INTRODUCTION
The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in October 2012. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca
Each jurisdiction contains information on the following:
1. Legislation in progress/proposed
1A. Acts
Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.
Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).
Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.
1B. Regulations
List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.
2. Amendments
Contains information about amendments which have come into force in October 2012. These amendments have been incorporated in the respective legislation by CCOHS staff.
3. Repealed Legislation
Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of October 2012 under which they were made (Governing Act).
4. New documents
Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Canadian Environmental Protection Act, 1999: SOR/2012-164 amends parts 1, 2 and 3 of Schedule 3. SOR/2012-186 amends item 8 in schedule 1. SOR/2012-187 adds item 125 to schedule 1. SOR/2012-189 adds item 126 to schedule 1. SOR/2012-219 add items 121-124 in schedule 1.

First Nations Land Management Act: SOR/2012-217 adds items 59-77 (First Nations that have signed the Framework Agreement) to the schedule.
Fisheries Act: S.C. 2012, c. 19 sections are in force to add the definition of "analyst" in s. 2, and adding ss. 4.1-4.4 (Agreements, Programs and Projects), s. 10, s. 39, s. 43.1-43.2 and ss. 89-91. Sections 32, 35-38, 40, 43, 63, and 82 are also amended.

Environment Act: S.N.S. 2011, c. 61 is now in force making substantial amendments as a result of a complete review of the Act in 2011. These include, but are not limited to, changes to allow rules and enforce standards that allow flexibility to protect the environment; clarification of the definition of "adverse effect"; changing the mandatory review period of the Act to every 10 years from five; and requiring professionals who become aware of spills and releases during the course of their work to report them.

Fish and Wildlife Conservation Act, 1997: S.O. 2012, c. 8, Sch. 16 amends the Act to rescind the requirement for various licences and authorizations in certain circumstances prescribed by the regulations. Section 60.1 is added allowing the Minister to delegate his or her powers to issue licences or authorizations in certain circumstances.
Fuel Tax Act: S.O. 2012, c. 8, Sch. 17 repeals subsection 3.6.1(4) providing an exception to the application of the current deemed trust rules. Subsection 17(3.0.1) is added allowing the Minister to garnish payments that are the result of loans or advances from a third party. This requirement is further governed by the addition of subsection 17(5.1).
Lakes and Rivers Improvement Act: S.O. 2012, c. 8, Sch. 26 expands the delegation powers of the Minister in section 15 and amends section 23.1 giving the Minister the power to order the owner of a dam or other structure on a lake or river to provide a plan for the operation and maintenance of said structure.
Mining Act: S.O. 2009, c. 21, several sections are in force making amendments relating to prospecting land, staking mining claims, disputing claims, assessment work, surface rights owners, exploration work, diamond mine royalties and consultation with Aboriginal communities. S.O. 2010, c. 18, s. 23 amends section 1 referencing the Far North Act, 2010.
Niagara Escarpment Planning and Development Act: S.O. 2012, c. 8, Sch. 36 amends section 17 requiring reviews of the Niagara Escarpment Plan to be carried out at the same time as reviews under the Greenbelt Act, 2005.
Places to Grow Act, 2005: S.O. 2012, c. 8, Sch. 46 is amended to reference the Minister and Ministry of Infrastructure.
Provincial Parks and Conservation Reserves Act, 2006: S.O. 2012, c. 8, Sch. 48 makes several amendments to sections 10, 11, 14, 28 and 54 of the Act.
Public Lands Act: S.O. 2012, c. 8, Sch. 49 is amended to give the Minister the power to delegate certain powers to individuals or bodies outside of government. Section 14 is amended to broaden regulation-making power with regard to activities performed on public lands.

Classification of Proposals for Instruments (Environmental Bill of Rights, 1993): O. Reg. 226/12 some sections are in force amending section 12 to reflect recent changes to the Mining Act.
Commercial Motor Vehicle Operators' Information (Highway Traffic Act): O. Reg. 281/12 adds section 1.3 regarding the examination process required for issuance of a CVOR certificate.
Mine Development and Closure Under Part VII of the Act (Mining Act): O. Reg. 307/12 makes several amendments to reflect the recent changes to the Mining Act.
