INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to June 2011. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between May 2011 to June 2011. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of May 2011 under which they were made (Governing Act).

4. New documents

Documents that will be on the web and the 2011-3 Issue of the Canadian enviroOSH Legislation DVD series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Hazardous Products Act: S.C. 2010, c. 21 is in force June 20, 2011 repealing definitions from s. 2, adding the definition for "controlled product" or "hazardous product", repealing part I, schedule 1 and replacing paragraph 12(f).

Paragraphs one and five are replaced and subsection 1(2) of schedule 3 to reflect that the reporting due date for the 2010 reporting year is changed from June 1, 2011, to June 17, 2011 to allow more time to comply, because of the delayed launch of the online reporting system for the Greenhouse Gas Emissions Reporting Program (GHGRP).

Division 2 ALBERTA AMENDMENTS

Section 2.A Alberta Acts

Alberta Utilities Commission Act: S.A. 2011, c. 11 amends the Act to add subsection 76(0.1).

Coal Conservation Act: S.A. 2011, c. 11 amends the Act to repeals and replaces Part 6 (Development, Operation and Abandonment of In Situ Coal Schemes) along with the addition of section 51 (Cancellation of Industrial Development Permits and Applications) and other amendments. The ERCB is no longer issuing permits authorizing the use of energy resources in industrial and manufacturing facilities.

Oil and Gas Conservation Act: S.A. 2011, c. 11 amends section 1 and section 10 (Regulations) of the Act along with the addition of section 51 (Cancellation of Industrial Development Permits and Applications). Section 43 has been repealed. The ERCB is no longer issuing permits authorizing the use of energy resources in industrial and manufacturing facilities.

Oil Sands Conservation Act: S.A. 2011, c. 11 amends the Act to repeal section 12 (Industrial development permits). The ERCB no longer issues permits authorizing the use of energy resources in industrial and manufacturing facilities.

Worker's Compensation Act: S.A. 2011, c. 17 amends the Act to repeal and replace the definition for full-time firefighter and adds a definition for part-time firefighter and updates references to them accordingly.

Section 2.B Alberta Regulations

Administrative Items Regulation (Safety Codes Act): Alta. Reg. 52/2011 amends the regulation to extend its expiration date to 2016.

Oil and Gas Conservation Regulations (Oil and Gas Conservation Act): Alta. Reg. 65/2011 amends the regulation to repeal sections 14.030, 14.040,14.070, 14.080, 14.090, 14.100, 14.110, 14.120, 14.140,14.150, 14.160, 14.170, 14.180 and 14.190. Subsections 14.060(1)(a) and (b), (2) and (3) were also repealed. Section 14.011 has been added.

Division 2 ONTARIO AMENDMENTS

Section 2.A Ontario Acts

Building Code Act, 1992: S.O. 2009, c. 33, Sch. 6 updates subsection 30(2) to reference the current Public Inquiries Act, 2009.

Environmental Bill of Rights, 1993: S.O. 2009, c. 33, Sch. 6 updates subsection 60(2) to reference the current Public Inquiries Act, 2009.

Fire Protection and Prevention Act, 1997: S.O. 2009, c. 33, Sch. 6 is now in force. It updates subsection 9(3) to reference the current Public Inquiries Act, 2009.

Niagara Escarpment Planning and Development Act: S.O. 2009, c. 33, Sch. 6 updates section 75 to reference the current Public Inquiries Act, 2009.

Occupational Health and Safety Act: S.O. 2011, c. 11 (Bill 160) is now partly in force. In response to the Tony Dean Report, these amendments establish the position and responsibilities of the Chief Prevention Officer and the Prevention Council. Much of the amendment is not in force and thus, the whole scheme is not currently in place. The Minister of Labour is empowered to establish standards for training programs as well as approving programs. The Chief Prevention Officer will co-ordinate and align the prevention system. The Prevention Council, with representatives from labour, employers, and safety experts, will advise the Chief Prevention Officer and Minister.

Workplace Safety and Insurance Act, 1997: S.O. 2011, c. 11 (Bill 160) is now partly in force. In response to the Tony Dean Report, consequential amendments for the Act are partly in force.

Workplace Safety and Insurance Act, 1997: S.O. 2009, c. 33, Sch. 6 updates section 136 to reference the current Public Inquiries Act, 2009.

Hospital Standards Act (R.S.S. 1978, c. H-10): S.S. 2002, c. R-8.2 subsections 99(1) and (4) are in force June 1, 2011 repealing the remaining sections of the act.

Hospital Standards Regulations, 1980 (Regional Health Services Act ): Sask. Reg. 27/2011 repeals clauses from s. 1, amends subsection 56(8) and repeals ss. 11, 16, 52, 54, 59 and 85.
