formulations. SOR/2007-140 establishes hunting season dates for 2007-2008; sets daily bag limits possession limits for migratory game birds; establishes special conservation measures for snow geese populations.

Motor Vehicle Restraint Systems and Booster Cushions Safety Regulations(Motor Vehicle Safety Act): SOR/98-159 is amended by SOR/2007-180. As a consequence of changes to the Motor Vehicle Safety Regulations and the addition of new standards, amendments have been made. A new definition ( "TSD209") has been added. Schedules 3 - 7 have been amended to reflect changes to the standards and safety regulations.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Eight technical standards documents (TSD) that reproduce the counterpart U.S. Federal Motor Vehicle Safety Standards are incorporated by reference in the Motor Vehicle Safety Regulations by SOR/2007-180. In addition, all the definitions that were contained in section 100 of Part I of Schedule IV have been moved to the Interpretation section, where most of the other definitions already reside, and section 100 has been repealed. The following TSDs are now incorporated by reference in their companion sections of the Regulations: TSD 106, Brake Hoses; TSD 116, Motor Vehicle Brake Fluids; TSD 118, Power-Operated Window, Partition, and Roof Panel Systems; TSD 123, Motorcycle Controls and Displays; TSD 124, Accelerator Control Systems; TSD 209, Seat Belt Assemblies; TSD 302, Flammability of Interior Materials; TSD 401, Interior Trunk Release. SOR/2005-342 amends subsection 120(12) by repealing and replacing subparagraph (a).

Port Authorities Operations Regulations (Canada Marine Act): 2007-171 amends SOR/2000-55. Section 31.1 is amended, requiring transportation and shipping vehicles or equipment that operate in the port to be licenced and in compliance with the stated minimum conditions. Conditions include rules on identification and monitoring of vehicles as well as payment for these services. These regulations promote efficient and safe transportation of goods through the ports.

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act, 1992): Amendments have been made to the standards CSA B620, CSA B621 and CSA B622. Subsection 1.3(2)(f) has been amended and section 5.14.1 has been added to reflect these changes. French language version

Motor Vehicle Act Regulations: B.C. Reg. 218/2007 replaces Division 36 - Child Seating and Restraint Systems. In force July 1, 2008. See B.C. Gazette, July 3, 2007, p. 305.

Division 2 AMENDMENTS

Section 2.A Acts

Forest Act: A section of 2007, c. 18 (Bill 18) now proclaimed in force, repeals clause 44(5)(a) and section 46.1 (timber processing facility).

Forest and Range Practices Act: The remainder of 2007, c. 18 (Bill 18) is now proclaimed in force. The definitions "forest practice" and "range practice" in subsection 1(1) are replaced, and subsection 46(1.1) is added (activity on Crown land that results in damage to the environment).

Protected Areas of British Columbia Act: Part of 2007, c. 27 (Bill 24) which amends Mount Robson Park in Schedule D in now proclaimed in force.

Section 2.B Regulations

Administrative Orders and Remedies Regulation (Forest and Range Practices Act): B.C. Reg. 101/2005 is amended by 269/2007. Technical amendments have been made to sections subsections 8(a) and (c), as well as 12(b).

Asphalt Plant Regulation (Environmental Management Act): B.C. Reg. 199/2007 amends the regulation to include hot mix asphalt plants in the Prince George Area. See sections 1, 11(2.2) & (2.3) and Schedule B.

Contaminated Sites Regulations (Environmental Management Act): B.C. Reg. 201/2007 & 239/2007 amendments allow approved professionals to take on greater responsibilities in managing contaminated sites. Among other changes: a new fee regime is established; provisions for summaries of site conditions are made (see new section 7.1); required information on the site registry is expanded; environmental quality standards are amended for chloride, uranium, trichloroethylene, and bromomethanes.

Forest Planning and Practices Regulation (Forest and Range Practices Act): B.C. Reg. 151/2007 amends subsections 46(1) & (3) (holder of a forestry licence to cut), and clause 51(1)(h) (reference to an Act).

Motor Vehicle Act Regulations: B.C. Reg. 219/2007 replaces Division 36 - Child Seating and Restraint Systems.

Private Managed Forest Land Council Matters Regulation (Private Managed Forest Land Act): B.C. Reg. 181/2007 adds new definitions to section 1, replaces subsection 2(1), and replaces section 5 (contraventions).

Stillwater Pilot Project Regulation (Forest Practices Code of British Columbia Act): B.C. Reg. 209/2007 amends the regulation in several places regarding forest stewardship plans described in subsection 3(1) of the Forest and Range Practices Act, and operations in the Stillwater area that are subject to a Stillwater pilot forest stewardship plan.

Water Regulation (Water Act): B.C. Reg. 235/2007 replaces subsections 44(2) & (3) (changes in and about a stream without obtaining a licence).

Woodlot Licence Planning and Practices Regulation (Forest and Range Practices Act): B.C. Reg. 21/2004 is amended by 268/2007. Small changes have been made to sections subsections 2(3) and 3(1).

Motor Vehicle Act: The part of 2007, c. 9 (Bill 158) which amends the Act is now proclaimed in force, amending the reinstatement fee in subsection 68(1).

Section 2.B Regulations

Activities Designation Regulations (Environment Act); N.S. Reg. 352/2007 clarifies which activities require an approval under Part V of the Act. See sections 5(1), 17 (injection to produce or enhance petroleum or natural gas recovery; deep well injection; liquified natural gas plants), and new section 28A (contaminated material generated from an industrial steel or coke production facility).

Weights and Dimensions of Vehicles Regulations (Motor Vehicle Act): N.S. Reg. 347/2007 extends the period for which certain weight tolerances are allowed and clarifies certain weight limitations. See especially Section C of Part 1 of Schedule A, a new note in Part 2 of Schedule A, and various items in Schedules B & C.

Section 2.B Regulations

Air Pollution - Local Air Quality (Environmental Protection Act): O. Reg. 516/07 amendments incorporate new or updated air standards for 14 toxic substances. The new or updated standards will be phased in to allow time for implementation. Other amendments in force immediately concern, among other things: approved dispersion models, discharge of sulphur compounds, notice of contaminants, preparation of technology reports for the Director.

Approval Exemptions (Ontario Water Resources Act): O. Reg. 396/07 adds section 3.2 (vegetated filter strip system that manages runoff).

Classification of Proposals for Instruments (Environmental Bill of Rights, 1993): O. Reg. 517/07 amends section 5 (Class II proposals - Environmental Protection Act) by adding item 13.1.1 in subsection (2).

Drinking-Water Systems (Safe Drinking Water Act, 2002): O. Reg. 399/07 adds Schedule 15.1 (lead sampling for large municipal residential systems, small municipal residential systems, and non-municipal year-round residential systems) and Schedule 15.2 (lead samples for large municipal non-residential systems, small municipal non-residential systems, non-municipal seasonal residential systems, large non-municipal non-residential systems, and small non- municipal non-residential systems) and makes commensurate amendments to the regulation.

Drinking-Water Testing Services (Safe Drinking Water Act, 2002): O. Reg. 401/07 replaces section 3.1 (supervised chlorine residual, turbidity and pH checks); amends paragraph 3 of section 6; amends sections 12 (test reports) and 13 (testing records).

Fuel Oil Code Adoption Document (Technical Standards and Safety Act, 2000): Amendments effective March 1, 2007 now adopt the Ontario Installation Code for Oil-Burning Equipment (Based on CSA B139, with Ontario Amendments), First Edition/2006.

Gaseous Fuels Code Adoption Document (Technical Standards and Safety Act, 2000): The April 16, 2007 amendments, effective August 1, 2007, amend the code adoption document in several areas. The amendments reflect the adoption of the 2007 supplement to Canadian Standards Association (CSA) standard B149.1-05 Natural Gas and Propane Installation Code.

General (Nutrient Management Act, 2002): O. Reg. 267/03 is amended by 394/07. These amendments encourage the implementation of on-farm mixed anaerobic digestion as a nutrient management strategy. As well, vegetative filter strips are being encouraged as a means of treating runoff. Farms using this method according to the standard set out in this regulation will be exempt from approval requirements of the Ontario Water Resources Act.

General - Waste Management (Environmental Protection Act): O. Reg. 395/07 amends the regulation in relation to anaerobic digestion materials and facilities. See especially the definitions in section 1 and sections 3 and 8(3.1) & (3.2). Sections of 461/05 are in force August 31, 2007 which add the following sections: 75 - 77, 79 - 83(land disposal of hazardous waste), 84 (generator of waste to provide information), 85 (development of written plan re chemical and physical testing of representative waste samples).

Hospital Management (Public Hospitals Act): O. Reg. 491/07 eliminates the reference to the "Medical Review Committee" in subsection 20(8).

Hours of Service (Highway Traffic Act): O. Reg. 417/07 replaces section 1 (issuing of land use permits).

Liquid Fuels Handling Code Adoption Document (Technical Standards and Safety Act, 2000): June 1, 2007 amendments adopt the Liquid Fuels Handling Code 2007.

Propane Code Adoption Document (Technical Standards and Safety Act, 2000): June 12, 2007 amendments replace all the sections of the adoption document in order to incorporate the 2007 supplements to the national codes.

Schools, Private Schools and Day Nurseries (Safe Drinking Water Act, 2002): O. Reg. 400/07 amends sections 3 (weekly flushing requirement), 4 (daily flushing requirement), 5 (testing for lead), and 6 (reporting of test results).

Water Taking and Transfer (Ontario Water Resources Act): O. Reg. 451/07 changes the name of the regulation to : "Water Taking". Also, sections 1 and 10 are repealed and new section 4.1 is added (prescribed water takings).
