The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to May 2009. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

Contains information about amendments which have come into force between March and April 2009. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of June under which they were made (Governing Act).

Canada Oil and Gas Drilling and Production Regulations (Canada Oil and Gas Operations Act): Proposed regulations replace Canada Oil and Gas Drilling Regulations (SOR/79-82) and Canada Oil and Gas Production and Conservation Regulations (SOR/90-791). Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Proposed amendments regarding bumpers are found in the Canada Gazette, Part I, March 22, 2008, p. 822. Newfoundland Offshore Petroleum Drilling and Production Regulations (Canada-Newfoundland Atlantic Accord Implementation Act): New regulations replace Newfoundland Offshore Petroleum Drilling Regulations (SOR/93-23) and Newfoundland Offshore Area Petroleum Production and Conservation Regulations (SOR 95-103). Proposed regulations are found in the Canada Gazette, Part I, April 18, 2009, p. 1136.

Notice of intent to amend the Phosphorus Concentration Regulations (Canadian Environmental Protection Act, 1999): Proposed amendments are found in the Canada Gazette, Part I, February 16, 2008, p. 329.

Nova Scotia Offshore Petroleum Drilling and Production Regulations (Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation Act ): New regulations replace Nova Scotia Offshore Petroleum Drilling Regulations (SOR/92-676) and Nova Scotia Offshore Area Petroleum Production and Conservation Regulations (SOR/95-190). Proposed regulations are found in the Canada Gazette, Part I, April 18, 2009, p. 1166.

Nuclear Non-Proliferation Import and Export Control Regulations (Nuclear Safety and Control Act): Proposed amendments are found in the Canada Gazette, Part I, February 7, 2009, p. 284.

Phosphorus Concentration Regulations (Canadian Environmental Protection Act, 1999). Proposed amendments are found in the Canada Gazette, Part I, June 28, 2008, p. 1999.

Port Authorities Operations Regulations (Canada Marine Act): Proposed amendments are found in the Canada Gazette, Part I, EXTRA Vol. 141, No. 1, 2007.

Virtual Elimination List (Canadian Environmental Protection Act, 1999): Proposals to add perfluorooctane and its salts to the regulation are found in the Canada Gazette, Part I, September 6, 2008, p. 2587.

Volatile Organic Compound (VOC) Concentration Limits for Architectural Coatings Regulations (Canadian Environmental Protection Act, 1999): Proposed regulations are found in the Canada Gazette, Part I, April 26, 2008, p. 1257.

Volatile Organic Compound (VOC) Concentration Limits for Automotive Refinishing Products Regulations (Canadian Environmental Protection Act, 1999): Proposed regulations are found in the Canada Gazette, Part I, April 26, 2008, p. 1295.

Volatile Organic Compound (VOC) Concentration Limits for Certain Products Regulations (Canadian Environmental Protection Act, 1999): Proposed regulations are found in the Canada Gazette, Part I, April 26, 2008, p. 1326.

First Nations Land Management Act: As a consequential amendment of 2008, c. 32, now proclaimed in force, item 24 of the Schedule is repealed.

Fisheries Act: As a consequential amendment of 2008, c. 32, now proclaimed in force, subsection 5(4) is replaced (laws of certain First Nations).

Canada Occupational Health and Safety Regulations (Canada Labour Code): SOR/2009-84 presents 4 miscellaneous amendments to Part XIV (Materials Handling) and Part XIX (Hazard Prevention Program): brings consistency to the English and French versions of section 14.40; clarifies existing wording; eliminates the requirement for employers to submit a copy of their HPP evaluation to the Minister of Labour (subsection 19.8(1)).

Migratory Birds Regulations (Migratory Birds Convention Act, 1994): SOR/2009-75 amends note (h) of Table II of Part VI of Schedule I to correct an error in wording.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): SOR/2009-79 is reenacting sections 105, 121, 131, 135 and 301 of Schedule IV to extend their application expiration dates. The safety requirements referenced through the Technical Standard Documents remain in force.

Land Act: 2009, c. 4 (Bill 2) adds subsection (2) (government exemption from Surveyor General fees). Deemed in force April 1, 2007.

Integrated Pest Management Regulation (Integrated Pest Management Act): B.C. Reg. 426/2008 and 427/2008 amends sections 5, 21, 64, 71 and 78, to regulate the application of pesticides to control mosquitoes and the spread of the West NileVirus. Subsection 64(3) has been replaced and outlines the public notice required when applying pesticides to control mosquitoes, including written notice to apiaries registered under the Bees Act. Section 78 is amended to control the conditions under which methoprene may be used.

Motor Vehicle Act Regulations (Motor Vehicle Act): B.C. Reg. 351/2008 amends the regulation to repeal and replace definitions for golf cart and utility vehicle. Division 24 (Vehicles of Unusual Size, Weight or Operating Characteristics) has been repealed and replaced. Several other amendments have been also amended to reflect the new Division 24. This division deals with vehicles such as golf cars and low and zero emission vehicles.

Motor Vehicle Act: 2008, c. 61 (Bill 93), now proclaimed in force, adds subsections 13(2A) and 65(5) regarding non-residents. 2008, c. 62 (Bill 191), now proclaimed in force, amends subsection 112 regarding the Minister's authority with respect to highways divided into two separate roadways and adds subsection 174A which stipulates the use of daytime running lights.

Vehicle Inspection Regulations (Motor Vehicle Act): Sections of 49/2009 in force change the frequency and scope of vehicle inspections. See sections 2, 6, 19 to 21A and 24. More amendments to come into force on June 1, 2009.

Building Code (Building Code Act, 1992): O. Reg. 205/08 amends the Building Code, effective April 1, 2010. See the Ontario Gazette, July 5, 2008.

Electrical Safety Code (Electricity Act, 1998): O. Reg. 453/08 updates references to the Canadian Electrical Code to the 2009 edition. In force May 1, 2009. See the Ontario Gazette, January 3, 2009, No. 1, p. 1576.

Needle Safety (Occupational Health and Safety Act): Amending regulation O. Reg. 317/08 is in force April 1, 2009. See the Ontario Gazette, Oct. 4, 2008, No. 40, p. 1103.

Highway Traffic Act: The remainder of 2007, c. 13 is now in force regarding licence suspension for blood alcohol concentration above .05. It replaces section 48 regarding police officers' powers to determine whether there is evidence to demand a breath sample. Wording additions are made to sections 48.1 to 48.3.

Pesticides Act: 2008, c. 11 (Bill 64) now proclaimed in force, amends the Act to prohibit the use and sale of certain pesticides that may be used for cosmetic purposes. See especially subsections 1(4) and new section 7.1.

Boilers and Pressure Vessels Code Adoption Document (Technical Standards and Safety Act): The document is amended by a Director's Order. It replaces Section 1.0 to cite an updated Canadian Standards Association (CSA) B51 standard plus the exceptions and additions.

General - Waste Management (Environmental Protection Act): Among other changes, O. Reg. 110/09 replaces the definition of "agricultural waste" in subsection 1(1) and adds "disposal facility" and "farm operation". Section 3 is amended (exemptions from Part V of the Act).

Hours of Service (Highway Traffic Act): O. Reg. 114/09 adds section 3.1 which describes exemptions for volunteer firefighters.

Lake Simcoe Protection (Ontario Water Resources Act): Sections 6 to 8 of the original 60/08 regulation are repealed concerning new sewage treatment plants.

Needle Safety (Occupational Health and Safety Act): Sections of O. Reg. 317/08 now in force amend section (application to more facilities) and replace subparagraph 5(1)1ii.

Races, Contests and Stunts (Highway Traffic Act): O. Reg. 406/08 repeals section 1, effective May 1, 2009, regarding the police officer's report to the Registrar concerning driver information.

Commercial Vehicle (Trip Inspection and Records) Regulations (Highway Traffic Act): Among other changes, EC2009-145 adds new definitions to section 1; clarifies the types of vehicles to which these regulations do not apply in section 2; revokes and replaces the provisions dealing with the required information to be included in commercial vehicle inspection reports in accordance with Schedules I- IV - an exemption is provided from the requirements to prepare inspection reports in the case of a driver of a truck, tractor and trailer that is being operated within a radius of 160 kilometres of the location at which the driver reported for work. See sections 7 to 11.

Regulation respecting wood burning appliances: Proposed new regulation under the Environment Quality Act is found in the Gazette officielle du Qu�bec, April 23, 2008, p. 1212.

Regulation respecting occupational health and safety in mines (An Act Respecting Occupational Health and Safety): O.C. 221-2009 amends the regulation in several sections regarding remote control systems and other matters, including inspections, the storage of combustible liquids and grease, storage of explosives, prevention of predetonation, blasting.

Occupational Health and Safety Regulations: Regulation109/2008 replaces section 77 (smoking), in force May 31, 2009. See Saskatchewan Gazette, Nov. 14, 2008, p. 780.

Occupational Health and Safety Regulations, 1996 (Occupational Health and Safety Act, 1993): Sask. Reg. 18/2009 replaces section 154 (trained operators for powered mobile equipment) and the title to Table 14.1 of the Appendix.

Territorial Lands (Yukon) Act: S.Y. 2008, c. 23 amends the act adding subsections 18(6) and (7). The minister may now delegate responsibilities assigned under subsection 18(1) to the Deputy Minister or other officials.
