Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to December 2007. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between November and December 2007. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of December 2007. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2008-1 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2008-1 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and citation.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Subsections 115(2.2) to (2.4) of Schedule IV as enacted by SOR/2004-250 (vehicle identification number in bar code format) come into force September 1, 2008. Storage Tank Systems for Petroleum Products and Allied Petroleum Products Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for Registration of Storage Tank Systems for Petroleum Products and Allied Petroleum Products on Federal Lands (SOR/97-10) are found in the Canada Gazette, Part I, April 7, 2007, p. 829.

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act, 1992): Proposed amendments are found in the Canada Gazette, Part I, September 30, 2006, p. 3015. More proposed amendments are found in the Canada Gazette, Part I, February 10, 2007, p. 255.

Division 2 AMENDMENTS

Section 2.A Acts

Hazardous Products Act: SOR/2007-259 consolidates the five separate Schedule I items under the Act concerning asbestos and asbestos products into one regulation (see item 44 of Part II).

Section 2.B Regulations

Inclusion List Regulations (Canadian Environmental Assessment Act): SOR/2007-263 makes technical adjustments and minor corrections to the Schedule.

Règlement sur la liste d'inclusion

Law List Regulations (Canadian Environmental Assessment Act): SOR/2007-263 corrects a numbering problem in Part I of Schedule I.

Règlement sur les dispositions législatives et réglementaires désignées

Marine Transportation Security Regulations (Marine Transportation Security Act): Most of the remainder of the SOR/2006-269 amendments are in force December 15, 2007. Replacement sections include 383 to 385 concerning restricted area passes or keys and added sections 501 to 504 regarding security clearance. Schedule 1 is added (Part 1 - Marine Facilities, Part 2 - Phase 1 Ports, Part 3 - Phase 2 Ports) with information regarding which parts are to come into force December 15, 2008.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): SOR/2007-246 amendments harmonize the requirements of the Canadian safety standard for theft protection and rollaway prevention with those of the United States. The amendment is required as the United States has published Federal Motor Vehicle Safety Standard 114, which specifies vehicle performance requirements, intended to reduce the incidence of crashes resulting from theft and accidental rollaway of motor vehicles. See sections 102 and 114 of Schedule IV.

Non-smokers' Health Regulations (Non-smokers' Health Act): SOR/2007-233 repeals sections 3, 14 and 15 which had permitted the designation of smoking rooms and smoking areas. Section 4 is amended in correlation to the repeal of section 3. See also the transitional provisions at the end of the sectioned portion of the regulation regarding workplaces where smoking rooms are designated in accordance with the terms of a collective or contractual agreement.

Surface Coating Materials Regulations (Hazardous Products Act): SOR/2007-230 redefines "display panel" in section 1 and adds subsections (2) & (3) (calculation of display panel area).

Règlement sur les revêtements

Pest Control Products Sales and Information Reporting Regulations (Pest Control Products Act): DORS/2007-235 amends the French language version of sections 3(b) and (f). The French version of section 8 has been repealed and replaced. No amendments have been made to the English version.

Fire Safety Act: The part of 2007, c. 10 which adds section 14A is now proclaimed in force. This section concerns the awarding of medals for long service.

Board Public Passenger Motor Carrier Act Regulations (Motor Carrier Act): N.S. Reg. 413/2007 amends the regulation in several places, including: amending section 19 (Canadian Standards Association (CSA) standards cited); amending section 20 (public passenger vehicles to be equipped with fire extinguishers, first aid kits, emergency equipment); adding section 24A (inspection and testing by an inspector); replacing subsections 25(1) & (2) (seating capacity); replacing section 32 (exemptions applicable to school buses); amending subsection 42C(1) (commercial vehicle requirements); repealing Forms A to L.

Renewable Energy Standard Regulations (Electricity Act): N.S. Reg. 416/2007 adds subsection 14(2) (provision for due diligence).

Vehicle Warning Lights Regulations (Motor Vehicle Act): N.S. Reg. 412/2007 adds section 6 to define "exhibiting flashing red lights" and "exhibits flashing amber lights" for the Act, and section 7 to prescribe what types of lights may be displayed by an inspector.

Control of Exposure to Biological or Chemical Agents (Occupational Health and Safety Act): The remainder of O. Reg. 607/05 is in force December 31, 2007. Changes to Part 4 of the Schedule affect formaldehyde and styrene. The time-weighted average exposure value (TWAEV) for formaldehyde is deleted; the short-term exposure value (STEV) is changed to 1.0 parts per million (ppm); and the ceiling exposure value (CEV) is now 1.5 ppm. The TWAEV for styrene is reduced to 35 ppm from 50 ppm.

Section 2.A Acts

The Occupational Health and Safety Act: 2007, c. 34 (Bill 66) is now proclaimed in force. Provisions of the Act regarding "harassment" are amended or added to. See especially new sections 48.1 and 56.1 concerning appeals of decisions by occupational health officers to special adjudicators respecting matters involving harassment.

Section 2.B Regulations

Occupational Health and Safety Regulations (Occupational Health and Safety Act): The part of Sask. Reg. 91/2007 in force makes a small adjustment to clause 101(1)(f). New section 469.1 (additional requirements re supervisors in health care facilities: an employer must appoint competent persons to supervise the place of employment in regard to the matters outlined) is in force November 21, 2007.

Hospital Standards Regulations, 1980 (Hospital Standards Act): Sask reg. 331/79 is amended by 86/2007. Some parts of this amendment are to come into force at a later time. Much of this amendment deals with changes in terminology and the addition of nurse practitioners to the range of health care professionals specified in these regulations. Several new definitions have been added to section 1. Sections 16(1),(2)(a), (c),(d), (e),(g),(h), (j), (k),(l), (m), 19, 20, 26, 27, 51, 60, 61, 62, 64, 84, and 98 are repealed. Section 54 (Ophthalmia neonatorum) has been repealed and replaced.

Saskatchewan Watershed Authority Regulations (Saskatchewan Watershed Authority Act): 76/2007 repeals and replaces Table 2 (Industrial Water Use Charges) and its accompanying footnotes.
