Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to July 2008. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between June and July 2008. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of June under which they were made (Governing Act).

4. New documents for the 2008-3 Issue of the Canadian enviroOSH Legislation DVD

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Subsections 115(2.2) to (2.4) of Schedule IV as enacted by SOR/2004-250 (vehicle identification number in bar code format) come into force September 1, 2008. See Canada Gazette, Part II, Dec. 1, 2004, No. 24, p. 1796. Proposed amendments of section 12 regarding the importation of a vehicle purchased in the United States are found in the Canada Gazette, Part I, December 1, 2007, p. 3366. Division 2 AMENDMENTS

Section 2.A Acts

Canada National Parks Act: As a consequential amendment of 2008, c. 2 (Bill C-11), the description of Torngat Mountains National Park is added to Part 10 of Schedule 1.

Food and Drugs Act: 2005, c. 42 is now proclaimed in force. The amendments provide the Minister of Health with the authority to issue interim marketing authorizations for foods that contain certain substances at specified levels, and to exempt foods from the applicable requirements of the Act and its regulations relating to the sale of those foods. See sections 4 and 30 and new section 30.2.

Loi sur les aliments et drogues

Hazardous Products Act: DORS/2008-190 replaces item 12 of Part I of Schedule I of the French version to provide a greater degree of correlation between the French and English versions.

Section 2.B Regulations

Cargo, Fumigation and Tackle Regulations (Canada Shipping Act, 2001): Section 364 (accommodation ladders) of the original SOR/2007-128 is in force July 1, 2008.

List of Pest Control Product Formulants and Contaminants of Health or Environmental Concern (Pest Control Products Act): SI/2008-67 replaces Parts 1 (Formulants of Health or Environmental Concern), 2 (Formulants of Health or Environmental Concern That Are Allergens Known to Cause Anaphylactic-type Reactions) and 3 (Formulants of Health or Environmental Concern That Are Allergens Known to Cause Anaphylactic-type Reactions).

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): SOR/2008-199 amendments incorporate safety standards of Europe and the United States. Until August 31, 2009, a passenger car may conform either to the current version or as it read before this Regulations. SOR/2008-73 incorporates a reference to the standard of the global technical regulation on door locks and door retention components. These changes are meant to reduce the risks associated with inadvertent door opening on doors in a variety of vehicles. SOR/2008-104 amends inconsistencies between the English and French versions as well as clarifying the intent of several sections in Schedule IV. The definition for 'mobility-impaired occupant' clarifies its application to the mass of the occupant instead of the occupant's age. Amendments are made to introduce metric numbering in subsection 103(1) of Schedule IV. Several inconsistencies and errors in Schedule IV have been corrected and amended.

Section 2.A Acts

Environmental Management Act: 2008, c. 33 (Bill 29) amends definitions for 'waste management facility' and 'recyclable material' in section 1, as well, a definition for 'wildlife' is added to section 138. Subsections 21(2)(u), 22(2)(f), and 80(2) have been repealed and replaced. Sections 22(2)(f.1), (f.2), (g.1),(g.2), 138(2)(o.1) and (o.2) have been added to the Act. Added to the Act, in several sections, including subsections 138(3)(f)(ii) and (iii), are references to recyclable and reusable waste resources including the energy potential of such materials. 2008, c. 42 (Bill 43) amends subsection 31(1).

Forest Act: 2008, c. 20 (Bill 31) amends the Act with several sections that are now in force. Sections 13.1 (Direct award of forest licence to produce bioenergy) and 13.2 (Designation of bioenergy supply contracts and specification of allowable annual cut) have been added to the Act as well as subsections 72(10) and 73(9). Subsection 72(1) a reference to a 'community forest agreement" has been added. 2008, c. 30 (Bill 33) adds section 127.1 (attempt to export Crown timber) and a reference this to the section in subsection 163(1).

Forest and Range Practices Act: 2008, c. 20 (Bill 31) changes a subsection reference in subsection 108(5). 2008, c. 30 (Bill 33) in force sections add subparagraph 67(1)(c)(iii.1) and amend clause 122(2)(a).

Passenger Transportation Act: The section of 2008, c. 30 (Bill 33) in force repeals sections 60, 61(1)(a) - (c) & (3), and 63 to 67.

Petroleum and Natural Gas Act: 2008, c. 42 (Bill 43) adds sections 59.1 (continuation of previous reversion rules for older leases), 61.1 (continuation of leases for certain disposal well purposes); sections 71 (disposal of Crown reserves by public auction or tender) and 72 (withdrawal from disposition under section 71 and alternative disposition) have been repealed and replaced. Sections 56, 58, 55, 60, 62, 63 and 133 have been amended to reflect these changes and additions.

Utilities Commission Act: 2008, c. 13 (Bill 15) has amended the Act by adding sections 44.1 (Long-term resource and conservation planning), 44.2 (Expenditure schedule), 58.1(Rate rebalancing), 64.01 (Electricity self-sufficiency), 64.02 (Clean and renewable resources), 64.03 (Standing offer), 64.04 (Smart Meters), 125.1 (Minister's regulations) and 125.2 (Adoption of reliability standards, rules or codes). Sections 3 and 22 have been repealed and replaced and sections 1, 2, 5 and 43 have been amended.

Wildfire Act: 2008, c. 30 (Bill 30) amends clause 68(2)(a).

Wildlife Act: In force provisions of 2008, c. 33 (Bill 29) add the definitions for 'controlled alien species', 'developmental stage', 'native species', 'species' and 'species individual'. Definitions of 'endangered species', 'fish' and 'threatened species' and 'wildlife' have been amended. Sections 6.4 - 6.6 and 97.7 - 97.73 concerning control of alien species, have been added to the Act and are in force. Age restrictions have been lowered to under 18 years of age, in subsections 11(5), 17(1)(b), (3) and (6)-(8). Section 109 has been amended adding subsections (h) and (i).

Section 2.B Regulations

Motor Vehicle Act Regulations: B.C. Reg. 218/2007, in force July 1, 2008, replaces Division 36 - Child Seating and Restraint Systems.

Crown Lands Act: 2008, c. 31 (Bill 3) amends the Act by adding sections 5.1 (Minister may dispose of lands with minimal value), 6.1 (Delegation by minister) and 34.1 (Disclosure of names of purchasers). Definition of 'director' and subsections 7.3(1) and (2) have been repealed and replaced.

Highway Traffic Act: 2008, c. 3 (Bill 44) amends subsections 68(13.2), 86(5.5) and 238(2). 2008, c. 5 (Bill 3) amends sections 242.3 and 264 (offences). 2008, c. 15 (Bill 13) adds section 189.1 (offence re damaging a highway).

Motor Vehicle Act: 2008, c. 27 (Bill 57) has amended the Act by repealing and replacing subsection 261(1) and (2) (special permit authorizing vehicle operation).

Off Road Vehicle Act: 2008, c. 29 (Bill 61) renumbers the second section 24.1 and section 24.2 as 24.01 and 24.02 respectively. References are amended accordingly.

Section 2.B Regulations

General Regulation - Motor Vehicle Act: N.B. Reg. 2008-65 amends subsection 15(13.1) (fee for drinking driver reeducation course).

Ozone Depleting Substances Regulation - Clean Air Act: N.B. Reg. 2008-66 amends the regulation by adding definitions for 'chiller', 'halocarbon', 'regulated substance' and 'used regulated substances' and replacing definitions for 'charging cylinder', 'dispose of', 'equipment', ozone depleting substance, 'pressurized container' and 'unitary'. Throughout the regulation many sections have replaced references to ozone depleting substances with a broader reference to regulated substances. Sections 8.1 (Air conditioning and refrigeration systems), 11.1 (Return of regulated substances) and 19.1 (Modifying equipment) have been added to the regulation, while section 12 and 16 have been repealed and replaced. Schedule B has been repealed and Schedule A replaced.

Wellfield Protected Area Designation Order - Clean Water Act: N.B. Reg. 2008-69 adds 4 protected areas, Schedules A.30 to A.33.

Forestry Act: 2008, c. 11 (Bill 16) has amended subsections 29(4) and 35(2) to reflect retroactive changes in charges, royalties and stumpage rates. References to fiscal year are replaced by references to calendar year.

Highway Traffic Act: S.N.L. 2007, c. 23 amends the act to impose penalties for a failure to use a safety belt or child seat safety restraint system where appropriate. Subsections 178(1) and (6) are repealed and replaced and subsection 4.1 is added. Section 178.1 (Child seat restraint systems) has been added to the Act. References in the schedule to 178(6) and 178(8) have been amended to 178(6)(a) and 178.1(2) respectively.

Motor Vehicle Act: 2008, c. 2 (Bill 157) amends subsection 68(1). 2008, c. 23 (Bill 170) adds section 111A (yielding right of way in merge). 2008, c. 22 (Bill 150) adds section 106C (speeding in temporary work area). Among other changes made by 2007, c. 45, now proclaimed in force: addition of subsection 47(3) (nitrous oxide in fuel), section 106B (temporary work area), sections 125B & 163A (motor vehicle operated during the course of committing an offense), 173A (soliciting drivers); replacement of section 125 (pedestrian right of way). 2008, c. 21 (Bill 146) replaces clause 2(ac)(i), adds subsection 67(5B), and makes minor changes to sections 298 & 299.

Pesticides Control Act Regulation (Pesticides Control Act): EC2008-290 amends the regulation repealing subsections 13(9), 21(3) and adding section 22.2. Section 29 and subsections 35(d) have been replaced. Section 18 has added references to golf courses. Section 1 adds a definition clarifying the meaning of 'ready-to-use herbicide'. Forms 7, 8 and 12 have been updated to reflect these amendments and Schedule 4 is amended.
