Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to June 2008. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between May and June 2008. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of June under which they were made (Governing Act).

4. New documents for the 2008-3 Issue of the Canadian enviroOSH Legislation DVD

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Subsections 115(2.2) to (2.4) of Schedule IV as enacted by SOR/2004-250 (vehicle identification number in bar code format) come into force September 1, 2008. Division 2 AMENDMENTS

Section 2.A Acts

Canada Labour Code (Part III): 2008, c. 15 (Bill C-40) amends the Canada Labour Code to provide for an entitlement to a leave of absence from employment for members of the reserve force who take part in certain military activities and operations in Canada and abroad and to prohibit employers from discriminating against employees on the basis that they are members of the reserve force. See new Division XV.2.

Code canadien du travail

Food and Drugs Act: Schedule A of the Act is a list of diseases, disorders or abnormal physical states for which preventative, treatment, and cure claims are prohibited by section 3 in the labelling and advertising to the general public of any food, drug, cosmetic or medical device. SOR/2007-289 amendments, in force June 1, 2008, revise Schedule A in accordance with the criteria identified by an advisory panel.

Section 2.B Regulations

Canada Occupational Health and Safety Regulations (Canada Labour Code): SOR/2008-148 adds Part XX - "Violence Prevention in the Work Place". The new regulations specifically define work place violence. It includes requirements to develop a work place violence prevention policy; to identify and assess risks related to work place violence; to put preventive controls in place and to provide training for employees. The employer will have to review the initiatives on a regular basis and update them if required, as well as to investigate each incident and provide a written report to the work place committee or the health and safety representative. The Regulations also introduce provisions for responding to, investigating and recording acts of violence.

Règlement canadien sur la santé et la sécurité au travail

Migratory Birds Regulations (Migratory Birds Convention Act, 1994): SOR/2008-149 makes a minor change to Schedule I, Part IX to correct an inconsistency between the French and English versions.

Motor Vehicle Restraint Systems and Booster Cushions Safety Regulations(Motor Vehicle Safety Act): SOR/2008-104 amends the regulation to correct inconsistencies between the French and English versions. The English definitions for 'booster cushion' and 'mobility-impaired occupant' is amended to clarify that it applies to occupant's weight rather than age. The amendment also corrects errors, duplication and introduces metric numbering.

Commercial Transport Act: The part of 2008, c. 15 (Bill 17) which is in force amends the definition of "trailer" in section 1.

Motor Vehicle Act: 2008, c. 15 (Bill 17) repeals section 5 and subsection 36(2) has been repealed. Subsections 21(1)(c), 31(2), 34(1)(c), 42(1), (3), (5) and (6) have been amended.

Transportation Act: 2008, c. 10 (Bill 2) amends subsection 87(2)(d) and adds subsection (2.1).

Onsite Wastewater Management Systems Regulation (The Environment Act): Under Man. Reg. 64/2008, Section 8 is amended to include a reference to the new Nutrient Management Regulation.

Livestock Manure and Mortalities Management Regulation (The Environment Act): The regulation is amended by Man Reg. 63/2008 and 68/2008. Definition for "manure management plan" is added to the regulation. Subsection 12.1(3) is repealed and replaced, while subsection (3.1) is added. Section 12.1.1 has been added and 16.1(3) has been amended. Section 16.4 is repealed and replaced (manure storage facilities in specified areas).

Clean Environment Act: 2008, c. 11 (Bill 39) amends subsection 33(1).

Clean Water Act: 2008, c. 11 (Bill 39) amends subsection 25(1).

Health Act: 2008, c. 11 (Bill 39) repeals section 32.

Mining Act: 2008, c. 11 (Bill 39) amends the act by repealing subsections 19(3), 115(1)(d) and (2). Sections and subsections 117(2) and 118 are repealed and replaced. Section 117.1 and subsection 115(1)(r.1) have been added to the act. These changes implement changes respecting fines and penalties for provincial offences.

Division 2 AMENDMENTS

Section 2.A Acts

Environment Quality Act: The remainder of 2002, c. 53 is now proclaimed in force. Section 31.0.1 (as amended by 2004, c. 24) is added which transfers to the Minister the right to determine fees. Other sections are amended incidental to this.

Loi sur la qualité de l'environnement

An Act Respecting la Société québécoise de récupération et de recyclage: 2008, c. 5 (Bill 61) makes the Société subject to the Act respecting the governance of state-owned enterprises and introduces new governance rules into its constituting act. The new governance rules determine the composition of the board of directors; new rules also apply to the operation of the board of directors, the constitution of the committees responsible to the board and the disclosure and publication of information.

Highway Safety Code: More sections of 2004, c. 2 are now proclaimed in force. Section 328 (speed limits) is amended; section 368 has a paragraph added (level crossing).
