Introduction
The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to May 2011. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca
Each jurisdiction contains information on the following:
1. Legislation in progress/proposed
1A. Acts
Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.
Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).
Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.
1B. Regulations
List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.
2. Amendments
Contains information about amendments which have come into force between February 2011 to March 2011. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.
3. Repealed Legislation
Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of March 2011 under which they were made (Governing Act).
4. New documents
Documents that will be on the web and the 2011-2 Issue of the Canadian enviroOSH Legislation DVD series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Division 2 CANADA AMENDMENTS
Section 2.A Canada Acts
Canadian Environmental Protection Act, 1999: SOR/2011-25 and SOR/2011-26 add toxic substances to Schedule 1 (97. - 107.)

Species at Risk Act: SOR/2011-8 adds new species under parts 1-4 of schedule 1 and removes "Aster, White-top (Sericocarpus rigidus)" from part 3 of schedule 1.
Section 2.B Canada Regulations
Domestic Substances List (Canadian Environmental Protection Act, 1999): SOR/2011-2 deletes 1 substance from Part 1 and adds 1 substance to Part 2. SOR/2011-29 deletes 1 substance and adds 6 substances to Part 1, adds 14 substances to Part 3and adds 3 substances to Part 4. SOR/2011-30 adds one substance to Part 3 of the list.
National Energy Board Cost Recovery Regulations (National Energy Board Act): SOR/2009-307, subsection 1(2) and ss. 15-19 are now in force repealing the definitions of "equichange transfer, "large electricity exporter" and "sale transfer". Section 15 is repealed, s. 16 is replaced and ss. 16.1-19 are amended.
Rules of Procedure for Boards of Review (Canadian Environmental Protection Act, 1999): SOR/2011-1 makes amendments to align the French and English versions, replaces s. 15 and adds ss. 16-18 (regarding costs).

Cleaner Gasoline Regulation (Environmental Management Act): B.C. Reg. 346/2010 amends the regulation to repeal and replace section 4 (Vapour pressure). Section 3.1 (Determination of grade of gasoline) has been added. Definitions for antiknock index, grade and research high octane number have been added to section 1.
Emissions Offsets Regulation (Greenhouse Gas Reduction Targets Act): B.C Reg, 347/2010 amends the regulation to add or amend definitions for validation body, validator, verification body and verifier. In addition to other amendments, section 10.1 (Determination respecting unaccredited validation or verification body) has been added to the act.
Renewable and Low Carbon Fuel Requirements Regulation(Greenhouse Gas Reduction (Renewable and Low Carbon Fuel Requirements)) : B.C. Reg. 379/2010 amends section 7 (Requirements for renewable fuel content).
Motor Vehicle Act Regulations (Motor Vehicle Report): B.C. Reg. 353/2010 amends the regulation by repealing Schedule U and adding Schedule W (Certificate of Enforcement Officer). B.C. Reg. 354/2010 amends section 27.03 of the regulation.
Reporting Regulation (Greenhouse Gas Reduction (Cap and Trade) Act): B.C. Reg. 376/2010 amends the regulation to add definitions for Canadian entitlement power, Columbia River Treaty, electricity import operation, final point of delivery, imported electricity, NERC E-tag, parent company, plant information summary, point of delivery, power contract, reporting-only emissions, specified power, sub-facility and unspecified power. In addition to other amendments to the reporting requirements under the regulation, Section 1.1 (Effect of amendments) Schedule D (Electricity Import Operation Methodologies, Additional Information and Instrumentation) have been added to the regulation.

Manitoba Building Code (The Buildings and Mobile Homes Act): Man. Reg. 157/2010 amends the regulation adding section 1.1. The National Building Code of Canada 2005 will not be adopted as the building code for Manitoba until April 01, 2011.

Division 2 NEWFOUNDLAND AND LABRADOR AMENDMENTS
Section 2.A Newfoundland and Labrador Acts
Highway Traffic Act: S.N.L. 2010, c. 31 amends the Act to correct an error in section 60.1(9). Section 49 is amended to clarify that the notice of licence suspension involves several sections of the Act and several periods of suspension.
Lands Act: S.N.L. 2010, c. 31 amends the act to update legislative references in section 15.
Section 2.B Newfoundland and Labrador Regulations
Heating Oil Storage Tank System Regulation (Environmental Protection Act): N.L.R. 114/10 amends the regulation to add subsection 3.1(1.1) dealing with the adoption of CSA B139. Sections 4, 13 and 16 are amended to impose later dates. Subsections 6(4) has been repealed and replaced and section 15(8) has been added. Both deal with requirements within the Labrador Inuit Settlement Area.

Trade Union Act: S.N.S. 2010, c. 76 amends the Act to repeal and replace section 43 (Powers and duty of arbitrator or arbitration board). Sections 43A - 43I have been added dealing with arbitration.
Occupational Health and Safety Act: S.N.S. 2010, c. 37 amends the act to reflect the establishment of the Labour Board under the Labour Board Act.
Section 2.B Nova Scotia Regulations
Air Quality Regulations (Environment Act): N.S. Reg. 187/2010 amends the regulation to deal with mercury emissions and capture. Sections 7A (Emission reduction plan for mercury emissions), 7B (Report on mercury emissions) and 7C (Compensating for mercury emissions over 65 kg in a calendar year) have been added.

Division 2 ONTARIO AMENDMENTS
Section 2.A Ontario Acts
Coroners Act: S.O. 2002, c. 33 amends the Act to update section 24. The Cemeteries Act has been replaced by the Funeral, Burial and Cremation Services Act, 2002.
Ontario Water Resources Act: S.O. 2002, c. 33 amends the Act to update section 53. The Cemeteries Act has been replaced by the Funeral, Burial and Cremation Services Act, 2002.
Provincial Parks and Conservation Reserves Act, 2006: S.O. 2010, c. 18 enacts a new Act with respect to land use planning and protection in the Far North. The Far North Act applies only to provincial crown land, and not any part of an Indian reserve or land owned by the federal Crown or located in a municipality. First Nations, may contribute their traditional knowledge and perspectives on protection and conservation for the purposes of land use planning under the Act.
Public Lands Act: S.O. 2010, c. 18 enacts a new Act with respect to land use planning and protection in the Far North. In section 1 the definition for "land use plan" has been added. The Minister's role has been amended under the Act.
Mining Act: S.O. 2010, c. 18 enacts a new Act with respect to land use planning and protection in the Far North. Section 1 has been amended to repeal and replace the definition for "community based land use plan". First Nations, may contribute their traditional knowledge and perspectives on protection and conservation for the purposes of land use planning under the Act.
Safety and Consumer Statues Administration Act, 1996: S.O. 2002, c. 33 amends the Act to update the Schedule. The Cemeteries Act has been replaced by the Funeral, Burial and Cremation Services Act, 2002. Sections 3 and 7 has been amended so that administrative authorities may be designated under that Act.
Section 2.B Ontario Regulations
Elevating Devices Code Adoption Document (Technical Standards and Safety Act, 2000): Ref. No. 238/09 amends the document adopt the updated CSA standard B355-09.
Provincial Parks: General Provisions (Provincial Parks and Conservation Reserves Act, 2006): O. Reg. 22/11 amends sections 1, 4, 5, 14, and 17. Schedule 1 has been amended and item 39 (Kawartha Highlands Signature Site Park) has been repealed and replaced.
Conservation Reserves: General Provisions (Provincial Parks and Conservation Reserves Act, 2006): O. Reg. 23/11 amends the regulation to add a definition for non-resident. Section 2 (Damage to Crown land) has been amended to add subsection 4 stating that fruit and edible plants may be picked for personal consumption.

Fire Prevention Acts: S.P.E.I. 2010, c. 14 amends the Act to make housekeeping updates sections 11 and 42.
Renewable Energy Act : S.P.E.I 2010, c. 9 is amended to repeal and replace section 6 (Definition, "former section"). This section deals with submission timelines for the Commission.
Section 2.B Prince Edward Island Regulations
Electrical Inspection Act Regulations (Electrical Inspection Act): EC2010-659 amends the regulation amends the regulation to repeal and add definitions to section 1. Section 5 is amended to allow the granting of a contractor's license two years of experience if the applicant has successfully completed an approved exam. Section 6.2 is amended to permit the granting of a registered technician's permit where the applicant has the required experience and has complete a home inspection program certified by the Canadian Home Inspection Association or other recognized organization that is acceptable to the Senior Electrical Inspector. Schedule 5 (Restricted Areas of Electrical Work) is repealed and replaced
Vehicle Weights and Dimensions Regulations (Roads Act): EC2010-656 amends section 16 (Existing triaxle trailers) in response to recent amendments to the regulations . Schedule 4 is amended to update the dimension requirements for tandem axle steering spreads in Category 5.

Division 2 QUEBEC AMENDMENTS
Section 2.A Quebec Acts
Act respecting industrial accidents and occupational diseases: S.Q. 2006, c. 53, remaining sections are now in force. S.Q. 2009, c. 19, ss. 7, 22-23 (enacting 315.1, 315.3-.4) and ss. 24-27 are now in force making extensive amendments to the Act.
Loi sur les accidents du travail et les maladies professionnelles
Act respecting off-highway vehicles: S.Q. 2010, c. 33 sections are now in force making amendments related to hours of operation, contributions of off-highway vehicle owners, complaints, mediation and arbritration of disputes. Some fines are also increased.
Loi sur les véhicules hors route
Act Respecting Owners, Operators and Drivers of Heavy Vehicles: S.Q. 2005, c. 39 subparagraph 3(3)(a) and (4) are now in force replacing 2(3)(a) regarding road vehicles with a gross vehicle weight rating of 4500 kg or more. Subparagrph 4 is also replaced providing a definition of gross vehicle weight rating.
Loi concernant les propriétaires, les exploitants et les conducteurs de véhicules lourds
Building Act: S.Q. 2010, c. 28 is now in force making several amendments which allow the Regie du batiment du Quebec to modernize the rules adopted under the Act, especially those relating to the safety of buildings and pressure installations.Amendments are also introduced to promote ecoefficiency in buildings, facilities and installations. S.Q. 2009, c. 57 remaining sections are now in force making amendments relating to the issue of building contractor and owner-builder licences and the restriction that may be attached to the licences. Penal provisions are also amended.
Civil Protection Act: S.Q. 2008, c. 18, s. 108 is in force adding Division II.1 (9-1-1 Emergency Centres). It also enacts S.Q. 2009, c. 26, s. 85 which amends the wording in s. 52.1. It also enacts S.Q. 2010, c. 18, which is now in force and repeals s. 52.9 of the Act.
Highway Safety Code: S.Q. 2010, c. 34 sections are now in force making extensive amendments. S.Q. 2008, c. 14 sections are now in force making amendments related to gross vehicle weight rating. S.Q. 2010, c. 33 makes amendments to reference off-highway vehicles.
Tobacco Act: S.Q. 2010, c. 7, s. 264 is now in force repealing s. 20.1 of the Act.
