Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to March 2008. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between February and March 2008. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of March 2008. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2008-2 Issue of the Canadian enviroOSH Legislation DVD

Documents that will be on the 2008-2 Issue of the Canadian enviroOSH Legislation DVD series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and citation.

Glass Doors and Enclosures Regulations (Hazardous Products Act): Proposed replacement regulations for Safety Glass Regulations (CRC 1978, c.933) are found in the Canada Gazette, Part I, November 3, 2007, p. 3114.

Interprovincial Movement of Hazardous Waste and Hazardous Recyclable Material Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for the Interprovincial Movement of Hazardous Waste Regulations are found in the Canada Gazette, Part I, September 2, 2006, p. 2515.

Marine Spark-Ignition Engine and Off-Road Recreational Vehicle Emission Regulations (Canadian Environmental Protection Act, 1999): Proposed regulations are found in the Canada Gazette, Part I, December 30, 2006, p. 4553.

Metal Mining Effluent Regulations (Fisheries Act): Proposed amendments may be found in the Canada Gazette, Part I, February 9, 2008, p. 291. The amendments add 2 fish-bearing water bodies in Nunavut to Schedule 2.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Subsections 115(2.2) to (2.4) of Schedule IV as enacted by SOR/2004-250 (vehicle identification number in bar code format) come into force September 1, 2008. Storage Tank Systems for Petroleum Products and Allied Petroleum Products Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for Registration of Storage Tank Systems for Petroleum Products and Allied Petroleum Products on Federal Lands (SOR/97-10) are found in the Canada Gazette, Part I, April 7, 2007, p. 829.

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act, 1992): Proposed amendments are found in the Canada Gazette, Part I, September 30, 2006, p. 3015. More proposed amendments are found in the Canada Gazette, Part I, February 10, 2007, p. 255.

Division 2 AMENDMENTS

Section 2.A Acts

First Nations Land Management Act: 2007, c. 17 amends the act. Definitions for 'first nation land', 'licence', 'interest' and 'rights' have either been added or amended. Much of the terminology has been broadened to bring the act in line concepts and language from legal areas such as property and contract law. The amendments provide for the appropriate language used under Quebec civil law. This ensures that act is consistently applied across relevant jurisdictions.

Section 2.B Regulations

Notice with respect to substances in the National Pollutant Release Inventory for 2007 (Canadian Environmental Protection Act, 1999): Can. Gaz. Pt. I, Vol. 142, Sch. 1 amends this notice. This notice is in force until March 2010. Amendments to this notice further the goal of harmonizing national environmental and pollution policy with those of the provinces. Amendments have been made to all four schedules.

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act): SOR/2008-34 amendments align Canadian regulations with international requirements; re-categorize infection substances; update standards; re-classify anhydrous ammonia as a toxic gas and revise explosives requirements. Subsidiary class numbers must now be displayed on placards. Class 3 classification criteria aligns with the UN Recommendations and the GHS (Globally Harmonized System of Classification and Labelling of Chemicals) of the UN. Infectious Substances risk groups are changed to 2 categories (A & B). Section 1.32.1 is added - UN1075, Liquified Petroleum Gas.

Beverage Container Recycling Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 18/2008 amends section 22 of the regulation (expiry date of regulation put back).

Electrical Code Regulation (Safety Codes Act): Alta. Reg. 14/2008 repeals and replaces subsection 3(c) of the regulation (reference to Alberta Electrical Utility Code).

Oil and Gas Conservation Regulation (Oil and Gas Conservation Act): Alta. Reg. 26/2008 amends subsection 16.530(1) of the regulation (fiscal year of the Board). The heading for Part 18 has been amended and section 18.015 added (expiry date of regulation).

Tobacco Reduction Regulation (Tobacco Reduction Act): Alta. Reg. 4/2008 adds subsection 7(i) and section 10.1 (exemption for lodge accommodation) to the regulation. Alta. Reg. 24/2008 makes a minor correction to section 7.

Motor Vehicle Act (R.S.N.B. 1973, c. M-17): This act has been amended by S.N.B. 2005, c. s-15.5 and 2007, c. 44. Amendments to subsections 15(1.1), 15.1 and 297(2) have been brought into force. Section 105.01, 200.1 (Seat belt assembly), 309.3 and 310.1 (Fee for reinstatement of licence) have been either added or replaced.

Off-Road Vehicle Act (A.N.B. 1985, c. O-1.5): This act has been amended by S.N.B. 2007, c. 53. Sections 2.1, 3.1, 3.2, 20, 24.2 have been either added or are replacing an existing section. Due to an error within the amendment, an additional section 24.1 has been added to the act.
