INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to May 2011. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between April 2011 to May 2011. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of May 2011 under which they were made (Governing Act).

4. New documents

Documents that will be on the web and the 2011-3 Issue of the Canadian enviroOSH Legislation DVD series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Nuclear Energy Act (R.S.C. 1985, c. A-16): S.C. 2010, c. 12, s. 2147 is in force and replaces subsection 11(2) regarding the agent of her Majesty.

Removes 1 substance and adds 1 substance to Part 3. Removes "Bacillus atrophaeus" from Part 5 and adds "Bacillus species" to Part 7 of the list. SOR/2011-106 adds 9 substances to Part 1, adds 1 substance to Part 2, adds 5 substances to Part 3 and adds 1 substance to Part 4.

Conservation and Reclamation Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 34/2011 amends the regulation to add sections 24.1 - 24.4, dealing with additional provisions relating to financial security. In addition to other amendments, sections 16 (Definitions) and 20 (Scheduled adjustment of security) have been repealed and replaced. Section 20.1 (Adjustment of security when required) has been added.

Elevating Devices, Passenger Ropeways and Amusement Rides Permit Regulation(Safety Codes Act): Alta. Reg. 12/2011 amends the expiration date in section 14 to read February 28, 2011.

Forest Resources Improvement Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 6/2011 amends the expiration date in section 14 to read February 28, 2011.

Off-Highway Vehicle Regulation (Traffic Safety Act): Alta. Reg. 38/2011 updates certain fees cited in this regulation.

Tire Designation Regulation (Environmental Protection Enhancement Act): Alta. Reg. 230/2010 amends the regulation to add a schedule (Maximum Advance Disposal Surcharges For Tires).

Forest Act: S.B.C. 2010, c. 11 amends the Act to add Division 3.01 (Allowable Annual Cut Partition). S.B.C. 2010, c. 17 amends section 8 to make changes in consequence of the Kunst'aa guu - Kunst'aayah Reconciliation Protocol between the Haida Nation and British Columbia.

Forest and Range Practices Act: S.B.C. 2010, c. 17 amends the Act to make changes in consequence of the Kunst'aa guu - Kunst'aayah Reconciliation Protocol between the Haida Nation and British Columbia.

Division 2 ONTARIO AMENDMENTS

Section 2.A Ontario Acts

Health Protection and Promotion Act: S.O. 2011, c. 1, Sch. 6 amends the Act to update section 77.7 and remove references to repealed acts.

Occupational Health and Safety Act: S.O. 2011, c. 1, Sch. 7 is partly in force and amends the act to clarify terminology and eliminate unintended gaps in sections 52 and 53. Sections 22.1 (Powers under federal legislation) and 53 (Accidents, etc., at project site or mine) have been replaced. Ontario Mining Acts: S.O. 2009, c. 21 is partly in force. Sections 17 (When documents Received), 46.1(Mining Claim where surface rights owner), 59 (Transfer) and 83 (Exchange of lease) have been added or replaced. Section 59.1 has been repealed.

Healing Arts Radiation Protection Act: S.O. 2011, c. 1, Sch. 6 amends the Act to update references to acts so they are current and to update technical language. It also removes outdated or redundant provisions.

Workplace Safety and Insurance Act: 2011, c. 1, Sch. 7 is partly in force and amends the Act. Sections 45 and 46 o address payments for loss of retirement income and compensation for non-economic loss benefit. Sections 45 and 46 of the Act are amended to address when payments for loss of retirement income and compensation fornon-economic loss benefit are paid as lump sums or as periodic payments. Section 47 is amended to provide workers shall be notified when the board intends to give a an employer a copy of a physician's report about a permanent impairment and the worker is to be given an opportunity to object to this disclosure outlined in the given procedure.

Section 2.B Ontario Regulations

General (Crown Forest Sustainability Act, 1994): O. Reg. 101/2011 amends the Regulation to gives the minister the power to set examinations for a scaler's licence. .

Renewable Energy Approvals under Part v.0.1 of the Act (Environmental Protection Act): O. Reg. 521/10 extensively amends the regulation to clarify and add detail where the original intent was either unclear or required additional instruction. These amendments deal with a variety of issues including noise receptors, setback prohibitions, cumulative noise assessments and requirements for the wind turbine specifications report . Requirements for municipal consultation and public notification have been clarified. The purpose of the regulation remains to govern the approach to regulating renewable energy generation facilities.

Environmental Assessment Fees Regulations (Environmental Protection Act): EC2011-96 clarifies that crown corporations listed in Schedule B of the Financial Administration Act are exempt from payment of feeds when corporations file under subsection 9(1) of the Environmental Protection Act.
