Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to October 2007. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between September and October 2007. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of October 2007. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2007-4 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2007-4 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Subsections 115(2.2) to (2.4) of Schedule IV as enacted by SOR/2004-250 (vehicle identification number in bar code format) come into force September 1, 2008. Division 2 AMENDMENTS

Section 2.A Acts

Hazardous Products Act: SOR/2007-205 replaces references to the test method D 1230-61 with the Canadian General Standards Board (CGSB) standard, CAN/CGSB 4.2 NO. 27.5-94, Textile Test Methods - Flame Resistance - 45° - Angle Test - One Second Flame Impingement. See items 4, 5, and 13 of Schedule I to the Act.

Canadian Nuclear Safety Commission Rules of Procedure Regulations(Nuclear Safety and Control Act): SOR/2007-208 amendments address comments and recommendations received from the Standing Joint Committee for the Scrutiny of Regulations with respect to Regulations and Rules of Procedure made in 2000 under the Nuclear Safety and Control Act. The modifications are intended to ensure conformity between the English and French versions of the Regulations, to correct wording in order to ensure consistency throughout the Regulations and to clarify certain sections. See sections 9(1), 12(1), 13(5), 21(3), 34(3)(b), 41(1).

Class I Nuclear Facilities Regulations (Nuclear Safety and Control Act): SOR/2007-208 amendments address comments and recommendations received from the Standing Joint Committee for the Scrutiny of Regulations with respect to Regulations and Rules of Procedure made in 2000 under the Nuclear Safety and Control Act. The modifications are intended to ensure conformity between the English and French versions of the Regulations, to correct wording in order to ensure consistency throughout the Regulations and to clarify certain sections. See sections 6(k) and 7(i).

General Nuclear Safety and Control Regulations (Nuclear Safety and Control Act): SOR/2007-208 amendments address comments and recommendations received from the Standing Joint Committee for the Scrutiny of Regulations with respect to Regulations and Rules of Procedure made in 2000 under the Nuclear Safety and Control Act. The modifications are intended to ensure conformity between the English and French versions of the Regulations, to correct wording in order to ensure consistency throughout the Regulations and to clarify certain sections. See sections 8(2)(b), 12(1)(c), 17(c)(ii) & (e), 21(1)(a).

Règlement général sur la sûreté et la réglementation nucléaires

Nuclear Non-Proliferation Import and Export Control Regulations (Nuclear Safety and Control Act): SOR/2007-208 makes a minor change in paragraph B.2.6.1 of the Schedule.

Radiation Protection Regulations (Nuclear Safety and Control Act): SOR/2007-208 amendments address comments and recommendations received from the Standing Joint Committee for the Scrutiny of Regulations with respect to Regulations and Rules of Procedure made in 2000 under the Nuclear Safety and Control Act. The modifications are intended to ensure conformity between the English and French versions of the Regulations, to correct wording in order to ensure consistency throughout the Regulations and to clarify certain sections. See replacement sections 3 and 21 and amended sections 2(2), 10, 22(a)(i) & (ii).

Uranium Mines and Mills Regulations (Nuclear Safety and Control Act): SOR/2007-208 repeals the definition of "effective dose" in section 1.

Calgary Restricted Development Area Regulations (Government Organization Act): Alta. Reg. 182/2007 amends Schedule A.

Gas Code Regulations (Safety Codes Act): Alta Reg. 113/2005 is amended by 178/2007. Subsection 2(2) is added to the act and deals with conflicts between the codes and supplements declared in force. References to Alberta Building Code 1997 are updated to reference Alberta Building Code 2006. Sections 4.1 (Natural Gas and Propane Installation Code Supplement), 7.1 (Propane Storage and Handling Code Supplement), 8.1 (Fuel Systems Code Supplement) are added to the regulation.

Mines and Mining Plants (Occupational Health and Safety Act): Amending R.R.O. 1990, Reg. 854, sections 1 and 3-17 of O. Reg. 84/07 are now in force. Amendments to this regulation reflect changes to federal standards and implement new procedures concerning mine safety. Section 71, concerning the use of overhead protective devices, is repealed and replaced. Braking systems, sections 119 and 119.1 are replaced and 119.2 added. New requirements concerning the storage of explosives have been have reflected in subsections 123(2)(a), 125(3), 125(5), 126(1), 129(1) and (2). Amendments to section 135 and the addition of section 135.0.1 concern the transportation of explosives within the context of this regulation. Amendments to sections 187 and 197 reflect changes to federal elevator safety standards. Section 256 has been repealed and replaced.

General Regulation (Environmental Assessment Act): O. Reg. 536/07 adds section 15.2 (non-application of subsections of Act).

Highway Safety Code (R.S.Q., c. C-24.2): O.C. 336-2007 brings into force more sections of 2004, c. 2. Section 517.2 is replaced (penalties for incorrect information regarding vehicle overloads) while section 517.1 inserts a reference to this section.

Construction Code (Building Code) (Building Act): O.C. 577-2007 amends Chapter V - Electricity - to cite the Twentieth Edition of the Canadian Electrical Code, CSA Standard C22.1- 06. Amendments to section 5.04 specify the amendments to the 2006 Code.

Regulation respecting environmental impact assessment and review(Environment Quality Act): As a consequential amendment of O.C. 808-2007 the reference to the Regulation respecting pulp and paper mills is changed in paragraph 2(n.1).

Section 2.B Regulations

Occupational Health and Safety Regulations (Occupational Health and Safety Act): The part of Sask. Reg. 91/2007 in force makes a small adjustment to clause 101(1)(f). New section 469.1 (additional requirements re supervisors in health care facilities: an employer must appoint competent persons to supervise the place of employment in regard to the matters outlined) is in force November 21, 2007.

Hospital Standards Regulations, 1980 (Hospital Standards Act): Sask reg. 331/79 is amended by 86/2007. Some parts of this amendment are to come into force at a later time. Much of this amendment deals with changes in terminology and the addition of nurse practitioners to the range of health care professionals specified in these regulations. Several new definitions have been added to section 1. Sections 16(1),(2)(a), (c),(d), (e),(g),(h), (j), (k),(l), (m), 19, 20, 26, 27, 51, 60, 61, 62, 64, 84, and 98 are repealed. Section 54 (Ophthalmia neonatorum) has been repealed and replaced.

Saskatchewan Watershed Authority Regulations (Saskatchewan Watershed Authority Act): 76/2007 repeals and replaces Table 2 (Industrial Water Use Charges) and its accompanying footnotes.
