Introduction
The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to January 2008. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

1A. Acts
Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.
Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).
Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.
1B. Regulations
List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.
2. Amendments
Contains information about amendments which have come into force between December 2007 and January 2008. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.
3. Repealed Legislation
Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of January 2008. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).
4. New documents for the 2008-1 Issue of the Canadian enviroOSH Legislation DVD
Documents that will be on the 2008-1 Issue of the Canadian enviroOSH Legislation DVD series. Division 2 AMENDMENTS
Section 2.A Acts
Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation Act: As a consequential amendment of 2007, c. 33 (Bill C-15) the definition of "gas" in section 2 is replaced.
National Energy Board Act: As a consequential amendment of 2007, c. 35 (Bill C-28) section 18 is replaced (general or particular orders) as well as paragraph 25(b) (proof of documents).
Species at Risk Act: SOR/2007-284 adds 36 species to Schedule 1, the List of Wildlife Species at Risk, and reclassifies one listed terrestrial species, pursuant to Section 27 of the Act.
Section 2.B Regulations
Canada Occupational Health and Safety Regulations (Canada Labour Code, Part II): SOR.2007- 271 amends the regulation to address ergonomics-related hazards in the workplace. Sections 19.1 - 19.7 have been amended. These amendments include the requirement to establish and implement ergonomics programs. The employer must assess and address the ergonomic needs of workers.
Règlement canadien sur la santé et la sécurité au travail
Marine Transportation Security Regulations (Marine Transportation Security Act): SOR/2007-275 amendments implement changes made to the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers (STCW), 1978, as well as minor miscellaneous amendments. See especially replacement section 211 (qualifications of vessel security officer); new Part 8 - Certification of Security Officers; new Schedule 0.1 - Training Institutions.
Motor Vehicle Restraint Systems and Booster Cushions Safety Regulations(Motor Vehicle Safety Act): SOR/2007-268 replaces paragraph 9(f) of Schedule 6 regarding restraint systems for disabled persons.
Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): SOR/2007-307 adds subsection 4.1 to section 12 (Importation of a Vehicle Purchased in the United States) to clarify the vehicle theft immobilization requirements for importation of vehicles into Canada that are sold at the retail level in the United States.

Division 2 AMENDMENTS
Section 2.A Acts
Smoke-Free Places Act (2005, c. S-9.5): Following the amendments of 2007, c. 40 (Bill 45) now proclaimed in force, this act is now the Tobacco Reduction Act under chapter T-3.8. These amendments are intended to provide further restrictions on the sale, display and use of tobacco products in the province of Alberta. Section (1)(a) is renumbered as a.1 and a new subsection (a) provides added definitions, along with subsection 1(e.1), (e.2), (h.1) and (j). Sections 3 and 9 are repealed and replaced. Subsections 5(3) and (4) are repealed. New sections 7.1 and 7.2 will come into force on July 1, 2008, while section 7.3 will come into force January 1, 2009.
Traffic Safety Act: Parts of 2007, c. 45 (Bill 49) which are in force repeal section 28 (board decision is final), amend section 39, and replace Division 4 of Part 2 with new section 47.1 (judicial review).
Section 2.B Regulations
Calgary Restricted Development Area Regulations (Government Organization Act): Alta. Reg. 226/08 amends sections 25, 26, 35 and 36, of Schedule A.
Coal Conservation Regulation (Coal Conservation Act): Alta. Reg. 254/2007 amends section 45(4) (reference to name change).
Edmonton Restricted Development Area Regulations (Government Organization Act): Alta. Reg. 226/08 amends the Schedule of 287/74. Sections 16 and 17, of item 5, are amended. In item 6, section 30 is amended. Sections 29 and 30, of item 9, are amended. Sections 25 and 26, of item 10, are amended.
Environmental Assessment Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 254/2007 amends section 2(1)(n) (reference to name change).
Forest and Prairie Protection Regulations, Part I (Forest and Prairie Protection Act): Alta. Reg. 254/2007 amends section 23(b) (reference to Act change).
Oil and Gas Conservation Regulations (Oil and Gas Conservation Act): Alta. Reg. 254/2007 amends section 17 (reference to name change).
Orphan Fund Delegated Administration Regulation (Oil and Gas Conservation Act): Alta. Reg. 254/2007 amends section 1(c) (reference to name change).
Specified Gas Emitters Regulation (Climate Change and Emissions Management Act): Alta. Reg. 254/2007 amends section 1(1)(q)(ii) (reference to name change).

Motor Vehicle Act Regulations: B.C. Reg. 218/2007 replaces Division 36 - Child Seating and Restraint Systems. In force July 1, 2008. See B.C. Gazette, July 3, 2007, p. 305.
Division 2 AMENDMENTS
Section 2.A Acts
Agricultural Land Commission Act: That part of 2007, c. 14 (Bill 33) which amends subsection 55(5) is now proclaimed in force (reference to section of Administrative Tribunals Act).
Attorney General Statutes Amendment Act, 2007: 2007, c. 14 (Bill 33) amends various Acts to remove unnecessary references to "regulations", "bylaws", "standards", that appear after a reference to a matter "under" an Act; for consistency, removes references to "by or" that precede "under"; changes "statute" to "Act". The following Acts are affected:
Commercial Transport Act (R.S.B.C. 1996, c. 58): The Greater Vancouver Transportation Authority is now the South Coast British Columbia Transportation Authority, as amended by 2007, c. 41 (Bill 43), now proclaimed in force.
Environmental Management Act: B.C. Reg. 389/2007 makes a correction to subsection 106(4).
Forest Act: B.C. Reg. 389/2007 makes corrections to sections 10, 45, and 103.1.
Forest and Range Practices Act: That part of 2007, c. 14 (Bill 33) which amends subsection 136(5) is now proclaimed in force (reference to section of Administrative Tribunals Act). B.C. Reg. 389/2007 makes corrections to sections 149.1, 150, 150.1, 150.3, and 191.
Land Act: The Greater Vancouver Transportation Authority is now the South Coast British Columbia Transportation Authority, as amended by 2007, c. 41 (Bill 43), now proclaimed in force.
Motor Vehicle Act: That part of 2007, c. 24 (Bill 35) which amends section 86 is now proclaimed in force (responsibility of owner of vehicle in certain cases). The Greater Vancouver Transportation Authority is now the South Coast British Columbia Transportation Authority, as amended by 2007, c. 41 (Bill 43), now proclaimed in force. Under 2007, c. 28 (Bill 16), subsections 210(2)(u) and (2.3) have been added to the Act. Minor amendments have been made to subsection 28(11) , under B.C. Reg. 390/2007.
Passenger Transportation Act: That part of 2007, c. 14 (Bill 33) which amends subsection 6(3) is now proclaimed in force (reference to section of Administrative Tribunals Act).
Petroleum and Natural Gas Act: That part of 2007, c. 14 (Bill 33) which amends subsection 13(6) is now proclaimed in force (reference to section of Administrative Tribunals Act).
Protected Areas of British Columbia: B.C. Reg. 389/2007 makes a correction to Schedule D.
Safety Standards Act: That part of 2007, c. 14 (Bill 33) which amends section 44 is now proclaimed in force (reference to section of Administrative Tribunals Act).
Transportation Act (S.B.C. 2004, c. 44) The Greater Vancouver Transportation Authority is now the South Coast British Columbia Transportation Authority, as amended by 2007, c. 41 (Bill 43), now proclaimed in force.
Utilities Commission Act: That part of 2007, c. 14 (Bill 33) which amends subsection 2(4) is now proclaimed in force (reference to section of Administrative Tribunals Act).
Wildlife Act: B.C. Reg. 389/2007 makes a correction to clause 36(2)(c).
Workers' Compensation Act: That part of 2007, c. 14 (Bill 33) which replaces subsection 232(10) (Appeal Tribunal) and which amends section 245.1 is now proclaimed in force (reference to section of Administrative Tribunals Act).
Section 2.B Regulations
Motor Vehicle Act Regulations (Motor Vehicle Act): B.C. Reg. 26/58 is amended by 381/2007. Division 30A (Driver's Licences - Foreign Representatives) has been added to the act. B.C. Reg. 382/2007 has added section 37.11.01 to the act (exemption for commercial motor vehicles of a certain weight).
Municipal Sewage Regulation (Environmental Management Act): B.C. Reg. 305/2007 replaces section 3 (registration under section 2 for an exemption) and makes other technical amendments, including ones to the schedules.
Occupational Health and Safety Regulation Parts 1-7; Parts 8-19; Parts 20-32 (Workers' Compensation Act): B.C. Reg. 318/2007 amendments concern workers working alone. The new requirements include new safety procedures and requirements for all workers working alone or in isolation; new requirements for written safety procedures for late-night workers; mandatory prepayment of fuel. See sections 4.20.1, 4.20.2, 4.21(1), 4.22, 4.22.1, 4.22.2, and 4.23. B.C. Reg. 319/2007 re-titles part 5 as "Chemical Substances and Biological Agents" and amends various sections, including adding section 5.1.1 (designation as hazardous substances). Part 6 amendments relating to biohazardous materials clarify that the scope/application of the part covers all infectious agents and that protective measures need to be implemented for any pathogenic infectious agent capable of causing mortality among workers. See especially sections 6.33, 6.34, 6.37, 6.39 & 6.40. Part 30 amendments require laboratory fume hoods to be compliant with current design technologies and standards covering their safe operation. See especially sections 30.7.1, 30.8, 30.9, 30.10. B.C. Reg. 320/2007 amends sections 3.1, 3.16, 3.20; adds section 3.17.1 (transporting injured worker by air); adds Schedule 3-A (minimum levels of first aid based on the time it would take to transport an injured person to hospital). Part 9 amendments strengthen requirements for isolation and de-pressurizing of harmful substances in a confined space, especially confined spaces that are part of the public water system (see section 9.18.1). Part 11 revisions concern re-useable fall arrest systems in the entertainment industry (see section 11.10). Part 13 amendments relate to work platforms and fall protection (see sections 13.24, 13.30, 13.33). Extensive amendments to Part 14 ensure that requirements are consistent with current equipment safety standards and recognized industry safe working practices. Criteria for multi-crane and critical lifts have been revised; requirements for self-erect tower cranes are added; standards are adopted for the installation and use of material hoists and chimney hoists. In addition, these amendments affect sections in Part 16 relating to cranes and hoists.
Pipeline Regulation (Pipeline Act): B.C. Reg. 405/2007 updates two Canadian Standards Association (CSA) Standards to 2007 editions, Z276 - Liquefied Natural Gas (LNG) - Production, Storage, and Handling, and Z662 - Oil and Gas Pipeline Systems.
Sewerage System Regulation (Health Act): B.C. Reg. 371/2007 amends subsection 9(3) (letter of certification). B.C. Reg. 372/2007 adds subsection 3(3) (domestic sewage discharge).
Water Regulation (Water Act): B.C. Reg. 390/2007 amends item 11.1(b) in Schedule A, Part 3 (general power use).

The Pesticides and Fertilizers Control Act: The remainder of 2002, c. 31 is in force January 1, 2008 which amends section 2 (commercial and off-farm manure applicators to obtain licence).
Loi sur les produits antiparasitaires et les engrais chimiques
The Planning Act: 2007, c. 22 (Bill 20) amends the Act so that two or more existing or proposed livestock operations will be treated as a single operation if they have the same owner or related owners and are located within 800 metres of each other. See new section 1.1 and clause 193(1)(b.1).
The Workers' Compensation Act: According to Man. Reg. 160/2007 (Adjustment in Compensation), increases to certain benefits and rates of compensation have been increased for subsections 28(2), 29(1)(a)(i), (b) - (e), 31(1) - (2) and 38(2)(a)-(b).

Conservation Agreement Board Procedure Regulation (The Conservation Agreements Act): Man. Reg. 154/2007 has amended section 2, updating the address information concerning applications under sections 7(4) and 9(4).
Conservation Agreement Forms Regulation (The Conservation Agreements Act): Man. Reg. 155/2007 has amended Schedule B, updating the address information concerning notice of applications.
Planning Districts Regulation (The Planning Act): Man. Reg. 153/2007 has amended section 37, of regulation 249/2006, to include Rapid City.

Division 2 AMENDMENTS
Section 2.A Acts
Environmental Protection Act: 2007, c. 4, in force January 17, 2008, amends subsections 118(1) & 168(1) (reference to Regulatory Modernization Act, 2007).
Health Protection and Promotion Act: Parts of 2007, c. 10, Sch. F now in force add section 29.1 (communicable disease acquired at facility), 29.2 (orders to deal with communicable disease outbreaks), and subsections 102(2) & (2.1) (prohibition of continuation of contravention).
Nutrient Management Act: 2007, c. 4, in force January 17, 2008, amends subsection 28(1) (reference to Regulatory Modernization Act, 2007).
Oil, Gas and Salt Resources Act: 2007, c. 4, in force January 17, 2008, replaces subsection 5(1) (confidential information).
Public Vehicles Act: 2007, c. 4, in force January 17, 2008, amends section 30 (reference to Regulatory Modernization Act, 2007).
Technical Standards and Safety Act: 2007, c. 4, in force January 17, 2008, replaces subsection 24(1) (confidential information).
Waste Diversion Act: 2007, c. 4, in force January 17, 2008, amends subsection 40(1) (reference to Regulatory Modernization Act, 2007).
Section 2.B Regulations
Wells Regulation (Ontario Water Resources): O. Reg. 372/07 amends R.R.O. 1990, no. 903 by repealing sections and subsections 11, 11.1, 13(15) and 17-19. These amendments were enacted to address the recommendations of the Environmental Commissioner of Ontario and the Advisory Council on Drinking Water Quality and Testing Standards. Several new definitions have been added to section 1 while definitions for annual space, bedrock, casing, sealant and well owner have been amended. The content has been replaced or added in sections 14 through 16.5 and sections 20 - 21.1. A new class of licence has been created for the installation of monitoring and sampling of wells. Disinfection procedures have been updated. These and other changes have been made to improve the clarity and facilitate enforcement of the regulation.

Occupational Health and Safety Act General Regulations: EC2007-652, in force October 31, 2008, revokes sections 8.1 to 8.4 and replaces them with sections 8.1 to 8.10, regarding noise exposure limits; section 13.1 is also replaced (confined space). Division 2 AMENDMENTS
Section 2.A Acts
Highway Traffic Act: 2007, c. 7 (Bill 17) amends section 176 (speed limits; construction zones); adds a definition of "flood damaged vehicle" in section 234.1; makes a change in the Schedule regarding section 202(1) (flashing lights on school bus).
Section 2.B Regulations
Commercial Vehicle Drivers Hours of Service Regulations (Highway Traffic Act): EC2007-741 amends sections 1 and 3 and the Schedule to delete provisions that are no longer needed.
Home Heat Tanks Regulations (Environmental Protection Act): EC2007-740 amendments to section 14 authorize an exemption for the delivery of petroleum to a home heat tank where no identification tag is permanently affixed to the tank's vent pipe as long as the tank does not constitute an immediate hazard. Notice provisions are added to the regulations to inform the owners that the delivery of petroleum has taken place and that such tanks must be inspected and tagged by a licensee; the Department is to be informed of such deliveries, and fuel oil suppliers are to be informed of the location of such home heat tanks and the last date on which petroleum may be delivered.

Act respecting the conservation and development of wildlife: 2007, c. 22 (Bill 28) establishes a Québec-wide wildlife panel to be known as the Table nationale de la faune, as well as regional wildlife panels. The mandate of the panels is to advise the Minister and his regional representatives on any question submitted to them concerning the conservation and development of wildlife, especially as regards developing and promoting hunting, fishing and trapping, and the next generation of hunters, fishers and trappers. See sections 161.1 & 161.2.

The Occupational Health and Safety Act: 2007, c. 34 (Bill 66) is now proclaimed in force. Provisions of the Act regarding "harassment" are amended or added to. See especially new sections 48.1 and 56.1 concerning appeals of decisions by occupational health officers to special adjudicators respecting matters involving harassment.
Section 2.B Regulations
Occupational Health and Safety Regulations (Occupational Health and Safety Act): The part of Sask. Reg. 91/2007 in force makes a small adjustment to clause 101(1)(f). New section 469.1 (additional requirements re supervisors in health care facilities: an employer must appoint competent persons to supervise the place of employment in regard to the matters outlined) is in force November 21, 2007.
Hospital Standards Regulations, 1980 (Hospital Standards Act): Sask reg. 331/79 is amended by 86/2007. Some parts of this amendment are to come into force at a later time. Much of this amendment deals with changes in terminology and the addition of nurse practitioners to the range of health care professionals specified in these regulations. Several new definitions have been added to section 1. Sections 16(1),(2)(a), (c),(d), (e),(g),(h), (j), (k),(l), (m), 19, 20, 26, 27, 51, 60, 61, 62, 64, 84, and 98 are repealed. Section 54 (Ophthalmia neonatorum) has been repealed and replaced.
Saskatchewan Watershed Authority Regulations (Saskatchewan Watershed Authority Act): 76/2007 repeals and replaces Table 2 (Industrial Water Use Charges) and its accompanying footnotes.
