INTRODUCTION
The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in September 2012. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca
Each jurisdiction contains information on the following:
1. Legislation in progress/proposed
1A. Acts
Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.
Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).
Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.
1B. Regulations
List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.
2. Amendments
Contains information about amendments which have come into force in September 2012. These amendments have been incorporated in the respective legislation by CCOHS staff.
3. Repealed Legislation
Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of September 2012 under which they were made (Governing Act).
4. New documents
Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Division 2 CANADA AMENDMENTS
Section 2.A Canada Acts
First Nations Land Management Act: S.C. 2012, c. 19, some sections are in force. Several amendments are made expediting the processes to enact environmental laws, excluding land from a land code when it is uncertain whether the particular land forms part of the reserve, removing uncertainty as to the date the land codes come into force, and bringing clarity to the schedule of the Act.
National Energy Board Act: S.C. 2012, c. 19, some sections are in force. The amendments allow the Governor in Council to make the decision about the issuance of certificates for major pipelines. The amendments also establish time limits for regulatory reviews under the Act and enhance the powers of the National Energy Board Chairperson and the Minister responsible for the Act to ensure that those reviews are conducted in a timely manner.
Section 2.B Canada Regulations
Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): SOR/2011-264 is in force updating the standards for Anchorages for Seats and Seat Belt Anchorages and amending the definition for designated seating position to improve the safety of vehicles by ensuring that occupants are provided with seat belts in all intended seating locations.
Pulp and Paper Effluent Regulations (Fisheries Act): SOR/2012-140 makes several amendments to reflect the fact that off-site treatment facilities are now regulated under the newly publish Wastewater Systems Effluent Regulations.

Sulphur in Diesel Fuel Regulations (Canadian Environmental Protection Act): SOR/2012-135 is in force making amendments to implement the North American Emission Control Area (ECA) requirements which will dramatically reduce air pollution from ships and deliver substantial air-quality and public health benefits that extend hundreds of kilometres inland. MARPOL Annex VI requires that when operating in an ECA, ship owners/operators will use lower sulphur fuels, with limits of 10 000 mg/kg or less as of August 1, 2012, and 1 000 mg/kg or less as of January 1, 2015.

Traffic Safety Act: S.A. 2009, c. 35, sections are now in force adding a definition for "investigator" and adding sections 2.1, 2.2 and 2.3 which outline the role, responsibilities and authority of investigators.
Section 2.B Alberta Regulations
Nuisance and General Sanitation Regulation (Public Health Act): Alta. Reg. 141/2012 amends the regulation to reflect a new expiry date of September 1, 2014.
Oil and Gas Conservation Regulations (Oil and Gas Conservation Act): Alta. Reg. 121/2012 amends subsection 1.020(2) by amending definitions 5.11 and 5.14 and adding definitions 5.141 and 5.21 referencing Directives 024 and 068 respectively. Section 1.200 is added.
Personal Services Regulation (Public Health Act): Alta. Reg. 142/2012 amends the regulation to reflect a new expiry date of September 30, 2014.
Public Railway Regulation (Railway (Alberta) Act): Alta. Reg. 131/2012 amends the regulation to reflect a new expiry date of August 31, 2017.
Vehicle Equipment Regulation (Traffic Safety Act): Alta. Reg. 143/2012 amends section 108 regarding safety helmets.

Forest Act: S.B.C. 2008, c. 20 is now in force making several amendments to reflect the introduction of a fibre supply licence to cut. S.B.C. 2011, c. 13, ss. 63 & 94(b) are now in force adding the definition of "restricted forest licence" and adding paragraph 151(2)(k.11).
Motor Vehicle Act: S.B.C. 2012, c. 33, s. 18 is in force amending section 26 of the Act to reflect recent amendments to the South Coast British Columbia Transportation Authority Act.

Administrative Orders and Remedies Regulation (Forest and Range Practices Act): B.C. Reg. 157/2012, Sch. 3 amends section 8 of the regulation.
Carbon Tax Regulation (Carbon Tax Act): B.C. Reg. 142/2012, Sch. 1 adds subsections 13(0.1) and 34(1.1) and adds section 45.1 regarding classes and prescribed amounts of fuel imported by ship.
Environmental Protection and Management Regulation (Oil and Gas Activities Act): B.C. Reg. 148/2012 adds Division 0.1 regarding the application of Part 3 to a holder of a master licence to cut.
Forest Planning and Practices Regulation (Forest and Range Practices Act): B.C. Reg. 157/2012, Sch. 4 makes several amendments to reflect the recent introduction of fibre recovery tenures to the forestry legislation.
Motor Vehicle Act Regulations (Motor Vehicle Act): B.C. Reg. 90/2012 adds paragraph 4.28(8)(h). B.C. Reg. 97/2012 replaces items 60 and 61 in Table 1 of the Schedule to Division 28. B.C. Reg. 128/2012 makes several amendments regarding certain classes of motor vehicles, including industrial utility vehicles, beverage carts, miniature motor vehicles, golf carts and mobile equipment, in order to reflect recent changes to section 3.1 of the Act. Part 2.1 regarding Mobile Equipment is also added to the regulation.
Oil and Gas Activities Act General Regulation (Oil and Gas Activities Act): B.C. Reg. 147/2012 amends section 5.1 and repeals sections 11 and 12 to reflect the introduction of the Pipeline Crossings Regulation.
Waste Discharge Regulation (Environmental Management Act): B.C. Reg. 87/2012 repeals the definitions of "domestic sewage" and "sewerage system" and repeals subsection 3(2) to remove references to the Sewerage System Regulation.
Wildfire Regulation (Wildfire Act): B.C. Reg. 157/2012, Sch. 5 adds a definition for "fibre recovery tenure holder" and adds section 12.2 regarding hazard abatement for fibre recovery tenure holders. Sections 11 and 33 are also amended.

Highway Traffic Act: S.N.L. 2012, c. 17 makes several amendments including consolidating subsection 73(2) and section 43 of the Act to provide one section respecting the offence of driving while suspended and, as a consequence of that consolidation amend the provisions for penalties, suspension, seizure and impoundment. S.N.L. 2012, c. O-7.02 amends section 61 referencing the Optometry Act.
Urban and Rural Planning Act: S.N.L. 2012, c. 10 adds section 106.1 regarding the application of fines.

Off-Highway Vehicle Act: S.P.E.I. 2012, c. 29 replaces subsection 1.2(2) regarding permit requirements for the Confederation Trail and amends the fines outlined in subsection 12(4).
Public Health Act: S.P.E.I. 2012, c. 31 adds a new part regarding Milk and Milk Products to replace the newly repealed Dairy Industry Act.
