INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to October 2011. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between September to October 2011. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of October 2011 under which they were made (Governing Act).

4. New documents

Documents that will be on the web and the 2011-4 Issue of the Canadian enviroOSH Legislation DVD series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): SOR/2009-323 is in force introducing a new standard 126 (electronic stability control systems) that requires an electronic stability control (ESC) system on prescribed vehicles with a gross vehicle weight rating of 4,536 kilograms or less and manufactured on or after September 1, 2011. This Canadian safety standard is expected to reduce the number of crashes in which the driver loses directional control of the vehicle. This also harmonizes requirements between Canada and the United States.

British Columbia Dam Safety Regulation (Water Act): B.C. Reg. 163/2011 amends the regulation to repeal and replace section 14 (Transition - dam safety review and report).

Gas Safety Regulation (Safety Standards Act): B.C. Reg. 150/2011 amends the regulation to update the referenced standards in various sections with more recent versions. Section 7 (Class B gas fitter certificate of qualification) is amended.

Motor Vehicle Act Regulation (Motor Vehicle Act): B.C. Reg. 160/2011 amends the regulation to update section 52.03 to clarify that the standard only applies to transporting cargo on a highway when exceeding a licensed gross weight of 5000 kg.

Environmental Protection Act: S.O. 2010, c. 16, Sch. 7 is not mostly in force. The Act has been amended to reflect the new environmental compliance approval process within Ontario.

Section 2.B Ontario Regulations

Designation of Waste (Environmental Protection Act): O. Reg. 243/11 amends the regulation to comply with changes to the environmental compliance process. Sections 3 and 4 have been repealed.

Disposal of Dead Farm Animals (Nutrient Management Act): O. Reg. 235/11 amends the regulation comply with changes to the environmental compliance process.

Environmental Penalties (Ontario Water Resources Act): O. Reg. 252/11 amends the regulation in consequence of the Open for Business Act, 2010 that is now in force. This change is made to reflect changes to the environmental compliance process.

General Regulation (Environmental Assessment Act): O. Reg. 249/11 amends section 11.1 of the regulation to comply with changes to the environmental compliance process.

Industrial, Commercial and Institutional Source Separation Programs (Environmental Protection Act): O. Reg. 230/11 amends 7 and 8 of the regulation to comply with changes to the environmental compliance process.

Licensing of Sewage Works Operators (Environmental Protection Act): O. Reg. 236/11 amends the regulation to comply with changes to the environmental compliance process.

Mine Development and Closure Under Part VII of the Act (Mining Act): O. Reg. 229/11 amends the regulation to comply with changes to the environmental compliance process.

Mobile PCB Destruction Facilities (Environmental Protection Act): O. Reg. 233/11 amends the regulation to repeal Form 1 (Application for a Certificate of Approval for Destruction of PCBs Using Mobile Technology). The regulation has removed references to the former certificate for approval to reflect changes to environmental compliance process.

Municipalities, Secured Creditors, Receivers, Trustees in Bankruptcy and Fiduciaries - Part XV.2 of the Act (Environmental Protection Act): O. Reg. 237/11 amends the regulation to comply with changes to the environmental compliance process.

Renewable Energy Approvals under Part V.0.1 of the Act (Environmental Protection Act): O. Reg. 231/11 amends the regulation to comply with changes to the environmental compliance process.
