INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in January 2013. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in January 2013. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of January 2013 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Division 2 CANADA AMENDMENTS

Section 2.A Canada Acts

Canada Labour Code (Part III): S.C. 2012, c. 27 amends the Act to provide an employee with the right to take leave when a child of the employee is critically ill or dies or disappears as the probable result of a crime. It also makes technical amendments to the Act.

Canadian Environmental Assessment Act, 2012: S.C. 2012, c. 31 makes technical amendments to the Act and amends one of its transitional provisions to make that Act applicable to designated projects, as defined in that Act, for which an environmental assessment would have been required under the former Act.

First Nations Land Management Act: SOR/2012-291 repeals item 1 (Westbank) from the Schedule.

Section 2.B Canada Regulations

Aviation Occupational Health and Safety Regulations (Canada Labour Code (Part II - Occupational Safety and Health): SOR/2012-271 adds the definition of "approved organization" to s.1, amends subsection 9.5(4), repeals s. 9.6 (teaching first aid) and amends Schedule 1 of Part 9.

Canada Industrial Relations Board Regulations, 2012 (Canada Labour Code (Part I): SOR/2012-305 amends the title, adds procedures, updates some procedures and removes some which are no longer required to make the regulations more clear and practical.

Canada Occupational Health and Safety Regulations (Canada Labour Code (Part II - Occupational Safety and Health): SOR/2012-271 makes amendments related to first aid, including definitions in ss. 1.2 and 16.1, s. 16.12 (teaching first aid) and Schedules II and V of Part XVI.

Northwest Territories Waters Regulations (Northwest Territories Waters Act): SOR/2012-250 amends paragraphs 3(a) and (b) of Schedule IV.

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act, 1992): SOR/2012-245 makes amendments to provide consistency in the text and clarity in the regulatory requirements. Most changes are editorial to return the text to wording that existed before amendments made by SOR/2008-34.

Oil Sands Conservation Regulation (Oil Sands Conservation Act): Alta. Reg. 170/2012 makes minor administrative amendments to sections 7 and 19. Alta. Reg. 217/2012 amends subsection 1(2) by adding clause (d.11) referencing "Directive 081" and adds section 36.1 requiring compliance with Directive 081.

Off-highway Vehicle Regulation (Traffic Safety Act): Alta. Reg. 166/2012 adds section 45.1 introducing an expiry date of June 20, 2018.

Passenger Ropeways and Passenger Conveyors Standards Regulation (Safety Codes Act): Alta. Reg. 227/2012, s. 5 repeals section 7 regarding expiry of the regulation.

Pipeline Regulation (Pipeline Act): Alta. Reg. 221/2012 amends section 1 by adding (v.1) and by replacing subsection (6). Section 1.1 (Exemption - agents) is replaced, as is clause 82(9)(c).

Plumbing Code Regulation (Safety Codes Act): Alta. Reg. 227/2012, s. 6 repeals section 7 regarding expiry of the regulation.

Potable Water Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 170/2012, s. 23 amends clause 1(1)(m).

Division 2 ONTARIO AMENDMENTS

Section 2.A Ontario Acts

Safe Drinking Water Act, 2002: Sections 14 and 19 have now been proclaimed in force. Section 121 was repealed without being brought into force (see Table of Public Statute Provisions Repealed Under Section 10.1 of the Legislation Act, 2006 - December 31, 2012).

Workplace Safety and Insurance Act, 1997: S.O. 2008, c. 20 is in force adding section 12.2 which makes insurance mandatory for independent operators, sole proprietors, partners in partnerships and executive officers of corporations. Section 12.3 is also added to make provisions for those independent operators, sole proprietors, partners in partnerships and executive officers of corporations that do not employ workers. Sections 141.1 and 141.2 are added, setting out requirements for those in the construction industry who employ contractors and subcontractors. S.O. 2010, c. 26, Sch. 21 replaces section 96 regarding insurance funds and replaces subsections 97(1), (2) and (2.1) regarding the reserve fund. Section 100 prescribing the power to make regulations is added. S.O. 2011, c. 1, Sch. 7 amends the definition of "independent operator" in section 12.1 and amends clause 12.3(5)(b).

Section 2.B Ontario Regulations

Development within the Development Control Area (Niagara Escarpment Planning and Development Act): O. Reg. 423/12 makes several amendments intended to minimize permit requirements and clarify the provisions of the Regulation, ultimately reducing the administrative responsibilities of the Niagara Escarpment Commission.

Display Screens and Hand-held Devices (Highway Traffic Act): O. Reg. 253/12 amends sections 11, 12 and 13 by replacing the current expiry date with a new one of January 1, 2018. Section 15 outlining commencement information is repealed.

Drinking Water Systems (Safe Drinking Water Act, 2002): O. Reg. 420/12 amends the definitions of "delivery agent care facility", "interested authority" and "social care facility" in subsection 1(1).

General (Off-Road Vehicles Act): O. Reg. 170/12 increases the fee for a permit and number plate for an off-road vehicle to $36.

General Regulation (Nutrient Management Act, 2002): O. Reg. 284/12 is in force January 1, 2013 making several amendments to reflect the introduction of several new guidelines and standards for commercial compost and composting.

Liquid Fuels Handling Code Adoption Document (Technical Standards and Safety Act, 2000): The October 1, 2012 amendment replaces all sections, adopting the recently released "Environmental Management Protocol for Fuel Handling Sites in Ontario".

Oil and Gas Pipeline Systems Code Adoption Document (Technical Standards and Safety Act, 2000): The November 1, 2012 amendment replaces sections 1 to 5 to reference newer editions of relevant codes.

Propane Code Adoption Document (Technical Standards and Safety Act, 2000): The December 1, 2012 amendment replaces sections 1 to 4 adopting CSA B149.2-10 and CSA B149.5-10.
