INTRODUCTION
The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to August 2011. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca
Each jurisdiction contains information on the following:
1. Legislation in progress/proposed
1A. Acts
Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.
Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).
Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.
1B. Regulations
List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.
2. Amendments
Contains information about amendments which have come into force between August to September 2011. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.
3. Repealed Legislation
Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of August 2011 under which they were made (Governing Act).
4. New documents
Documents that will be on the web and the 2011-4 Issue of the Canadian enviroOSH Legislation DVD series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Species at Risk Act: SOR/2011-128 amends parts 1-4 of schedule 1
Section 2.B Canada Regulations
Migratory Birds Regulations (Migratory Birds Convention Act, 1994): SOR/2011-120 amends schedule 1 to change hunting season dates for certain species for the 2011/12 hunting season and to set daily bag limits and possession limits for migratory game birds. It also extends to southeastern Ontario the existing spring special conservation season in place in Quebec regarding Snow Geese to provide additional opportunity to reduce the size of overabundant Snow Goose populations.
Regulations Respecting the Coordination by Federal Authorities of Environmental Assessment Procedures and Requirements (Canadian Environmental Assessment Act): SOR/2011-139 replaces s. 2 regarding the application of the regulation to the environmental assessment of projects.

Division 2 ALBERTA AMENDMENTS
Section 2.A Alberta Acts
Alberta Land Stewardship Act: S.A. 2011, c. 9 makes several amendments including clarifying the intent of the legislation to focus on increased respect for property and individual rights. The compensatory framework of the Act is broadened and focuses of strengthening the provisions relating to the regional planning process.
Pipeline Act: S.A. 2011, c. 11 amends section 1 concerning synthetic coal gas and liquid.
Workers' Compensation Act: S.A. 2011, c. 17 amends the Act to add definitions for full-time and part-time firefighters in section 24.1. Subsequent language is updated to reflect this amendment.
Section 2.B Alberta Regulations
Activities Designation Regulation (Environmental Protection and Enhancement Act): Alta Reg. 97/2011 amends section 15 to amend the date for review of this regulation to June 30, 2013.
Administrative Penalty Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 105/2011 amends the regulation to update section 6 (Expiry).
Commercial Vehicle Dimension and Weight Regulation (Traffic Safety Act ) Alta. Reg. 114/2011 amends the regulation to update section 23 (Expiry).
Conservation and Reclamation Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 105/2011 amends the regulation to update section 25.1 (Expiry).
Edmonton Restricted Development Area Regulations (Government Organization Act): Alta. Reg. 123/2011 amends items 5 and 7 of the Schedule.
Energy Resources Conservation Board Administration Fees Regulation(Energy Resources Conservation Act): Alta. Reg. 95/2011 amends the regulation to update fees and references to the fiscal year.
Lubricating Oil Material Recycling and Management Regulation (Energy Resources Conservation Act): Alta. Reg. 105/2011 amends the regulation to update section 11 (Expiry).
Metallic and Industrial Minerals Exploration Regulation (Mines and Minerals Act): Alta. Reg. 104/2011 amends the regulation to update section 46 (Expiry).
Oil Sands Conservation Regulation (Oil Sands Conservation Act): Alta. Reg. 115/2011 adds several definitions to section 1, amends section 21, adds section 24 (Storage or disposal structures) and replaces sections 30 and 31 regarding mine plans and mining operations reports, respectively. Several other administrative amendments are made, including a new expiry date of June 30, 2021.
Paint and Paint Container Designation Regulation (Energy Resources Conservation Act): (Energy Resources Conservation Act): Alta. Reg. 105/2011 amends the regulation to update section 4 (Expiry)
Radiation Health Administration Regulation (Government Organization Act): Alta. Reg. 120/2011 makes several amendments regarding authorized radiation health administrative organizations and radiation protection agencies.
Specified Gas Emitters Regulation (Climate Change and Emissions Management Act): Alta. Reg. 127/2011 replaces the definition of "emission offset", adds subsections 1(1) - (6) regarding requirements for calculating emission offsets and replaces subsection 8(2).
Work Camps Regulation (Public Health Act): Alta. Reg. 107/2011 amends the regulation to update section 16.

Division 2 BRITISH COLUMBIA AMENDMENTS
Section 2.A British Columbia Acts
Environmental Management Act: S.B.C. 2011, c. 13 amends the definition of "motor vehicle" in section 71.
Land Act: S.B.C. 2010. c. 21 is now in force and imposes a requirement for the Surveyor General to file a survey plan of treaty lands where required by the final agreement.
Ministry of Environment Act: S.B.C. 2011, c. 5 amends s. 6.1 regarding the disclosure of information.
Motor Vehicle Act: S.B.C. 2011, c. 13 adds the definitions of "golf cart", "industrial vehicle" and "mobile equipment" section 3.1 regarding exemptions with respect to registration, licences and insurance for these classes of vehicles. Further amendments are made to reflect these changes.
Section 2.B British Columbia Regulations
Recycling Regulation (Environmental Management Act): B.C. Reg. 296/2009, s. 2 is in force replacing the definition of "product category" in section 1.
Renewable and Low Carbon Fuel Requirements Regulation (Greenhouse Gas Reduction (Renewable and Low Carbon Fuel Requirements) Act): B.C. Reg. 77/2011 amends section 11.02 (Requirement for reduced carbon intensity). Section 11.021 (Crediting retained carbon dioxide equivalent emissions) is also amended concerning with greenhouse gas emission credits.
Clean or Renewable Resource Regulation (Clean Energy Act ): B.C. Reg. 81/2011 amends sections 1 and 2 of the regulation. The resources defined as clean or renewable have been amended.

Employment Standards Regulation (Employment Standards Code): Man. Reg. 62/2011 revises the minimum wage rate in section 11 and adds Quebec as a reciprocating jurisdiction in section 27. Man. Reg. 106/2011 replaces item 7 of subsection 19(2) regarding deductions for payroll error, cash advance or service charges and repeals subsection 21(2).
Minimum Periods of Employment and Non-Smoking Firefighters and OFC Personnel Regulation (Workers Compensation Act): Man. Reg. 108/2011 amends the name of the regulation. Section 2 (Minimum period of employment for diseases) is amended.

Division 2 ONTARIO AMENDMENTS
Section 2.A Ontario Acts
Ontario Water Resources Act: S.O. 2007, c. 7 replaces paragraph 1 of subsection 89.2(1) regarding records of site condition and adds section 89.2.2 requiring a notice of order to be filed in the Registry.
Environmental Protection Act: S.O. 2007, c. 7, Sch. 13 amends the act to make changes in the concerning how records of site condition are processed and what information is retained and by whom.
Section 2.B Ontario Regulations
Air Pollution - Local Air Quality (Environmental Protection Act): O. Reg. 282/11 is now partly in force and amends the regulation to replace the risk-based process for contaminated sites Site-specific Standards are to be introduced and based on best available technology. Economic constraints will be considered where requested.
Classification of Proposals for Instruments (Environmental Bill of Rights, 1993): O. Reg. 512/09 is in force replacing paragraph 15 of subsection 5(2).
General (Application of Act) (Environmental Bill of Rights, 1993): O. Reg. 513/09 is in force July 1, 2011 adding section 15.4 regarding a proposal for a certificate of property use.
General (Endangered Species Act, 2007): O. Reg. 67/11 amends the regulation to add section 4.1 (Bobolink). O. Reg. 293/11 amends the regulation to add sections 5.1(Eastern flowering dogwood), 23.1 (Development and infrastructure - redside dace), 24.2(Eastern flowering dogwood habitat), 28.1 (Ogden's pondweed habitat) and section 29.1 (Redside dace habitat). O. Reg. 294/11 amends the regulation to repeal and replace section 5 (Butternut).
General (Pesticides Act): O. Reg. 63/09, ss. 116(4) is in force amending clause 103(a) of the regulation.
Hospital Management (Public Hospitals Act): O. Reg. 216/11 is partly in force and amends the regulation to allows nurses in the extended class to have extra responsibilities concerning patients within hospitals.
Product Safety (Electricity Act): O. Reg. 226/11 amends the regulation to exclude medical devices from sections 8 and 9.
Records of Site Condition - Part XV.1 of the Act (Environmental Protection Act): O. Reg. 511/09 is now in force making the following changes. New Standards are introduced, along with revisions to the Phase I and II Environmental Site Assessment requirements such as mandating the completion of a Phase II Environmental Site Assessment where a property has been used for an industrial use or certain specified commercial uses. O. Reg. 245/10 and O. Reg. 179/11 are also in force, making additional amendments to the content added by O. Reg. 511/09.
Species at Risk in Ontario List (Endangered Species Act, 2007): O. Reg. 224/11 replaces Schedules 1 to 4 of this regulation.
Vehicle Weights and Dimensions - For Safe, Productive and Infrastructure-Friendly Vehicles (Highway Traffic Act): O. Reg. 457/10 related to Phase 4 of the vehicle weights and dimensions reforms came into force on July 1, 2011. This regulation introduced Safe, Productive and Infrastructure-Friendly (SPIF) trucks, truck-trailer combinations, buses and some specialty combinations. Those vehicles and vehicle combinations manufactured after June 31, 2011 must be built to SPIF standards or operate at reduced weights. Any Phase 4 vehicle manufactured before July 1, 2011 will be grandfathered until the end of 2020 or until it reaches 15 years from date of original manufacture, whichever is longer. Certain vehicles may operate up to 20 years from date of manufacture.

Environment Quality Act: S.Q. 2011, c. 14 is in force making several amendments regarding residual materials management. It better defines the concept of reclamation and enables the Government to determine what residual material treatment operations constitute reclamation. An order of precedence is established in the treatment of residual materials and reduction at source is given priority. S.Q. 2009, c. 21 is in force adding several sections to Division V of Chapter 1 pertaining to water resource protection and management. Schedule O.A is also added.
