INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to June 2011. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between March 2011 to April 2011. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of March 2011 under which they were made (Governing Act).

4. New documents

Documents that will be on the web and the 2011-2 Issue of the Canadian enviroOSH Legislation DVD series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Section 2.A Canada Acts

Canadian Environmental Protection Act, 1999: SOR/2011-34 and SOR/2011-35 add 5 substances to Schedule 1 of the Act.

Benzene in Gasoline Regulations (Canadian Environmental Protection Act, 1999): SOR/2011-41 replaces paragraph 19(8)(b) to improve clarity.

Fishery (General) Regulations (Fisheries Act): SOR/2011-39 replaces paragraph 7(1)(f) regarding notices in sport fishing publications published by the province or Department.

Règlement de pêche (dispositions générales)

Pulp and Paper Effluent Regulations (Fisheries Act): SOR/2011-38 replaces schedule V which prescribes the persons who may issue an authorization to deposit deleterious substances into water frequented by fish. Paragraph 4(2)(b) and subsection 4(3) of Schedule IV.1 in the French version are also amended.

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act, 1992): SOR/2011-60 amends s. 1.3.1 to reference CGSB-43.126 on drums, and CGSB-43.147 on rail transport, amends Part 5, Means of Containment, and removes a sunset date from special provision 89 in Schedule 2 referring to subsection 5.12(1). References are also updated to the International Civil Aviation Organization (ICAO) Technical Instructions and the Supplement to the ICAO Technical Instructions to the 2009-2010 Edition.

Traffic Safety Act: S.A. 2007, c. 45 and 2009, c. 36 are now partly in force. Sections 184 and 187 have been amended. Definitions for lender, lessor, motor vehicle liability policy, security agreement, security interest and seller have all been added to section 187.

Section 2.B Alberta Regulations

Commercial Vehicle Certificate and Insurance Regulation (Traffic Safety Act): Alta Reg. 208/2010 amends the regulation to add section 31.1, Liability.

Exemption Regulation (Safety Codes Act): Alta. Reg. 209/2010 has been amended to extend the expiry date of the regulation.

Section 2.A British Columbia Acts

Safety Standards Act: S.B.C. 2010, c. 21 amends the act to remove the use of "equivalent standards agreement" and replaced it with the term "alternative safety approach". Section 10 is amended to state that regulated products without a certification mark or an approval mark must have a notice attached or posted nearby stating that they are accepted under an alternative safety approach. Such a product must be used in accordance with the alternative safety approach.
