Introduction
The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to March 2011. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

1. Legislation in progress/proposed
1A. Acts
Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.
Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).
Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.
1B. Regulations
List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.
2. Amendments
Contains information about amendments which have come into force between January 2011 to March 2011. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.
3. Repealed Legislation
Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of January 2011 under which they were made (Governing Act).
4. New documents

Division 2 CANADA AMENDMENTS
Section 2.A Canada Acts
Antarctic Environmental Protection Act: S.C. 2009, c. 14 is now in force and directs any fines as payable under the Act to the Environmental Damages Fund. This fund will be used for restoration and other environmental projects. The amendment brings into force new penalty schemes and improves other enforcement tools within the Act.
Canadian Environmental Protection Act, 1999 (S.C. 1999, c. 33): S.C. 2009, c. 14 is in force making several amendments including the addition of enforcement officer immunity and changes to the sentencing provisions of the Act. The existing liability and duty provisions are amended to make them consistent with other environmental acts. The Act is also amended to reflect the requirement that all fines collect from convicted corporations be credited to the Environmental Damages Fund.
Canada National Marine Conservation Areas Act: S.C. 2009, c. 14 is now in force and directs any fines as payable under the Act to the Environmental Damages Fund. Canada Wildlife Act (R.S.C. 1985, c. W-9): S.C. 2009, c. 14 is in force making several amendments including the addition of enforcement officer immunity and the power to designate analysts. The existing liability and duty provisions are amended to make them consistent with other environmental acts.

Division 2 ALBERTA AMENDMENTS
Section 2.A Alberta Acts
Energy Resources Conservation Act: This act has been amended to by the Carbon Capture and Storage Statutes Amendment Act, 2010 (S.A. 2010, c. 14) which provides a regulatory framework for the capturing and storage of carbon dioxide in Alberta. A definition has been added to section 1. Sections 3 (Consideration of public interest) and 21 (Inquiries and recommendations) have also been amended.
Oil and Gas Conservation Act: This act has been amended to by the Carbon Capture and Storage Statutes Amendment Act, 2010 (S.A. 2010, c. 14) which provides a regulatory framework for the capturing and storage of carbon dioxide in Alberta. Notable amendments have been made to sections 4 (Purposes of the Act), 41 Escape of oil, gas, water or substance),, 10 (Regulations), 39 (Approval of scheme), 68, of Part 11(Orphan Fund) and 97 (Closing area to travel). Section 23.1 (Captured carbon dioxide wells, facilities, and schemes) has been added to the act.
Public Lands Act: Section 20 (Occupation of land) has been amended to refer to "underground formations".
Section 2.B Alberta Regulations
Exemption Regulation (Safety Code Act): Alta. Reg. 209/2010 has extended the expiry date to 2015.
Oil and Gas Conservation Regulations (Oil and Gas Conservation Act): Alta. Reg. 156/2010 amends the regulation to delete "dipmeter survey" from subsection 12.150(4).
Power Engineers, Boiler, Pressure Vessel and Refrigeration Safety Regulation (Safety Standards Act): B.C. Reg. 333/2010 and 334/2010 amends the regulation to its references to various codes so they are current.
Renewable Fuels Standard Regulation (Climate Change and Emissions Management Act): Alta. Reg. 179/2010 amends sections 21 and 22 to update transitional periods.
Soil Conservation Notice Regulation (Soil Conservation Act): Alta. Reg. 195/2010 amends the regulation to repeal and replace the Schedule. The expiry date has been extended to 2020.

Occupational Health and Safety Regulation (Workers Compensation Act): The 2011 Proposed Amendments for Consultation are to be found on the Worksafe BC website. Consultation period ends 4:30 pm Friday, November 26, 2010.
Division 2 BRITISH COLUMBIA AMENDMENTS
Section 2.A British Columbia Acts
Forest Act: Section 2 of S.B.C. 2010, c. 11 is now in force. Section 59.1 is amended to amends sections to allow the Lieutenant Governor in Council to make regulations concerning the maximum terms for innovative forestry practices agreements.
Greenhouse Gas Reduction (Renewable and Low Carbon Fuel Requirements) Act: S.B.C. 2010, c. 21 amends the act to allow Part 2 fuel suppliers to retain overages and defer any shortages in the renewable fuel requirements and apply them to the next compliance period. Part 3.1 (Fuel Labelling Requirements) has been added requiring suppliers post labels or give notice of the renewable content of their fuel. Subsections 11(5) and (6) is amended to impose penalties for failing to meet renewable or low carbon fuel requirements. Sections 27.1 (Regulations in relation to labelling) and 29.1 (Transition - deferring Part 2 obligations).
Greenhouse Gas Regulation (Cap and Trade) Act: S.B.C. 2010, c. 21 is partly in force and amends section 4 (Emissions report) and section 39 (Regulations in relation to regulated operations and reporting operations) to deal with omissions or errors that are immaterial to emissions reports.
Section 2.B British Columbia Regulations
Elevating Devices Safety Regulation (Safety Standards Act): B.C. Reg. 335/2010 amends the Schedule (Adopted Safety Codes) is amended to outline amendments to CSA B44-07, CSA (Safety Code for Elevators and Escalators) and include B44.7-07 (Performance-based safety code for elevators and escalators) and CSA Standard B44.2-07 (Maintenance requirements and intervals for elevators, dumbwaiters, escalators, and moving walks).
Power Engineer, Boiler, Pressure Vessel and Refrigeration Safety Regulation: B.C. Reg. 333/2010 amends section 84 of the regulation. B.C. Reg. 334/2010 updates the Schedule with the latest versions of various standards.

Manitoba Building Code (Buildings and Mobile Homes Act): Man. Reg. 142/2010 amends the Building Code schedule to include references to certain changes under the National Building Code of Canada, 2005 including the use of HOT2000 energy analysis software or a comparable equivalent under certain circumstances. Fisheries and Costal Resources Act: S.N.S. 2010, c. 51 amends the act to restrict the definition of marketing. Section 73 has been clarified concerning when a licence is required to deal with fish products. Amendments to section 75 to simplify the grounds for refusing a license and section 77 simplifies the regulation-making powers of the Governor in Council concerning licensing and inspecting of fish products.
Occupational Health and Safety Act: In addition to some housekeeping amendments and the repeal of outdated subsections 25(3) - (4) and section 84, S.N.S. 2010, c. 66 amends the act to harmonize the definitions for serious and bodily injury.

Division 2 ONTARIO AMENDMENTS
Section 2.A Ontario Acts
Highway Traffic Act: S.O. 2009, c. 5 amends the act by adding sections 41.4, 48.4 and 55.2 which implement new seven-day vehicle impoundments. These apply to drivers driving with suspended licences, without a required vehicle ignition interlock device and those drivers who fail to meet blood alcohol content requirements.
Provincial Offences Act: S. O. 2009, c. 33, Sch. 4 amends section 18.6 (Authority to collect parking fines) and repeals subsection 20(1)(h) to reflect changes made to section 18.6.
Section 2.B Ontario Regulations
Building Code(Building Code Act): O. Reg. 315/10 amends the regulation to add definitions for Area affected by a significant drinking water threat, Lake Simcoe shoreline, Significant drinking water, Source protection area, Source protection plan, Vulnerable area. Section 1.10. (Sewage System Maintenance Inspection Programs) has been added to Division C.
Commercial Motor Vehicle Inspections (Highway Traffic Act): O. Reg. 411/10 amends the regulation to make consequential amendments to section 19 and Schedule 5.
Control of Exposure to Biological or Chemical Agents (Occupational Health and Safety Act): O. Reg. 419/10 amends the regulation to repeal and replace the Ontario Table of Occupational Exposure Limits.
Critical Defects of Commercial Motor Vehicles (Highway Traffic Act): O. Reg. 410/10 amends the regulation to repeal section 3 (Service of an Order to Impound and Suspend).
Designated Substance - Asbestos on Construction Projects and in Buildings and Repair Operations (Occupational Health and Safety): O. Reg. 422/10 amends the regulation to repeal section 7 (Ongoing asbestos management in buildings, two-year transitional period).
Industrial Establishments (Occupational Health and Safety): O. Reg. 413/10 amends the regulation to repeal Form 1. As well amendments have been made to update the language used and increase its accuracy.
Oil and Gas - Offshore (Occupational Health and Safety): O. Reg. 421/10 amends the regulation to update the language used and increase its accuracy. Sections 50, 95 and 100 have been repealed and replaced.
Safety Regulations (Highway Traffic Act): O. Reg. 413/10 amends Schedule 4.
