Introduction
The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to April 2011. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

1. Legislation in progress/proposed
1A. Acts
Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.
Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).
Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.
1B. Regulations
List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.
2. Amendments
Contains information about amendments which have come into force between January 2011 to February 2011. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.
3. Repealed Legislation
Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of February 2011 under which they were made (Governing Act).
4. New documents
Documents that will be on the web and the 2011-2 Issue of the Canadian enviroOSH Legislation DVD series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Division 2 CANADA AMENDMENTS
Section 2.A Canada Acts
Antarctic Environmental Protection Act (S.C. 2000, c. 32): S.C. 2009, c. 14 is in force making several amendments including the addition of enforcement officer immunity. The existing liability and duty provisions are amended to make them consistent with other environmental acts. The sentencing provisions including offences and their accompanying penalties are amended. The Act is also amended to reflect the requirement that all fines collected from convicted corporations be credited to the Environmental Damages Fund.
Hazardous Products Act (R.S.C. 1985, c. H-3): SOR/2010-297 adds item 38 regarding child care articles composed of vinyl that contains phthalates to Part II of Schedule 1.

International River Improvements Act (R.S.C. 1985, c. I-20): S.C. 2009, c. 14 is in force making several amendments including the addition of enforcement officer immunity and the power to designate analysts. The existing liability and duty provisions are amended to make them consistent with other environmental acts. The amendment brings into force new penalty schemes and improves other enforcement tools within the Act. The Act is also amended to reflect the requirement that all fines collected from convicted corporations be credited to the Environmental Damages Fund.
Section 2.B Canada Regulations
Domestic Substances List (Canadian Environmental Protection Act, 1999): SOR/2010-316 adds 11 substances to Part 1 and 3 substances to Part 3. SOR/2010-317 adds one substance to Part 1 of the list.

Occupational Health and Safety Regulation (Workers Compensation Act): The 2011 Proposed Amendments for Consultation are to be found on the Worksafe BC website. Consultation period ends 4:30 pm December 10, 2010.
Division 2 BRITISH COLUMBIA AMENDMENTS
Section 2.A British Columbia Acts
Occupational Health and Safety Regulation (Workers' Compensation Act): B.C. Reg. 312/2010 is a large amendment to the regulation. Part 1(Definitions) has been amended to include a registered forest technician and clarifies the reference to registered professional forester. In section 4.22.1 the definition of late night hours has been amended to harmonize the Occupational Health and Safety Regulation with the BC Liquor Control and Licensing Regulation. Part 4 (General Conditions) has been amended to establish minimum requirements for rope guardrail systems. The new Worksafe BC Standard will require the rope guardrails be installed and used in accordance with written instructions from an engineer and require the employer ensure an inspection of the completed installation by a qualified person prior to use. This will place responsibility for planning, design, installation and use of such guardrails solely with the employer, prime contractor or owner, as applicable, and the professional engineer. Parts 5, 6 and 30 have been amended to replace the term 'biohazardous' with 'biological agent'. It is Health Canada has deferred all biosecurity and biosafety matters to Public Health Agency of Canada and therefore all references to Health Canada have been updated. The definition of hazardous substances will now apply to human pathogens that have been classified by the Public Health Agency of Canada. Part 8 (Personal Protective Clothing and Equipment) has been amended relating to leg protection to ensure manufacturers have options for performance testing, regular re-testing and certification and will be able to provide customers with a choice of products. Part 16, (Mobile Equipment) has been amended to require mobile waste and recyclable materials collection, transportation and compaction equipment have a visual or audio warning signal device that meets the requirements of clause 7.2.14.1. Amendments have been made to clarify the vehicles and methods that may be used when collecting waste.
Section 2.B British Columbia Regulations
Commercial Transport Regulation (Commercial Transport Act): B.C. Reg. 337/2010 amends the regulation to replace the definition of 'axle width' with 'axle track width'. Appendices B, D - G, I and other sections have been amended to reflect this new terminology. Section 7.07 has been amended to update the time limits.
Renewable and Low Carbon Fuel Requirements Regulation (Greenhouse Gas Reduction (Renewable and Low Carbon Fuel Requirements) Act ): B.C. Reg. 338/2010 is now fully in force. In addition to other amendments, sections 7.1 (Retaining, deferring and transferring renewable fuel obligations), 7.2 (Exemption from "Part 2 fuel supplier), 7.3 (Renewable fuel labelling requirements), 11.021 (Crediting retained carbon dioxide equivalent emissions), 11.022 (Exemption from "Part 3 fuel supplier) have been added to the act.

Workplace safety and Health Regulation (Workplace Safety and Health Act): Man. Reg. 147/2010 has been amended to repeal and replace the definition for 'harassment'. In addition to these amendments the several sections have been amended to convert the use of tons, to kilograms. Section 1.1.1 (Interpretation of 'harassment') has been added to the act. These amendments include new requirements to protect workers from psychological harassment in the workplace. Many sections have been amended to simplify the terminology used and provide clear direction to employers and workers on necessary steps to control workplace hazards and to improve the requirements for the use of personal protective equipment. Division 2 ONTARIO AMENDMENTS
Section 2.A Ontario Acts
Building Code Act: S.O. 2009, c. 33, Sch. 21 is now completely in force amending sections 8 and 43.
Coroners Act: S.O. 2009, c. 15 amends the Act to create the Death Investigation Oversight Council to oversee and advise the Chief Coroner and the Chief Forensic Pathologist. The addition of section 8.1 outlines the role of the Council to provide advice in the areas of financial resource management, strategic planning, quality assurance, performance measures, accountability mechanisms, appointment and dismissal of senior personnel, the exercise of the power to refuse to review complaints, compliance with the Act and the regulations. Section 8.2 has been added to the Act, creating a complaints committee and section 8.4 outlines the complaints process. Members of the public may ask the complaint committee to review the outcome of a complaint to the Chief Coroner or Chief Forensic. The committee will make its report to Oversight Council.
Mining Act: S.O. 2009, c. 21 is in force making several amendments relating to prospecting , staking, disputing claims, assessment work, surface rights owners, exploration, diamond mine royalties and consultation with Aboriginal communities. Claims may be made by map staking and that the requirements for map staking may be set out in regulations. Exploration must be done in accordance with the Act's requirements and in consultation with concerned Aboriginal communities, as well as in accordance with the dispute resolution process for Aboriginal consultations. In Southern Ontario, if the Crown has the mining rights, but is not the surface owner, the land has been deemed to be withdrawn from prospecting, staking, selling or leasing. In the North those lands may be withdrawn by order. Part IV (Oil, Gas Underground Storage and Salt Solution Mining) is now applicable to the whole province. Technical amendments are made regarding the administration of diamond royalties in Part VIII. The amendment makes various changes regarding staking and recording of claims where there is a surface rights owner including notification requirements. As well, prosectors must now complete a prospector's awareness program in obtain a licence.
Section 2.B Ontario Regulations
Building Code (Building Code Act): O. Reg. 315/10 amends the regulation to add definitions for Area affected by a significant drinking water threat, Lake Simcoe shoreline, Significant drinking water, Source protection area, Source protection plan, Vulnerable area. Section 1.10. (Sewage System Maintenance Inspection Programs) has been added to Division C.
General - Waste Management (Environmental Protection Act): O. Reg. 336/09 amends the regulation to outline exemptions from Part V for waste disposal sites where there is a NASM plan area and the requirements of section 8.3, of Ontario Regulation 267/03, are satisfied (General).
Greenhouse Gas Emissions Reporting (Environmental Protection Act): O. Reg. 493/10 repeals the definition of "general stationary combustion" in subsection 1(1), replaces paragraphs 1-26 in subsection 2(1), replaces subsection 5(4), adds s. 5.1 (additional information), replaces subsection 11(6) and table 1.
Safety Inspections (Highway Traffic Act): O. Reg. 407/10 amends section 8 of the regulation and is now in force.

Beverage Containers Act: S.P.E.I. 2010, c. 3 amends section 23 to allow the Minister to appoint any an auditor that is not an employee of the Ministry.
Highway Traffic Act: S.P.E.I 2010, c. 14 amends the act to reflect the January 2010 reorganization of Government and a June 2010 name change for the Department of Justice and Public Safety. In addition to some housekeeping amendments, S.P.E.I 2010, c. 17 clarifies, in section 261, that offenses under section 253 or subsection 254(5) of the Criminal Code include care and control of a motor vehicle as well as its operation. S.P.E.I 2010 c. 18, amends the act to clarify and simplify that definition for 'emergency vehicle'. Section 114 is amended to change an incorrect reference to "authorized emergency vehicles" as there is no provision in the Act that provides for the "authorizing" of these vehicle. A provision that anticipates an exception, regarding the use of red lamps on vehicles, that is not provided for in the Act. Section 237 is amended to clarify that a driver of an emergency vehicle can approach and proceed through a red light at an intersection if the driver first stops and yields the right of way. The schedule is amended to set out the relevant fines for the operation of an emergency vehicle without a required warning device. 2010, c. 19 adds to the Act to definitions for "Class 5 driver's license", "international driving permit" and "work permit". Section 80 is amended to exempt to migrant workers, who are employed in the province in the agricultural or fishing industry. The exemption allows these workers to operate vehicles requiring Class 5 licenses, for a period of up to eight months in any year.
Smoke-free Places Act: S.P.E.I. 2010, c. 8 makes a minor amendment to section 1.
