Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to November 2007. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between October and November 2007. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of November 2007. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2008-1 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2008-1 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Subsections 115(2.2) to (2.4) of Schedule IV as enacted by SOR/2004-250 (vehicle identification number in bar code format) come into force September 1, 2008. Domestic Substances List (Canadian Environmental Protection Act, 1999): SOR/2007-156 adds 14 substances to Part 1, one substance to Part 2, and 10 substances to Part 3 of the DSL. SOR/2007-191 adds 14 substances to Part 1 and 17 substances to Part 3. SOR/2007-221 adds 21 substances to Part 1 and 18 substances to Part 3 of the DSL.

Marine Transportation Security Regulations (Marine Transportation Security Act): The International Maritime Organization adopted the International Ship and Port Facility Security Code (ISPS Code) and amendments to the International Convention for the Safety of Life at Sea, 1974. Canada, an IMO Contracting Government, implemented these documents through the Marine Transportation Security Regulations. SOR/2006-270 amendments in force in November 2007 add substantive new Parts 6 and 7 to the Regulations. Part 6 implements an administrative monetary penalty (AMP) enforcement scheme and Part 7 implements the notice and service requirements applicable to that enforcement scheme. Schedules 2 and 3 outline the provisions of the Act and regulations whose contravention is designated a violation.

Certification and Permit Regulation (Safety Codes Act): Alta. Reg. 206/2007 extends the expiry date of the regulation to 2009. It also repeals Parts 1 & 2 effective April 1, 2008.

Motor Vehicle Act (R.S.N.B. 1973, c. M-17): Sections and subsections 1(a), 1(b)(ii), 1(c), 2, 4(b), 8-12, 15(a) and 22(b), of 2007, c. 44 are now in force. These sections add "construction zone" and amends the definitions for "peace officer" and school zone". Several sections have been amended to reflect the addition of sections 141.1 and 142.01. Section 140.1 concerns the regulation of school zones. Section 142.01 concerns the regulation of construction zones.

Section 2.A Acts

The Occupational Health and Safety Act: 2007, c. 34 (Bill 66) is now proclaimed in force. Provisions of the Act regarding "harassment" are amended or added to. See especially new sections 48.1 and 56.1 concerning appeals of decisions by occupational health officers to special adjudicators respecting matters involving harassment.

Section 2.B Regulations

Occupational Health and Safety Regulations (Occupational Health and Safety Act): The part of Sask. Reg. 91/2007 in force makes a small adjustment to clause 101(1)(f). New section 469.1 (additional requirements re supervisors in health care facilities: an employer must appoint competent persons to supervise the place of employment in regard to the matters outlined) is in force November 21, 2007.

Hospital Standards Regulations, 1980 (Hospital Standards Act): Sask reg. 331/79 is amended by 86/2007. Some parts of this amendment are to come into force at a later time. Much of this amendment deals with changes in terminology and the addition of nurse practitioners to the range of health care professionals specified in these regulations. Several new definitions have been added to section 1. Sections 16(1),(2)(a), (c),(d), (e),(g),(h), (j), (k),(l), (m), 19, 20, 26, 27, 51, 60, 61, 62, 64, 84, and 98 are repealed. Section 54 (Ophthalmia neonatorum) has been repealed and replaced.

Saskatchewan Watershed Authority Regulations (Saskatchewan Watershed Authority Act): 76/2007 repeals and replaces Table 2 (Industrial Water Use Charges) and its accompanying footnotes.
