The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to January 2010. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

Contains information about amendments which have come into force between December 2009 to February 2010. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of December 2009 under which they were made (Governing Act).

Canada Oil and Gas Drilling and Production Regulations (Canada Oil and Gas Operations Act): Proposed regulations replace Canada Oil and Gas Drilling Regulations (SOR/79-82) and Canada Oil and Gas Production and Conservation Regulations (SOR/90-791). Newfoundland Offshore Petroleum Drilling and Production Regulations (Canada-Newfoundland Atlantic Accord Implementation Act): New regulations replace Newfoundland Offshore Petroleum Drilling Regulations (SOR/93-23) and Newfoundland Offshore Area Petroleum Production and Conservation Regulations (SOR 95-103). Notice of intent to amend the Phosphorus Concentration Regulations (Canadian Environmental Protection Act, 1999): Proposed amendments are found in the Canada Gazette, Part I, February 16, 2008, p. 329.

Nova Scotia Offshore Petroleum Drilling and Production Regulations (Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation Act ): New regulations replace Nova Scotia Offshore Petroleum Drilling Regulations (SOR/92-676) and Nova Scotia Offshore Area Petroleum Production and Conservation Regulations (SOR/95-190). Port Authorities Operations Regulations (Canada Marine Act): Proposed amendments are found in the Canada Gazette, Part I, EXTRA Vol. 141, No. 1, 2007.

Regulations Prescribing Circumstances for Granting Waivers Pursuant to Section 147 of the Act (Canadian Environmental Protection Act, 1999): Proposed regulations are found in the Canada Gazette, Part I, Nov. 14, 2009, p. 3406.

Species at Risk Act: Proposed amendments are found in the Canada Gazette, Part I, Dec. 5, 2009, pp. 3620, 3669.

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act, 1992): Proposed amendments are found in the Canada Gazette, Part I, May 2, 2009, p. 1376.

Virtual Elimination List (Canadian Environmental Protection Act, 1999): Proposals to add perfluorooctane and its salts to the regulation are found in the Canada Gazette, Part I, September 6, 2008, p. 2587.

Volatile Organic Compound (VOC) Concentration Limits for Architectural Coatings Regulations (Canadian Environmental Protection Act, 1999): Proposed regulations are found in the Canada Gazette, Part I, April 26, 2008, p. 1257.

Volatile Organic Compound (VOC) Concentration Limits for Automotive Refinishing Products Regulations (Canadian Environmental Protection Act, 1999): Proposed regulations are found in the Canada Gazette, Part I, April 26, 2008, p. 1295.

Volatile Organic Compound (VOC) Concentration Limits for Certain Products Regulations (Canadian Environmental Protection Act, 1999): Proposed regulations are found in the Canada Gazette, Part I, April 26, 2008, p. 1326.

Disposal at Sea Regulations (Canadian Environmental Protection Act, 1999): SOR/2009-256 amends the regulation by adding s. 8.1 regarding areas of the sea.

Domestic Substances List (Canadian Environmental Protection Act, 1999): SOR/2009-276 adds 13 substances to Part 1, amends the portion before paragraph (a) for 431-89-0 T-S in Part 2, and adds 15 substances to Part 3.

Federal Halocarbon Regulations, 2003 (Canadian Environmental Protection Act, 1999): SOR/2009-221 updates references to two ULC standards and aligns the English and French versions.

Migratory Birds Regulations (Migratory Birds Convention Act, 1994): SOR/2009-190 amends Schedule I to change some hunting season dates for the 2009-2010 hunting season and to set daily bag limits and possession limits for migratory game birds. SOR/2009-255 amends s. 15 to relieve an unecessary burden on mobility-impaired hunters of migratory birds, in recognition of their need to have use of a motorized vehicle to move to a location from which they can hunt.

Agricultural Operation Practices Act: S.A. 2009, c. A-26.8 amends subsection 1(a.1), ss. 20, 22 and subsection 44(1) regarding compliance with ALSA regional plans.

Coal Conservation Act: S.A. 2009, c. A-26.8 amends subesction 9(1) regarding compliance and enforcement of ALSA regional plans.

Environmental Protection and Enhancement Act: S.A. 2008, c. 32 is now in force amending subsection 194(a) by replacing "provincial court judge" with "judge of the Provincial Court". S.A. 2009, c. A-26.8 adds s. 3.1 regarding ALSA regional plans, repeals s. 22, and replaces ss. 23 and 24 regarding registration of agreements.

Natural Resources Conservation Board Act: S.A. 2009, c. A-26.8 adds s. 2.1 and adds clause (f) to subsection 44(2) regarding compliance with ALSA regional plans.

Oil and Gas Conservation Act: S.A. 2009, c. A-26.8 adds clause (bbb) to to subsection 10(1) regarding compliance with ALSA regional plans.

Oil Sands Conservation Act: S.A. 2009, c. A-26.8 adds clause (v) to subsection 20(1) regarding compliance with ALSA regional plans.

Pipeline Act: S.A. 2009, c. A-26.8 adds clause (hh) to subsection 3(1) regarding compliance with ALSA regional plans.

Oil and Gas Conservation Regulation (Oil and Gas Conservation Act): Alta. Reg. 234/2009 adds s. 16.635 to the regulation regarding the definition of "oilfield waste management facility".

Occupational Health and Safety Regulation (Workers Compensation Act): The 2010 Proposed Amendments for Consultation are to be found on the Worksafe BC website. Consultation period ends 4:30 pm Friday, December 18, 2009.

Motor Vehicle Act: 2009, c. 10, ss. 2(b), 3-9 and 10-14 are now in force amending the definition of "motor vehicle related Criminal Code offence" in s. 1, adding s. 25.01 (retention or seizure of records), and amending ss. 26.1, 31, 69, 70, and 74.

Wildlife Act: 2009, c. 33, subsections 8(a) and (c), ss. 14, 15(b), 17-27 and 30-32 are now in force adding definitions for "guiding area", "guiding territory" and "guiding territory certificate" and amending the definition of "person" in subsection 1(1). Amendments related to these definitions affect several sections.

Motor Vehicle Act Regulations (Motor Vehicle Act): B.C. Reg. 177/2009 amends table 4 of the Schedule to Division 28 by adding the following offences related to street racing and alcohol under the Criminal Code - 12.3 - 12.5, 17.1 - 17.2 and 18.1 - 18.2.

Planning Districts Regulation (Planning Act): Man. Reg. 159/2009 adds Rhineland, Plum Coulee, Gretna, and Altona Planning District to Schedule B.

Crown Lands and Forests Act: S.N.B. 2009, c. 23 is now in force amending s.1 by adding the definition of forest operations compliance audit, adding ss. 31.1 to 31.6 regarding compliance audits and amending subsection 95(1).

Mining Act: S.N.B. 2009, c. 35, ss. 33 and 69(a)(iii) are now in force adding ss. 48.1 - 48.8 and clauses (d.1) - (d.5) in subsection. 115(1) regarding mineral claims.

Building Code (Building Code Act, 1992): O. Reg. 205/08 amends the Building Code, effective April 1, 2010. See the Ontario Gazette, July 5, 2008.

General (Toxic Reduction Act, 2009, 2009, c. 19): This is a proposed regulation under the Toxic Reduction Act, 2009.

Building Code (Building Code Act, 1992): O. Reg. 365/09 adds subclause (vi.1) to clause 1.4.1.3(1)(a) of Division A.

Classification of Proposals for Instruments (Environmental Bill of Rights, 1993): O. Reg. 362/09 adds paragraph 9.1 to subsection 5(2) regarding proposals for renewable energy approval.

General Regulation (Environmental Assessment Act): O. Reg. 364/09 amends ss. 1, subsections 5(2), 6(1), ss. 7, 15 and adds s. 15.0.1.

General - Waste Management (Environmental Protection Act): O. Reg. 451/05 subsection 1(22) and s. 16 are now in force amending the definition of "subject waste" in subsection 1(1) and adding s. 78 regarding disposal of toxic waste.

Growth Plan Areas (Places to Grow Act, 2005): O. Reg. 385/09 adds s. 3 to the regulation regarding the geographic areas in the Northern Ontario growth plan area.

Records of Site Condition - Part XV.1 of the Act (Environmental Protection Act): O. Reg. 66/08 is now partly in force and section 5 (Qualified persons, other than risk assessment) has been repealed and replaced.

Construction Code (Building Act): Proposed amendment is found in the Gazette officielle du Qu�bec, May 6, 2009, p. 1632.

Regulation respecting accident reports (Highway Safety Code): Proposed amendments are found in the Gazette officielle du Qu�bec, Oct. 14, 2009, p. 3504.

Regulation respecting the application of the Environment Quality Act (Environment Quality Act): Proposed amendments are found in the Gazette officielle du Qu�bec, February 27, 2008, p. 690. The amendments concern authorization exemptions under section 22 of the Act.

Regulation respecting greenhouse gas emissions from motor vehicles and fees for excess emissions (Environment Quality Act). The draft regulation is found in the Gazette officielle du Qu�bec, January 3, 2008, p. 19.
