Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to February 2011. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between December 2010 to January 2011. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of December 2010 under which they were made (Governing Act).

4. New documents

Documents that will be on the web and the 2011-1 Issue of the Canadian enviroOSH Legislation DVD series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Division 2 CANADA AMENDMENTS

Section 2.A Canada Acts

Canadian Environmental Protection Act, 1999: SOR/2010-194 adds one toxic substance and SOR/2010-210 adds 4 toxic substances to Schedule 1 of the Act.

Hazardous Products Act: SOR/2010-225 replaces item 2, amends item 9 and replaces item 18 in Part I of Schedule I regarding the amount of lead in surface coating materials used for children's furniture and other articles.

Hazardous Products Act: SOR/2010-262 replaces item 25 in Part II of Schedule I regarding cribs, cradles and bassinets and SOR/2010-272 adds item 5 in Part II of Schedule 1 regarding consumer products containing lead (contact with mouth).

Section 2.B Canada Regulations

Antarctic Environmental Protection Regulations (Antarctic Environmental Protection Act): SOR/2010-196 makes several minor amendments intended to add clarity to the current text. Section 40 is amended to reference the Madrid Protocol.

Migratory Birds Regulations (Migratory Birds Convention Act, 1994): SOR/2010-139 changes certain hunting season dates for the 2010-2011 hunting season and sets daily bag limits and possession limits for migratory game birds. It also creates an earlier open date for the measures aiming to reduce the size of overabundant Snow Goose populations. .

Prohibition of Certain Toxic Substances Regulations, 2005 (Canadian Environmental Protection Act, 1999): SOR/2010-211 adds subsection 4(2) and adds Part 2 to Schedule 1 consisting of a table of prohibited toxic substances unless present in manufactured items.

Surface Coating Materials Regulations (Hazardous Products Act): SOR/2010-224 amends subsection 4(1) regarding concentration and test method criteria, subsection 5(1) regarding lead-content information on the display panel, and replaces s. 8 regarding lead in pavement markings.

Division 2 SASKATCHEWAN AMENDMENTS

Section 2.A Saskatchewan Acts

Tobacco Control Act: S.S. 2010, c. 34 amends section 2 by prohibiting smoking in the enclosed common areas of multi-unit residential dwellings and adding a definition for "little cigar". Section 5 is amended to prohibit the sale of little cigars in packages of less than 20. Section 6 is amended to prohibit the display of outdoor signs that promote tobacco or tobacco-related products. Section 10.1 is added to prohibit smoking in vehicles when children under 16 are present.

Section 2.B Saskatchewan Regulations

Reclaimed Industrial Sites Regulations (Reclaimed Industrial Sites Act): Sask. Reg. 109/2010 amends the regulation to add section 5.1 (Confirmation Letter) which concerns the acceptance of a closed site into the Institutional Control Program.

Tobacco Control Regulations (Tobacco Control Act): Sask. Reg. 94/2010 amends the regulation by adding sections 3.1 (Signs listing products and prices) and 3.2 (Signs re age restriction and health warning) restricting the display of indoor signs and prohibiting the display of outdoor signs that advertise or promote tobacco or tobacco-related products. Section 4.1 (Distance from doorway, window or air intake) prohibits smoking within 3 metres of all doorways, windows and air intakes of enclosed public places.
