INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to September 2011. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between August to September 2011. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of September 2011 under which they were made (Governing Act).

4. New documents

Documents that will be on the web and the 2011-4 Issue of the Canadian enviroOSH Legislation DVD series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Renewable Fuels Regulations (Canadian Environmental Protection Act, 1999): SOR/2011-143 makes several amendments requiring diesel fuel and heating distillate oil producers and importers to have an average annual renewable fuel content of at lest 2% of the volume of distillates that they handle. Fuel for use in certain northern parts of Canada is excluded.

Section 2.A Alberta Acts

Workers' Compensation Act: S.A. 2010, c. 16, as it amends the Workers' Compensation Act, is now in force. "born out of wedlock" has been removed from the definition for child in section 1.

Section 2.B Alberta Regulations

Firefighters' Primary Site Cancer Regulation (Workers' Compensation Act): Alta. Reg. 73/2011 amends section 2 (Designated cancers and periods of employment) to add additional primary cite cancers and multiple myeloma.

Oil Sands Conservation Regulation (Oil Sands Conservation Act): Alta. Reg. 133/2011 amends the regulation to remove the definition for "processing plant under clause 1(2)(x) and amend section 2.

Pressure Equipment Safety Regulation (Safety Codes Act): Alta. Reg. 138/2011 amends the regulation to a definition for shop inspection in section 1. Section 4 has been amended to update the referenced standards. Section 25 has been amended to require a shop inspection by a safety codes officer when the manufacturer's data report must be certified.

Division 2 BRITISH COLUMBIA AMENDMENTS

Section 2.A British Columbia Acts

Forest and Range Practices Act: S.B.C. 2010, c. 12 is now partly in force. Section 2.1 (Application of Act to first nations woodland licence) has been added to the Act, specifying that first nations woodland licences are to be treated either like community forest agreements or woodlot licences, depending on the size and location. Other sections have been amended concerning timber harvesting and obligations relating to invasive plants. S.B.C. 2011, c. 13 amends section 67 of the act.

Protected Areas of British Columbia Act: S.B.C. 2009, c. 19 amends the Schedule C to update the entries on Big Bunsby Marine Park, Tahsish-Kwois Park and Brooks Peninsula Park. S.B.C. 2010, c. 13 amends the Schedule D to update the entry on Cariboo River Park.

Section 2.B British Columbia Regulations

British Columbia Dam Safety Regulation: B.C. Reg. 108/2011 amends the regulation add sections 3.1 (Emergency preparedness plans) and 3.2 (Change of classification), 6.1 (Downstream Conditions) and 7.1 (Potential safety hazard at a dam). Section 5 to 7 have been repealed and replaced to reflect the addition of the new sections. Schedules 1 (Dam Classification) and 2 (Minimum Frequency of Safety Activities) have been repealed and replaced.

Carbon Tax Regulation (Carbon Tax Act): B.C. Reg. 112/2011 amends the regulation to add Part 4.1 (Biomethane Credit).

Cleaner Gasoline Regulation (Environmental Management Act): B.C. Reg. 131/2011 amends the regulation to add references to standard CAN/CGSB - 3.512 - 2011 (Automotive Ethanol Fuel (E50 - E85)) have been added to Section 9 and Schedule 1.

Commercial Transport Regulations (Commercial Transport Act): B.C. Reg. 127/2011 amends the regulation to repeal and replace Appendices A - I. Section 8.02 (Pilot Car) has also been repealed and replaced.

Contaminated Sites Regulation (Environmental Management Act) B.C. Reg. 97/2011 amends the Regulation to update Schedules 6 and 10.

Drilling and Production Regulation (Oil and Gas Activities Act): B.C. Reg. 94/2011 amends section 4 (Exemptions for particular sites and installations from specified provisions).

Drinking Water Protection Regulation (Drinking Water Protection Act): B.C. Reg. 87/2011 amends section 1 to add a definition for "system within a system". Section 3 is amended to exclude a system within a system from the definition of a domestic water system within the Act.

Firefighters' Occupational Disease Regulation (Workers Compensation Act): B.C. Reg. 123/2011 amends Section 3 to add primary site esophageal cancer.

Tree Farm Licence Management Plan Regulation (Forest Act): B.C. Reg. 133/2011 amends section 6 (Public review). The minister is now responsible for outlining the management plan strategy.

Weed Control Regulation (Weed Control Act): B.C. Reg. 143/2011 amends the regulation to add entires for Part I (Provincial Weeds) of Schedule A.

Wildfire Regulation (Wildfire Act): B.C. Reg. 96/2011 amends the regulation to add section 12.1 (Hazard abatement: qualified holders). A definition for "qualified holder" is added to section 1. Subsection 11(3.1) is added to the regulation to outline the prescribed intervals for the conduct of fire hazard assessments. B.C. Reg. 104/2011 amends the regulation to add a reference to first nations woodland licences to section 4 (Requirement to provide contact details).

Section 2.B Manitoba Regulations

Biodiesel (General) Regulation (Biofuels Act): Man. Reg. 116/2011 amends the regulation by replacing the definition for diesel and adding section 11.1 which details the supplementary reports to be submitted by commercial and non-commercial licence holders.

Biodiesel Mandate for Diesel Fuel Regulation (Biofuels Act): Man. Reg. 117/2011 adds section 3.1 (Exemptions), which is deemed to have come into force on November 01, 2009. Other amendments have been made as a result of the addition of section 3.1.

Ethanol General Regulation (Biofuels Act): Man. Reg. 118/2011 adds sections 7.1 (Fuel suppliers), 12.1 (Supplementary reports) and 12.2 (Transition: amended report for exemptions) to the regulation. Amendments to section 2 and the addition of section 2.1 (Time limit for exclusions) are deemed to have come into force on January 01, 2008.

Water Supply System Regulations (Public Health Act ): R-069-2011 amends ss. 13 and 15 regarding drinking water transported by pipes required to have a small amount of free chlorine residual. Sections 24-29 are repealed.

Section 2.A Nova Scotia Acts

Labour Standards Code: S.N.S. 2010, c. 37 amends the act to reflect the establishment of the Labour Board under the Labour Board Act. S.N.S. 2011, c. 19 makes several amendments regarding the recruitment and protection of foreign workers and makes several corrections as a result of changes made by S.N.S. 2010, c. 37.

Motor Vehicle Act: S.N.S. 2011, c. 8 amends section 68 to update the reinstatement fee. S.N.S. 2010, c. 21 is now in force and amends section 191 (Regulations respecting weights and loads).

Trade Union Act: S.N.S. 2010, c. 37 amends the act to reflect the establishment of the Labour Board under the Labour Board Act.

Section 2.B Nova Scotia Regulations

Classes of Vehicles to be Inspected at Official Testing Stations Regulations (Motor Vehicle Act): N.S. Reg. 243/2011 amends the regulation to amend section 3 (Classes of vehicles to be tested biannually).

General Regulations (Labour Standards Code): N.S. Reg. 219/2011 makes several amendments reflecting changes to the Labour Standards Code resulting from the establishment of the Labour Board under the Labour Board Act. .

Nova Scotia Building Code Regulations (Building Code Act): N.S. Reg. 266/2011 amends the regulation to add section 3.1.1.20 to the regulation.

Vehicle Inspection Regulations (Motor Vehicle Act): N.S. Reg. 238/2011 amends the regulation to add section 18A (Official Inspection Station Manual). Additional amendments have been made as a result of this addition.

Vehicle Warning Lights Regulation (Motor Vehicle Act): N.S. Reg. 233/2011 amends the regulation to repeal and replace section 7(Lights displayed by certain peace officers) and add section 7A (Lights displayed by vehicle of a peace officer of Corrections Service of Canada).

Weights and Dimensions of Vehicles Regulations (Motor Vehicle Act): N.S. Reg. 232/2011 amends Schedule A (Vehicle Weights and Dimension Limits) of the Regulation. Schedules A-2 (2-axle Pony Trailer Axle Weight Reduction for Pony Trailers Model Year 2002 and Earlier) and A-3 (3-axle Pony Trailer Axle Weight Reduction for Pony Trailers Model Year 2002 and Earlier) have been repealed and replaced. Schedules A-4 (Semi-trailer Axle Weight Reduction for Semi-trailers Model Year 2002 and Earlier), B (B-Train Routes), C (Maximum Weight Roads) and Schedule D (Intermediate Weight Roads) have been repealed. Other sections have been amended throughout as a result of these changes.

General (Environmental Assessment Act ): O. Reg. 308/11 adds Section 7.1 and related amendments to state that public works undertaken by the Ontario Infrastructure and Lands Corporation are exempt from the Act.

Restricted Use of Left Lanes by Commercial Motor Vehicles (Highway Traffic Act): O. Reg. 366/11 repeals and replaces Schedule 8 (Highway No. 417).

Seat Belt Assemblies (Highway Traffic Act): O. Reg. 362/11 amends sections 5 and 6 to remove references to repealed definitions in Part VI (Equipment) of the Act and replace them with references to the definitions in subsection 1(1).

Transit Projects and Metrolinx Undertakings (Environmental Assessment Act): Under O. Reg. 355/11, Transit Projects and Greater Toronto Transportation Authority Undertakings is now called Transit Projects and Metrolinx Undertakings.
