Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to September 2008. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between August and September 2008. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of June under which they were made (Governing Act).

4. New documents for the 2008-4 Issue of the Canadian enviroOSH Legislation DVD

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Subsections 115(2.2) to (2.4) of Schedule IV as enacted by SOR/2004-250 (vehicle identification number in bar code format) come into force September 1, 2008. Division 2 AMENDMENTS

Section 2.A Acts

Railway Safety Act: As a consequential amendment of 2008, c. 6 (Bill C-2), now proclaimed in force, subsection 41(7) is replaced (admissibility of evidence).

Section 2.B Regulations

Migratory Birds Regulations (Migratory Birds Convention Act, 1994): SOR/2008-217 amends Schedule I to establish hunting season dates for 2008/2009 and to set daily bag and possession limits for migratory game birds.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): SOR/2008-72 amends the Canada Motor Vehicle Safety Standards 210, 210.1, 210.2 and 213.4 regarding user-ready tether anchorages and aligns requirements with the U.S. Child Restraint Anchorage Systems standard. SOR/2008-73 incorporates a reference to the standard of the global technical regulation on door locks and door retention components. These changes are meant to reduce the risks associated with inadvertent door opening on a variety doors in a variety of vehicles. SOR/2008- 104 amends inconsistencies between the English and French versions as well as clarifying the intent of several sections in Schedule IV. The definition mobility for 'mobility-impaired occupant' is changed to clarify its application to the mass of the occupant instead of the occupant's age. Amendments are made to introduce metric numbering in subsection 103(1) of Schedule IV. Several inconsistencies and errors in Schedule IV have been corrected and amended. SOR/2008-199 amends section 215 of Schedule IV to modify the safety standard for bumpers. The remainder of SOR/2004-250 is now in force which amends section 115 of Schedule IV (vehicle identification). SOR/2008-229 replaces the definitions of "low-speed vehicle", "motorcycle", "three-wheeled vehicle" and "truck" in section 2; amends item 205 of Schedule III; amends section 500 of Schedule IV.

Pulp and Paper Effluent Regulations (Fisheries Act): SOR/2008-239 makes several changes in the regulations, including: suspending environmental effects monitoring at mills that have ceased production for an extended period of time; streamlining sublethal toxicity testing; regarding the frequency of monitoring for each component of the biological monitoring: the amendments allow each component of the biological monitoring study to now be assessed individually; exemption from a benthic invertebrate study; the description of the requirements respecting the magnitude and geographical extent of the biological study has been modified under the amendments; investigation of solutions; administrative changes.

Section 2.A Acts

Motor Vehicle Act (R.S.B.C. 1996, c. 318): Sections 48 and 49 of 2007, c. 14 are now proclaimed in force. Under subsection 83(2.1), vehicles owners are liable for parking violations.

Protected Areas of British Columbia Act: More sections of 2007, c. 27 and 2008, c. 26 (Bill 38) are proclaimed in force amending Schedules C, D, E, and F.

Workers' Compensation Act (R.S.B.C. 1996, c. 492): 2008, c. 12 (Bill 13) amends section 94 of the act. Subsections (1) - (1.2) have been repealed and replaced. Subsections (1.4) and (1.5) have been repealed and subsection (4) amended.

Section 2.B Regulations

Commercial Transport Regulations (Commercial Transport Act): B.C. Reg. 128/2008 amends sections 7.06 (vehicle width), 7.07 (vehicle axle width), and 7.08 (vehicle length).

Motor Vehicle Act Regulations: B.C. Reg. 145/2008 introduces regulations for neighbourhood zero emission vehicles in new sections 24.07 & 24.08 and amends other sections accordingly. B.C. Reg. 191/2008 changes a section reference in subsections 37.01(1) & (2).

Building Code (Building Code Act, 1992): O. Reg. 205/08 amends the Building Code, effective April 1, 2010. See the Ontario Gazette, July 5, 2008.

Certification of Petroleum Equipment Mechanics (Technical Standards and Safety Act): O. Reg. 251/08 changes the title of the regulation to "Certification of Petroleum Mechanics" and makes other amendments, including changes having to do with direct supervision, director's orders, certificates, and aboveground tanks.

Fuel Industry Certificates (Technical Standards and Safety Act): O. Reg. 253/08 makes numerous amendments regarding mainly certificates and the qualifications necessary to perform various functions. New sections 52.2 (GUT-1 certificate) and 52.3 (GUT-2 certificate) are added.

Hospital Management (Public Hospitals Act): O. Reg. 257/08 has amended the regulation by adding subsection 22.2 which requires hospitals to provide information about hospital-acquired infections and mortality rates when requested by the Minister.

Records of Site Condition - Part XV.1 of the Act (Environmental Protection Act): 266/08 amends subsection 41(3) by replacing paragraph 7 to reference the Endangered Species Act, 2007.

Classification and Exemption of Spills and Reporting of Discharges(Environmental Protection Act): Sections 5 and 6 of Ontario Regulation 225/07 are now in force. Section 10 (Non- reportable Spills) has been repealed and replaced. Subsection 12(1) is replaced and subsection (1.1) has been added to section 12 (Records).
