INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to July 2011. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between June to July 2011. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of July 2011 under which they were made (Governing Act).

4. New documents

Documents that will be on the web and the 2011-3 Issue of the Canadian enviroOSH Legislation DVD series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Carbon Tax Act: S.B.C. 2011, c. 9 amends the Act to add sections 13.1 (Calculation of tax for certain biomethane blends and mixtures), 14.1 (Biomethane Credits), 14.2 (Refund to retail dealer of natural gas), and 14.3 (Recovery of amount by retail of natural gas. Other amendments are made to incorporate these amendments and the addition of Biomethane Credits.

Clean Energy Act: S.B.C. 2011, c. 5 amends the Act to add section 17.1 (Improvement financing) and amends section 37. S.B.C. 2011, c. 13 amends section 3 to change the submission date requirements for a integrated resource plan.

Environment and Land Use Act: S.B.C. 2011, c. 13 amends the section 2 (Committee continued) of the act.

Forest Act: S.B.C. 2011, c. 13 amends subsection 44(5) and adds subsection (5.1).

Petroleum and Natural Gas Act: S.B.C. 2011, c. 11 amends the Act to repeal subsection 80/2(1) (Treaty first nation exemption).

Section 2.A Manitoba Acts

Crown Lands Act: S.M. 2011, c. 36 adds s. 7.1.1 regarding wetlands.

Environment Act: S.M. 2011, c. 36 replaces subsection 40.1(1) outlining prohibitions on confined livestock areas and manure storage facilities for pigs and adds section 40.2 regarding winter spreading of livestock manure and section 40.3 prohibiting disposal fields in the capital region.

Loi sur l'Environnement

Mines and Minerals Act: S.M. 2011, c. 36 adds section 128.1 implementing a moratorium on permits or leases for peat and peat moss. Further amendments are made to reflect this change.

Planning Act: S.M. 2011, c. 36 adds subsection 1(3) outlining what municipalities are considered part of the capital region and subsection 51(1.1) regarding when drinking water and wastewater plans are required. Section 62.2 regarding water and wastewater infrastructure is also added.

Water Protection Act: S.M. 2011, c. 36 adds ss. 4.1 to 4.4 regarding the North End Water Pollution Control Centre and adds section 35.1 outlining the power of the minister to enter into agreements with the Government of Canada. Additionally, clauses 39(1)(b.1) to (b.3) are added.

Division 2 ONTARIO AMENDMENTS

Section 2.A Ontario Acts

Crown Forest Sustainability Act, 1994: S.O. 2011, c. 10 amends the act by replacing section 28 and adding section 35.1 regarding the surrender of licenses and sections 41.1 and 41.2 regarding the cancellation of agreements, licences or commitments and limitations on remedies, respectively. Section 54.1 requiring holders of forest resource processing facility licences to make returns containing the specified information is also added.

Dangerous Goods Transportation Act: S.O. 2010, c. 16, Sch. 12 amends the act to reflect the applicable requirements of the Transportation of Dangerous Goods Act, 1992 (Canada). These amendments include changes to terminology in the Act for consistency with the federal Act. Amendments to section 11 allow the Lieutenant Governor to make regulations differing from or prescribing exemptions from the federal Act. The penalties outlined in section 4 are revised to include a maximum fine of $50,000 and/ or imprisonment for less than 2 years.

Fire Protection and Prevention Act, 1997: S.O. 2011, c. 13, s. 2 adds section 53.1 regarding mandatory retirement.

Highway Traffic Act: S.O. 1996, c. 20, s.4 is now in force replacing clauses 35(1)(b) and (f).

Section 2.B Ontario Regulations

Accessible Vehicles (Highway Traffic Act): O. Reg. 172/11 updates the requirements for vehicles designed or modified to transport passengers with disabilities, not including those being used for personal purposes (e.g. family van). The regulation has also been streamlined to remove outdated or redundant requirements.

Commercial Motor Vehicle Inspections (Highway Traffic Act): O. Reg. 78/11 amends paragraph 14(1)3 by removing the reference to Schedule 4. O. Reg. 171/11 replaces notes 14 and 23 in Section 19.

Confined Spaces (Occupational Health and Safety Act): O. Reg. 95/11 is in force July 1, 2011. It consolidates the various sector specific legal requirements relating to work in confined spaces into a single regulation. It should be noted that the amendments continue to recognize the differences between those provisions applying specifically to construction projects and those for workplaces covered by existing sector-specific legislation.

Construction Projects (Occupational Health and Safety Act): O. Reg. 96/11 is in force July 1, 2011 repealing Part II.1 regarding Confined Spaces and amending clause 247(1)(b) by referencing O. Reg. 632/05 (Confined Spaces).

Designation and Classification of Provincial Parks (Provincial Parks and Conservation Reserves Act, 2006): O. Reg. 125/11 makes several amendments to park classifications and boundary descriptions.

Equipment (Highway Traffic Act): O. Reg. 73/11 repeals section 1 regarding brakes, makes minor amendments to section 2, adds subsection 3(2) and replaces items 5 and 6 of the Table to section 3.

General (Off-Road Vehicles Act): O. Reg. 458/10 adds paragraphs 33 - 35 to Schedule 1.

General Regulation (Toxics Reduction Act): O. Reg. 214/11 sets out the qualifications and licencing requirements for the newly created position of toxic substance reduction planner and outlines their role in the certification of a toxic substance reduction plan. The regulation also makes several administrative amendments including extending the due date for Phase 1 plans and plan summaries by one year, to December 31, 2012.

Health Care and Residential Facilities (Occupational Health and Safety Act): O. Reg. 97/11 repeals sections 43 to 43.19 regarding work in confined spaces. O. Reg. 169/11 amends the list of applicable facilities in section 2.

Industrial Establishments (Occupational Health and Safety Act): O. Reg. 98/11 repeals Part I.1 regarding Confined Spaces and amends section 50 by referencing O. Reg. 632/05 (Confined Spaces).

Lamps - Use of Flashing Red or Green Lights (Highway Traffic Act): O. Reg. 76/11 repeals the definitions of "ambulance", "emergency" and "emergency response vehicle". Paragraph 2(3) is also repealed.

Mines and Mining Plants (Occupational Health and Safety Act): O. Reg. 99/11 repeals Part XII regarding Confined Spaces.

Safety Inspections (Highway Traffic Act): O. Reg. 80/11 makes extensive amendments to reflect the requirements of the National Safety Code Standard 11B, entitled "Periodic Commercial Motor Vehicle Inspections". This includes revised inspection requirements for buses, school-purpose vehicles, accessible vehicles, and commercial vehicles such as trucks and trailers.

X-Ray Safety Code (Healing Arts Radiation Protection Act): O. Reg. 173/11 adds definitions of "CT scanner" and "dental CT scanner". Sections 5.1 - 5.3 are added regulating the operation of these devices.

Regulation respecting the quality of the atmosphere (Environment Quality Act): O.C. 501-2011 (Clean Air Regulation, Q-2, r.4.1) replaces this regulation, except for paragraph 33 of s. 1 and ss. 96.1 - 96.3 and 96.6. The provisions of this regulation continue to apply to existing establishments, facilities, equipment and furnaces to the extent provided for in the Title VII of the Clean Air Regulation. (c.
