INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in February 2013. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in February 2013. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of February 2013 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Division 2 CANADA AMENDMENTS

Section 2.A Canada Acts

Canada Shipping Act, 2001: S.C. 2012, c. 31 amends the Act to permit the incorporation by reference into regulations of all Canadian modifications to an international convention or industry standard that are also incorporated by reference into the regulations, by means of a mechanism similar to that of many other maritime nations. It also provides for third parties acting on behalf of the Minister of Transport to set fees for certain services that they provide in accordance with an agreement with that Minister.

Section 2.A British Columbia Acts

Forest Act: S.B.C. 2012, c. 14 replaces sections 105.1 and 105.2 regarding stumpage rates.

Motor Vehicle Act: S.B.C. 2003, c. 48, s. 20 repeals paragraph 21(2)(b)(vii). S.B.C. 2011, c. 13 amends sections 25, 31 and 33 and adds section 25.02 to reflect changes made to the Medicare Protection Act. S.B.C. 2012, c. 11 makes several administrative amendments to the Act.

Utilities Commission Act: S.B.C. 2012, c. 27 adds Part 8.1 regarding administrative penalties. Further amendments are mede to reflect this change.

Wildlife Act: S.B.C. 2008, c. 33, s. 16 replaces subsection 54(1).

Section 2.B British Columbia Regulations

Forest Service Road Use Regulation (Forest and Range Practices Act): B.C. Reg. 302/2012 adds subsection 3(5) regarding the operation of a snowmobile on a forest service road.

Motor Vehicle Act Regulations (Motor Vehicle Act): B.C. Reg. 338/2012, Sch. 2 makes several administrative amendments referencing the Insurance Corporation of British Columbia.

Occupational Health and Safety Regulation (Workers Compensation Act): B.C. Reg. 305/2012 adds a definition for "resource road" to section 1 and adds subsections (2) - (4). B.C. Reg. 312/2012 brings into force the recent selection of amendments proposed by the Workers' Compensation Board. These amendments relate to the following sections: 12.60, 12,173, 12.174, 13.30, 16.7, 19.9, 19.10, 19.34.1, 23.15, 23.16 and 26.83.1.

Ozone Depleting Substances and Other Halocarbons Regulation (Environmental Management Act): B.C. Reg. 317/2012 amends subsection 1(1), adding a definition for "retrofitting" and amending the definition of "approved person" to reflect this change.

Regulated Activities Regulation (Public Health Act): B.C. Reg. 286/2012, Sch. 1 amends section 2 and adds sections 3.1, 3.2 and 3.3 prohibiting persons under age 18 from using tanning facilities.

Biodiesel (General) Regulation (Biofuels Act): Man. Reg. 147/2012 adds a definition for "renewable diesel fuel". Section 2.1 is added and sections 3 and 4 are amended to reflect this change.

Biodiesel Mandate for Diesel Fuel Regulation (Biofuels Act): Man. Reg. 148/2012 amends the definition of "reporting period" in section 1, repeals section 7.1 regarding reporting in the interim period and replaces section 11 regarding the first reporting period.

Manitoba Building Code (Buildings and Mobile Homes Act): Man. Reg. 175/2012 adds section 1.1, replaces subsection 2.1(1) and amends the Schedule.

Manure Regulation (Pesticides and Fertilizers Control Act): Man. Reg. 141/2012 makes several amendments allowing businesses to hold commercial manure applicator licences. The regulation also outlines the training requirements for employees of those businesses.

Planning Districts Regulation (Planning Act): Man. Reg. 176/2012 amends Schedule B by adding section 3 defining the Carman-Dufferin Planning District.

Workplace Safety and Health Regulation (Workplace Safety and Health Act): Man. Reg. 165/2012 replaces section 20.6 (Flagpersons) and adds sections 20.6.1 and 20.6.2 regarding the use of warning signs and training certificates for flagpersons, respectively. Section 1.1 is amended by adding a definition for "flagperson".

Boilers and Pressure Vessels Code Adoption Document (Technical Standards and Safety, 2000): Director's Order, January 21, 2013 is in effect making substantial amendments to reflect the adoption of newer editions of the relevant codes and standards. The amendment has not yet been incorporated into the document, but is available separately for reference.

Designation of Greenbelt Area (Greenbelt Act, 2005): O. Reg. 6/13 adds paragraph 4. to subsection 1(1) and amends subsection 1(2) to reflect this change.

Gaseous Fuels Code Adoption Document (Technical Standards and Safety Act): The October 1, 2012 amendment replaces all sections, adopting several recently released and updated fuel codes and standards.

Species at Risk in Ontario List (Endangered Species Act, 2007): O. Reg. 25/13 replaces Schedules 1, 2, 3 and 4 of the Regulation.

Used Tires (Waste Diversion Act, 2002): O. Reg. 45/13 amends section 1 by adding a definition of "OTS Tire Classification". Section 3 regarding the industry funding organization is replaced and section 8 and 9, regarding base fees and fee reconciliation respectively, are added to the Regulation.
