The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to September 2008. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

Contains information about amendments which have come into force between August and September 2008. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of June under which they were made (Governing Act).

Gasoline Regulations: (Canadian Environmental Protection Act, 1999): Proposed regulations are found in the Canada Gazette, Part I, December 22, 2007, p. 3517 regarding leaded gasoline in competition vehicles.

Glass Doors and Enclosures Regulations (Hazardous Products Act): Proposed replacement regulations for Safety Glass Regulations (CRC 1978, c.933) are found in the Canada Gazette, Part I, November 3, 2007, p. 3114.

Hazardous Materials Information Review Act Appeal Board Procedures Regulations (Hazardous Materials Information Review Act): Proposed amendments are found in the Canada Gazette, Part I, April 12, 2008, p. 1075.

Interprovincial Movement of Hazardous Waste and Hazardous Recyclable Material Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for the Interprovincial Movement of Hazardous Waste Regulations are found in the Canada Gazette, Part I, September 2, 2006, p. 2515.

Marine Spark-Ignition Engine and Off-Road Recreational Vehicle Emission Regulations (Canadian Environmental Protection Act, 1999): Proposed regulations are found in the Canada Gazette, Part I, December 30, 2006, p. 4553.

Metal Mining Effluent Regulations (Fisheries Act): Proposed amendments may be found in the Canada Gazette, Part I, February 9, 2008, p. 291. The amendments add 2 fish-bearing water bodies in Nunavut to Schedule 2.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Subsections 115(2.2) to (2.4) of Schedule IV as enacted by SOR/2004-250 (vehicle identification number in bar code format) come into force September 1, 2008. See Canada Gazette, Part II, Dec. 1, 2004, No. 24, p. 1796. Proposed amendments of section 12 regarding the importation of a vehicle purchased in the United States are found in the Canada Gazette, Part I, December 1, 2007, p. 3366. Pulp and Paper Effluent Regulations (Fisheries Act): Proposed regulations are found in the Canada Gazette, Part I, November 3, 2007, p. 3090.

Restricted Components Regulations (Explosives Act): Proposed regulations are found in the Canada Gazette, Part I, August 12, 2006, p. 2365.

Review Panel Regulations (Pest Control Products Act). Proposed regulations are found in the Canada Gazette, Part I, December 6, 2006, p. 4305.

Storage Tank Systems for Petroleum Products and Allied Petroleum Products Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for Registration of Storage Tank Systems for Petroleum Products and Allied Petroleum Products on Federal Lands (SOR/97-10) are found in the Canada Gazette, Part I, April 7, 2007, p. 829.

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act, 1992): Proposed amendments are found in the Canada Gazette, Part I, February 10, 2007, p. 255.

Volatile Organic Compound (VOC) Concentration Limits for Architectural Coatings Regulations (Canadian Environmental Protection Act, 1999): Proposed regulations are found in the Canada Gazette, Part I, April 26, 2008, p. 1257.

Volatile Organic Compound (VOC) Concentration Limits for Automotive Refinishing Products Regulations (Canadian Environmental Protection Act, 1999): Proposed regulations are found in the Canada Gazette, Part I, April 26, 2008, p. 1295.

Volatile Organic Compound (VOC) Concentration Limits for Certain Products Regulations (Canadian Environmental Protection Act, 1999): Proposed regulations are found in the Canada Gazette, Part I, April 26, 2008, p. 1326.

Railway Safety Act: As a consequential amendment of 2008, c. 6 (Bill C-2), now proclaimed in force, subsection 41(7) is replaced (admissibility of evidence).

Migratory Birds Regulations (Migratory Birds Convention Act, 1994): SOR/2008-217 amends Schedule I to establish hunting season dates for 2008/2009 and to set daily bag and possession limits for migratory game birds.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): SOR/2008-72 amends the Canada Motor Vehicle Safety Standards 210, 210.1, 210.2 and 213.4 regarding user-ready tether anchorages and aligns requirements with the U.S. Child Restraint Anchorage Systems standard. SOR/2008-73 incorporates a reference to the standard of the global technical regulation on door locks and door retention components. These changes are meant to reduce the risks associated with inadvertent door opening on a variety doors in a variety of vehicles. SOR/2008- 104 amends inconsistencies between the English and French versions as well as clarifying the intent of several sections in Schedule IV. The definition mobility for 'mobility-impaired occupant' is changed to clarify its application to the mass of the occupant instead of the occupant's age. Amendments are made to introduce metric numbering in subsection 103(1) of Schedule IV. Several inconsistencies and errors in Schedule IV have been corrected and amended. SOR/2008-199 amends section 215 of Schedule IV to modify the safety standard for bumpers. The remainder of SOR/2004-250 is now in force which amends section 115 of Schedule IV (vehicle identification). SOR/2008-229 replaces the definitions of "low-speed vehicle", "motorcycle", "three-wheeled vehicle" and "truck" in section 2; amends item 205 of Schedule III; amends section 500 of Schedule IV.

Pulp and Paper Effluent Regulations (Fisheries Act): SOR/2008-239 makes several changes in the regulations, including: suspending environmental effects monitoring at mills that have ceased production for an extended period of time; streamlining sublethal toxicity testing; regarding the frequency of monitoring for each component of the biological monitoring: the amendments allow each component of the biological monitoring study to now be assessed individually; exemption from a benthic invertebrate study; the description of the requirements respecting the magnitude and geographical extent of the biological study has been modified under the amendments; investigation of solutions; administrative changes.

Environmental Protection and Enhancement Act: As a consequential amendment of 2007, c. U-1.5, now proclaimed in force, the definition "person responsible" in section 1 is amended.

Motor Vehicle Act (R.S.B.C. 1996, c. 318): Sections 48 and 49 of 2007, c. 14 are now proclaimed in force. Under subsection 83(2.1), vehicles owners are liable for parking violations.

Protected Areas of British Columbia Act: More sections of 2007, c. 27 and 2008, c. 26 (Bill 38) are proclaimed in force amending Schedules C, D, E, and F.

Workers' Compensation Act (R.S.B.C. 1996, c. 492): 2008, c. 12 (Bill 13) amends section 94 of the act. Subsections (1) - (1.2) have been repealed and replaced. Subsections (1.4) and (1.5) have been repealed and subsection (4) amended.

Commercial Transport Regulations (Commercial Transport Act): B.C. Reg. 128/2008 amends sections 7.06 (vehicle width), 7.07 (vehicle axle width), and 7.08 (vehicle length).

Motor Vehicle Act Regulations: B.C. Reg. 145/2008 introduces regulations for neighbourhood zero emission vehicles in new sections 24.07 & 24.08 and amends other sections accordingly. B.C. Reg. 191/2008 changes a section reference in subsections 37.01(1) & (2).

Buildings and Mobile Homes Act: As a consequential amendment of 2008, c. 17 (Bill 15), the definition of "building construction standard" in section 1 is amended.

Highway Traffic Act: As a consequential amendment of 2008, c. 17 (Bill 15), subsection 319(1.2) is added (regulations re low-speed vehicles).

Transportation of Dangerous Goods Act, 1990: As a consequential amendment of 2008, c. 8 (Bill 4) the name of the Act is changed to Transportation of Dangerous Goods Act. The wording of subsections 39(1) & 64(1) are changed in regard to "territory" and sections 65 & 67 are repealed (housekeeping).

Workers' Compensation Act: As a consequential amendment of 2008, c. 8 (Bill 4) sections 121 (term of office of the Appeals Tribunal) and 122 (remuneration of members of Appeals Tribunal) are replaced.

General Regulations (Workers's Compensation Act): R-035-2008 replaces subsections 8(3) & 9(1) regarding remuneration.

Motor Vehicle Act: Parts of 2007, c. 45 (Bill 7) are now proclaimed in force which amend the Point System Table (9A, 9B & 9C) in subsection 282(2) (amended by 2008, c. 21 (Bill 146)); section 300A is added (amended by 2008, c. 21) (violations of section 106B).

Building Code (Building Code Act, 1992): O. Reg. 205/08 amends the Building Code, effective April 1, 2010. See the Ontario Gazette, July 5, 2008.

Certification of Petroleum Equipment Mechanics (Technical Standards and Safety Act): O. Reg. 251/08 changes the title of the regulation to "Certification of Petroleum Mechanics" and makes other amendments, including changes having to do with direct supervision, director's orders, certificates, and aboveground tanks.

Fuel Industry Certificates (Technical Standards and Safety Act): O. Reg. 253/08 makes numerous amendments regarding mainly certificates and the qualifications necessary to perform various functions. New sections 52.2 (GUT-1 certificate) and 52.3 (GUT-2 certificate) are added.

Hospital Management (Public Hospitals Act): O. Reg. 257/08 has amended the regulation by adding subsection 22.2 which requires hospitals to provide information about hospital-acquired infections and mortality rates when requested by the Minister.

Classification and Exemption of Spills and Reporting of Discharges(Environmental Protection Act): Sections 5 and 6 of Ontario Regulation 225/07 are now in force. Section 10 (Non- reportable Spills) has been repealed and replaced. Subsection 12(1) is replaced and subsection (1.1) has been added to section 12 (Records).

Occupational Health and Safety Act General Regulations: EC2007-652, in force October 31, 2008, revokes sections 8.1 to 8.4 and replaces them with sections 8.1 to 8.10, regarding noise exposure limits; section 13.1 is also replaced (confined space). Regulation respecting the application of the Environment Quality Act (Environment Quality Act): Proposed amendments are found in the Gazette officielle du Qu�bec, February 27, 2008, p. 690. The amendments concern authorization exemptions under section 22 of the Act.

Regulation respecting the application of section 32 of the Environment Quality Act (Environment Quality Act): Proposed regulations are found in the Gazette officielle du Qu�bec, January 10, 2007, No. 2, p. 63.

Regulation respecting occupational health and safety (An Act respecting occupational health and safety): Proposed amendments are found in the Gazette officielle du Qu�bec, October 3, 2007, p. 2784.

Regulation respecting waste water disposal systems for isolated dwellings (Environment Quality Act): Proposed amendments are found in the Gazette officielle du Qu�bec, January 23, 2008, p. 485. The amendments are in regard to non-watertight secondary treatment systems.

Regulation respecting water containers with a capacity exceeding 8 litres - recovery and reuse. Proposed new regulation under the Environment Quality Act is found in the Gazette officielle du Qu�bec, July 11, 2007, p. 2109.

Regulation respecting wood burning appliances: Proposed new regulation under the Environment Quality Act is found in the Gazette officielle du Qu�bec, April 23, 2008, p. 1212.

Conservation and Development of Wildlife Act: The part of 1988, c. 39 which enacts section 78.5 (as amended by 2000, c. 48) is now proclaimed in force.The section concerns who may use "outfitter" designations.

Construction Code (Building Code) (Building Act): O.C. 293-2008 amends the National Building Code of Canada 2005. O.C. 294-2008 amends the National Plumbing Code of Canada 2005.

Motor Vehicles Act: As a consequential amendment of 2007, c. 13 (Bill 40) a reference to the Motor Transport Act is deleted in paragraph 65(1)(a).
