INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in July 2012. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in July 2012. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of July 2012 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Canadian Environmental Protection Act, 1999: S.C. 2009, c. 14, ss. 72-80 and 87-88 are in force making amendments regarding offences, penalties, regulations, criminal negligence, liability of corporations and offences, penalties, regulations, and liability with respect to ships.

Section 2.B Canada Regulations

Migratory Birds Regulations (Migratory Birds Convention Act, 1994): SOR/2012-110 makes amendments to change hunting season dates and set daily bag limits and possession limits as well as make other related modifications for certain species of migratory game birds for the 2012-13 hunting season to ensure the sustainable harvest of migratory game bird populations.

Section 2.A Alberta Acts

Safety Codes Act: S.A. 2011, c. 3, subsection 33(7) is in force updating references in ss. 11, 45 and 65 to the Engineering and Geoscience Professions Act.

Traffic Safety Act: S.A. 2011, c. 22 is in force introducing progressive administrative penalties for drivers with blood alcohol levels of .05 or greater, tougher penalties for drivers over .08 and a stronger zero tolerance policy for new drivers.

Water Act: S.A. 2011, c. 3, subsection 33(8) is in force updating a reference in s. 23 to the Engineering and Geoscience Professions Act.

Wildlife Act: Alta. Reg. 86/2012 amends Item 1 of the Schedule to the Act.

Workers' Compensation Act: S.A. 2008, c. 19, section 44 is in force updating a reference in s. 1.1 to the Insurance Act.

Section 2.B Alberta Regulations

Drivers' Hours of Service Regulation (Traffic Safety Act): Alta. Reg. 98/2012 establishes a new expiry date of January 1, 2015.

Elevating Devices, Passenger Ropeways and Amusement Rides Administration Regulation (Government Organization Act): Alta. Reg. 65/2012 amends section 92 to reflect a new expiry date of April 30, 2014.

Energy Resources Conservation Board Administration Fees (Energy Resources Conservation Act): Alta. Reg. 97/2012 establishes a new fee structure for the 2012-12 fiscal year.

Oil and Gas Conservation Regulations (Oil and Gas Conservation Act): Alta. Reg. 50/2012 amends section 3.051 regarding production exceptions from section 3.050.

Pipeline Regulation (Pipeline Act): Alta. Reg. 48/2012 makes several amendments to reflect changes to the titles of various Directives and replaces sections 13 and 50 pertaining to shutdown devices. Alta. Reg 78/2012 adds a definition for "drilling waste" and references Directives 050 and 058.

Vehicle Inspection Regulation (Traffic Safety Act): Alta. Reg. 64/2012 amends section 92 to reflect a new expiry date of April 1, 2017.

Wildlife Regulations (Wildlife Act): Alta. Reg. 86/2012 makes several amendments to the regulations.

Division 2 BRITISH COLUMBIA AMENDMENTS

Section 2.A British Columbia Acts

Carbon Tax Act: S.B.C. 2012, c. 8 ss. 6 - 18 add section 1.1 regarding fuel imported by ship. Further amendments are made referencing this new section.

Clean Energy Act: S.B.C. 2012, c. 27 redefines self-sufficiency and eliminates the requirement for BC Hydro to acquire an extra 3,000 gigawatt hours per year of insurance energy by 2020.

Forest Act: S.B.C. 2012, c. 18 makes minor amendments to sections 12 and 151. S.B.C. 2012, c. 27 amends subsection 47.5(2) by referencing the Oil and Gas Activities Act.

Forest and Range Practices Act: S.B.C. 2012, c. 27 amends sections 203 and 204 to reflect recent changes to the Oil and Gas Activities Act.

Motor Vehicle Act: S.B.C. 2012, c. 26 amends sections 215.41 - 215.5 in order to provide drivers with a way to more meaningfully challenge the results of failed roadside breath-tests.

Oil and Gas Activities Act: S.B.C. 2012, c. 27 makes several amendments to clarify the rules for municipalities and third parties doing work around a pipeline. Further amendments are made to increase the efficiency and authority of the Oil and Gas commission.

Protected Areas of British Columbia Act: S.B.C. 2012, c. 9 makes minor amendments to sections 2 and 3. S.B.C. 2012, c. 32 makes several amendments to the protected areas described in Schedules C, D, E and F.

Public Health Act: S.B.C. 2012, c. 22 replaces paragraph 9(1)(f) regarding puposes for the collection, use and disclosure of personal information.

Utilities Commission Act: S.B.C. 2012, c. 27 increases the ability of the B.C. Utilities Commission (BCUC) to levy administrative penalties for non-compliance with the act. This includes a maximum allowable fine will be $1 million per day.

Workers' Compensation Act: S.B.C. 2012, c. 23 replaces section 5.1 regarding mental disorder and 33.2 regarding workers classified as apprentices or learners. Further amendments are made to fees throughout the Act.

Section 2.B British Columbia Regulations

Conservation Officer Service Authority Regulation (Environmental Management Act): B.C. Reg. 34/2012 repeals paragraph 1(2)(a) and adds paragraph 1(2)(a.6) referencing the Forest Act.

Food Premises Regulation (Public Health Act): B.C. Reg. 69/2012 repeals the definition of "health official" and adds section 2.1 regarding prescribed health hazards and regulate activities. Several other minor amendments are made to reflect these changes.

Motor Vehicle Act Regulations (Motor Vehicle Act): B.C. Reg. 204/2011 is in force amending clause 27.05(7)(b).

Oil and Gas Activities Act General Regulation (Oil and Gas Activities Act): B.C. Reg. 40/2012 adds section 5.1 regarding the application of s. 8 of the Act and adds Schedule A.

Permit Fees Regulation (Environmental Management Act): B.C. Reg. 60/2012 removes a reference to the recently repealed Finfish Aquaculture Waste Control Regulation from section 3.

Recycling Regulation (Environmental Management Act): B.C. Reg. 297/2009 is in force replacing subsection 2(1) of Schedule 3 regarding the electronic and electrical product category. Sections 2.1, 2.2, 2.3, 3.1, 3.2 and 3.3 of Schedule 3 are repealed.

Reviewable Projects Regulation (Environmental Assessment Act): B.C. Reg. 59/2012 amends Table 11 of the regulation.

Waste Discharge Regulation (Environmental Management Act): B.C. Reg. 60/2012 repeals paragraph (b) in the definition of "aquaculture - marine-based industry".

Hospital Management (Public Hospitals Act): O. Reg. 216/11 amends sections 11, 14, and 25.

Independent Forest Audits (Crown Forest Sustainability Act, 1994): O. Reg. 54/12 adds subsections 1(4) and (5) regarding forest audit periods.

Prescribed Activities and the Environmental Activity and Sector Registry - Heating Systems, Standby Power Systems and Automotive Refinishing (Environmental Protection Act): O. Reg. 100/12 replaces paragraph 5(4)1 to reference the newly published Ground Source Heat Pumps Regulation (O. Reg. 98/12).

Safety Helmets (Highway Traffic Act): O. Reg. 102/12 adds clause 2(e) referencing United Nations Economic Commission for Europe Regulation No. 22.

Security of Loads (Highway Traffic Act): O. Reg. 165/12 replaces the definition of "National Standard: in subsection 1(1) and replaces section 7. Other amendments are made to reflect these changes.

Electrical Inspection Act Regulations (Electrical Inspection Act): EC2012-245 replaces Schedule 1 outlining the flat rate fee structure and Schedule 2 regarding the itemized fee schedule. Clause 4(1)(c) regarding the contractor (restricted) fee is also replaced.

Elevators and Lifts Act Regulations (Elevators and Lifts Act): EC2012-246 replaces the fee structure outlined in subsection 286(1).

Environmental Records Review Regulations (Environmental Protection Act): EC2012-197 adds definitions of "commercial property" and "residential property" to section 1, replaces section 2 regarding the request process and fees for review of records and replaces subsection 3(2) establishing the information to be provided to an applicant. Schedule 1 containing the current Form 1 is repealed.

Fall Protection Regulations (Occupational Health and Safety Act): EC2012-304 adds section 2.1 requiring that employees be trained in the use of a means of fall protection.
