Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to May 2009. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between March and April 2009. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of June under which they were made (Governing Act).

4. New documents for the 2009-2 Issue of the Canadian enviroOSH Legislation DVD

Division 2 AMENDMENTS

Section 2.A Acts

First Nations Land Management Act: As a consequential amendment of 2008, c. 32, now proclaimed in force, item 24 of the Schedule is repealed.

Fisheries Act: As a consequential amendment of 2008, c. 32, now proclaimed in force, subsection 5(4) is replaced (laws of certain First Nations).

Section 2.B Regulations

Canada Occupational Health and Safety Regulations (Canada Labour Code): SOR/2009-84 presents 4 miscellaneous amendments to Part XIV (Materials Handling) and Part XIX (Hazard Prevention Program): brings consistency to the English and French versions of section 14.40; clarifies existing wording; eliminates the requirement for employers to submit a copy of their HPP evaluation to the Minister of Labour (subsection 19.8(1)).

Règlement canadien sur la santé et la sécurité au travail

Migratory Birds Regulations (Migratory Birds Convention Act, 1994): SOR/2009-75 amends note (h) of Table II of Part VI of Schedule I to correct an error in wording.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): SOR/2009-79 is reenacting sections 105, 121, 131, 135 and 301 of Schedule IV to extend their application expiration dates. The safety requirements referenced through the Technical Standard Documents remain in force.

Land Act: 2009, c. 4 (Bill 2) adds subsection (2) (government exemption from Surveyor General fees). Deemed in force April 1, 2007.

Section 2.B Regulations

Integrated Pest Management Regulation (Integrated Pest Management Act): B.C. Reg. 426/2008 and 427/2008 amends sections 5, 21, 64, 71 and 78, to regulate the application of pesticides to control mosquitoes and the spread of the West NileVirus. Subsection 64(3) has been replaced and outlines the public notice required when applying pesticides to control mosquitoes, including written notice to apiaries registered under the Bees Act. Section 78 is amended to control the conditions under which methoprene may be used.

Motor Vehicle Act Regulations (Motor Vehicle Act): B.C. Reg. 351/2008 amends the regulation to repeal and replace definitions for golf cart and utility vehicle. Division 24 (Vehicles of Unusual Size, Weight or Operating Characteristics) has been repealed and replaced. Several other amendments have been also amended to reflect the new Division 24. This division deals with vehicles such as golf cars and low and zero emission vehicles.

Building Code (Building Code Act, 1992): O. Reg. 205/08 amends the Building Code, effective April 1, 2010. See the Ontario Gazette, July 5, 2008.

Electrical Safety Code (Electricity Act, 1998): O. Reg. 453/08 updates references to the Canadian Electrical Code to the 2009 edition. In force May 1, 2009. See the Ontario Gazette, January 3, 2009, No. 1, p. 1576.

Needle Safety (Occupational Health and Safety Act): Amending regulation O. Reg. 317/08 is in force April 1, 2009. See the Ontario Gazette, Oct. 4, 2008, No. 40, p. 1103.

Division 2 AMENDMENTS

Section 2.A Acts

Highway Traffic Act: The remainder of 2007, c. 13 is now in force regarding licence suspension for blood alcohol concentration above .05. It replaces section 48 regarding police officers' powers to determine whether there is evidence to demand a breath sample. Wording additions are made to sections 48.1 to 48.3.

Pesticides Act: 2008, c. 11 (Bill 64) now proclaimed in force, amends the Act to prohibit the use and sale of certain pesticides that may be used for cosmetic purposes. See especially subsections 1(4) and new section 7.1.

Section 2.B Regulations

Boilers and Pressure Vessels Code Adoption Document (Technical Standards and Safety Act): The document is amended by a Director's Order. It replaces Section 1.0 to cite an updated Canadian Standards Association (CSA) B51 standard plus the exceptions and additions.

General - Waste Management (Environmental Protection Act): Among other changes, O. Reg. 110/09 replaces the definition of "agricultural waste" in subsection 1(1) and adds "disposal facility" and "farm operation". Section 3 is amended (exemptions from Part V of the Act).

Hours of Service (Highway Traffic Act): O. Reg. 114/09 adds section 3.1 which describes exemptions for volunteer firefighters.

Lake Simcoe Protection (Ontario Water Resources Act): Sections 6 to 8 of the original 60/08 regulation are repealed concerning new sewage treatment plants.

Needle Safety (Occupational Health and Safety Act): Sections of O. Reg. 317/08 now in force amend section (application to more facilities) and replace subparagraph 5(1)1ii.

Provincial Parks - General Provisions (Provincial Parks and Conservation Reserves Act, 2006): O. Reg. 113/09 adds Nagagamisis to Schedule 2.

Races, Contests and Stunts (Highway Traffic Act): O. Reg. 406/08 repeals section 1, effective May 1, 2009, regarding the police officer's report to the Registrar concerning driver information.

Commercial Vehicle (Trip Inspection and Records) Regulations (Highway Traffic Act): Among other changes, EC2009-145 adds new definitions to section 1; clarifies the types of vehicles to which these regulations do not apply in section 2; revokes and replaces the provisions dealing with the required information to be included in commercial vehicle inspection reports in accordance with Schedules I- IV - an exemption is provided from the requirements to prepare inspection reports in the case of a driver of a truck, tractor and trailer that is being operated within a radius of 160 kilometres of the location at which the driver reported for work. See sections 7 to 11.
